सा.का.नि. 759 ( अ ) . केंद्रीय सरकार, रेल अधिनियम , 1989 ( 1989 का 24 ) की धारा 87 की उप- धारा ( 2) के खंड ( घ) के साथ पठित उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और रेल (वैगनों की अधिक लदाई के लिए दंडात्मक प्रभार) नियम , 2006 को उन बातों के सिवाय अधिक्रान्त करते हुए , जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने से लोप किया गया है , उक्त अधिनियम की धारा 73 के अधीन वैगनों की अधिक लदाई के लिए दंडात्मक प्रभारों हेतु निम्नलिखित नियम बनाती है , अर्थात्ः-
1. संक्षिप्त नाम और प्रारंभ-
( 1 ) इन नियमों का संक्षिप्त नाम रेल ( वैगनों की अधिक लदाई के लिए दंडात्मक प्रभार) नियम, 2006 है.
(2) ये 01.01.2007 से प्रभावी होंगे.
(2) परिभाषाएं: इन नियमों में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो: -
(क) " अधिनियम " से रेल अधिनियम , 1989 ( 1989 का 24) अभिप्रेत है.
(ख) "धारा " से अधिनियम की धारा अभिप्रेत है .
(ग) " वर्ग रेट " से किसी वस्तु को समनुदेशित वर्ग के अनुसार उस वस्तु को लागू भाड़ा दर अभिप्रेत है .
(घ) " अनुज्ञेय वहन क्षमता " से धारा 72 की उपधारा (2) या उपधारा (3) के अधीन अवधारित सामान्य वहन क्षमता या किसी रेल प्रशासन द्वारा धारा 72 की उपधारा (4) के अधीन अवधारित भिन्न वहन क्षमता , इनमें से जो भी अधिक हो, अभिप्रेत है .
(ङ) "अनुसूची " से इन नियमों की अनुसूची अभिप्रेत है .
(च) "सामान्य भाड़े " से अनुज्ञेय वहन क्षमता तक लदी वस्तुओं के भार के लिए किसी वस्तु के वर्ग रेट पर वसूलनीय मालभाड़ा प्रभार, जमा यथास्थिति 1 टन या 2 टन , अनुसूची में यथा विनिर्दिष्ट, अभिप्रेत है.

(छ) इन नियमों में प्रयुक्त और अपरिभाषित किंतु अधिनियम में परिभाषित शब्दों और अभिव्यक्तियों के वही अर्थ हैं , जो क्रमशः अधिनियम में उनके हैं.
(3) अधिक लदान के लिए दंडात्मक प्रभार जहां रेलवे वैगन में अधिक वस्तु लादी जाती है वहां रेल प्रशासन प्रारंभिक स्टेशन से गंतव्य स्टेशन तक वैगन की दुलाई में गाड़ी द्वारा तय की गई समूची दूरी के लिए, भले ही अधिक लदान के बारे में किसी बिंदु पर पता चला हो , यथास्थिति प्रेषक, प्रेषिती या पृष्ठांकिती, से दंडात्मक प्रभारों की वसूली करेगा जैसा कि अनुसूची की स्थिति ' क ' और ' ख' के भाग । और भाग ।। में उपबंधित है.
परंतु दंडात्मक प्रभार उद्गृहीत नहीं किए जाएंगे यदि प्रारंभिक स्टेशन पर ही अधिक लदान का पता चल जाता है और ग्राहक प्रारंभिक स्टेशन पर ही लदान समायोजन कर लेता है .
अनुसूची
:
स्थिति- क
यदि कुल संदाय लदान किसी रेक की सम्मिलित अनुज्ञेय वहन क्षमता से अधिक नहीं है तो निम्नानुसार दंडात्मक प्रभार उद्गृहीत किए जाएंगे .
भाग-1
8-पहिया वैगनों (बीओएक्स , बीओएसटी तथा बीओवाई वैगनों को छोड़कर) में लदे हुए ' वर्द्धित सी सी'
वस्तुओं के लिए
अधिक लदान की सीमा
अनुज्ञेय वहन क्षमता तथा 2 टन सह्यता लदान से अधिक वस्तुओं के समग्र भार पर वसूल किए जाने वाले दंडात्मक प्रभार
यदि वस्तुओं का भार वैगन की अनुज्ञेय वहन क्षमता से अधिक है
(क) 2 टन तक
कुछ नहीं
उस वस्तु पर लागू मालभाड़ा दर का दुगुना
(ख ) 2 टन से अधिक किंतु 5 टन से अधिक नहीं
(ग) 5 टन से अधिक
उच्चतम श्रेणी पर लागू मालभाड़ा दर का तिगुना
*शंकाओं को दूर करने के लिए यह घोषणा की जाती है कि 2 टन तक अनुज्ञेय वहन क्षमता से अधिक वस्तु के भार पर उस वस्तु को प्रदान की गई श्रेणी पर लागू दर के अनुसार सामान्य भाड़ा तथा अनुज्ञेय वहन क्षमता और 2 टन सह्यता लदान से अधिक वस्तु के समग्र भार के लिए दंडात्मक प्रभार वसूलनीय होगा.
भाग- ।।
बीओएक्स , बीओएसटी और बीओवाई तथा सभी अन्य प्रकार के वैगनों (8- पहिया वैगनों को छोड़कर) में लदे हुए ' वर्द्धित सी सी' वस्तु के लिए;
सभी प्रकार के वैगनों में लदे हुए ' सी सी' वस्तु; तथा
कंटेनर यातायात के लिए
अधिक लदान की सीमा
अनुज्ञेय वहन क्षमता तथा 1 टन* सह्यता लदान से अधिक वस्तुओं के समग्र भार पर वसूल किए जाने वाले दंडात्मक प्रभार
यदि वस्तु का भार वैगन की अनुज्ञेय वहन क्षमता से अधिक है
कुछ नहीं
(क) 1 टन तक
उस वस्तु पर लागू मालभाड़ा दर का दुगुना
(ख) 1. टन से अधिक तथा 4 टन से अधिक नहीं
(ग ) 4 टन से अधिक
उच्चतम श्रेणी पर लागू मालभाड़ा दर का तिगुना 3.

*शंकाओं को दूर करने के लिए यह घोषणा की जाती है कि 1 टन तक अनुज्ञेय वहन क्षमता से अधिक वस्तु के भार पर उस वस्तु को प्रदान की गई श्रेणी पर लागू दर के अनुसार सामान्य भाड़ा तथा अनुज्ञेय वहन क्षमता और 1 टन सह्यता लदान से अधिक वस्तु के समग्र भार के लिए दंडात्मक प्रभार वसूलनीय होगा.
स्थिति- ख
यदि कुल संदाय लदान किसी रेक की सम्मिलित अनुज्ञेय वहन क्षमता से अधिक है तो निम्नानुसार दंडात्मक प्रभार उद्गृहीत किए जाऐंगे .
भाग-।
8-पहिया वैगनों ( बीओएक्स, बीओएसटी तथा बीओवाई वैगनों को छोड़कर) में लदे हुए 'वर्द्धित सी सी' वस्तुके लिए

उच्चतम श्रेणी पर लागू मालभाड़ा दर का 5 गुणा
*शंकाओं को दूर करने के लिए यह घोषणा की जाती है कि 2 टन तक अनुज्ञेय वहन क्षमता से अधिक वस्तु के भार पर उस वस्तु को प्रदान की गई श्रेणी पर लागू दर के अनुसार सामान्य भाड़ा वसूलनीय होगा.
भाग ।।
बीओएक्स, बीओएसटी और बीओवाई तथा सभी अन्य प्रकार के वैगनों (8- पहिया वैगनों को छोड़कर) में

NOTIFICATION
New Delhi , the 19th December, 2006
G.S.R. 759 (E ) . In exercise of the powers conferred by sub - section ( 1 ) read with clause ( d) of sub - section (2) of section 87 of the Railways Act , 1989 , (24 of 1989) and in supersession of the Railways (Punitive charges for overloading of wagon) Rules , 2006 , except as respects things done or omitted to be done before such supersession , the Central Government hereby makes the following rules for punitive charges for overloading of wagons under section 73 of the said Act, namely: -
1. Short title and commencement.- ( 1 ) These rules may be called the Railways ( Punitive charges
for overloading of wagon) Rules , 2006 .
(2) They shall come into force w.e.f 01.01.2007 .
2. Definitions . In these rules , unless the context otherwise requires , -
(a) "Act " means the Railways Act, 1989 (24 of 1989) ;
(b) " section" means the section of the Act;
(c) " class rate " means the freight rate applicable to a commodity as per the class assigned to thatcommodity;
( d) " Permissible carrying capacity " means the normal carrying capacity determined under sub- section (2) or (3 ) of section 72 , or where a railway administration has determined a varied carrying capacity under sub - section (4) of section 72 , such varied carrying capacity, whichever is higher ;
(e) " Schedule " means the Schedule to these rules;
(f) "Normal freight " means the freight charge recoverable on a commodity at the class rate for the weight of the commodity loaded upto permissible carrying capacity plus 1 tonne or 2 tonnes, as the case may be , as specified in the Schedule;
(g) Words and expression used and not defined in these rules but defined in the Act shall have the meaning respectively assigned to them in the Act.
3. Punitive charges for overloading.- Where the commodities are over - loaded in Railway wagon , the railway administration shall recover punitive charges as provided in part I and II of the situation ' A' and ' B ' of the Schedule, from the consignor, the consignee or the endorsee , as the case may be , for the entire distance to be travelled by the train hauling the wagon from the originating station to the destination point , irrespective of the point of detection of overloading:
Provided that no punitive charges will be levied if the customer carries out load adjustment at the originating station itself in case of detection of overloading at originating point .

SCHEDULE
Situation -A
If the aggregated payload in a rake does not exceed the combined permissible carrying capacity of the rake , the punitive charges shall be levied as per following:
Part-I
For Enhanced CC' commodities loaded in 8- wheeled wagons ( except BOX, BOST and BOY wagons )
Extent of overloading
Punitive charges leviable on the entire weight of commodity loaded in excess of permissible carrying capacity and loading tolerance of 2 tonnes *
If the weight of commodity exceeds the permissible carrying capacity of the wagon;
Nil
(a) upto 2 tonnes
(b) by more than 2 tonnes but not more than 5 tonnes
2 times of the freight rate applicable to that commodity.
(d) by more than 5 tonnes
3 times of the freight rate applicable to the highest class .
*For removal of doubts , it is hereby declared that on the weight exceeding the permissible carrying capacity up to 2 tonnes, the normal freight at the rate applicable to the class assigned to the commodity shall be recoverable and punitive charges will be recovered for the entire weight of the commodity in excess of permissible carrying capacity and loading tolerance of 2 tonnes.
Part-II
For ' Enhanced CC ' commodities loaded in BOX, BOST and BOY and all other types of wagons (except 8- wheeled wagons) ;
For ' CC' commodities loaded in all types of wagons ; and
For container traffic
Extent of overloading
Punitive charges leviable on the entire weight of commodity loaded in excess of permissible carrying capacity and loading tolerance of 1 tonne *
If the weight of commodity exceeds the permissible carrying capacity of the wagon;
Nil
(a) upto 1 tonne
(b) by more than 1 tonne but not more than 4 tonnes
2 times of the freight rate applicable to that commodity.
(c) by more than 4 tonnes
3 times of the freight rate applicable to the highest class .
* For removal of doubts, it is hereby declared that on the weight exceeding the permissible carrying capacity up to 1 tonne , the normal freight at the rate applicable to the class assigned to the commodity shall be recoverable and punitive charges will be recovered for the entire weight ofthe commodity in excess of permissible carrying capacity and loading tolerance of 1 tonne.
