भारतीय प्रतिभूति और विनिमय बोर्ड अधिसूचना
मुम्बई , 9 नवम्बर , 2006 भारतीय प्रतिभूति औरं विनिमय बोर्ड ( अधिनिर्णायक ) (संशोधन ) विनियम, 2006
का.आ. 1935( अ ), बोर्ड, भारतीय प्रतिभूति और विनिमय बोर्ड अधिनियम , 1992 ( 1992 का 15 ) की धारा 11 की उप - धारा ( 1 ) के साथ पठित धारा 20 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए एतद्वारा भारतीय प्रतिभूति और विनिमय बोर्ड ( अधिनिर्णायक) विनियम, 2003 का संशोधन करने के लिए निम्नलिखित विनियम बनाता है , अर्थात्:-
1. (i ) इन विनियमों को भारतीय प्रतिभूति और विनिमय बोर्ड (अधिनिर्णायक) (संशोधन ) विनियम, 2006 कहा जा सकेगा ।
(ii ) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. भारतीय प्रतिभूति और विनिमय बोर्ड ( अधिनिर्णायक ) विनियम , 2003 में, विनियम 6 में, उप - विनियम ( 1 ) में, खण्ड ( V ) के पश्चात् निम्नलिखित अंतःस्थापित किया जाएगा , अर्थात्:- " परंतु यह कि खण्ड ( V ) में उपबंधित निरर्हता उस व्यक्तिके मामले में लागू नहीं होगी जो पब्लिक सेक्टर ( सार्वजनिक क्षेत्र ) बैंक या पब्लिक सेक्टर उपक्रम का पूर्णकालिक निदेशक रहा हो ।
स्पष्टीकरण: - इस खण्ड के प्रयोजनों के लिए-
(क) ' पब्लिक सेक्टर बैंक ' से अभिप्रेत है-
(i ) बैंककारी कंपनी ( उपक्रमों का अर्जन और अंतरण) अधिनियम , 1970 ( 1970 का 5) की प्रथम अनुसूची में विनिर्दिष्ट तत्स्थानी नया बैंक;

( ii) बैंककारी कंपनी ( उपक्रमों का अर्जन और अंतरण) अधिनियम , 1980 ( 1980 का 40) की प्रथम अनुसूची में विनिर्दिष्ट तत्स्थानी नया बैंक;
(iii ) भारतीय स्टेट बैंक अधिनियम, 1955 ( 1955 का 23 ) के अधीन गठित भारतीय स्टेट बैंक;
(iv ) भारतीय स्टेट बैंक ( समनुषंगी बैंक) अधिनियम, 1959 ( 1959 का 38 ) में यथा परिभाषित समनुषंगी बैंक;
( ख ) ' पब्लिक सेक्टर उपक्रम ' से किसी केंद्रीय , राज्यया प्रांतीय अधिनियम द्वारा या के अधीन स्थापित कोई निगमअथवा कंपनी अधिनियम, 1956 ( 1956 का 1 ) की धारा 617 में यथा परिभाषित सरकारी कंपनी अभिप्रेत है जिसका स्वामित्व, नियंत्रण या प्रबंध केंद्रीय सरकार द्वारा किया जाता है । "

पाद टिप्पण: ( 1 ) भारतीय प्रतिभूति और विनिमय बोर्ड ( अधिनिर्णायक) विनियम, 2003 , सं काआ 953 (अ) , 21-8-2003 को भारत के राजपत्र में अधिसूचित हुए थे ।
(2) यह तत्पश्चात् 5-12-2003 को भारतीय प्रतिभूति और विनिमय बोर्ड ( अधिनिर्णायक ) संशोधन) विनियम , 2003 , फा. सं. भाप्रविबो/ विधि/डीओपी/22090/2003 , द्वारा संशोधित हुआ था ।

SECURITIES AND EXCHANGE BOARD OF INDIA ( OMBUDSMAN) ( AMENDMENT) REGULATIONS , 2006
SO. 1935 (E) .-In exercise of the powers conferred by Section30 read with Sub-section (1 ) of Section 11 of the Securities and Exchange Board of India Act , 1992 ( 15 of 1992), the Board hereby makes the following regulations to amend the Securities and Exchange Board of India (Ombudsman) Regulations , 2003 , namely : -
1. (i) These regulations may be called the Securities and Exchange Board of India ( Ombudsman) (Amendment) Regulations, 2006.
(ii) They shall come into force on the date of their publication in the Official Gazette.
2 In the Securities and Exchange Board of India (Ombudsman ) Regulations , 2003 , in regulation 6, in sub- regulation (1) , after clause (v) the following shall he inserted, namely: -
" Provided that the disqualification provided in clause (v) shall not be applicable in case of a person who has been the whole- time director of a public sector bank or a public sector undertaking.
Explanation : For the purposes of this clause--
(a) ' public sector bank ' means
(i) a corresponding new bank specified in the First Schedule to the Banking

Companies (Acquisition and Transfer of Undertakings) Act, 1970 (5 of 1970);
(ii) a corresponding new bank specified in the First Schedule to the Banking Companies (Acquisition and Transfer of Undertakings) Act , 1980 (40 of 1980) ;
(iii) the State Bank of India constituted under the State Bank of India Act, 1955 (23 of 1955);
(iv) a subsidiary bank as defined in the State Bank of India (Subsidiary Banks) Act , 1959 (38 of 1959) ;
(b) ' public sector undertaking ' means any corporation established by or under any Central, State or Provincial Act or a Government company as defined in Section 617 of the Companies Act, 1956 (1 of 1956) which is owned, controlled or managed by the Central Government ."
