सा.का.नि. 744(अ) संसद् सदस्य वेतन , भत्ता और पेंशन अधिनियम, 1954 ( 1954 का 30 ) की धारा 9 की उप - धारा ( 1 ) के अधीन गठित संयुक्त समिति , केन्द्रीय सरकार से परामर्श करने के पश्चात्, उक्त धारा की उपधारा ( 3 ) के खंड ( च ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , आवास और टेलीफोन सुविधाएं ( संसद् सदस्य ) नियम, 1956 का और संशोधन करने के लिए उक्त धारा की उप - धारा ( 4 ) के अधीन यथा अपेक्षित राज्य सभा के सभापति और लोक सभा के अध्यक्ष द्वारा अनुमोदित और पुष्ट किए गए, निम्नलिखित नियम बनाती है , अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम आवास और टेलीफोन सुविधाएं ( संसद् सदस्य) ( संशोधन ) नियम , 2006 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे।
2. आवास और टेलीफोन सुविधाएं ( संसद् सदस्य ) नियम , 1956 में-
(क) नियम 2 में,-
(i ) उपनियम (2 ) के परंतुक के पश्चात्, निम्नलिखित परंतुक , अंतःस्थापित किए जाएंगे , अर्थात्: -
" परन्तु यह और कि यदि पति और पत्नी , दोनों संसद् के किसी या उसी सदन के सदस्य हैं और एक ही वास- सुविधा में निवास कर रहे हैं तो इस उपनियम के अधीन यथा अनुज्ञेयं यूनिटों में विद्युत और किलोलीटरों में जल , पृथक रूप से संगणित होंगे :
परन्तु यह भी कि जहां कोई सदस्य , किसी वर्ष में इस उप नियम के अधीन यथा अनुज्ञेय विद्युत के यूनिटों और किलोलीटरों में जल का उपभोग नहीं करता है वहां , विद्युत के यूनिटों का और किलोलीटरों में जल का अतिशेष, उसके स्थान के रिक्त होने तक , पश्चात्वर्ती वर्षों में अग्रनीत होगा :
परन्तु यह भी कि जहां कोई सदस्य , किसी विशिष्ट वर्ष में उन विद्युत के यूनिटों और किलोलीटरों में जल, जिसके लिए वह हकदार है , से अधिक उपभोग करता है , वहां उसके द्वारा इस प्रकार अधिक उपभोग किए गए, विद्युत के यूनिट और किलोलीटर में जल, आगामी वर्ष के लिए उपलब्ध विद्युत के यूनिटों और किलोलीटरों में जल , से समायोजित होंगे :
परन्तु यह भी कि यदि किसी सदस्य का स्थान , त्यागपत्र या पदावधि की समाप्ति के कारण , रिक्त होता है, तो वह उस तारीख से , जिसको उसका स्थान रिक्त हुआ है , एक मास की अधिकतम अवधि के भीतर , इस उप नियम के अधीन उस वर्ष के लिए यथा उपलब्ध, विद्युत के यूनिट और किलोलीटर में जल का अतिशेष , उपभोग करने का हकदार होगा। " (ii) उप नियम (3 ) के पहले परंतुक में, -
" टिकाऊ फर्नीचर की बाबत 24,000 रुपए और गैर टिकाऊ फर्नीचर की बाबत 6,000 रुपए " शब्दों, अक्षरों और अंकों के स्थान पर, " टिकाऊ फर्नीचर की बाबत 60,000 रुपए और गैर टिकाऊ फर्नीचर की बाबत 15,000 रुपए " शब्द, अक्षर और अंक रखे जाएंगे ;

(iii ) उपनियम ( 3 ) के दूसरे परंतुक के पश्चात्, और स्पष्टीकरण 1 से पहले , निम्नलिखित परंतुक अंतःस्थापित किया जाएगा , अर्थात्: -
" परन्तु फर्नीचर की अतिरिक्त मदों के लिए किराया , किसी सदस्य के निवास पर इस प्रकार उपलब्ध कराए गए फर्नीचर के अवक्षयित मूल्य पर प्रभारित होगा । "
(ख ) नियम 2क में, " दो मास " शब्दों के स्थान पर, " छह मास " शब्द रखे जाएंगे;
(ग ) नियम 2क के पश्चात् निम्नलिखित परंतुक अंतःस्थापित किया जाएगा , अर्थात्: -
" परन्तु किसी मृतक सदस्य का परिवार , उसकी मृत्यु की तारीख से एक मास की अवधि के भीतर , उसकी पदावधि के दौरान उसको उस विशिष्ट वर्ष के लिए, निवास पर आबंटित ऐसे सदस्य को उपलब्ध विद्युत के अतिशेष यूनिटों और किलोलीटरों में जल के अतिशेष का उपभोग करने का हकदार होगा। "
(घ) नियम 4 में,-
(i) उपनियम ( 3 ) के दूसरे परन्तुक का लोप किया जाएगा ।.
(ii ) उपनियम (6 ) के स्थान पर निम्नलिखित उपनियम रखे जाएंगे , अर्थात्:-
" ( 6 ) कोई सदस्य , उसकी प्रार्थना पर , राष्ट्रीय रोमिंग सुविधा सहित महानगर टेलीफोन निगम लिमिटेड के एक मोबाइल फोन संयोजन और उसके निर्वाचन क्षेत्र में उपयोग के लिए राष्ट्रीय रोमिंग सुविधा सहित महानगर टेलीफोन निगम लिमिटेड या भारत संचार निगम लिमिटेड के अन्य मोबाइल फोन संयोजन का उपभोग करने के लिए हकदार है और ऐसे मोबाइल फोन संयोजनों के रजिस्ट्रीकरण और किराए के संबंध में उसके द्वारा , कोई प्रभार संदेय नहीं होगाः परन्तुक ऐसे मोबाइल फोन संयोजनों से किसी सदस्य द्वारा की गई कालें, उपनियम ( 1 ) , उपनियम ( 3 ) और उपनियम ( 5 ) के अधीन उसको प्राप्त कुल मुफ्त स्थानीय कालों में से समायोजित की जाएंगी :
परन्तु यह और कि जहां महानगर टेलीफोन निगम लिमिटेड या भारत संचार निगम लिमिटेड की सेवाएं , उपनियम ( 1 ) , उपनियम ( 3 ) और उपनियम ( 5 ) के अधीन उसको उपलब्ध कुल मुफ्त कालों के उपभोग के लिए उपलब्ध नहीं है , यहां वह , इस शर्त के अधीन कि प्राइवेट मोबाइल फोन संयोजन के लिए रजिस्ट्रीकरण और किराया प्रभारों को , स्वयं सदस्य के द्वारा वहन किया जाएगा , किसी अन्य प्राइवेट मोबाइल आपरेटर से ऐसी सुविधा का उपभोग कर सकेगा । " " ( 7 ) कोई सदस्य, उपनियम ( 1 ) , उपनियम ( 3 ) या उपनियम ( 5 ) के अधीन उसको किसी एक टेलीफोन पर , महानगर टेलीफोन निगम लिमिटेड या भारत संचार निगम लिमिटेड से उपलब्ध ब्राडबैंड सुविधा का उपभोग कर सकेगा , और इस सुविधा के लिए प्रभारों हेतु , एक हजार पांच सौ रुपए प्रतिमास तक के अधिकतम संदाय को करने के लिए दायी नहीं होगा जो , यथास्थिति , महानगर टेलीफोन निगम लिमिटेड या भारत संचार निगम लिमिटेड को सीधे संदत्त किया जाएगा । "
(ङ) नियम 4क में , उपनियम ( 6 ) का लोप किया जाएगा।

G.S.R. 744 (E) .- In exercise of the powers conferred by clause (f) of sub- section (3 ) of Section 9 of the Salary, Allowances and Pension of Members of Parliament Act , 1954 (30 of 1954) , the Joint Committee constituted under sub- section ( 1) of the said section, after consultation with the Central Government, hereby makes the following rules furtherto amend the Housing and Telephone Facilities (Members of Parliament) Rules, 1956, the same having been approved and confirmed by the Chairman of the Council of States and the Speaker of the House of the People , as required under sub- section (4) of the said section, namely :-
1. (1) These rules may be called the Housing and Telephone Facilities (Members of Parliament) (Amendment) Rules, 2006 .
(2) They shall come into force on the date of their publication in the Official Gazette .

2. In the Housing and Telephone Facilities (Members of Parliament) Rules , 1956--
(a) in rule 2,-
(i) in sub -rule (2) , after the proviso, the following provisos shall be inserted , namely:-
"Provided further that the electricity in units and water in kilolitres as admissible under this sub -rule shall be calculated separately, if both husband and wife are members of either or the same House of Parliament and are residing in the same accommodation:
Provided also that where a member does not consume the units of electricity and water in kilolitre as admissible under this sub - rule in any year , the balance units of electricity and water in kilolitre shall be carried over to the subsequent years till his seat becomes vacant:
Provided also that where a member consumes more than his entitled units of electricity and water in kilolitres in a particular year, the excess units of electricity and water in kilolitres so consumed by him shall be adjusted from units of electricity and water in kilolitres available for the next year :
Provided also that in case the seat of a member becomes vacant due to resignation or completion of term, he shallbe entitled to consume the balance units ofelectricity and water in kilolitres as available for that year under this sub- rule within a maximum period of one month from the date on which his seat becomes vacant . "
(ii) in sub - rule (3) , in the first proviso,-
for the words , letters and figures " ceiling of Rs . 24,000 in respect of durable furniture and RS . 6,000 " , the words , letters and figures " ceiling of Rs . 60,000 in respect of durable furniture and Rs . 15,000 " shall be substituted.
(iii) in sub - rule (3 ) , after the second proviso, and before the Explanation I, the following proviso shall be inserted, namely :- "Provided that the rent for additional items of furniture shall be charged on the depreciated value of the furniture so made available at the residence of a member . "
(b) in rule 2A, for the words "two months ", the words " six months " shall be substituted.
(c) after rule 2A, the following proviso shall be inserted, namely:-
"Provided that the family of a deceased member shall be entitled to consume the balance units of electricity andwater in kilolitres available to such member for that particular year at the residence allotted to him during his term of office within a period of one month from the date of his death . "
(d) in rule4,
(1) in sub - rule (3 ) the second proviso shall be omitted .
(ii) for sub - rule (6 ), the following sub- rules shall be substituted , namely:-
"(6) A member , on his request, is entitled to avail one mobile phone connection of Mahanagar Telephone Nigam Limited with national roaming facility and another mobile phone connection of Mahanagar Telephone Nigam Limited or Bharat Sanchar Nigam Limited with national roaming facility for utilisation in his constituency and no charges shall be payable by him in respect of the registration and rental of such mobile phone connections :
Provided that the calls made by a member from such mobile phone connections shall be adjusted from the total free local calls available to him under sub - rule ( 1 ) , sub - rule (3 ) and sub -rule (5) :
Provided further that where services of Mahanagar Telephone Nigam Limited or Bharat Sanchar Nigam Limited are not available for utilising total free local calls available to him under sub- rule ( 1 ), sub - rule (3 ) and sub - rule ( 5 ) , he may avail such facility from any other private mobile operator subject to the condition that the registration and rental charges for the private mobile phone connection shall be borne by the member himself. "
"(7) A member may avail broadband facility from Mahanagar Telephone Nigam Limited or Bharat Sanchar Nigam Limited on any one telephone available to him under sub - rule ( 1 ) , sub - rule (3 ) or sub- rule(5) , and shall not be liable to make payment upto a maximum of one thousand five hundred rupees per mensem which shall be paid directly to Mahanagar Telephone Nigam Limited or Bharat Sanchar Nigam Limited, as the case may be, towards charges for this facility. "
(e) in rule 4A, sub - rule ( 6) shall be omitted .

2. संसद् सदस्य ( यात्रा और दैनिक भत्ते ) नियम , 1957 में,-
(क) नियम 4 क में , " आठ रुपए प्रति किलोलिटर " शब्दों के स्थान पर , " तेरह रुपए प्रति किलोमीटर " शब्द, 15 सितम्बर , 2006 से रखे गए समझे जाएंगे ।
(ख ) नियम 5 के टिप्पण में, " 500 रुपए " अक्षरों और अंकों के स्थान पर , " एक हजार रुपए " शब्द 14 सितम्बर , 2006 से रखे गए समझे जाएंगे ।
( ग ) नियम 10 के उप - नियम ( 2 ) के परन्तुक में, " बत्तीस " शब्द के स्थान पर, " चौंतीस " शब्द 15 सितम्बर, 2006 से रखे गए समझे जाएंगे ।

स्पष्टीकारक ज्ञापन
संसद् सदस्य वेतन , भत्ता और पेंशन अधिनियम , 1954 की धारा 9 ( 1 ) के अधीन गठित संसद् सदस्य वेतन और भत्ता के लिए संयुक्त समिति ने , समय - समय पर संसद् सदस्यों के लिए निश्चित वेतन , दैनिक भत्ता और मील भत्ता की सिफारिश की है जिसके लिए संसद् सदस्य वेतन , भत्ता और पेंशन अधिनियम, 1954 में, सुसंगत उपबंध , 14 सितम्बर, 2006 और 15 सितम्बर , 2006 से लागू किए गए हैं । अतः कुछ पारिणामिक संशोधन , संसद् सदस्य वेतन , भत्ता और पेंशन अधिनियम , 1954 के उपबंधों के अनुरूप , संसद् सदस्य ( यात्रा और दैनिक भत्ते ) नियम 1957 में किए जाने हैं । क्योंकि इन नियमों के संशोधनों का प्रयोजन , वेतन , दैनिक भत्ते और मील भत्ते को बढ़ाया जाना है , जिससे नियमों को भूतलक्षी प्रभाव देने से संसद् के किसी सदस्य पर , प्रतिकूल प्रभाव पड़ने की संभावना नहीं है ।

In exercise of the powersvers conferred by clause (cc) of sub- section ( 3) of Section 9 of the Salary , Allowances and Pension of Members of Parliament Act, 1954 (30 of 1954) , the Joint Committee constituted under sub- section (1 ) of the said section , after consultation with the Central Government, hereby makes the following rules furtherto amend the Members of Parliament (Travelling and Daily Allowances ) Rules , 1957 , the same having been approved and confirmed by the Chairman of the Council of States and the Speaker of the House of the People , as required under sub- section (4) of the said section , namely:---
1. (1) These rules may be called the Members of Parliament (Travelling and Daily Allowances) ( Amendment) Rulcs, 2006.
(2) Save as otherwise provided in these rules , they shall come into force on the date of their publication inthe Official Gazette .
2. In theMembers of Parliament ( Travelling and Daily Allowances) Rules , 1957,-
(a) inrule4A, for the words and figure "rupees 8 per kilometre " , the words " thirteen rupees per kilometre" shall be deemed to have been substituted with effect from the 15th September, 2006.
(b) in rule 5, in the Note , for the letters and figures "Rs . 500 ", the words " one thousand rupees" shall be deemed to havebeen substituted with effect from the 14th September, 2006.
(c) in rule 10, in proviso to sub - rule (2) , for the words "thirty - two " , the words " thirty - four " shall be deemed to have been substituted with effect from the 15th September , 2006 .

Note: The principal rules were published vide S.R.O. 1148 dated the 4th April, 1957, published in Part II , Section 3 of the Gazette of India, Extraordinary dated the 6th April , 1957 and subsequently amended vide notification numbers G.S.R. 338 (E) dated the 2nd July, 1973 , G.S.R. 769 (E) dated the 1stOctober, 1983 , G.S.R. 572 (E) dated the 25th August 1993, G.S.R. 383 (E) dated the 30th August, 1996,G.S.R. 539 (E) dated the 31st August, 1998 , and G.S.R. 702 (E) dated the 26th October , 2004.
EXPLANATORY MEMORANDUM
The Joint Committee on Salaries and Allowances of Members of Parliament constituted under section 9 (1 ) of the Salary, Allowances and Pension of Members of Parliament Act, 1954 have recommended from time to time certain salary, daily allowance and road mileage to the Members of Parliament for which the relevant provisions in the Salary, Allowances and Pension of Members of Parliament Act, 1954 have been made applicable with effect from the 14th September , 2006 and 15th September, 2006. Therefore , some consequential amendments have to be made in the Members of Parliament( Travelling andDaily Allowances) Rules , 1957 in conformity with the provisions of the Salary, Allowances and Pension of Members of Parliament Act, 1954. As the purpose of the amendments of these rules is to give increased salary, daily allowance and road mileage, no Member of Parliament is likely to be adversely affected by giving the rules retrospective effect.

New Delhi , the 12th December, 2006
G.S.R. 746(E) . In exercise of the powers conferred by clause (f) of sub- section (3 ) of Section 9 of the Salary, Allowances and Pension of Members of Parliament Act, 1954 (30 of 1954) , the Joint Committee constituted under sub- section ( 1 ) of the said section , after consultation with the Central Government, hereby makes the following rules furtherto amend the Members of Parliament ( Constituency Allowance ) Rules, 1986, the same having been approved and confirmed by the Chairman of the Council of States and the Speaker of the House of the People , as required under sub - section (4) of the said section, namely :
1. (1 ) These rules may be called the Members of Parliament ( Constituency Allowance) (Amendment) Rules , 2006.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In rule 2 of the Members of Parliament ( Constituency Allowance) Rules , 1986 , for the words " rupees ten thousand per mensem", the words "rupees twenty thousand per mensem" shall be substituted .

सा.का.नि. 747( अ ). संसद् सदस्य वेतन , भत्ता और पेंशन अधिनियम , 1954 ( 1954 का 30 ) की धारा 9 की उपधारा ( 1 ) के अधीन गठित संयुक्त समिति , केन्द्रीय सरकार से परामर्श करने के पश्चात् उक्त धारा की उपधारा ( 3 ) के खंड ( च ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए संसद् सदस्य ( कार्यालय - व्यय भत्ता ) नियम, 1988 का और संशोधन करने के लिए उक्त धारा की उपधारा ( 4 ) के अधीन यथा अपेक्षित राज्य सभा के सभापति और लोक सभा के अध्यक्ष द्वारा अनुमोदित और पुष्ट किए गए, निम्नलिखित नियम बनाती है , अर्थात्: - 1. ( 1 ) इन नियमों का संक्षिप्त नाम संसद् सदस्य ( कार्यालय- व्यय भत्ता ) ( संशोधन ) नियम , 2006 है ।
(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. संसद् सदस्य ( कार्यालय - व्यय भत्ता ) नियम , 1988 के नियम 3 के स्थान पर, निम्नलिखित नियम रखा जाएगा , अर्थात्: -
" 3. कार्यालय - व्यय भत्ते की रकम कोई संसद् सदस्य अधिनियम की धारा 8 के अधीन बीस हजार रुपए प्रतिमास की दर कार्यालय - व्यय भत्ता पाने का हकदार होगा , जिसमें से- से
(क ) चार हजार रुपए लेखन सामग्री मदों, आदि पर व्यय की पूर्ति के लिए होगी; और
(ख ) दो हजार रुपए, पत्रों की फ्रेंकिंग पर व्यय की पूर्ति के लिए होगा और लोक सभी तथा राज्य सभा सचिवालय , दस हजार रुपए तक का संदाय ऐसे कंप्यूटर साक्षर व्यक्ति को कर सकेंगे जिसे संसद् सदस्य ने दिल्ली में सचिवीय सहायता प्राप्त करने के लिए लगाया हो और चार हजार रुपए तक का संदाय ऐसे व्यक्ति को कर सकेंगे जिसे उसने, अपने निर्वाचन क्षेत्र में, कार्य की देखभाल करने के लिए लगाया हो । "

1. (1) These rules may be called the Members of Parliament (Office Expense Allowance ) (Amendment) Rules , 2006 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. IntheMembers of Parliament ( Office Expense Allowance ) Rules, 1988, for rule 3 , the following rule shallbe substituted , namely
"3. Amount of Office Expense Allowance . Amember shall be entitled to receive office expense allowance under Section 8 of the Act at the rate of rupees twenty thousand per mensem, out of which- (a) rupees four thousand should be for meeting expenses on stationery item , etc .; and (b) rupees two thousand should be for meeting expenses on franking of letters , and Lok Sabha/Rajya Sabha Secretariat may pay upto ten thousand rupees to a computer literate person as may be engaged by a member for obtaining secretarial assistance in Delhi and upto four thousand rupees to a person as may be engaged by him in his constituency to look after the work ."
