का.आ. 1941 ( अ. ). यतः , केन्द्रीय सरकार ने, सशस्त्र बल ( विशेष शक्तियां ) , अधिनियम, 1958 ( 1958 का 28 ) की धारा 3 . द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, सम्पूर्ण असम राज्य को दिनांक 27.11.1990 की अधिसूचना कां. आ. 916 (अ ) के तहत दिनांक 27.11.1990 से ' अशान्त क्षेत्र ' के रूप में घोषित किया था;
और , यतः , केन्द्रीय सरकार ने पूर्वोक्त अधिनियम की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , अन्य क्षेत्रों के अतिरिक्त असम राज्य की सीमा से लगे अरुणांचल प्रदेश, मेघालय और नागालैंड राज्य में सीमा से 20 किमी. चौड़ी पट्टी के अंतर्गत आनेवाले क्षेत्रों को भी 'अशान्त क्षेत्र' के रूप में घोषित किया था;
और, यतः , वह अवधि जिसके दौरान असम राज्य तथा असम राज्य की सीमा से लगे अरुणाचल प्रदेश , नागालैंड और मेघालय राज्य में सीमा से 20 किमी. चौड़ी पट्टी के अंतर्गत आने वाले क्षेत्रों को उक्त अधिनियम के अंतर्गत 'अशान्त क्षेत्र ' के रूप में घोषणा को असम राज्य तथा पूर्वोक्त क्षेत्रों में कानून एवं व्यवस्था की स्थिति की समीक्षा करने के बाद समय - समय पर बढ़ाया गया था;
और, यतः , असम तथा असम की सीमा से लगे अरुणाचल प्रदेश, मेघालय एवं नागालैंड राज्यों में 20 किमी . चौड़ी पट्टी में कानून एवं व्यवस्था की आगे और समीक्षा करने से निम्नलिखित इंगित होता हैः-
(i) असम राज्य में कानून एवं व्यवस्था की स्थिति मुख्यतः यूनाइटेड लिबरेशन फ्रंट ऑफ असम ( उल्फा ) की बड़ी संख्या में हिंसक गतिविधियों के कारण बिंगड़ी रही है । अन्य विद्रोही गुंट अर्थात् नेशनल डेमोक्रेटिक फ्रंट बोरोलैंड ( एनडीएफबी ) , कर्बी लोगरी एन सी हिल्स लिबरेशन फ्रंट (केएलएनएलएफ ) , कुकी रिवोल्यूशनरी आर्मी (के आर ए ) तथा दीमा हलाम दा ओगाह (डी एच डी) भी असम राज्य में सक्रिय हैं:
( ii ) यतः , उल्फा तथा एनडीएफबी प्रभुसत्ता की मांग कर रहे हैं, यूनाइटिड पीपुल्स डेमोक्रेटिक सोलिडेरिटी ( यूपीडीएम ) तथा डीएचडी पृथक राज्यों की मांग कर रहे हैं । केएलएनएलएफ की मांग में भी अलगाव के स्वर हैं;

(iii ) उपर्युक्त गुटों में से कुछ का सशस्त्र संघर्ष में विश्वास बना हुआ है और उनमें से अधिकांश आम जनता में डर पैदा करने, प्रशासनिक प्रणाली को अव्यवस्थित करने तथा लोगों से जबरन धन वसूली करने के लिए हिंसक कार्यों में लिप्तहैं;
( iv ) असम की सीमा से लगे राज्यों अरुणाचल प्रदेश, मेघालय तथा नागालैंड की 20 किमी . चौड़ी पट्टी में विद्रोही गुटों जैसे उल्फा, एनडीएफबी , नेशनल सोशलिस्ट काउंसिल ऑफ नागालैंड ( एनएससीएन ) के दो गुट, पीपुल्स लिबरेशन आर्मी ( पीएलए ) , नेशनल लिबरेशन फ्रंट ऑफ त्रिपुरा ( एनएलएफटी ) , अचिक नेशनल वॉलंटीयर काउंसिल ( एएनवीसी ) , हन्नीवट्रैप नेशनल लिबरेशन काउंसिल ( एचएनएलसी ) आदि की हिंसक गतिविधियां जारी हैं।
अतः, अब, सम्पूर्ण असम राज्य तथा असम की सीमा से लगे अरुणाचल प्रदेश, मेघालय तथा नागालैंड राज्यों की 20 किमी. चौड़ी पट्टी के अंतर्गत आने वाले क्षेत्र सशस्त्र बल ( विशेष शक्तियां ) अधिनियम, 1958 की धारा 3 के अंतर्गत 4.5.2007 तक 'अशान्त क्षेत्र ' बना रहेगा जब तक कि इस धारा को इससे पहले ही हटा न लिया जाए ।

NOTIFICATION
New Delhi , the 10th November, 2006
S.O. 1941 (E) .-Whereas , the Central Government in exercise of powers conferred by Section 3 of the Armed Forces (Special Powers ) Act , 1958 (28 of 1958 ) had declared the entire State of Assam as 'disturbed area' with effect from 27-11-1990 vide Notification S.O. 916( E ) dated 27-11-1990.
And whereas the Central Government in exercise of power conferred by Section 3 of the aforesaid Act had also declared besides other areas , the areas failing within 20 kms wide belt in the State of Arunachal Pradesh , Meghalaya and Nagaland , along their border with the State of Assam as ' disturbed area ' .
And whereas the period during which the State of Assam and areas falling within 20 KMs wide belt in the State of Arunachal Pradesh , Nagaland andMeghalaya along their border with the State of Assam shall be ' disturbed area' under the aforesaid Act was extended from time to time reviewing the law and order situation in the State of Assam and aforesaid areas .
And whereas a further review of the law and order situation in Assam and 20 Kms wide belt in the State of Arunachal Pradesh , Meghalaya and Nagaland bordering Assam indicates the following ; - [भाग II- खण्ड 3 ( ii ) ]

3 i) The law and order situation in the State of Assam has remained vitiated mainly due to large number of violent activities of the United Liberation front of Asom ( ULFA) . Other insurgent outfits namely National Democratic Front of Boroland ( NDFB ) , Karbi Longri NC Hills Liberation Front ( KLNLF ) , Kuki Revolutionary Army ( KRA) and Dima Halam Daogah (DHD ) are also active in the State ofAssam.
ii ) While the ULFA and the NDFB have been demanding sovereignty, the United Peoples Democratic Solidarity ( UPDS ) and the DHD are demanding separate States . The demands of the KLNLF also has secessionist overtones .
Some of the above - mentioned outfits continue to affirm their faith in armed struggle and most of them indulge in acts of violence to create panic among the common people , disturb the administrative system and to extort money from people.
iv) In the 20 Kms wide belt in the States of Arunachal Pradesh , Megahalaya and Nagaland bordering Assam the violent activities of insurgent outfits such as the ULFA, the NDFB, the two factions of the National Socialist Council of Nagaland ( NSCN ) , the People's Liberaton Army ( PLA) , National Liberation Front of Tripura (NLFT) , Achik National Volunteer council (ANVC) , Hynniewtrep National Liberation Council ( HNLC) etc. continue .
Now, therefore the entire State of Assam and 20 kms wide belt in the State of Arunachal Pradesh , Meghalaya and Nagaland bordering Assam shall continue to be ' disturbed area ' under Section 3 of the Armed Forces(Special Powers ) Act , 1958 upto 4.5.2007 unless withdrawn earlier.
