सा.का.नि. 705( अ ). केन्द्रीय सरकार, सीमाशुल्क अधिनियम, 1962 (1962 का 52) की धारा 25 की उपधारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार के इस बात से संतुष्ट हो जाने पर कि लोकहित में ऐसा करना आवश्यक है, भारत सरकार के वित्त मंत्रालय (राजस्व विभाग) की अधिसूचना सं. 39 /36-सीमाशुल्क, तारीख 23 जुलाई, 1996, जो कि भारत के राजपत्र, असाधारण में सा.का.नि. 291 (अ) तारीख 23 जुलाई, 1996 द्वारा प्रकाशित की गई थी, में निम्नलिखित और संशोधन करती है, अर्थातुः-
उक्त अधिसूचना में, सारणी में, क्रम सं० 30 तथा इससे संबंधित प्रविष्टियां के बाद निम्नलिखत क्रम सं० और प्रविष्टियां जोड़ी जाएँगी, अर्थात

यदि, -

(क) उक्त माल का आयात प्रोजेक्ट एयरबोर्न अर्ली वार्निंग एंड कंट्रोल (एईडल्यू एंड सी) कार्यक्रम के प्राधिकृत ऐसे कार्यशाला केन्द्रों जो किसी ऐसे अधिकारी द्वारा जो भारत सरकार के रक्षा मंत्रालय में उप सचिव की पंक्ति से नीचे का न हो, अभिहित किए जाये , द्वारा किया जाता है; और
एयरबोर्न अर्ली वार्निंग एंड कंट्रोल (एइडब्ल्यूएंड सी) सिस्टम कार्यक्रम के लिए निम्नलिखित माल अपेक्षित (i) एयरक्राफ्ट्स, एयरक्राफट्स के पुर्जे, एयरक्राफट्स इंजिन, एयरक्राफ्ट्स इंजिन के पूर्जे तथा रक्षा के प्रयोजनार्थ ग्राउंड हैंडलिंग एयरक्राफट्स उपस्कर;
( ख) प्राधिकृत कार्यशाला केन्द्र संयुक्त आयुक्त, सीमाशुल्क अथवा उप आयुकत, सीमाशुल्क अथवा सहायक आयुक्त, सीमाशुल्क को मामलानुसार आयात के समय प्रत्येक मामले में कार्यक्रम निदेशक, कार्यक्रम कार्यालय एईडब्ल्यूएंडसी, सेंटर फॉर एयर बर्बोन सिस्टम, बंगलोर द्वारा विधिवत प्रमाणित संबंधित विवरण सहित उक्त माल की सूची प्रस्तुत करते हैं जो इस आशय का होता है कि-
( i) वह माल जो कि उस सूची में वर्णित है वह प्रोजक्ट एईडब्ल्यूएंडसी के हेतु ही अपेक्षित है ।
(ii) रडार, ईएसएम, सीएसएम, आर डब्ल्यू आर सीएमडीएस, एमएडब्ल्यू एस, संचार तथा उनसे संबंधित कलपुर्जे, इलेक्ट्रोनिक कलपुर्जे/बोर्ड; सिमुलेटर्स तथा संबंधित हार्डवेयर/साफटवेयर;
(ii) सूची में उल्लिखित उक्त माल का आयात एईडब्ल्यू एंड सी कार्यक्रम के अंतर्गत रक्षा मंत्रालय द्वारा प्राधिकृत है और उक्त माल का उपयोग केवल एईडब्ल्यू एंड सी कार्यक्रम के लिए ही किया जायेगा ।
(iii ) मशीनें, जाँच उपस्कर सहित अन्य उपस्कर, यंत्र, फिटिंग तंत्र , पुर्जे, स्पेयर्स, जिक्स तथा फिक्चर्स, डायज , यंत्र , मोल्डस , एसेसरिज, कच्चे माल, कास्टिंग्स, फोरगिंग्स,

स्पष्टीकरणः इस छूट में अंतर्विष्ट किसी भी उल्लेख 1 जनवरी , 2012 को या उसके बाद प्रभावी नहीं होगा । "

(Department of Revenue) NOTIFICATION New Delhi , the 16th November , 2006 No. 113 /2006- CUSTOMS
G.S.R.705(E). In exercise of the powers conferred by sub - section ( 1 ) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government , on being satisfied that it is necessary in the public interest so to do, hereby makes the following further amendments in the notification of the Government of India in the Ministry of Finance (Department of Revenue) , No. 39 /96 - Customs , dated the 23rd July, 1996, published in the Gazette of India, Extraordinary, vide number G.S.R. 29.1 (E) ; dated the 23rd July, 1996 , namely: -
In the said notification, in the Table , after S.No.number 30 , and the entries relating thereto, the following S.No. and entries shall be inserted , namely: -

"31. The following goods , required for the Airborne Early Warning and Control (AEW& C) System Programme of Ministry of Defence , -
If, - (a) the said goods are imported by authorised works centers of the Airborne Early Warning and Control (AEW&C) programme , as may be designated by an officer not below the rank of Deputy Secretary to the Government of India in the Ministry of Defence; and i) aircrafts , aircraft parts , aircraft engines, aircraft engine parts , including ground handling equipment ofaircrafts for defence use ;
(b) the authorised works centre produces to the Joint Commissioner of Customs or the Deputy Commissioner ofCustoms or the Assistant Commissioner of Customs , as the case may be , at the time of import, in each case , a list of the said goods with their relevant description duly certified by the Programme Director , Programme Office AEW& C, Centre for Air Borne System , Banglore, to the effect that -
ii) radars , ESM, CSM , RWR , CMDS , MAWS , Communication and their related components/parts , Electronic components/boards , simulators and related hardware /softwarc;
i) the said goods mentioned in the list are required for the purposes of the AEW&C
( ii) the import of the said goods mentioned in the list are authorized by the Ministry of Defence under AEW& C programme and the said goods shall be used only for the purpose of the AEW & C programme .
iii) machinery, equipments including test equipments , instruments , fitting devices, components , spares , jigs and fixtures , dies , tools , moulds , accessories, raw materials , castings , forgings , piping, tubing, consumables , mockup and models;

iv) computer hardware , computer
software, accessories and consumables .
Explanation. Nothing contained in this exemption shall have effect on or after the 1st day of January, 2012" .
