सा.का.नि. 723 ( अ ) - राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक और अनुच्छेद 148 के खंड ( 5 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, तथा भारतीय लेखा परीक्षा और लेखा विभाग में कार्यरत व्यक्तियों के संबंध में भारत के नियंत्रक तथा महालेखा परीक्षक से परामर्श करनें के बाद एतद्वारा केन्द्रीय सिविल सेवा (पेंशन) नियम, 1972 में आगे और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-
1. ( 1 ) इन नियमों का नाम केन्द्रीय सिविल सेवा ( पेंशन) संशोधन नियम , 2006 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. केन्द्रीय सिविल सेवा ( पेंशन ) नियम, 1972 में
नियम 10 में;
(i) उप- नियम ( 1 ) और ( 6 ) में , ' दो वर्षों' शब्दों के स्थान पर क्रमशः ' एक वर्ष ' शब्द प्रतिस्थापित किया जाएगा;
(ii) उप- नियम (3 ) के स्थान पर निम्नलिखित उप- नियम प्रतिस्थापित किया जाएगा, अर्थात्:-
" (3 ) उप- नियम (2 ) के तहत किसी पेंशनभोगी को कोई वाणिज्यिक रोजगार प्राप्त करने की अनुमति प्रदान करने अथवा अस्वीकार करने में, सरकार को निम्नलिखित बातों को ध्यान में रखना होगा , अर्थात्ः
(क ) क्या सेवानिवृत्ति के बाद प्रस्तावित वाणिज्यिक रोजगार हेतु संवर्ग नियंत्रण प्राधिकारी से और अधिकारी के उस कार्यालय से जहां से , वह

(1) सेवानिवृत्त हुआ है , ' अनापत्ति प्रमाण- पत्र' प्राप्त कर लिया गया है ;
(ख) क्या अधिकारी का अपनी सेवा के अंतिम तीन वर्षों में किसी ऐसी संवेदनशील अथवा सामरिक महत्व की सूचना से संबंध रहा है जिसका प्रत्यक्ष संबंध ऐसे संगठन, जिसमें उसने कार्यभार ग्रहण करने का प्रस्ताव किया है अथवा ऐसे क्षेत्रों में जिसमें उसने प्रैक्टिस अथवा परामर्शी सेवाएं देने का प्रस्ताव किया है, के हित अथवा कार्य क्षेत्रों से है;
( ग ) क्या जिस कार्यालय में अधिकारी ने अंतिम तीन वर्षों में पद धारित किया हुआ था, उसकी नीतियों और जिस संगठन में वह शामिल होने का प्रस्ताव करता है , उसके द्वारा प्रतिनिधित्व किए जा रहे हितों अथवा कार्यों के बीच हितों का टकराव है अथवा नहीं ।
स्पष्टीकरणः- इस खंड के प्रयोजनार्थ " हित के टकराव " में सरकार अथवा इसके उपक्रमों के साथ सामान्य आर्थिक प्रतिस्पर्धा शामिल नहीं होगी ।
(घ) क्या जिस संगठन में वह शामिल होना चाहते हैं, उसका, किसी भी प्रकार से , भारत के विदेश संबंधों, राष्ट्रीय सुरक्षा और आंतरिक सौहार्द के साथ टकराव रहा है अथवा वह संगठन इन सभी के प्रतिकूल रहा है और क्या वह संगठन किसी भी रूप में आसूचना एकत्र करने से संबंधित कोई कार्य कर रहा है;
(ङ) क्या अधिकारी का सेवा रिकॉर्ड, विशेषतः सत्यनिष्ठा और गैर- सरकारी संगठनों के साथ कार्य - व्यवहार के संबंध में , साफ- सुथरा है;

(च) क्या प्रस्तावित परिलब्धियां और आर्थिक लाभ , उद्योग जगत में वर्तमान में प्रचलित परिलब्धियों और आर्थिक लाभों से बहुत अधिक हैं ।
टिप्पणीः मूल नियम भारत के राजपत्र भाग II , खंड 3 , उप- खंड ( i ) में दिनांक1-4-1972 के संख्या का.आ. 934 के अंतर्गत प्रकाशित किए गए थे और बाद में निम्नलिखित द्वारा संशोधित किए गए थे:-

स्पष्टीकरणः- इस उप- खंड के प्रयोजनार्थ " बहुत अधिक " शब्दों का अर्थ यह नहीं लगाया जाए कि इसमें ऐसी प्रसुविधाओं में हुई बढ़ोतरी को भी शामिल किया जाए जो उद्योग जगत अथवा समग्र अर्थव्यवस्था में उन्नयन के परिणामस्वरूप दिए जा रहे हों;

G.S.R. 723 (E) .- In exercise of the powers conferred bytheproviso to article 309 and clause (5) ofarticle 148 of the Constitution , and after consultation with the Comptroller and Auditor General of India in relation to persons serving in the Indian Audition and Accounts Department, the President hereby makes the following rules

further to amend the Central Civil Services (Pension) Rules , 1972 , namely:
1. (1) These rules may be called the Central Civil Services (Pension) Amendment Rules, 2006
(2) They shall come into force on the date of theirpublication in the Official Gazette.
2. In the Central Civil Services (Pension) Rules , in rule 10,-
(1) in sub -rules ( 1) and (6) , for the words ' two years' , the words ' one year ' shall respectively be substituted;
(ii) for sub -rule (3 ) the following sub - rule shall be substituted, namely : -
"(3) In granting or refusing permission under sub- rule (2) to a pensioner for taking up any commercial employment, the Government shall have regard to the following factors , namely:
(a) Whether a ' No Objection ' for the proposed post retirement commercial employment has been obtained from the cadre controlling authority and from the office where the officer retired;
(b) Whether the officer has been privy to sensitive orstrategic information in the last three years of his service which is directly related to the areas of interest or work of the organization which he proposes to join or the areas in which he proposes to practice or consult ;
( c) Whether there is conflict of interest between the policies of the office he has held in the last three years and the interest represented or work undertaken by the organization he proposes tojoin.
Explanation. For the purposes of this clause," conflict of interest" shall not include normal economic competition with the Government or its undertakings .
(d) Whether the organization he proposes tojoin has been known to be in any way in conflict with or prejudicial to India's foreign relations, national security and domestic harmony , and whether the organization is undertaking any for intelligence gathering.
( e) Whether service record of the officer is clear , particularly with respect to integrity and dealings with non- Government organizations ;
(f) Whether the proposed emoluments and pecuniary benefits are far in excess of those currentlyprevailing in the Industry.
Explanation. -For the purposes of this sub-clause, the words "far in excess" , shall not be construed as to cover increase in such benefit that may be as a result of buoyancy in industry or in the economy as a whole;
(g) Any other relevant factor . "
(iii) In FORM 25 ;-
(a) In serial number 7 , for clause ( c) , the following shall be substituted , namely :- " ( c) Whether the officer had during the last
three years ofhis official career, any dealings
with the firm or company or Co - operative
Society, etc."
(b) for serial number 9 , the following shall be substituted, namely:-
"9. Declaration : -
I hereby declare that-
(a) The employment, which I propose to take up , will not involve activities prejudicial to India's foreign relations , national security and domestic harmony. It will not involve conflict of interest with the policies of the office held by me during the last three years and the interest represented or work undertaken by the organization I propose tojoin will not bring me into conflict with the working of the Government .
(b) I have not been privy to sensitive or strategic information in the last three years of service , which is directly related to the areas of interest or work of the organization that I propose to join or to the areas in which I propose to practice orconsult.
( c) My service record is clear , particularly with respect to integrity and dealings with Non- GovernmentOrganisations .
(d) I agree to withdraw from the commercial employment in case of any objection by the Government:
