आ.अ. 118( अ ).-यतः उत्तर प्रदेश राज्य की विधान सभा के निर्वाचित सदस्यों द्वारा निर्वाचित ललित सूरी का स्थान , राज्य सभा में उनकी पदावधि, जो 4 जुलाई, 2010 सहित् उस तारीख तक थी , के समाप्त होने से पूर्व , जिनकी मृत्यु के कारण , 10 अक्तूबर , 2006 से रिक्त हो गया है ; और
यतः , इस प्रकार हुई रिक्ति को भरने के प्रयोजन से उप - निर्वाचन कराना है ;
अतः अब लोक प्रतिनिधित्व अधिनियम , 1951 ( 1951 का 43 ) की धारा 147 , धारा 39 की उपधारा ( 1 ) और धारा 56 के अनुसरण में, भारत निर्वाचन आयोग एतद्वारा : -
(अ ) उत्तर प्रदेश राज्य की विधान सभा के निर्वाचित सदस्यों से यह अपेक्षा करता है कि वे 13 दिसम्बर , 2006 ( बुधवार ) से पूर्व तथा उक्त अधिनियम और तद्दीन बनाए गए नियमों और किए गए आदेशों के उपबन्धों के अनुसार राज्य सभा में उक्त रिक्ति को भरने के प्रयोजन से एक सदस्य निर्वाचित कर दें ,-
(आ ) उक्त निर्वाचन के संबंध में : -
(क) नाम निर्देशन करने की अन्तिम तारीख
1 दिसम्बर, 2006 ( शुक्रवार )
(ख) नाम निर्देशन की संवीक्षा की तारीख
2 दिसम्बर , 2006 ( शनिवार)
( ग ) अभ्यर्थिताएं वापस लेने की अंतिम तारीख
4 दिसम्बर, 2006 (सोमवार )
11 दिसम्बर , 2006 ( सोमवार )
(घ) वह तारीख , जिसको यदि आवश्यक हुआ तो मतदान होगा
(ङ) वह तारीख जिससे पूर्व निर्वाचन सम्पन्न करा लिया जाएगा 13 दिसम्बर , 2006 (बुधवार)
नियत करता है; और
( इ ) 9.00 बजे पूर्वाह्न से 4.00 बजे अपराहन तक का समय , ऐसे समय के रूप में नियत करता है जिसके दौरान यदि आवश्यक हुआ तो , निर्वाचन के लिए उपर्युक्त विनिर्दिष्ट तारीख को , मतदान होगा ।

NOTIFICATION
New Delhi, the 24th November , 2006
O. N. 118(E).-Whereas , the seat of Shri Lalit Suri in the Council ofStates , elected by the elected members ofthe Legislative Assembly of the State of Uttar Pradesh , has become vacant on 10th October , 2006 by the reason of his death , before the expiration ofhis term of office which was upto and including the 4th July, 2010; and
Whereas, a bye -election is to be held for the purpose of filling the vacancy so caused;
Now, therefore , in pursuance of Section 147 , sub - section ( 1) of Section 39 and Section 56 of the Representation of the People Act, 1951 (43 of 1951 ) , the Election Commission of India hereby:--
(A) calls upon the elected members of the Legislative Assembly of the State of Uttar Pradesh to elect, before 13th December , 2006 ( Wednesday ) and in accordance with the provisions of the said Act and of the rules and orders made thereunder , a person for the purpose of filling the said vacancy in the Council of States;
(B) appoints , with respect to the said election;
(a) the 1st December, 2006 (Friday) , as the last date for making nominations ;
(b) the 2nd December , 2006 (Saturday) , as the date for the scrutiny of the nominations ;
(c) the 4th December, 2006 ( Monday) , as the last date for the withdrawal of candidatures ;
(d) the 11th December , 2006 ( Monday) , as the date on which a poll shall , if necessary , be taken ; and (e) the 13th December , 2006 ( Wednesday ) , as the date before which the election shall be completed; and (C) Fixes the hours from 9:00 A.M. to 4:00 P.M. , as the hours during which the poll shall, ifnecessary, be taken on the date specified above for the election.

आ.अ. 119( अ) . लोक प्रतिनिधित्व अधिनियम , 1951 ( 1951 का 43 ) की धारा 21 के अनुसरण में और धारा 22 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निर्वाचन आयोग , उत्तर प्रदेश राज्य सरकार के परामर्श से एतद्वारा तारीख 24 नवम्बर, 2006 को भारत के राजपत्र में प्रकाशित आयोग की अधिसूचना के अनुसरण में इस राज्य में राज्य सभा के लिए उप-निर्वाचन के संबंध में : - ( 1 ) नीचे की सारणी के स्तम्भ ( 1 ) में विनिर्दिष्ट अधिकारी को रिटर्निंग आफिसर के रूप में पदाभिहित करता है, और ( II ) उक्त सारणी के स्तम्भ ( 2 ) में विनिर्दिष्ट अधिकारी को , रिटर्निंग आफिसर की उसके कृत्यों के निष्पादन में सहायता के लिए सहायक रिटर्निंग आफिसर नियुक्त करता है।

NOTIFICATION

O. N. 119 (E ). In pursuance of Section 21 , and in exercise of the powers conferred by sub - section ( 1 ) of Section 22, of the Representation of the People Act, 1951 (43 of 1951 ), the Election Commission of India, in consultation with the Government ofthe State of Uttar Pradesh, hereby----
(i) designates the officer , specified in column ( 1 ) of the TABLE below, to be the Returning Officer ; and
(ii) appoints the officer , specified in column (2 ) of the said Table , to be the Assistant Returning Officer to assist the Returning Officer in the performance of his functions;
inrespect ofthe bye-election to the Council of States, to be held in that State in pursuance of the Commission's Notification, published in the Gazette of India on 24th November, 2006 :-
