संकल्प
7. इस आयोग के विचारार्थ विषय इस प्रकार हैं :-
नईदिल्ली , 15 नवम्बर , 2006.
(क) ई. वी. चिन्नैया बनाम आन्ध्र प्रदेश राज्य और अन्य [2004 (9 ) स्केल ] के मामले में भारत के उच्चतम. न्यायालय के निर्णय के अनुसरण में , आंध्र प्रदेश में अनुसूचित जाति के उपवर्गीकरण की मांग के विभिन्न पहलुओं की जांच करना;
सं. 12025/ 12/2005- एस.सी.डी. ( आर.एल. सैल ).- जबकि भारत सरकार ने ई.वी. चिन्नैया बनाम आंध्र प्रदेश राज्य [2004 ( 9 ) स्केल ] दिनांक 5-11-2004 में उच्चतम न्यायालय के निर्णय , जिसमें आंध्र प्रदेश में अनुसूचित जातियों के उपवर्गीकरण के संबंध में उच्चतम न्यायालय ने आंध्र प्रदेश अनुसूचित जाति ( आरक्षण काऔचित्य स्थापन ) अधिनियम , 2000 को खारिज कर दिया था , से उत्पन्न स्थिति के कारण मामले को अपने अधिकार में ले लिया है।
(ख) अनुसूचित जातियों के उपवर्गीकरण की मांग के संवैधानिक, सांविधिक और कानूनी निहितार्थों कीजांच करना;
2. और जबकि आंध्र प्रदेश विधान सभा ने सर्वसम्मति से इस मामले को भारत सरकार द्वारा संसद में विचार करने के लिए 10 दिसम्बर , 2004 को संकल्प. पारित किया है ।
(ग) भविष्य की कार्रवाई पर सिफारिशें करना , उन आधारों और मानदंडों को पूर्णतः स्पष्ट करना जिन पर ये सिफारिशें आधारित हैं ।
8. अध्यक्ष के कार्यभार ग्रहण करने से इस आयोग का कार्यकाल एक वर्ष का होगा ।
डॉ. अरविन्द प्रसाद, संयुक्त सचिव 3. अतः , अब, भारत सरकार ने आंध्र प्रदेश में अनुसूचित जातियों को आरक्षण के लिए चार वर्गों में उपवर्गीकृत करने के संबंध में उच्चतम न्यायालय के निर्णय से उत्पन्न स्थिति की जांच करने के लिए उच्चतम न्यायालय के अवकाश प्राप्त न्यायाधीश की अध्यक्षता. में एक राष्ट्रीय आयोग गठित करने का संकल्प लिया है ।

4. आयोग का नाम आंध्र प्रदेश में अनुसूचित जातियों के उपवर्गीकरण के मामले की जांच के लिए राष्ट्रीय आयोग होगा ।

5. आयोग का मुख्यालय नई दिल्ली होगा और यह भाड़े पर लिए गए परिसर में कार्य करेगा ।

(Rationalization of Reservation) Act, 2000, regarding sub-categorization of Scheduled Castes in Andhra Pradesh .
2. And whereas the Andhra Pradesh Legislative Assembly unanimously adopted the Resolution on 10th December, 2004 to recommend to Government of Indiato take up the matter in the Parliament.
3. Now, therefore, the Government of India has resolved to constitute a National Commission under a retired Judge of the Supreme Court to examine the issue arising out of the Judgment of the Supreme Court relating to sub- categorization of Scheduled Castes in Andhra Pradesh into four groups for the purpose of reservation, in all its aspects .
14. The Commission shall be named as National Commission to examine the issue of Sub -Categorization of Scheduled Castes in Andhra Pradesh .
5. The headquarter of the Commission shall be in NewDelhi and operate from hired premises .
6. The fixation of pay and other allowances of the Chairperson shall be governed by the guidelines on the subject relatingto fixation of pay and other terms of retired Judges of the Supreme Court , as contained in the
[PART I SEC . 1 ]
Department of Expenditure Office Memorandum No. 19048/ 7/80- E. IV, dated 08-10-1987, as amended from time to time.
7. The terms of reference of the Commission are as under:--
(a) To examine the various facets of the demand for sub -categorization of Scheduled Castes in Andhra Pradesh subsequent to the judgment of the Supreme Court of India in the case of EV. Chinnaiah Vs. State of Andhra Pradesh & others [2004 (9 ) Scale] .
(b) To examine the Constitutional , statutory and legal ramifications of the demand for sub- categorization of Scheduled Castes .
(c) To make recommendations on the future course of action , clearly specifying the grounds and the criteria on which these recommendations are based .
8. The Tenure of the Commission will be one year from the date of taking over of the charge by the Chairperson.
