7.75 प्रतिशत तेल विपणन कंपनियों के भारत सरकार विशेष बांड , 2021 का निर्गम एफ. सं. 4(13) -डब्ल्यू एंड एम/2006.- भारत सरकार एतदद्वारा 28 नवम्बर, 2006 को कुल 5,000 करोड़ रूपए (नामिनल) की राशि के लिए 7.75 प्रतिशत तेल विपणन कंपनियों के भारत सरकार " विशेष बांड" 2021 ( जिन्हें इसके बाद संक्षिप्त रूप में " विशेष बांड" के रूप में निर्दिष्ट किया गया है ) का निर्गम अधिसूचित करती है ।
1. विशेष बांड में अभिदान की पात्रता और अभिदान की सीमा
यहां अनुबंध -1 में यथा उल्लिखित कंपनियां ही विशेष बांडों में अभिदान की पात्र होंगी और विशेष बांडों में उनका ' अभिदान उक्त अनुबंध- I में उनके नाम के सामने दर्शाई गई राशि की सीमा तक सीमित होगा । उक्त अनुबंध में यथा उल्लिखित कम्पनियों को छोड़कर कोई बैंक, कंपनी, निगम अथवा अन्य कोई निकाय सहित कोई अन्य व्यक्ति विशेष बांडों में अभिदान के लिए पात्र नहीं होगा।
2. मूल्य
विशेष बांड पात्र कंपनियों द्वारा किए गए आवेदन के अनुसार राशि के लिए सममूल्य पर किए गए आवेदन पर जारी किए जाएंगे। विशेष, बांड न्यूनतम 10,000 रूपए (नामिनल) की राशि और उसके बाद 10,000 रूपए के गुणजों में जारी किए जाएंगे।
3. आवेदन पत्र
विशेष बांड पात्र कंपनियों से अनुबंध- II में दिए गए प्रपत्र के अनुसार आवेदन पर जारी किए जाएंगे ।

विशेष बांड स्टॉक के रूप में अर्थात् ' स्टॉक प्रमाण पत्रों ' अथवा भारतीय रिजर्व बैंक, फोर्ट, मुम्बई के लोक ऋण कार्यालयों में धारित सहायक सामान्य बही लेखा में क्रेडिट द्वारा जारी किए जाएंगे।
5. कार्यकाल का प्रारम्भ और वापसी अदायगी की तारीख
विशेष बांड का कार्यकाल 28 नवम्बर, 2006 से शुरू होगा। विशेष बांड परं ब्याज उनके अवधि की प्रारम्भ की तारीख से उपचित होगा । विशेष बांडों की वापसी अदायगी सममूल्य पर 28 नवम्बर, 2021 को भारतीय रिजर्व बैंक, मुम्बई के लोक ऋण कार्यालय में की जाएगी ।
6.
ब्याज
विशेष बांड पर 7.75 प्रतिशत वार्षिक की दर पर ब्याज प्राप्त होगा । ब्याज का हिसाब विशेष बांडों की अवधि प्रारंभ होने की तारीख से लगाया जाएगा और यह भुगतान विशेष बांड की परिपक्वता तक अर्द्धवार्षिक आधार पर 28 मई और 28 नवम्बर को देय होगा ।
विशेष बांड पर ब्याज का भुगतान भारतीय रिजर्व बैंक के फोर्ट, मुम्बई के लोक ऋण कार्यालय में किया जाएगा । ब्याज का भुगतान ब्याज की राशि को निकटतम रूपए तक पूर्णांकित करने के बाद किया जाएगा ।
7. हस्तांतरणीयता
(i ) इस अधिसूचना के पैरा 4 के प्रावधानों के अधीन, धारक द्वारा लोक ऋण अधिनियम, 1944 तथा इसके अंतर्गत निर्मित लोक ऋण नियमावली, 1946 के अंतर्गत विशेष बांड का नवीकरण , उप- विभाजन , समेकन, रूपान्तरण अथवा अंतरण किया जा सकता है ।
( ii ) इस अधिसूचना में ऊपर पैरा 1 में दिए गए कथन के बावजूद, अभिदानकर्ताओं द्वारा विशेष बांड को बैंकों, निगम अथवा किसी अन्य निकाय सहित किसी अन्य व्यक्ति के पक्ष में अंतरण करने पर कोई प्रतिबंध नहीं होगा और ऐसी प्रतिभूति का अन्तरिती भी उन्हें उसी तरीके से धारण तथा अंतरण करने का पात्र होगा।
सांविधिक प्रावधान

ऐसे किसी भी मामले के संबंध में जिसकी व्यवस्था इस अधिसूचना के तहत नहीं की गई है, विशेष बांड लोक ऋण अधिनियम, 1944 और उसके तहत निर्मित लोक ऋण नियमावली, 1946 द्वारा नियंत्रित किए जाएंगे ।
9. कर कानून की प्रयोज्यता
विशेष बांड में निवेश का मूल्य और उस पर देय ब्याज समय - समय पर लागू कर कानूनों के उपबंधों द्वारा शासित किए जाएंगे ।
बांड की पात्रता

तेल कम्पनियों अथवा बैंकों अथवा वित्तीय संस्थाओं, निगमों सहित अन्य संस्थाओं द्वारा अथवा अन्य किसी निकाय द्वारा जिसमें बांडों को बाद में पात्र निवेश के रूप में अन्तरित किया जाता है, विशेष बांड में किए गए निवेश को, किसी सांविधिक अपेक्षा के अनुसरण में, जैसा भी मामला हो, पात्र निवेश के रूप में नहीं माना जाएगा।

New Delhi , the 28th November, 2006
Issue of 7.75 per cent Oil Marketing Companies ' Government of India Special Bonds , 2021
f. No. 4 ( 13) -W& M/ 2006.- Government of India hereby notifies the issue of 7.75 per cent Oil Marketing Companies ' Government of India Special Bonds , 2021 , ( hereinafter briefly described as "Special Bonds " ) for an aggregate amount of Rs.5,000 crore (nominal ) on November 28 , 2006 .
1. Eligibility for making subscription to the Special Bonds and limits of subscription .
The companies as referred to in the Annex 1 hereto shall be eligible to subscribe to the Special Bonds and their subscription to the Special Bonds shall be limited to the extent of the amount, as shown against their respective names in the said Annex 1. No other person including any bank , company , corporation or any other body, except the companies as referred to in the aforesaid Annex , shall be eligible to subscribe to the Special Bonds .
2. Price
The Special Bonds shall be issued on application at par for the amounts as per the application made by the eligible companies . The Special Bonds will be issued for a minimum amount of Rs . 10,000 (Nominal ) and in multiples of Rs . 10,000 thereafter .
3. Application
The Special Bonds shall be issued on application as per proforma in Annex II , from the eligible companies .
4. Form of Security
The Special Bonds will be issued in the form of stock, i.e. ' Stock Certificates ' or by credit to Subsidiary General Ledger Account maintained with Public Debt Office of the Reserve Bank of India, Fort, Mumbai .
5. Commencement of tenure and date of repayment
The tenure of Special Bonds will commence from November 28 , 2006. Interest on the Special Bonds will accrue from the date of commencement of tenure . The special Bonds will be repaid at par on November 28 , 2021 at Public Debt Office , Reserve Bank of India , Mumbai .
6. Interest
The Special Bonds will bear interest at the rate of 7.75 per cent per annum . Interest will be reckoned from the date of commencement of tenure of the Special Bonds and will be payable half yearly on May 28 and November 28 till maturity of the Special Bonds .
Interest on the Special Bonds will be payable at Public Debt Office , Reserve Bank of India, Fort , Mumbai . Interest will be paid after rounding off the amount of interest to the nearest rupee.

7. Transferability
(i) Subject to the provisions of paragraph 4 of the notification , the Special Bonds can be renewed , sub -divided, consolidated , converted and transferred by the holder in accordance with the provisions of the Public Debt Act , 1944 and Public Debt Rules , 1946 framed thereunder .
(ii ) Notwithstanding what is stated in paragraph 1 hereinabove , there will be no restriction on the transfer of the Special Bonds by the subscribers in favour of any other person including banks , corporation or any other body and the transferee of such security would also be entitled to hold and transfer the same in such manner .
8. Statutory Provisions
With respect to any such matter which has not been provided under this Notification, the Special Bonds shall be governed by the Public Debt Act , 1944 and the Public Debt Rules , 1946 framed thereunder .
9. Applicability of Tax Law
The value of the investment in the Spécial Bonds and the interest payable thereon will be governed by the provisions of tax laws as applicable from time to time.
10. Eligibility of Bonds
The investment in Special Bonds by Oil Companies or the banks or other institutions including Financial Institutions , Corporations or any other body to which the bonds are subsequently transferred would not be considered as an eligible investment in pursuance of any statutory requirement as the case may be .
