का.आ. 1974( अ.).-यतः मेघालय के अचीक नेशनल वालिटयर काउंसिल ( जिसे इसमें इसके पश्चात् ' एएनवीसी ' कहा गया है) ने हिंसा छोड़ने पर सहमत होने तथा अपनी मांगों को पूरा करने के लिए भारत के संविधान के दायरे में वार्ता करने की इच्छा व्यक्त करने के बावजूद जबरन धन वसूलना जारी रखा है:- ン
और यतः , केन्द्रीय सरकार की राय है कि मेघालय की हन्नीषट्रेप नेशनल लिब्रेशन काउंसिल ( जिसे इसमें इसके बाद एचएनएलसी कहा गया है ) मेघालय को भारत संघ से अलग करने के अपने उद्देश्य की खुलेआम घोषणा कर रही है।
और यतः , केन्द्रीय सरकार की पुनः राय है कि एएनवीसी तथा एचएनएलसी दोनों-
(i) अपने संगठन के लिए निधियां एकत्रित करने के उद्देश्य से आम लोगों को डराने - धमकाने , जबरन धन वसूली तथा लूट - पाट की कार्रवाईयों में लिप्त हैं;
( ii ) जबरन धन वसूली तथा डराने - धमकाने की कार्रवाईयों को जारी रख़ाने के लिए पूर्वोत्तर क्षेत्र के अन्य विद्रोही गुटों के साथ संपर्क बनाए हुए हैं;
(iii ) आश्रय तथा अपने प्रशिक्षण कार्डरों के प्रयोजन के लिए कुछ पड़ोसी देशों में शिविर स्थापित किए हुए हैं;
और यतः , केन्द्रीय सरकार का मत हैं कि-
(i ) एएनवीसी वर्ष 2004 में चौबीस हिंसक घटनाओं , वर्ष 2005 में छः हिंसकं घटनाओं तथा वर्ष 2006 ( 31 अगस्त, 2006 तक ) में एक हिंसक घटना में संलिप्त रही है ।
( ii ) एएनवीसी की हिंसा की इन वारदातों में वर्ष 2004 में 12 व्यक्ति ( 4 सुरक्षा बल कर्मिक सहित ) तथा वर्ष 2005 में एक व्यक्ति मारा गया।
( iii ) एचाएनएलसी वर्ष 2004 में एक हिंसक घटना में , वर्ष 2005 में चार हिंसक घटनाओं में तथा वर्ष 2006 ( 31 अगस्त, 2006 तक ) में दो हिंसक घटनाओं में शामिल रही।
और यतः , केन्द्रीय सरकार का यह भी मत है कि उपरोक्त कारणों से एएनवीसी और एचएनएलसी और उनके द्वारा गठित अन्य निकाय विधिविरुद्ध संगमहै ।
और यतः , केन्द्रीय सरकार का यह भी मत है कि अचीक नेशनल वालंटियर काउंसिल ( एएनवीसी ) और हन्नीवट्रेप नेशलन लिब्रेशन काउंसिल ( एचएनएलसी ) की उपरोक्त गतिविधियां भारत की प्रभुसत्ता और अखंडता को विच्छिन्न करने के लिए आशयित है, और यदि इन पर 3627 GI/2006 ..(1) THE GAZETTE OF INDIA : EXTRAORDINARY

तत्काल नियंत्रण न किया गया तो ये संगठन पुनर्संगठित होंगे , पुनः शस्त्रों से लैस होंगे , अपने कार्यकर्ताओं की संख्या बढ़ाएंगे , अत्याधुनिक हथियार प्राप्त करेंगे , भारी संख्या में नागरिकों और सुरक्षा बलों की हत्या करेंगे और राष्ट्र विरोधी गतिविधियों को तेज करेंगे।
अतः , अब , विधिविरुद्ध गतिविधियां ( निवारण ) अधिनियम, 1967 ( 1967 का 37 ) की धारा 3 की उप -धारा ( 1 ) के तहत प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार , एतद्वारा , अचीक नेशनल वालंटियर काउंसिल ( एएनवीसी ) और हम्मीवट्रेप नेशनल लिब्रेशन काउंसिल ( एचएनएलसी) को इनके सभी गुटों, विंगों और मुख्य संगठनों सहित विधिविरुद्ध संगम घोषित करती है।
केन्द्रीय सरकार का यह भी मत है कि अचीक नेशनल वालंटियर काउंसिल ( एएनवीसी ) और हन्नीबट्रेप नेशनल लिब्रेशन काउंसिल (एचएनएलसी ) को इनके सभी गुटों, विंगों और मुख्य संगठनों सहित तत्काल प्रभाव से विधिविरुद्ध संगम घोषित करना आवश्यक है, और तद्नुसार धारा 3 की उप - धारा ( 3 ) के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार , पंतद्वारा , निदेश देती है कि यह अधिसूचना उक्त अधिनियम की धारा 4 के अधीन किए जा सकने वाले किसी आदेश के अध्यधीन सरकारी राजपत्र में इसके प्रकाशित होने की तारीख से प्रभावी होगी ।

NOTIFICATION

S.O. 1974 (E). Whereas the Achik National Volunteer Council (hereinafter referred to as the 'ANVC' ) of Meghalaya have continued collection of funds and extortion despite having agreed to abjure violence and having expressed their willingness to hold talks within the framework of the Constitution of India for fulfilling their demands;
And whereas , the Central Government is of the opinion that the Hynniewtrep National Liberation Council (hereinafter referred to as the HNLC ) of Meghalaya have been openly declaring as their objective the secession of the State of Meghalaya from Indian Union;
Andwhereas , the Central Government is further of the opinion that both ANVC and HNLC have been, (i) indulging in acts of intimidation, extortion and looting of civilian population for collection offunds for their organization; :
(ii) maintaining links with other insurgent groups of the North Eastern Region for carrying out acts of extortion and intimidation;
(iii) maintaining camps in some neighbouring countries for the purpose of sanctuary and training of their cadres .
And whereas the Central Government is also of the opinion that
(i) the ANVC was involved in twenty four violent incidents in 2004 , six violent incidents in 2005 and one violent incident in 2006 ( upto 31st August, 2006).
(ii) these violent incidents by ANVC resulted in killing of 12 persons (including 4 Security Forces) in 2004 and one person in 2005.
(iii) the HNLC was involved in one violent incident in 2004, four violent incidents in 2005 and two violent incidents in 2006 ( upto 31st August , 2006) ;
And whereas , the Central Government is also of the opinion that for the reasons aforesaid , the ANVC anó the HNLC and other bodies set up by them , are unlawful associations ;
And whereas , the Central Government is also of the opinion that the aforesaid activities of the ANVC and the HNLC are detrimental to the sovereignty and integrity of India , and if these are not immediately curbed and controlled, the said ANVC and the HNLC would regroup and rearm themselves , expand their cadres , procure sophisticated weapons , cause heavy loss of lives of civilians and Security Forces , and accelerate their anti - national activities ;
Now, therefore , in exercise of the powers conferred by sub - section ( 1 ) of Section 3 of the Unlawful Activities (Prevention) Act , 1967 (37 of 1967 ) , the Central Government hereby declares the Achik National Volunteer Council (ANVC) and the Hynniewtrep National Liberation Council (HNLC) alongwith all their factions , wings and front organiza- tions as unlawful associations;
The Central Government is of further opinion that it is necessary to declare the ANVC and the HNLC alongwith all their factions , wings and front organizations as unlawful with immediate effect and accordingly , in exercise ofthe powers conferred by the provisoto sub- section (3 ) of Section 3, the Central Government hereby directs that this notification shall , subject to any order that may be made under Section 4 of the said Act, have effect from the date of its publication in the Official Gazette .
