सं. प्रका/पी/आईआर/आरएस/1111.- बैंककारी कम्पनी ( उपक्रमों का अर्जन एवं अंतरण ) अधिनियम , 1970 ( 1970 का 5 ). की धारा 12 की उप - धारा ( 2 ) के साथ पठित धारा 19 द्वारा दिये गये अधिकारों का प्रयोग करते हुए बैंक ऑफ इंडिया के निदेशक मंडल द्वारा भारतीय रिज़र्व बैंक के साथ परामर्श से और केन्द्रीय सरकार की पूर्व स्वीकृति से बैंक ऑफ इंडिया ( अधिकारी ) सेवा विनियम, 1979 के विनियम 5 को और अधिक संशोधित करने हेतु एतद्द्वारा निम्नलिखित विनियम बनाते हैं , अर्थात्:-

1. ( 1 ) इन विनियमों को बैंक ऑफ इंडिया ( अधिकारी ) सेवा संशोधन विनियम , 2006 कहा जाएगा ।

(2) ये विनियम सरकारी राजपत्र में उसके प्रकाशन की तारीख से प्रभावी होंगे ।

2. बैंक ऑफ इंडिया ( अधिकारी ) सेवा विनियम, 1979 में, विनियम 5 में, -

(क) उप- विनियम ( 1 ) में , खण्ड (ग ) के अंतर्गत , परंतुक के बाद और नोट के पूर्व, निम्नलिखित परंतुक शामिल किए जाएंगे ,. अर्थातः--

" बशर्ते और कि ऐसी वेतनवृद्धि/वेतनवृद्धियाँ अगले उच्च वेतनमान में/गत्यवरोध वेतनवृद्धि/वेतनवृद्धियाँ उस अधिकारी को अनुमत नहीं होगी जिसने प्रस्तावित की गई पदोन्नति लेने से इंकार किया हो";

(ख ) स्पष्टीकरण के खण्ड ( घ) में उप- विनियम (2 ) में, नोट ( ii ) के बाद , निम्नलिखित नोट शामिल की जाएगी, अर्थात:-

" ( iii ) कोई अधिकारी उपर्युक्तानुसार व्यावसायिक शैक्षणिक अर्हता वेतन हेतु पात्र नहीं होगा , यदि उसने प्रस्तावित की गई पदोन्नति स्वीकार करने से इन्कार किया हो " ।

Mumbai , the 1st December, 2006

No. HO /P/IR/RS /1111.- In exercise of the powers conferred by Section 19 read with Sub- section ( 2) of Section 12 oftheBanking Companies (Acquisition and Transfer of Undertakings ) Act, 1970 (5 of 1970) , the Board of Directors ofBank ofIndia in consultation with the Reserve Bank of India and with the previous sanction of the Central Government hereby makes the following regulations further to amend Regulations 5 of Bank of India ( Officers' ) Service Regulations , 1979 , namely:

1. (1) These regulations may be called Bank of India (Officers ' ) Service (Amendment) Regulations, 2006.

(2) These regulations shall come into force on the date of its publication in the Official Gazette.

2. In the Bank of India (Officers ' ) Service Regulations , 1979 , in Regulation 5,---

(a) in sub- regulation ( 1 ) , under clause (c ) , after the proviso and before the Note, the following proviso shall: be inserted, namely :-

"Provided further that such increment/ s in the next higher scale /stagnation increment/s shall not be allowed to an officer who refuses promotion when offered" ;

(6) in sub- regulation (2) in clause (d ) of the Explanation , after Note (ii ) , the following Note shall be inserted , namely:-

"( iii) An Officer shall not be eligible for Professional Qualification Pay, as above, if he refuses to accept promotionwhen offered" .
