का.आ. 2036( अ ).- केन्द्र सरकार, मोटरयान अधिनियम, 1988 की धारा 58 की उपधारा ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए संलग्न अनुसूची में उल्लिखित गुजरात राज्य में पंजीकृत 7 ट्रेलरों के उच्च प्रति धुरी भार एवं वाहन सकल भार के लिए अनुमोदन प्रदान करती है -

6. उपर्युक्त छूट इन शर्तों के अध्यधीन हैः-
(i) इन ट्रेलरों का कभी-कभार प्रचालन किया जाएगा ।
(il) लो.नि.वि. । स्थानीय प्राधिकारियों / भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा विभिन्न सड़कों के लिए विनिर्दिष्ट भार प्रतिबंधों का अनुपालन किया जाएगा और वाहनों को प्रत्येक बार सड़कों पर लाते समय इन प्राधिकारियों से अनुमति ली जाएगी । सुरक्षा की दृष्टि से ट्रेलरों का प्रत्येक प्रचालन राज्य । संघ शासित प्रदेश । भारतीय राष्ट्रीय राजमार्ग प्राधिकरण के संबंधित परिवहन विभाग द्वारा अनुमोदित किया जाएगा और उस पर कड़ी निगरानी रखी जाएगी ।
(üⅲ ) सड़क की चौड़ाई में ट्रेलरों को जोड़ने की अनुमति नहीं दी जाएगी ।
(iv ) ट्रेलरों का पंजीकरण स्वतंत्र रूप से जारी रहेगा न कि संयुक्त रूप से ।

किसी राज्य या संघ शासित प्रदेश के लोक निर्माण विभाग । भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा यदि ऐसा निर्देश दिया जाए तो भारी वाहनों को उस राज्य संघ शासित प्रदेश में सडकों पर बने पुलों से गुजरने की अनुमति नहीं होगी और ऐसे मामलों में आवेदकों को नदियों । नालों को पार करने के लिए स्वयं व्यवस्था करनी होगी ।
(Vi) बड़े भार के कार्गो को ध्यान में रखते हुए उन्हें किसी मार्ग विशेष पर चलने से पहले प्रत्येक बार संबंधित राज्य या संघ शासित प्रदेश के प्राधिकारियों भारतीय राष्ट्रीय राजमार्ग प्राधिकरण की अनुमति प्राप्त करनी होगी । ऐसे प्रत्येक आवागमन के लिए संबंधित प्राधिकारी द्वारा समय का निर्धारण किया जाना चाहिए । सड़क पर चलने के लिए ट्रेलरों की अधिकतम गति 10 कि. मी. / घंटा से अधिक नहीं होगी ।
(vii) वे राज्य । संघ शासित प्रदेश । भारतीय राष्ट्रीय राजमार्ग प्राधिकरण के प्राधिकारियों द्वारा निर्धारित गति सीमा का पालन करेंगे ।
(vii) उक्त वाहन , यातायात के सामान्य आवागमन में कोई बाधा पंहुचाए बगैर चलाया जाना चाहिए ।
(ix) ट्रेलरों की संपूर्ण चौड़ाई में अगले एवं पिछले हिस्से पर पीले एवं काले रंग से जेबरा पट्टी बनाई जाएगी और उस पर रात्रि के समय चलाने के लिए विधिवत लिखा होना चाहिए । पार्किंग के लिए आगे , और पीछे समुचित रूप से लाल बत्ती होनी चाहिए तथा दिन में दोनों ओर लाल झण्डी लगाई जाएंगी , जिससे वाहन की सही - सही स्थिति का स्पष्ट रूप से पता चल सके । इसके अतिरिक्त माल का बाहरी भाग पूरी तरह से एक लाल परावर्तक । परावर्ती टेप से ढका होना चाहिए ताकि रात्रि के समय बाहरी भाग निर्विघ्न रुप से दिखाई दे ।
(x) मै. नाबरोस (ट्रांसपोर्ट) प्रा. लि.. अहमदाबाद सडकों अथवा सडक ढांचों । अन्य सडक प्रयोक्ताओं व्यक्तियों को ऐसे ट्रेलरों के प्रचालन के कारण प्रत्यक्ष अथवा अप्रत्यक्ष रूप से हुई किसी क्षति के लिए राज्य । संघ शासित प्रदेश सरकार / भारतीय राष्ट्रीय राजमार्ग प्राधिकरण या किसी अन्य प्रभावित व्यक्ति को ऐसी राशि का भुगतान करने के लिए जिम्मेदार होगा ।
(xi) मै . नाबरोस (ट्रांसपोर्ट) प्रा. लि. , अहमदाबाद ऐसे प्रतिबंधों का पालन करेंगे जो इस संबंध मे राज्य सरकारों/ संघ शासित प्रदेश भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा आदेश द्वारा विनिर्दिष्ट किए जाएं ।
(xii) मै. नाबरोस (ट्रांसपोर्ट) प्रा. लि. , अहमदाबाद ऐसे वाहनों के प्रत्येक बार आवागमन के संबंध में राज्य सरकार/ भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा इस संबंध में विनिर्दिष्ट ऐसे प्राधिकारी या अधिकारी को अग्रिम सूचना देगा ।
( xiii) पंजीकरण प्रमाण पत्र में एक विशेष प्रविष्टि की जाए कि ट्रेलर मालिक के लिए यह आवश्यक होगा कि वह प्रत्येक प्रचालन के लिए संबंधित प्राधिकारी अर्थात राज्य सरकार संघ शासित प्रदेश सरकार । भारतीय राष्ट्रीय राजमार्ग प्राधिकरण से अनुमति प्राप्त करे ।

New Delhi , the 28th November, 2006
S.O. 2036(E ). In exercise of the powers conferred by sub - section (3) of Section 58 of the Motor Vehicles Act, 1988, the Central Government hereby accords approval for higher per axle load and Gross Vehicle Weight (GVW) in respect of seven hydraulic trailers registered in Gujarat as mentioned in the Schedule appended hereto:

6. The above relaxation is subject to the conditions that: -
(i) The operations of the trailers shall be done only sparingly .
(ii) Load restrictions on various roads stipulated by the Public Works Department/Local Authorities /National Highway Authority of India will be observed and permission of such authorities will be obtained every time the vehicles are put on the roads . Each of such movement of the trailers will be approved and closely monitored by the concerned road transport authorities in State/ Union Territory /National Highway Authority of India from safety point of view.
( iii) Coupling of the trailers along side by side the width of the road shall not bepermitted.
The trailers shall continue to be registered individually and not as a (iv) combination.
(v) If so directed by the Public Works Department of a State/ Union Territory /National Highway Authority of India , the loaded vehicles will not be allowed to 4

pass over the bridges on the roads in that State/Union Territory and in such cases applicants will have to make their own arrangements to cross the rivers / drains .
(vi ) They would need to obtain permission each and every time before moving on a particular route from concerned State or Union Territory Authorities /National Highway Authority of India en - route , in view of the oversized cargo . For each such movement, the timing should be prescribed by the concerned authority . The maximum speed of the trailers for movement on the road shall not exceed 10 kms/hour.
(vii) They would adhere to the speed limits prescribed by the authorities in State/Union Territory /National Highway Authority of India .
(viii) The said vehicles should be moved without any hindrance to the normal flow of traffic .
(ix) The trailers shall be painted for the entire width by yellow and black zebra strips on the front and rear sides duly marked for night time driving/ parking suitably by red lamps at the front and rear and red flags on both the sides during day time to indicate the extreme position of the vehicles clearly. In addition the entire overhang shall be covered with a red reflector/ reflective tape to facilitate clear vision of overhang at night time .
(x) M/S Nabros Transport Pvt . Ltd. Ahmedabad, would be liable to pay such amount to the Government of State/Union Territory / National Highway Authority ofIndia or any other affected person where any damage is caused to the roads or road structures/other road users /person directly or indirectly due to the movement of the trailers .
(xi) M /S Nabros Transport Pvt. Ltd. Ahmedabad , will observe such restrictions as the State/ Union Territory Government/ National Highway Authority of India may by order specify in this behalf .
(xii) M/S Nabros Transport Pvt . Ltd. Ahmedabad , will give an advance intimation to such authority or officer specified in this behalf by the State Government/National Highway Authority of India regarding each movement of such vehicles .
(xiii ) A specific entry in Registration Certificate is to be made that the trailers owner in case of each and every movement will be required to take the permission of concerned Authority i.e. State Govt./Union Territory Govt./National Highway Authority of India.
