का.आ. 2034( अ) -यतः यूनाइटेड लिब्रेशन फ्रंट ऑफ असम और उसके अमेक गुट ( जिन्हें इसमें इसके पश्चात् यू.एल.एफ.ए. कहा गया है ) का घोषित उद्देश्य पूर्वोत्तर क्षेत्र के अन्यं सशस्त्र पृथकतावादी संगठनों से मिलकर, सशस्त्र संघर्ष द्वारा असम को भारत संघ से ' मुक्त कराना ' और भारत- बर्मा क्षेत्र की राष्ट्रीय मुक्ति के लिए , उस क्षेत्र के समरूचि संगठनों से मिलकर संघर्ष करना और इस प्रकार असम को भारत संघ से पृथक करना है ,
और यतः केन्द्रीय सरकार की यह राय है कि यू.एल.एफ.ए.:-
(i ) असम को मुक्त करने के अपने उद्देश्य की प्राप्ति के लिए, भारत की संप्रभुता और भू- भागीय अखंडता को विच्छिन्नू करने के लिए आशयित अनेक अवैध और हिंसात्मक क्रियाकलापों में लिप्त है;
(ii) असम को भारत से पृथक करने के लिए पूर्वोत्तर क्षेत्र के कुछ विधि विरुद्ध संगमों के साथ संबद्ध रहा है;
(iii ) इसकी विधिविरुद्ध संगम के रूप में घोषणा किए जाने के दौरान भी यह अपने ध्येयों और उद्देश्यों के अनुसरण में अनेक विधिविरुद्ध एवं हिंसक क्रियाकलापों में संलिप्त रहा है ;
और यतः केन्द्रीय सरकार की यह भी राय है कि इसके विधिविरुद्ध और हिंसक क्रियाकलापों में निम्नलिखित सम्मिलित हैं :-
( i ) 01 जनवरी , 2004 से 31 जुलाई, 2006 तक की अवधि के दौरान 437 हिंसक और आतंकवादी घटनाएं, जो यू.एल.एफ.ए. द्वारा कीगई;
:
( ii) 04 जनवरी, 2004 से 31 जुलाई , 2006 तक की अवधि के दौरान उल्फा ने 26 सुरक्षा बल कार्मिकों सहित 148 व्यक्तियों की हत्याएं की हैं;
(iii ) फिरौती के लिए अपहरण की अपनी कार्रवाइयों के अलावा धन ऐंठने और अलगाववादी गतिविधियों तथा निर्दोष नागरिकों के जीवन को खतरे में डालने के क्रियाकलापों में इसकी संलिप्तता;
(iv) अपने आतंकवादी और विद्रोही क्रियाकलापों को जारी रखते हुए नए काडरों की भर्ती करना और जिला , आंचलिक एवं शाखा समितियों को पुनर्गठित करने का शांतिपूर्ण किन्तु व्यवस्थित अभियान चलाकर आधारभूत स्तर पर अपने संगठनात्मक नेटवर्क को पुनर्गठित करने का कार्यक्रम प्रारंभ करना;

(v ) संगठन के प्रचार विंग को सक्रिय करना जिसने संगठन के लक्ष्यों, केन्द्रीय सरकार द्वारा कथित शोषण को प्रदर्शित करते हुए और तथाकथित मुक्तिसंघर्ष में सम्मिलित होने के लिए लोगों को प्रोत्साहित करते हुए, गुप्त पुस्तिकाएं एवं मैगजीन प्रकाशित की हैं और इस प्रकार उनकी निष्ठाओं को भंग किया है;
(vi ) अपने कॉडरों को पुलिस मुखबिरों/ सरकार के सहयोगियों की सूची तैयार करने की हिदायत देना और उनके विरुद्ध प्रतिकारात्मक कार्रवाई करने के लिए लक्ष्यों की पहचान करना;
(vii ) यू.एल.एफ.ए. के सैन्य विंग को आम जनता के साथ घुल - मिल जाने और सौंपे गए कार्यों को निष्पादित करने का अनुदेश देना , (vii ) पड़ोसी देशों में अनेक शरण स्थल और प्रशिक्षण शिविर स्थापित करना ।
और यतः , केन्द्रीय सरकार की यह भी राय है कि ऊपर उल्लिखित कारणों से, यू.एल.एफ.ए. के क्रियाकलाप भारत की संप्रभुता और अखण्डता के लिए हानिकर हैं और यह कि एक विधिविरुद्ध संगम है;
और यतः , यू.एल.एफ.ए. के विधिविरुद्ध क्रियाकलापों को तत्काल रोका और नियंत्रित नहीं किया गया तो इसे निम्नलिखित कार्य करने का अवसर प्राप्त हो सकता है :-
(i ) अपने काडरों को अपने पृथकतावादी , विध्वंसक और हिंसक क्रियाकलापों के लिए लामबंद करना;
( ii) भारत की संप्रभुता और राष्ट्रीय अखंडता की विरोधी ताकतों के सहयोग से , राष्ट्र विरोधी क्रियाकलापों का खुले आम प्रसार करना;
(iii ) नागरिकों की अधिकाधिक हत्या करना और पुलिस एवं सुरक्षा बल कार्मिकों को निशाना बनाने में संलिप्त रहना;
( v) सीमा पार से और अधिक अवैध शस्त्र एवं गोलाबारूद प्राप्त करना और लाना;
(v ) अपने विधिविरुद्ध क्रियाकलापों के लिए जनता से प्रचुर मात्रा में धन और अवैध कर ऐंठना एवं संग्रह करना;
अतः , अब, केन्द्रीय सरकार , विधिविरुद्ध क्रियाकलाप ( निवारण ) अधिनियम , 1967 ( 1967 का 37 ) की धारा 3 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यूनाइटेड लिबरेशन फ्रंट ऑफ असम ( यू.एल.एफ.ए. ) के साथ इसके सभी गुटों, विंगों एवं मुख्य संगठनों को विधिविरुद्ध संगम घोषित करती है;
केन्द्रीय सरकार की यह भी दृढ़ राय है कि यू.एल.एफ.ए. के उल्लिखित क्रियाकलापों को ध्यान में रखते हुए और हाल ही में पुलिंस , सशस्त्र बलों और नागरिकों के विरुद्ध यू.एल.एफ.ए. की सतत बढ़ती हिंसा का मुकाबला करने के लिए यूएल.एफ.ए. को तात्कालिक प्रभाव से विधिविरुद्ध संगम घोषित किया जाना आवश्यक है और तदनुसार , केन्द्रीय सरकार , धारा 3 की उपधारा ( 3 ) के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निदेश देती है कि यह अधिसूचना , उक्त अधिनियम की धारा 4 के अधीन किए जा सकने वाले किसी आदेश के अध्यधीन रहते हुए, सरकारी राजपत्र में इसके प्रकाशन की तारीख से प्रभावी होगी ।

NOTIFICATION
NewDelhi , the 27th November , 2006
S.O. 2034(E) . Whereas the United Liberation Front of Asorn and the various wings thereof (hereinafter referred to as the ULFA), has as its professed aim, the " Liberation " of Assam from the Indian Union through an armed struggle in alliance with other armed secessionist organizations of the North East Region as well as to struggle for the national liberation of the Indo - Burma region in alliance with like - minded organizations of that region and thereby , the secession of Assam from the Indian Union;

And whereas , the Central Governinent is of the opinion that ULFA has ---
(i) indulged in various illegal and violent activities intended to disrupt the sovereignty and territorial integrity of India in furtherance of its objective of liberating Assam;
(ii) aligned itself with some other unlawful associations of North Eastern Region to secede Assam from India;
(ii) in pursuance of its aims and objectives , engaged in several unlawful and violent activities during the currency of its declaration as an unlawful association ;

And whereas , the Central Government is further of the opinion that the unlawful and violent activities include...
(i) 437 violent incidents , which are attributed to ULFA during the period from 1st January, 2004 to 31st July, 2006;
(ii) killing of 148 persons including 26 members of security forces which are attributed to ULFAduring the period 1st January, 2004 to 31st July,2006;
(iii) indulging in a spate of extortion and secessionist activities , and endangering lives of innocent citizens, in addition to its acts of kidnapping for ransom;
(iv) embarking on a programme of restructuring its organizational network at grass root level by launching a quiet but systematic drive for recruitment of fresh cadres and revamping the district anchalik and sakha committees , while continuing its violent and insurgent activities;
(v) making publicity wing of the organization active , which has published clandestine leaflets, magazines highlighting the goal of the outfit , alleged exploitation by the Central Government and exhorting the people to jointhe so-called liberation struggle and thereby subverting their loyalties ;
(vi) instructing its cadres to compile the list of police informers and government collaborators and to identify targets for retaliatory action against them;
(vii) instructing the army wing of ULFA to mingle with the common people and execute assigned tasks;
(viii) establishing sanctuaries and a number of training camps in neighbouring countries;
And whereas, if the Central Government is also of the opinion that for the reasons mentioned above, the activities ofULFA are detrimental to the sovereignty and integrity of India and it is an unlawful association;
And whereas , if there is no immediate curb and control of unlawful activities of the ULFA , it may take the opportunity to
(1) mobilize its cadres for escalating its secessionist, subversive and violent activities ;
(ii) openly propagate anti - national activities in collusion with forces inimical to India's sovereignty and national integrity;
(iii) indulge in increased killings of civilians and targeting of police and security forces personnel ;
(iv) procure and induct more illegal arms and ammunitions from across the border;
(v) extort and collect huge funds and illegal taxes from the public for its unlawful activities;
Now therefore, in exercise of the powers conferred by sub- section ( 1 ) of Section 3 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967) , the Central Government hereby declares the United Liberation Front ofAsom (ULFA ) alongwith all its factions , wings and front organizations as unlawful associations ;
The Central Government is further of the opinion that having regard to the activities of ULFA mentioned above. and to meet the sustained and ever increasing violence committed by ULFA in the recent past against the police , the armed forces and the civilians , it is necessary to declare ULFA an unlawful association with immediate effect and accordingly, in exercise of the powers conferred by the Proviso to sub -section (3) of Section 3 , the Central Government directs that the notification shall , subject to any order that may be made under Section 4 of the said Act, have effect from the date of its publication in the Official Gazette.
