सा.का.नि. 768 (अ).-पासपोर्ट अधिनियम , 1967 ( 1967 का 15 ) की धारा 5 के साथ पठित , धारा 24 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार पासपोर्ट नियमावली , 1980 को संशोधित करते हुए निम्नलिखित नियम बनाती है, अर्थात्:-

1. ( 1 ) इन नियमों का नाम पासपोर्ट ( संशोधन ) नियमावली, 2006 होगा ।

(2 ) ये नियम सरकारी राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।

2. पासपोर्ट नियमावली , 1980 की अनुसूची III में : -

(क) भारत के लिए भाग -1 फार्म ई ए ( पी )-1 संशोधित हो गया और उससे सम्बद्ध प्रविष्टियों के मामले में निम्नलिखित को प्रतिस्थापित किया जाएगा , अर्थात्,

चेतावनी

पासपोर्ट को पासपोर्ट अधिनियम, 1967 के अन्तर्गत जारी किया जाता है । जानबूझकर झूठी जानकारी देना अथवा जानकारी छिपाना अपराध है जिसके लिए उक्त अधिनियम की संगत धाराओं के अंतर्गत दण्ड और अन्य कार्रवाई का प्रावधान है । पासपोर्ट एक महत्वपूर्ण दस्तावेज होता है । सभी पासपोर्ट धारकों को इस बात का यथोचित ध्यान रखना आवश्यक है कि पासपोर्ट न तो क्षतिग्रस्त हो और न ही कटे-फटे और न ही खोए । पासपोर्ट को किसी देश में डाक द्वारा नहीं भेजा जाना चाहिए ।

पासपोर्ट खो जाने की सूचना तत्काल निकटतम पुलिस स्टेशन और निकटतम पासपोर्ट कार्यालय / भारतीय मिशन को दी जानी चाहिए । पासपोर्ट धारक, सम्बन्धित पासपोर्ट कार्यालय/ भारतीय मिशन को पासपोर्ट के खो जाने की जानकारी न देने के कारण पासपोर्ट का दुरुपयोग होने के लिए जिम्मेदार होगा । पासपोर्ट एक सरकारी संपत्ति है और पासपोर्ट जारी करने वाले किसी प्राधिकारी द्वारा लिखित में माँगे जाने पर इसे सौंप दिया जाना चाहिए ।

I. नई पासपोर्ट पुस्तिका जारी करना

खण्ड I-सामान्य जानकारी.

1. आवेदन कैसे करें

किसी पासपोर्ट के लिए आवेदन , व्यक्तिगत तौर पर अथवा प्राधिकार पत्रधारी किसी प्रतिनिधि के माध्यम से प्रस्तुत किया जा सकता है (नमूना नीचे दिया गया है) । सभी मूल दस्तावेज दिखाए जाने चाहिए और स्वयं साक्ष्यांकित प्रतियां संलग्न की जानी चाहिएं ।

2. शुल्क और उसके भुगतान का तरीका : आवेदन पत्र के साथ निम्नलिखित सम्पूर्ण शुल्क सम्बन्धित पासपोर्ट अधिकारी के पक्ष में बैंक ड्राफ्ट के द्वारा अथवा नकद भुगतान करना होगा। डिमान्ड ड्राफ्ट के मामले में ड्राफ्ट के पीछे आवेदक का पूरा नाम और आवेदन पत्र संख्या लिखें । संगत खाने में शुल्क के भुगतान के ब्यौरे का उल्लेख किया जाए । यदि शुल्क का भुगतान डिमान्ड ड्राफ्ट द्वारा किया जाता है तो इसे जारी करने वाले बैंक का बैंक कोड, डिमान्ड ड्राफ्ट सं. और डिमान्ड ड्राफ्ट जारी करने की तारीख का उल्लेख किया जाना चाहिए ।

10 वर्ष की वैधता वाला नया पासपोर्ट (36 पृष्ठ) (15 वर्ष से 18 वर्ष की आयु वाले नाबालिगों सहित, जो 10 वर्ष की वैधता वाला पासपोर्ट प्राप्त करना चाहते हैं)

10 वर्ष की वैधता वाला नया पासपोर्ट (60 पृष्ठ)

600/- रू.

नाबालिग (18 वर्ष से कम आयु) का 5 वर्ष की वैधता वाला अथवा नाबालिग के 18 वर्ष की आयु का होने तक, जो भी पहले हो , का नया पासपोर्ट

पासपोर्ट के खो जाने, क्षतिग्रस्त हो जाने अथवा चोरी हो जाने की स्थिति में पासपोर्ट की दूसरी प्रति (36 पृष्ठ)

पासपोर्ट के खो जाने, क्षतिग्रस्त हो जाने अथवा चोरी हो जाने की स्थिति में पासपोर्ट की दूसरी प्रति (60 पृष्ठ)

पासपोर्ट के पुनः जारी किए जाने की स्थिति में उद्‌ग्रहणीय शुल्क वही होगा जो आवेदक की आयु पर निर्भर करता है ।

3. पासपोटों की सुपुर्दगी :

पासपोर्ट, आवेदक को ही सुपुर्द किया जायेगा अथवा आवेदन पत्र में दिए गए पते पर स्पीड पोस्ट द्वारा भेजा जायेगा ।

खण्ड II - आवेदन पत्र भरने के लिए अनुदेश एवं दिशा- निर्देश

पासपोर्ट आवेदन पत्र मशीन द्वारा पढ़ा जाएगा । इसे कम्प्यूटर पर स्कैन किया जायेगा । अतः निम्नलिखित अनुदेशों का सख्ती से अनुपालन किया जाए ।

बॉक्स की सीमाओं को छुए बिना बॉक्स के भीतर स्पष्ट रूप से लिखें ।

साफ अक्षरों का ही प्रयोग करें । आवेदन पत्र में दिए गए विवरण को पासपोर्ट में मुद्रित किया जायेगा । अतः कृपया आवेदन पत्र को भरने में सावधानी बरतें और किसी प्रकार की गलती से बचें

केवल काले/नीले बाल पैन का प्रयोग सूचना को दिए गए बॉक्सों की संख्या 11

में फिट करने के लिए समायोजित करें आवेदन पत्र को पेंसिल अथवा स्याही वाले पैन से न भरें

बाक्स के बाहर कुछ नहीं लिखें । काट छाँट से बचें

अधूरा आवेदन स्वीकार नहीं किया जायेगा ।

बॉक्सों को भरते समय प्रत्येक शब्द के पूरा हो जाने के पश्चात् कृपया एक बाक्स को खाली छोड़ दें ।

महत्वपूर्ण टिप्पणी : पासपोर्ट आवेदन पत्र जमा करते समय सभी मूल दस्तावेज दिखाने होंगे ।

मूल पासपोर्ट आवेदन पत्र के साथ सभी अपेक्षित दस्तावेजों की स्व- साक्ष्यांकित प्रतियों को संलग्न किया जाना आवश्यक है । अशिक्षित आवेदक, अंगूठे के निशान/हस्ताक्षर के लिए दिए गए बाक्स में ही अंगूठे का निशान लगाएं । आवेदक के गत एक वर्ष के दौरान एक से अधिक पते पर रहने के मामले में रहने के प्रत्येक स्थान के लिए पासपोर्ट फार्म की दो अतिरिक्त छाया प्रतियां संलग्न की जानी चाहिए ।

खण्ड III - आवेदन फार्म को भरने के लिए कालम - वार दिशा-निर्देश

आवेदन पत्र के आरम्भ में फोटो लगाने, हस्ताक्षर करने और अंगूठे का निशान लगाने तथा शुल्क के भुगतान का ब्यौरा देने के लिए बाक्स दिए गए हैं ।

फोटो : पूरे चेहरे को दर्शाने वाला हाल ही का पासपोर्ट आकार का रंगीन फोटो (तीन) आवश्यक है । एक फोटो, फार्म पर चिपकाना होगा और दो फोटो पासपोर्ट फार्म , जिसे दो प्रतियां में भरना है, पर चिपकाने होंगे । श्याम एवं श्वेत फोटो, रंगीन अथवा काले चश्मे वाले फोटो अथवा यूनिफार्म में , पोलराइड प्रिंट अथवा कम्प्यूटर प्रिंटों को स्वीकार नहीं किया जायेगा । फोटो लगाने के लिए बाक्स में कृपया 3.5 से.मी. x 3.5 से.मी. आकार की आपकी हाल की और एक समान, रंगीन फोटो चिपकाएं । फोटो, बाक्स में पूरी तरह से फिट होना चाहिए और किसी भी स्थिति में फार्म में दिए गए बॉक्स से छोटा न हो । बड़ी पुस्तिका के लिए दो अतिरिक्त फोटो आवश्यक हैं ।

हस्ताक्षर/अंगूठे का निशान बॉक्स की सीमाओं को छुए बिना पूरी तरह से बाक्स के भीतर होने चाहिए । अंगूठे का निशान पुरुषों के मामलों में बाएं हाथ का और स्त्रियों के मामले में दाहिने हाथ का होना चाहिए ।

कालम 1- नाम (दस्तावेजी प्रमाण के साथ)

आवेदन पत्र में 75 अक्षर का नाम दिया और भरा जा सकता है । पूरा नाम, जैसा पासपोर्ट में लिखा जाए , यहाँ लिखें । उदाहरण के लिए

कालम- 2- यदि आपने अपना नाम परिवर्तित कर लिया हो तो कृपया अपना पूर्व नाम पूरा लिखें । यह उस व्यक्ति के लिए लागू होगा जिसने मामूली रूप से नाम परिवर्तित कर लिया हो अथवा उस महिला के लिए लागू होगा जिसने अपना नाम/ उपनाम विवाह के उपरान्त परिवर्तित कर लिया हो । यदि नाम में किसी प्रकार का परिवर्तन न हो तो कृपया लिखें : लागू नहीं ।

कालम -3- पुरुष/ स्त्री के विकल्प के मामले में कृपया दिए गए बाक्स में यथा लागू पुरुष अथवा स्त्री लिखें । अन्य के लिए कृपया इस बॉक्स में ' एक्स ' लिखें ।

कालम - 4- जन्म तिथि : जन्म की तारीख नगरपालिका / सरकारी प्राधिकारियों द्वारा जारी जन्म प्रमाणपत्र में दर्शाये गये अनुसार दिन/ माह/ वर्ष और शब्दों में भरें । जन्म की तारीख का प्रमाण संलग्न किया जाना है । कृपया संलग्न किए जाने वाले सम्बन्धित दस्तावेजों के लिए खण्ड IV देखें ।

कालम 5 जन्म का स्थान और देश : यदि भारत में जन्म हुआ हो तो कृपया गाँव/कस्बा, जिला, राज्य जैसे स्थान के नाम का उल्लेख करें और यदि भारत से बाहर जन्म हुआ हो तो स्थान तथा देश के नाम का उल्लेख करें । यदि भारत विभाजन के पूर्व ऐसे स्थान पर जन्म हुआ है जो अब पाकिस्तान अथवा बांग्लादेश में आता है, तो स्थान का नाम भरने के बाद देश का नाम अविभाजित भारत ' लिखें ।

कालम 6,7 और 8 : संबंधित कॉलमों में पिता, माता तथा पति/ पत्नी के नाम की प्रविष्टि करनी है । इन कालमों में उपनाम, यदि कोई हो, दिए गए नामों के बाद का उल्लेख करें । यदि आवेदक अविवाहित है तो कॉलम 8 में पति/ पत्नी के नाम के बारे में मांगी गई सूचना के लिए "लागू नहीं " लिखें ।

कॉलम 9 तथा 10 : कृपया दिए गए पते पर निवास करने की तिथि, टेलीफोन नंबर तथा क्षेत्र के कोड नं . के साथ - साथ संगत ब्योरों का उल्लेख करें जो पासपोर्ट कार्यालय द्वारा अतिरिक्त सूचना अथवा दस्तावेज की आवश्यकता पड़ने पर संपर्क किए जाने के प्रयोजनार्थ अपेक्षित है । इस प्रयोजनार्थ आवेदक को एस.एम.एस संदेश भजने के लिए उसका मोबाइल फोन नंबर उपयोगी होगा। यदि कॉलम 9 में दिए गए आवास पर रहने की अवधि, आवेदन करने की तिथि से एक वर्ष से कम है तो कृपया अन्य पतों को प्रस्तुत करें और उन पर रहने की अवधि भी बताएं । अपने माता- पिता से दूर रहने वाले छात्रों के पास अध्ययन करने के स्थान से आवेदन करने का विकल्प होगा । ऐसे मामलों में शैक्षणिक संस्था के प्रिंसिपल / निदेशक/रजिस्ट्रार/ डीन से पते के प्रमाण का वास्तविक प्रमाण पत्र होना चाहिए ।

कॉलम 11 कृपया पूर्व धारित पासपोर्ट (पासपोर्टों) का ब्यौरा प्रस्तुत करें । पिछला पासपोर्ट संख्या अथवा फाइल संख्या के साथ- साथ संगत बाक्सों में जारी करने की तिथि और जारी करने के स्थान 13

का यहां उल्लेख करें । यदि पासपोर्ट के लिए पहले आवेदन किया गया हो किंतु पासपोर्ट प्राप्त नहीं हुआ हो / जारी न हुआ हो तो पासपोर्ट के लिए जहाँ आवेदन किया गया था उसकी फाइल संख्या, तारीख तथा स्थान जैसे ब्योरों को प्रस्तुत किया जाना चाहिए । पासपोर्ट अधिनियम, 1967 की धारा 12 के अनुसार तथ्यों के छिपाने पर दांडिक प्रावधान लगाए जा सकते हैं ।

कालम 11 ( क) : यदि कभी सरकारी खर्च पर आपात प्रमाण पत्र के आधार पर भारत की यात्रा की गई हो अथवा कभी भारत लौटाया गया हो अथवा प्रत्यावर्तित किया गया हो तो इस कॉलम में मूल जब्ती ज्ञापन के साथ - साथ आपात प्रमाण पत्र की संख्या, तारीख और जारी किए जाने का स्थान तथा उस स्थान और देश के नाम का उल्लेख करें जहां से लौटाया गया था अथवा प्रत्यावर्तित किया गया था । यदि आपात प्रमाण पत्र के ब्यौरे तत्काल रूप से उपलब्ध न हों तो कम से कम उस स्थान तथा देश का नाम जहाँ से लौटाया गया अथवा प्रत्यार्वतन किया गया, का ब्यौरा अनिवार्य रूप से प्रस्तुत करें । ऐसे सभी आवेदक नोटरी पब्लिक से साक्ष्यांकित शपथ पत्र में अपने प्रत्यार्वतन/ पासपोर्ट की गुमशुदगी की परिस्थितियों के ब्यौरे प्रस्तुत करें ।

कालम 12 : संबंधित मदों के लिए उपलब्ध कराए गए स्थान में शैक्षणिक योग्यताएं, स्पष्ट पहचान चिह्न एवं ऊंचाई (से.मी. में) जैसे ब्योरों को प्रस्तुत करें ।

कालम 13 : दिए गए बाक्स की जगह में ' हाँ' अथवा ' नहीं' के रूप में संगत प्रविष्टि चिह्नित की जानी चाहिए । यदि वह केन्द्रीय/ राज्य सरकार, सार्वजनिक क्षेत्र के उपक्रमों, सांविधिक निकायों में कार्यरत है तो अनुबंध ' ख' के अनुसार संबंधित कार्यालय से एक पहचान प्रमाण पत्र संलग्न किया जाना चाहिए ।

कालम 14 : नागरिकता के संबंध में यदि यह जन्म, वंश , पंजीकरण अथवा नागरिकीकरण से प्राप्त है तो दिए गए बाक्स की जगह में यथा स्थिति जन्म/ वंश/ पंजीकरण /नागरिकीकरण रिकार्ड किया जाना चाहिए । यदि भारतीय नागरिकता के पूर्व कोई अन्य नागरिकता रही हो तो कृपया दी गई खाली जगह में पिछली नागरिकता लिखें ।

कालम 15 : कृपया यथा लागू 'हाँ' अथवा ' नहीं' लिखें । यहाँ यह उल्लेखनीय है कि देश छोड़ने से पूर्वई सी. आर के रूप में श्रेणीबद्ध भारतीय नागरिकों को प्राक्टर जनरल आफ एमिग्रेंट्स से अनुमति प्राप्त करना आवश्यक है । ई.सी.आर श्रेणी के आवेदकों को अपने पासपोर्ट पर ई.सी.आर की मोहर लगवानी होगी । यदि पासपोर्ट पुस्तिका में ई.सी.आर मोहर नहीं लगी है तो आवेदक को ई.सी.एन.आर. स्थिति का समझा जाएगा । पासपोर्ट पर ई.सी.एन.आर. की कोई मोहर नहीं लगाई जाएगी । यदि कोई आवेदक निम्नलिखित श्रेणियों में से किसी एक श्रेणी में आता/ आती है और यदि वह इसके लिए दस्तावेजी प्रमाण प्रस्तुत करता/ करती है तो वह ई सी. एन. आर. स्तर का पात्र होगा/होगी ।

वे व्यक्ति जिनके पासपोर्ट पर ई.सी.आर. मुहर नहीं लगेगी :

राजनयिक/ सरकारी पासपोर्टों के सभी धारक ।

(ग) अपनी व्यक्तिगत क्षमता में सभी आयकर दाता ( जिनमें कृषि जनित आयकर आदाता भी शामिल है) । पिछले एक वर्ष के आयकर निर्धारण का प्रमाण तथा वास्तविक आयकर भुगतान का प्रमाण अथवा पैन कार्ड की प्रति पर बल दिया जाना है न कि नाममात्र के अग्रिम कर का भुगतान । तथापि अधिकांश मामलों में , जैसा कि आयकर विभाग द्वारा अलग से कर - निर्धारण आदेश जारी नहीं किया जाता है, आयकर विवरणियां जो आय कर प्राधिकारियों द्वारा मोहर लगी हों , स्वीकार की जा सकती हैं ।

(घ) सभी व्यावसायिक डिग्री धारक जैसे डाक्टर जिनके पास एम.बी.बी.एस. की उपाधि अथवा आयुर्वेद में समकक्ष उपाधि अथवा होम्योपैथी में समकक्ष उपाधि, प्रत्यायित पत्रकार , इंजीनियर, चार्टर्ड एकाउंटेंट्स , कॉस्ट एकाउंटेट्स, लेक्चरार , अध्यापक, वैज्ञानिक, एडवोकेट आदि ।

(ड.) (ख) से (घ) में सूचीबद्ध व्यक्तियों की श्रेणी में पति/ पत्नी तथा आश्रित बच्चे ।

(च) मैट्रिक अथवा उससे अधिक शैक्षिक योग्यता रखने वाले सभी व्यक्ति।

(छ) ऐसे नाविक जो सी.डी.सी अथवा नाविक कैडेट्स , डेक कैडेट्स प्रमाण पत्र धारी हैं ।

(i ) जिन्होंने टी . एस . चाणक्य, मुम्बई में समुद्री विज्ञान पाठ्यक्रम की तीन वर्षीय बी.एस.सी. की अन्तिम परीक्षा उत्तीर्ण है । और

(ii) जिन्होंने शिपिंग मास्टर मुम्बई/ कोलकाता/ चेन्नई द्वारा जारी पहचान प्रमाण पत्र प्रस्तुत करने के पश्चात सरकार द्वारा अनुमोदित किसी एक प्रशिक्षण संस्थान जैसे टी.एस. चाणक्य, टी.एस. रहमान , टी.एस. जवाहर, एम.टी.आई ( एस.सी.आई) तथा एन आई पी एम , चेन्नई से तीन महीने का पूर्व समुद्री प्रशिक्षण लिया हो ।

(ज) यूनाइटेड किंगडम , यू.एस.ए. तथा आस्ट्रेलिया जैसे स्थायी प्रवासी वीजा धारक व्यक्ति ।

(झ) राष्ट्रीय व्यावसायिक प्रशिक्षण परिषद अथवा राज्य व्यावसायिक प्रशिक्षण परिषद द्वारा मान्यता प्राप्त किसी संस्थान से दो वर्षीय डिप्लोमा धारक व्यक्ति अथवा केन्द्रीय/राज्य सरकार द्वारा मान्यता प्राप्त संस्थानों जैसे पोलीटेक्नीक्स से तीन वर्षीय डिप्लोमा/समकक्ष उपाधि धारी व्यक्ति ।

भारत का राजपत्र असाधारण

[ भाग II - खण्ड 3 ( i) ]

(স) भारतीय नर्सिंग परिषद अधिनियम , 1947 के अन्तर्गत मान्यता प्राप्त योग्यता धारी नर्स ।

(ट) 50 वर्ष से अधिक आयु के सभी व्यक्ति ।

(ठ) तीन वर्ष से अधिक समय से विदेश में रह रहे सभी व्यक्ति ( तीन वर्ष की अवधि चाहे लगातार रही हो अथवा खंडित रही हो ) तथा उनके पति/ पत्नी ।

(ड) 18 वर्ष तक की आयु के सभी बच्चे ( 18 वर्ष की आयु होने पर (पासपोर्ट) पुनः जारी करते समय यदि लागू हुआ तो ई सी आर मुहर लगाई जाएगी ) ।

(II) बंगलादेश, पाकिस्तान तथा यूरोप में सभी देशों ( सी.आई.एस. राज्यों को छोड़कर ) उत्तरी अमेरिका , आस्ट्रेलिया , जापान , न्यूजीलैंड , दक्षिण कोरिया , दक्षिण अफ्रीका तथा सिंगापुर की यात्रा करने के लिए कोई उत्प्रवासन अनुमति लेने की आवश्यकता नहीं है ।

इस कालम के अन्तर्गत दी गई खाली जगह में पात्रता श्रेणी का उल्लेख किया जाना चाहिए और आवेदन पत्र के साथ समर्थनकारी दस्तावेज संलग्न किया जाना चाहिए । यह उल्लेखनीय है कि ई.सी.आर. पासपोर्ट धारकों को उपर्युक्त से भिन्न देशों में किसी गैर- रोजगार प्रयोजनों के लिए यात्रा शुरू करने से पूर्व प्राक्टर आफ एमिग्रेन्ट्स कार्यालय से अथवा निर्दिष्ट पासपोर्ट कार्यालयों से ईसी आर पृष्ठांकन को हर बार निलंबित कराना होगा । रोजगार प्रयोजनों के लिए ऐसे पासपोर्ट धारकों के लिए यह अपेक्षित है कि वे प्राक्टर आफ एमिग्रेंट्स के कार्यालयों से उत्प्रवासन की अनुमति प्राप्त करें , अन्यथा उन्हें निर्गम पत्तन पर ही यात्रा करने से रोक दिया जाएगा । अतः आवेदकों को सलाह दी जाती है कि यदि वे पात्र हैं तो ई.सी.एन. आर. के लिए आवेदन करें ताकि उनकी बाधामुक्त विदेश यात्रा सुनिश्चित की जा सके । यह भी ध्यान दिया जाए कि पासपोर्ट पुस्तिका केवल ई.सी.आर श्रेणी की मुहर लगी होनी चाहिए और यदि पासपोर्ट पुस्तिका पर ई.सी.आर. की मुहर नहीं होगी तो उन्हें ई.सी. एन आर स्तर का आवेदक समझा जाएगा ।

कालम 16 : इस कालम में, नाबालिग बच्चे, जिनकी आयु 18 वर्ष से कम है, के लिए पहली बार आवेदन करते समय माता- पिता दोनों अथवा माता- पिता में से किसी एक द्वारा धारित वैध पासपोर्ट का विवरण संबंधित कालम में भरा जाना चाहिए । प्रत्येक मामले में, अनुबंध ' ज ' में दी गई घोषणा को सादे कागज पर भरा जाना आवश्यक है । ऐसे मामलों में उनके नाबालिग बच्चे का पासपोर्ट पुलिस सत्यापन के बिना ही जारी कर दिया जाएगा । इसके अलावा यदि माता- पिता के पास वैध पासपोर्ट नहीं है तो ऐसे नाबालिगों के आवेदन अनुबंध ' झ' में उल्लिखित शपथ- पत्र के साथ माता- पिता के तीन ऐसे दस्तावेजों के आधार पर किए जा सकते हैं जिनके ब्योरे पासपोर्ट सूचना पुस्तिका के खंड- IV के पैरा ग ( ख) में दिए गए हैं । ऐसे सभी मामलों में उनके नाबालिग बच्चे का पासपोर्ट पुलिस सत्यापन होने के बाद जारी किया जाएगा। अनुबंध 'ज' के अनुसार सादे कागज पर एक धोषणा प्रत्येक मामले में भरनी होगी । यदि 15 से 18 वर्ष की आयु के वे नाबालिग बच्चे जो 10 वर्ष की पूर्ण वैधता वाला . पासपोर्ट प्राप्त करना चाहते हैं, तो माता - पिता द्वारा अनुबंध ' झ' में दिए गए मानक शपथ- पत्र और पासपोर्ट सूचना पुस्तिका के खंड- IV के पैरा ग (ख ) में उल्लिखित 14 दस्तावेजों में से कोई तीन जमा करने तथा किसी प्रौढ़ के लिए यथा लागू 36 पृष्ठ के पासपोर्ट के लिए सामान्य पासपोर्ट शुल्क अर्थात् 1000/- रू के शुल्क का भुगतान करने पर उन्हें वैसा पासपोर्ट जारी कर दिया जाएगा । अन्यथा पासपोर्ट की वैधता पांच वर्षों के लिए अथवा 18 वर्ष की आयु प्राप्त होने तक, जो भी पहले हो , सीमित होगी । एकल माता- पिता और विवाह होने से पहले उत्पन्न 16

संतान के मामले में अथवा ऐसे माता-पिता के मामले में जो न्यायिक रूप से अलग हो गए हों, किसी मजिस्ट्रेट के समक्ष लिया गया शपथ पत्र जिसमें दस्तावेजी साक्ष्य के साथ मामले के तथ्यों का उल्लेख होगा, अनुबंध ग के अनुसार प्रस्तुत किया जाएगा । सामान्य स्थिति में किसी नाबालिग को पासपोर्ट जारी किए जाने के लिए ( अनुबंध "जै) माता- पिता दोनों के हस्ताक्षर/ सहमति आवश्यक है। तथापि, यदि आवेदक माता/ पिता के मामले में, माता या पिता में से किसी एक की सहमति चाहे जिस कारण से प्राप्त करने की स्थिति में नहीं हो तो नाबालिग के पासपोर्ट के लिए आवेदन करने वाले माता/ पिता आवेदन पत्र पर हस्ताक्षर करेंगे और अनुबंध ' छ ' के अनुसार शपथ पत्र प्रस्तुत करेंगे, जिसमें आवेदन- पत्र के साथ मामले के तथ्यों और परिस्थितियों का उल्लेख होगा । शपथ पत्र में यह भी उल्लेख किया जाना चाहिए कि किसी प्रकार के मुकदमे की स्थिति में वह जिम्मेदार होगा/होगी, न कि पासपोर्ट कार्यालय । ऐसे मामलों में, जहां माता - पिता में से कोई एक आवेदन करता हो , बच्चे की शारीरिक उपस्थिति के लिए अनुरोध किया जा सकता है, ताकि यह सुनिश्चित हो सके कि आवेदक माता/ पिता वास्तविक अभिरक्षक है ।

कॉलम 17 : आवेदक सही सूचना दें । किसी तथ्य को छिपाने से प्रति अपराध 5000/ - रू जुर्माना हो सकता है और समय- समय पर यथासंशोधित पासपोर्ट अधिनियम 1967 के प्रावधानों के अंतर्गत यथा लागू अन्य दाण्डिक प्रावधान लागू होंगे ।

कॉलम 18 : इस कालम में मृत्यु अथवा दुर्घटना की स्थिति में सूचित किये जाने वाले व्यक्ति के नाम और पते और मोबाइल या टेलीफोन नंबर/ई मेल प्रस्तुत करना होगा ।

कॉलम 19 : यह कॉलम आवेदक द्वारा की गयी स्वतः घोषणा के बारे में है जो भारत की संप्रभुता, एकता और अखण्डता के प्रति निष्ठा के बारे में है और किसी अन्य देश से नागरिकता अथवा यात्रा दस्तावेज आदि स्वैच्छिक रूप से प्राप्त करने के बारे में नहीं है । इसके अलावा इस कॉलम में आवेदन पत्र में सही सूचना प्रस्तुत किये जाने के बारे में घोषणा है और यह जानकारी है कि पासपोर्ट प्राप्त करने में किसी गलत सूचना अथवा किसी महत्वपूर्ण सूचना को छिपाना पासपोर्ट अधिनियम 1967 के अंतर्गत एक अपराध है । आवेदक यह भी घोषणा करता है कि उसके पास कोई अन्य पासपोर्ट या यात्रा दस्तावेज नहीं है । दिये गये स्थान में हस्ताक्षर या अंगूठे का निशान ( पुरुष के लिए बांए हाथ के अंगूठे का निशान और स्त्री के मामले में दाहिने हाथ के अंगूठे का निशान) आवेदन की तारीख और स्थान सहित प्रस्तुत किया जाना चाहिए ।

कॉलम 20 : उन सभी दस्तावेजों की फोटो प्रतियों, जो आवेदन पत्र के साथ अनुलग्नक के रूप में संलग्न किये गये हैं, की सूची दिये गये खाली स्थान में दी जानी चाहिए और प्रत्येक दस्तावेज आवेदक द्वारा स्व- साक्ष्यांकित होना चाहिए ।

खण्ड IV-आवेदन पत्र के साथ संलग्न किए जाने वाले दस्तावेज

यदि आवेदक, आवेदन पत्र स्वयं प्रस्तुत करता/करती है, तो सभी दस्तावेजों की साक्ष्यंकित प्रतियाँ आवेदन पत्र के साथ संलग्न करना आवश्यक है । तथापि मूल दस्तावेज सत्यापन के लिए प्रस्तुत किया जाना चाहिए और उसे लौटा दिया जाना चाहिए । यदि आवेदन पत्र आवेदक द्वारा स्वयं प्रस्तुत न किया गया हो तो वह अपने परिवार के किसी सदस्य को प्राधिकार पत्र देकर ऐसा करने के लिए

प्राधिकृत कर सकता/सकती है । यदि आवेदन पत्र डाक द्वारा भेजा जाता है तो मूल दस्तावेजों की प्रतियों को राजपत्रित अधिकारी या नोटरी पब्लिक से साक्ष्यांकित कराना होगा ।

(क) पासपोर्ट

(1) नये पासपोर्ट के लिए आवेदन करते समय निम्नलिखित दस्तावेजों की दो-दो प्रतियां संलग्न करें :

(क) पते का प्रमाण (निम्नलिखित में से एक संलग्न करें) :

आवेदक का राशन कार्ड, प्रतिष्ठित कंपनियों के नियोक्ता से लेटर हेड पर प्रमाण-पत्र, पानी/ टेलीफोन/ बिजली का बिल/ चालू बैंक खाते की स्टेटमेंट/आयकर निर्धारण आदेश/चुनाव आयोग का पहचान-पत्र / पति/ पत्नी के पासपोर्ट की प्रति, नाबालिग के मामले में माता- पिता के पासपोर्ट की प्रति । ( टिप्पणी : यदि कोई आवेदक पते के प्रमाण के रूप में केवल राशन कार्ड प्रस्तुत करता है तो उसे उपर्युक्त श्रेणियों में से पते का एक अतिरिक्त प्रमाण इसके साथ संलग्न करना होगा) ।

(ख) जन्म तिथि का प्रमाण (निम्नलिखित में से एक संलग्न करें )

किसी नगर निगम प्राधिकरण, अथवा जन्म और मृत्यु पंजीकरण के जिला कार्यालय द्वारा जारी किया गया जन्म प्रमाणपत्र ; आवेदक द्वारा अध्ययन के अंतिम स्कूल अथवा किसी अन्य मान्यता प्राप्त शैक्षणिक संस्था से जन्म तिथि प्रमाण पत्र अथवा निरक्षर अथवा अर्ध साक्षर आवेदक द्वारा अनुबंध-क में नमूने के अनुसार किसी मजिस्ट्रेट / नोटरी के समक्ष लिया गया शपथपत्र जिसमें जन्म तिथि/ स्थान का उल्लेख किया गया हो ।

टिप्पणीः दिनांक 26.01.89 को अथवा उसके बाद पैदा हुए आवेदकों के मामले में केवल नगर निगम प्राधिकरण अथवा जन्म- मृत्यु पंजीकरण के कार्यालय द्वारा जारी किया गया जन्म प्रमाण पत्र स्वीकार्य है ।

(ग) नागरिकता के कागजात, यदि आवेदक पंजीकरण अथवा नागरिकीकरण के द्वारा भारत का नागरिक है।

(घ) सरकारी/ सार्वजनिक क्षेत्र/ सांविधिक निकाय के कर्मचारियों को अनुबंध- झ के अनुसार मानक शपथ पत्र के साथ मूल रूप में पहचान प्रमाण- पत्र प्रस्तुत करना चाहिए (अनुबंध- ख) ।

(ङ) यदि आवेदक " ई सी एन आर के लिए पात्र है तो समर्थनकारी दस्तावेज की सत्यापित प्रति संलग्न करे । (आवेदन पत्र भरने के लिए अनुदेशों तथा दिशा- निर्देशों का कालम 15 देखें )

(च) यदि आवेदक ने सरकारी लागत पर देश प्रत्यावर्तन किया है तो उस व्यय को दर्शाने के लिए दस्तावेज संलग्न करें कि खर्च की गई राशि भारत सरकार, विदेश मंत्रालय को पूर्ण रूप से वापस की गई है।

(छ) यदि आवेदक को कभी भारत लौटा दिया गया हो तो आपातकालीन प्रमाण पत्र / पासपोर्ट के ब्यौरे दें ।

2. 10 वर्ष के पश्चात पासपोर्ट पुनः जारी किए जाने के लिए आवेदन करना हो तो निम्नलिखित संलग्न करें :

(क) मूल रूप से पुराने पासपोर्ट के साथ इसके पहले चार तथा अंतिम चार पृष्ठों की स्वयं साक्ष्यांकित की गई फोटो प्रति, जिसमें ई सी आर/ ई सी एन आर के पृष्ठ भी शामिल हैं ।

(ख) ( 1 ) (घ) में उल्लिखित दस्तावेज, यदि लागू हों ।

(ग) (1 ) (ङ) में उल्लिखित दस्तावेज, यदि पुराने पासपोर्ट पर ई सी एन आर मुहर नहीं हो अथवा यह उस समय जारी किया गया हो जब आवेदक नाबालिग था ।

(घ) यदि पते में कोई परिवर्तन हो तो 1 (क) में उल्लिखित दस्तावेज ।

(ङ) यदि पुराने पासपोर्ट में पति/ पत्नी का नाम नहीं है तो अनुबंध -घ में नमूने के अनुसार विवाह के पंजीयक द्वारा जारी किए गए विवाह प्रमाण पत्र की प्रति अथवा शपथपत्र।

3. नाबालिग के पासपोर्ट के लिए आवेदन करते समय निम्नलिखित संलग्न करें :

(क) यथास्थिति माता- पिता/ एकल माता- पिता / आवेदक माता-पिता/ कानूनी अभिभावक से एक घोषणा जिसमें यथास्थिति अनुबंध ' ज' ( सभी नाबालिग आवेदकों के लिए) , अनुबंध ' ग' (एकल माता/पिता जो अलग-अलग हैं किंतु औपचारिक रूप से तलाकशुदा नहीं हैं/ विवाह होने से पहले जन्मे बच्चे के एकल माता/ पिता) , अनुबंध 'छ' (जब एकल माता/ पिता या कानूनी अभिभावक द्वारा पासपोर्ट के लिए आवेदन किया जा रहा हो) , अनुबंध ' झ' ( जब 15 से 18 वर्ष की आयु के बीच किसी नाबालिग के लिए दस वर्षीय पासपोर्ट की पूर्ण बैधता के लिए आवेदन किया जाता है अथवा जब माता/ पिता में से कोई एक, जिसके पास अपने नाबालिग बच्चे के पासपोर्ट के लिए आवेदन करते समय वैध भारतीय पासपोर्ट न हो ) के अनुसार नाबालिग बच्चे के बारे में आवेदन पत्र में प्रस्तुत किए गए ब्यौरे की पुष्टि की गई हो । अपने बच्चे के लिए पाससपोर्ट हेतु आवेदन करने वाले एकल माता/ पिता को यथास्थिति अनुबंध 'ग ' और अनुबंध ' छ' भरना चाहिए ।

(ख) माता- पिता दोनों के पासपोर्ट , यदि कोई हो, की साक्ष्यांकित फोटो प्रति यदि लागू हो ।

( ग) ब्यौरों के सत्यापन के लिए माता- पिता के मूल पासपोर्ट को प्रस्तुत किया जाना चाहिए ।

(घ) यदि माता- पिता मे से कोई एक विदेश में रहता हो तो विदेश मे रह रहे माता/ पिता को भारतीय मिशन द्वारा साक्ष्यांकित शपथ पत्र प्रस्तुत करना होगा तथा भारत मे रह रहे माता पिता को भी शपथपत्र प्रस्तुत करना होगा ।

टिप्पणीः सामान्य रूप से किसी नाबालिग (18 वर्ष की आयु से कम ) के लिए पासपोर्ट जारी करने हेतु माता- पिता दोनों की सहमति आवश्यक है । तथापि, यदि किसी कारणवश यह पूर्णरूप से संभव नहीं है तो पासपोर्ट के लिए आवेदन करने वाले माता/ पिता नाबालिग की ओर से एक शपथ पत्र तुत करें (अनुबंध छ) और उसी पासपोर्ट पर आवेदन पत्र के आधार पर कार्रवाई की जाएगी । यदि माता/पिता भारत से बाहर रह रहे हों तो लिए गए शपथपत्र, जिसे विदेश स्थित भारतीय मिशन 19

[भाग II- खण्ड 3 (i ) ]

द्वारा साक्ष्याकित किया गया हो, मे माता पिता से ली गई ऐसी सहमति स्वीकार्य है । ऐसे मामलों में जिनमें नाबालिग बच्चे 18 वर्ष की आयु से कम हों, माता- पिता दोनों या माता- पिता में से किसी एक द्वारा धारित वैध पासपोर्ट के ब्योरे प्रस्तुत किए जाने चाहिए । इसके अलावा उन मामलों में जिनमें मता - पिता के पास वैध पासपोर्ट न हो, ऐसे नाबालिगों के लिए आवेदन अनुबंध ' झ' के अनुसार मानक शपथ - पत्र सहित माता - पिता के ऐसे तीन दस्तावेजों के आधार पर किए जा सकते हैं जिनके ब्योरे पासपोर्ट सूचना पुस्तिका के खंड IV के पैरा ग (ख) में दिए गए हैं । ऐसे सभी मामलों में उनके नाबालिग बच्चों को पासपोर्ट पुलिस सत्यापन के बाद जारी किया जाएगा । सभी आयु के बच्चों को अलग-अलग पासपोर्ट के लिए आवेदन किया जाना चाहिए ।

तथापि, 15 वर्ष से कम आयु के बच्चों को 5 वर्ष अथवा 18 वर्ष की आयु तक पासपोर्ट की वैधता दी जाएगी । यदि नाबालिग बच्चा 15-18 वर्ष की आयु के बीच है , और 10 वर्ष के लिए पासपोर्ट की पूर्ण वैधता प्राप्त करना चाहता है तो अनुबंध ' झ' में यथा निर्दिष्ट मानक शपथ- पत्र प्रस्तुत करने पर पुलिस सत्यापन के बाद तथा माता- पिता द्वारा पासपोर्ट सूचना पुस्तिका के खंड- IV के पैरा ग (ख) में उल्लखित 14 कागजातों में से किन्ही तीन कागजात और किसी प्रौढ़ के लिए यथा लागू 36 पृष्ठीय पासपोर्ट के लिए सामान्य पासपोर्ट शुल्क अर्थात 1000/- रू. के समतुल्य शुल्क की अदायगी पर उसे जारी किया जा सकता है । एकल माता/ पिता या ऐसे माता/पिता जो अलग-अलग रह रहे हों किंतु औपचारिक रूप से उनका तलाक नहीं हुआ हो के मामले के ' अनुबंध ' ग' में उल्लिखित शपथ - पत्र प्रस्तुत करना होगा ।

दत्तक बच्चों के लिए

दत्तक बच्चों के मामले में निम्नलिखित कागजात प्रस्तुत किए जाने हैं :

(i) भारतीय कानून के अनुसार वैध दत्तक विलेख।

(ii) इसाई , मुसलमान तथा पारसी के मामले में अभिभावकता प्रदान करने वाला और बच्चे को देश के बाहर ले जाने की अनुमति देने वाला न्यायालय आदेश ।

(iii) संबंधित न्यायालय के समक्ष निष्पादित गांरटी की प्रति

(ख) नाम में परिवर्तन

II 'विवाह, पुनर्विवाह अथवा तलाक के बाद

(क) विवाह के कारण मौजूदा पासपोर्ट में नाम/ उपनाम बदलने वाली किसी महिला को निम्नलिखित कागजात प्रस्तुत करना होगा :

(i ) पति के पासपोर्ट, यदि कोई हो, की फोटो प्रति, और

(ii) विवाह पंजीयक द्वारा जारी किए गए विवाह प्रमाणपत्र की एक साक्ष्यांकत प्रति अथवा

पति और पत्नी की ओर से एक शपथ-पत्र जिसमें दोनों का फोटो एक साथ साक्ष्यांकित हो

(अनुबंध -घ में दिए गए नमूने के अनुसार 20

(ख ) मौजूदा पासपोर्ट में पति- पत्नी का नाम बदलने अथवा नाम हटाने के लिए आवेदन करने वाले तलाकशुदाओं को निम्नलिखित कागजात प्रस्तुत करना होगाः

(i ) तलाक डिक्री की प्रमाणित प्रति

(ii ) एक पक्षीय विलेख/ लिया गया शपथ-पत्र (अनुबंध - ङ)

(ग) नाम/ पति/ पत्नी का नाम बदलने के लिए आवेदन करने वाले पुनर्विवाहित आवेदकों को निम्नलिखित कागजात प्रस्तुत करना होगा :

(i ) प्रथम पति / पत्नी के संबंध में यथा स्थिति तलाक विलेख/ मृत्यु प्रमाण पत्र और

( ii) दूसरे विवाह से संबंधित उपर्युक्त (क) में उल्लिखित कागजात ।

II अन्य परिस्थितियों में , नाम बदलने के लिए आवेदक ( पुरुष तथा स्त्री दोनों) को निम्नलिखित कागजात प्रस्तुत करना होगाः

(i) एक पक्षीय विलेख/ लिया गया शपथ- पत्र (अनुबंध 'ङ' )

( ii) दो प्रमुख दैनिक समाचार- पत्रों की कतरन (एक दैनिक समाचार पत्र को आवेदक के स्थायी तथा वर्तमान पते के क्षेत्र अथवा निकटतम क्षेत्र का होना चाहिए ।

(ग) तत्काल स्कीम के अन्तर्गत बिना- बारी के पासपोर्ट जारी किया जाना ।

(क) यदि कोई आवेदक तत्काल स्कीम मे अन्तर्गत पासपोर्ट प्राप्त करना चाहता है तो अनुबंध 'च में दिए गए नमूने के अनुसार एक सत्यापन प्रमाण पत्र और अनुबंध 'झं के अनुसार मानक शपथ पत्र तत्काल शुल्क के साथ प्रस्तुत किया जाना चाहिए । पासपोर्ट जारी करने वाले प्राधिकारी को यह अधिकार होगा कि वह सत्यापन प्रमाण-पत्र की प्रामाणिकता का उस अधिकारी से लिखित में सत्यापन कराए जिसने उसे जारी किया है । तत्काल स्कीम के अंतर्गत बिना बारी के पासपोर्ट चाहने वाले सभी आवेदकों को सलाह दी जाती है कि वे अपने आवेदन, दस्तावेज नीचे यथा निर्दिष्ट शुल्क प्रस्तुत करें । बिना बारी के पासपोर्ट जारी किए जाने के लिए अतिशीघ्रता के किसी प्रमाण की आवश्यकता नहीं है । बिना बारी के पासपोर्ट जारी किए जाने के सभी मामलों में बाद में पुलिस सत्यापन किया जाएगा ।

(ख) आवेदक को यह भी विकल्प होगा कि नीचे दिए गए अनुसार चौदह दस्तावेजों में से तीन दस्तावेजों के प्रस्तुत किए जाने पर तत्काल स्कीम के अंतर्गत पासपोर्ट प्राप्त करें जिमसें से तीन दस्तावेजों में से एक दस्तावेज फोटो पहचान दस्तावेज हो और कम से कम एक दस्तावेज उनमें से हो जिनका उल्लेख नीचे (क) से (झ) में किया गया है और अनुबंध-'झ' के अनुसार नोटरी द्वारा विधिवत साक्ष्यांकित शपक्ष पत्र हो । तत्काल स्कीम के अंतर्गत बिना बारी के पासपोर्ट चाहने वाले सभी आवेदकों को सलाह दी जाती है कि अपने आवेदन दस्तावेज नीचे यथा निर्दिष्ट शुल्क प्रस्तुत करें ।

पहचान और राष्ट्रिकता का प्रमाण (कृपया निम्नलिखित चौदह दस्तावेजों में से तीन दस्तावेज संलग्न करें जिनमें से तीन दस्तावेजों में से एक दस्तावेज फोटो पहचान दस्तावेज हो और कम से कम एक दस्तावेज उनमें से हो जिनका उल्लेख नीचे (क) से (झ) में किया गया है और अनुबंध ' झं में दिए गए अनुसार गैर- न्यायिक पेपर पर नोटरी पब्लिक द्वारा साक्ष्यांकित मानक शपथ -पत्र हो )

(क) मतदान फोटो पहचान पत्र; (ख) राज्य / केंद्र सरकार, सार्वजनिक क्षेत्र के उपक्रमों , स्थानीय निकायों अथवा सार्वजनिक लिमिटेड कंपनियों द्वारा जारी किसी गए सेवा पहचान पत्र; (ग) एस सी/एस टी / ओ बी सी प्रमाण- पत्र (घ) स्वतंत्रता सेनानी पहचान पत्र; (ङ) आयुध लाइसेंस; (च ) संपत्ति संबंधी दस्तावेज जैसे पट्टा, पंजीकृत विलेख आदि, (छ) राशन कार्ड; ( ज) पेंशन संबंधी दस्तावेज दस्तावेज जैसे - पूर्व सैनिक की पेंशन बुक / पेंशन भुगतान आदेश, पूर्व सैनिक की विधवा / आश्रित प्रमाण-पत्र, वृद्धावस्था पेंशन आदेश, विधवा पेंशन आदेश; (झ) रेलवे पहचान पत्र; (ञ) आयकर-पहचान (पैन) पत्र; (ट) बैंक / किसान/डाक घर पास बुक; (ठ) मान्यता प्राप्त शैक्षिक संस्थाओं द्वारा जारी किए गए छात्र पहचान पत्र; (ङ) ड्राइविंग लाइसेंस और ( ढ) आर बी डी अधिनियम के अंतर्गत जारी किया गया जन्म प्रमाण पत्र ।

(उपर्युक्त सभी दस्तावेज मूलरूप में स्व-साक्ष्यांकित प्रतियों के साथ प्रस्तुत किए जाएंगे)

तत्काल शुल्क, लागू पासपोर्ट शुल्क के अतिरिक्त होगा और नकद या संबंधित पासपोर्ट अधिकारी के पक्ष में डिमाण्ड ड्राफ्ट के रूप में देय होगा । बिना बारी के तत्काल पासपोर्ट के लिए अतिरिक्त शुल्क निम्नानुसार होगाः

नया पासपोर्ट

आवेदन की तारीख से 1-7 दिन के अंदर 1,500/ -रू. + यथा लागू पासपोर्ट शुल्क 2 आवेदन की तारीख से 8-14 दिन के अंदर 1000 / -रू. + यथा लागू पासपोर्ट शुल्क डुप्लीकेट पासपोर्ट

1. आवेदन की तारीख से 1-7 दिन के अंदर 2,500/-रू. + यथा लागू पासपोर्ट शुल्क 2.

1,500/-रू. + यथा लागू पासपोर्ट शुल्क आवेदन की तारीख से 8-14 दिन के अंदर

10 वर्ष की वैधता अवधि समाप्त होने के बाद पासपोर्ट पुनः जारी किए जाने से संबंधित मामले

1,500/ -रु. + यथा लागू पासपोर्ट शुल्क आवेदन की तारीख से 3 कार्य दिवसों के अंदर

(घ) ऐसी कंपनियों के स्वामी, भागीदार और निदेशक जो सी आई आई , फिक्की और एसोचेम की सदस्य हैं, को पासपोर्ट जारी किए जाने के लिए । आवेदकों को अनुबंध ' झ' के अनुसार मानक शपथ - पत्र के साथ अनुबंध (ञ) में दिए गए अनुसार सत्यापन प्रमाण-पत्र प्रस्तुत करना होगा ।

(ङ) यदि किसी आवेदक के पास सत्यापन रिपोर्ट और अथवा खण्ड IV के पैरा ग (ख) (क) में यथा उल्लिखित तीन (3 ) दस्तावेज हैं किंतु तत्काल के अंतर्गत यथा अपेक्षित अतिरिक्त शुल्क अदा नहीं करना चाहता है तो ऐसे मामले में आवेदकों को पासपोर्ट सामान्य अवधि में पुलिस सत्यापन के बाद जारी किया जाएगा ।

(च) गुम/ क्षतिग्रस्त पासपोर्टों के मामलेः

आवेदक को पासपोर्ट आवेदन पत्र भरकर उसे निम्नलिखित विलेखों के साथ प्रस्तुत करना होगाः

i ) मूल रूप में प्राथमिकी (एफ.आई.आर. )

ii ) पुराने पासपोर्ट का पहला और अन्तिम चार पृष्ठ।

iii ) यदि पते में कोई परिवर्तन हो तो पते का प्रमाण।

टिप्पणीः 1 सत्यापन प्रमाण पत्र पर आवेदक का पासपोर्ट आकार का फोटो लगाना भी अपेक्षित है और सत्यापन प्रमाण - पत्र जारी करने वाले अधिकारी द्वारा प्रमाणित भी होना अपेक्षित है और उसके हस्ताक्षर तथा रबड की मुहर इस रूप में हो कि हस्ताक्षर तथा मुहर का आधा भाग फोटो पर तथा आधा भाग प्रमाण पत्र पर हो ।

4. कोई ऐसा अधिकारी जो गलत सत्यापन प्रमाण पत्र जारी करता है, के विरूद्ध पासपोर्ट अधिनियम, 1967 की धारा 12 (2) के अंतर्गत अभियोजन चलाया जा सकता है ।

5. पासपोर्ट अधिनियम , 1967 की धारा 6 (2) (ग)

इस अधिनियम के अन्य उपबंधों के अध्यधीन, पासपोर्ट प्राधिकारी निम्नलिखित आधारों में से किसी एक अथवा एक से अधिक आधार पर न कि अन्य आधार पर खंड (ग) की उपधारा 5 के अंतर्गत विदेश यात्रा के लिए पासपोर्ट अथवा यात्रा दस्तावेज जारी करने से मना कर देगा अर्थात

(क) आवेदक भारत का नागरिक न हो ।

(ख) आवेदक, 'भारत के बाहर ऐसी गतिविधियों में संलिप्त हो या होने की संभावना हो जो कि भारत की संप्रभुता और अखंडता के प्रतिकूल हों ।

(ग) आवेदक का भारत से बाहर प्रस्थान करना भारत की सुरक्षा के लिए हानिकारक हो अथवा होने की संभावना हो ।

(घ) आवेदक का भारत से बाहर उपस्थिति से किसी दूसरे देश के साथ भारत के मैत्री संबंध प्रतिकूल हो सकते हों अथवा होने की संभावना हो ।

(ड.) आवेदन की तिथि के तत्काल पूर्व पांच वर्ष की अवधि के दौरान नैतिक अधमेत्ता के किसी अपराध के लिए भारत के किसी न्यायालय द्वारा आवेदक को दोषसिद्ध किया गया हो और उस संबंध में उसे कम से कम दो वर्ष की सजा सुनायी गई हो ।

(च) आवेदक द्वारा तथाकथित किए गए किसी अपराध के संबंध में आपराधिक कार्यवाही भारत के किसी न्यायालय के समक्ष लंबित हो ।

( ii) ऐसा कोई भी व्यक्ति, जो भारत का नागरिक नहीं होते हुए पासपोर्ट के लिए आवेदन करता है या अपनी राष्ट्रीयता से संबंधित सूचना को छिपाते हुए पासपोर्ट प्राप्त करता है या किसी जाली भारतीय पासपोर्ट अथवा यात्रा दस्तावेज को धारण करता है , तो 5 वर्ष की कैद और 50,000/- रू . तक के जुर्माने के लिए दंडनीय होगा ।

CAUTION

A passport is issued under the Passports Act . 1967. It is an offence knowingly to furnish false information OR suppress information, which attracts penal and other action under relevant sections of the said Act. Passport is a valuable document . All holders are required to take due care that it does not get damaged , mutilated or lost. Passports should not be sent out to any country by post. Loss of passport should be immediately reported to the nearest Police Station and to the nearest Passport Office/Indian Mission . Passport holder shall be responsible for misuse of passport, due to non - intimation of loss to the concerned Passport Office/Indian Mission. Passport is a Government property and should be surrendered when demanded in writing by any Passport Issuing Authority.

2. FEE AND MODE OF PAYMENT: The following all - inclusive fee is to be paid along with the application form, either by Bank Draft in favour ofthe Passport Officer concerned or in cash. In case of DD, full name of applicant and application number to be written on the reverse of the draft . Details of payment of fee may be mentioned in the relevant boxes . If the fee is paid by Demand Draft, then the Bank Code of Issuing Bank, the Demand Draft Number and date of issue of the Demand Draft should be mentioned .

Passport may be delivered only to the applicant or dispatched by speed post to the address given in the application form. SECTION II - INSTRUCTIONS AND GUIDELINES FOR FILLING UP THE APPLICATION FORM

ThePassport Application Form is Machine Readable. It will be scanned on computer. Therefore , the following instructions may be followed strictly:

Write clearly within the box without touching the boundaries.

Use capital letters only. Particulars given in the form willbe printed in the passport . Therefore , please be careful in filling up the form and avoid any mistakes.

Useblack/blue ball pen only .

Adjust the information to fit within the number of given boxes.

Donot fill the form with pencils or ink-pen.

Do not write anything outside the box. Avoid over- writing.

While filling up the boxes, kindly leave one box blank after

each completed word.

Incomplete application will not be accepted .

Important Note: All original documents are to be shown at the time of submission of the passport application form. With the Original Passport Application Form, self- attested copies of all required documents need to be attached. Illiterate applicants should put only thumb impression in the box meant for thumb impression/signature. In case an applicant has stayed at more than one address during the last one year, he/she should furnish two additional photocopies of the PP form for each additional place of stay .

SECTION III - COLUMN - WISE GUIDELINES FOR FILLING UP THE APPLICATION FORM

At the beginning of the Application Form there are boxes for affixing photograph, appending signature and thumb impression and giving details of payment of the fee.

PHOTGRAPHS: Recent passport size photographs ( Three) in colour showing frontal view of full face are required. One photograh is to be pasted on form and two on the PP forms , which is to be filled in duplicate. Black and white photograph, photograph with coloured or dark glasses or in uniform , Polaroid prints or computer prints will not be accepted. In the box meant for affixing the photograph, please paste your recent and identical colour photograph of size 3.5 cm x 3.5 cm.. Photograph should fit exactly in the box and in any case not smaller than thebox provided in the form . For Jumbo booklets, two additional photographs are required.

Signature/thumb impression should be strictly within the box without touching the boundaries . Thumb impression should be of left hand in case of males and right hand in case of females .

COLUMN 1 - NAME (WITH DOCUMENTARY PROOF)

The name up to 75 character long name can be given and filled in the form . The full name as it should appear in the Passport should be furnished here. For example ,

Students staying away from their parents have the option of applying from place of study. COLUMN 11: Please give details of previous passport ( s) held. Either the Previous Passport Number or the file number may be mentioned here along with date of issue and place of issue in the relevant boxes . In case previously applied for passport but the same was not received/ issued , then the details such as file number , date applied and place where applied should be furnished here . Suppression of facts may attract penal provisions as per the section 12 of the Passports Act, 1967 .

COLUMN 11 (8) : If ever travelled on Emergency Certificate ( EC) or ever deported or repatriated to India at Government cost, then the details ofEC number , date and place of issue along with original seizure memorandum, place and country from where deported or repatriated should be furnished in this column . Even if the EC details are not available readily, at least the place and country from where deported or repatriated should invariably be given here . All such applicants should furnish details of circumstances of their repatriation/loss of passport in a form of notarized affidavit.

(1) All persons who have been staying abroad for more than three years ( the period of three years couldbe either in one stretch or broken) and their spouses.

(m) Allldren upto the age of 18 years of age . (At the time of re-issue at the age of 18 years , ECR stamping shall be done, if applicable)..

( 11 ) No emigration clearance is required for visiting Bangladesh , Pakistan and all countries in Europe ( excluding CIS states) , North America , Australia , Japan, New Zealand, South Korea , South Africa aud Singapore.

The eligible category should be mentioned in the blank space provided under this column and supportive documents shouldbe attached with the application. It may be mentioned that passport holders with ' ECR ' endorsement travelling to countries other than mentioned above for any non - employment purposes are required to have the ' ECR ' endorsement suspended each time from the offices of the Protector of Emigrants ( POE ) or designated Passport Offices ,before they undertake the travel . For employment purposes , such passport holders require emigration clearance from the offices of POEs . Otherwise, they willbe stopped from travelling at the port of exit . Applicants are, therefore, advised to apply for ECNR, if they are eligible , to ensure hassle- free travel abroad. It may be noted that the passport booklet will only have ECR category stamped and in case the passport booklet does not have ECR stamp, the applicant wouldbe deemed to have been granted ECNR status .

COLUMN 16 : In this column , while applying for the first time for the minor children who are less than 18 years of age , the details of valid passports held by BOTH OR EITHER parents should be fumished in the relevant column . In such cases , passport to their minor child will be issued without any police verification . Further, in the cases where the parents do not hold valid passports , applications for such minors can be made on the basis of three documents of parents details of which are given in para C (B ) of Section IV of the Passport Information Booklet along with Standard affidavit Annexure I. In all such cases , passport to their minor child will be issued on post -police verif.cation basis . A declaration on plain paper as given at annexure H is needed to be filled up in each case . In case the minor child who is between 15 and 18 years of age wishes to -obtain a full validity passport for 10 years , the same can be issued only on submission of Standard Affidavit as in Annexure " I" and any three of the 14 document as mentioned in para C ( B ) of Section IV of Passport Information Booklet by the parents and on payment of fee equivalent to the nomia sport fee i.e. Rs . 1000/ - for a 36 pages passport, as applicable for an adult . Otherwise the validity of the passport is restricted to five years or attaining the age of 18 , whichever is earlier . In case of single parent and children born out of wedlock or in case of parents who are judiciali, separated , a sworn affidavit before a Magistrate , stating the facts of the case along with documentary proof to be submitted as per Annexure " C " . In the NORMAL COURSE the signature / consent of both parents is required for issue of a passport to the minor (Annexure "H" ). However, if in case the applicant parent is not in a position to get the consent of the other parent, FOR WHATEVER REASON, the parent applying for the passport of the minor may sign the form and submit a sworn affidavit as per Annexure " G" staring the facts and circumstances of the case along with the application . The affidavit should als state that in case al a court case he/she would be responsible and not the passport office. In such cases , where only one parent is applying, t'e physical appearance of the child may be requested to ensure the applicant parent has the actual custody of the child.

COLUMN 17 : The applicant should give correct information . Suppression of any fact may lead to fine up to Rs 5000 per offence and other penal provisions as applicable under the provisions of the Passports Act, 1967 as amended from time to time . COLUMN 18: In this column , the name and address along with Mobile or Telephone number/e - mail of person to be intimated in the event of death or accident is to be furnished .

COLUMN 19 : This column is a self declaration made by the applicant about owing allegiance to the sovereignty, unity and integrity of india , noi voluntarily acquiring the citizenship or travel document from any other country etc. Also this column contains declaration in furnishing true information in the application form and aware that it is an offence under the Passport Act 1967 for any wrong information or suppression of any material information in getting the passport . The applicant also declares that he has no other passport or travel document . Under the space provided, the signature or Thumb Impression (left hand thumb impression for male and right hand thumb impression for female ) should be furnished along with date and place of application .

COLUMN 20: Photocopies of all documents that are attached as caclosures along with the application torm should be listed in the blank spaces provided and each document self attested by the applicant .

SECTION IV - DOCUMENTS TO BE ATTACHED WITH THE APPLICATION

( In case the applicant is submitting the application himself/herself, seif attested copies of all documents are required to be attached with the application form . Original documents should, however, also be produced for verification and are returned. In case the application is not being submitted by the applicant himself, he can authorize any member of his family to do so with on authority letter . In case of applications sent by post, the copies of original documents are to be attested by a GAZETTED Officer or Notary public.

(A) PASSPORTS

(1)While applying for a fresh passport attach two copies of the following documents :

(a) Proof of address (attach one of the following) :

Applicant's ration card , certificate from Employer of reputed companies on letter head , water /telephone /electricity bill/statement of running bank account/Income Tax Assessment Order /Election Commission ID card, Spouse's passport copy, parent's passport copy in case of minors ( NOTE: If any applicant submits only ration card as proof of address , it should he accompanied by one more proof of address out of the above categorics) .

(b) Proof ofDate ofBirth (attach one of the following) :

Birth certificate issued by a Municipal Authority or district office of the Registrar ofBirths & Deaths;

Date of birth certificate from the school last attended by the applicant or any other recognized educational institution ; or an Affidavit sworn before a Magistrate/Notary stating date/place of birth as per the specimen in ANNEXURE ' A' by illiterate orsemi - illiterate applicants .

N.B.: In the case of applicants born on or after 26.01.89 , only Birth Certificate issued by the Municipal Authority or the Office of the Registrar of Births & Deaths is acceptable .

(d) Government/Public Sector/Statutory body employees should submit " Identity Certificate " in original (ANNEXURE B ) alongwith Standard Affidavit Arinexure I.

(e) Ifthe applicant is eligible for "ECNR " attach attested copy of supporting document (see COLUMN 15 of the INSTRUCTIONS AND GUIDELINES FOR FILLING UP THE APPLICATION FORM) .

(f) If the applicant was repatriated at Government cost, enclose documents to show that the expenditure, if any, incurred by the Government of India on his/her repatriation has been fully refunded to the Government of India, Ministry of External Affairs.

(g) If the applicant was ever deported to India, give details of Emergency Certificate/Passport.

(2) When applying for reissue of a passport after 10 years, attach:

(a) Old passport in original with self- attested photocopy of its first four and last four pages , including ECR/ECNR page .

(b) Document mentioned at ( I ) (d), if applicable .

(c) Document mentioned at ( 1 ) (e ), if the old passport did not have ECNR stamp or it was issued when the applicant was a minor.

(d) If there is any change in address , document mentioned at 1 (a) .

(e) If the old passport does not contain spouse name , copy of marriage certificate issued by the Registrar of Marriage or affidavitas per specimen in Annexure 'D' .

(3) When applying for a minor's passport attach:

(a) A Declaration from the parents /single parent/applicant parent/legal guardians , as the case maybe, affirming the particulars furr ished in the application about the minor child as per ' Annexure - H ( for all minor applicants ) , Annexure "C" ( Single parents who are separated but not formally divorced/Single parent of the child bom out of wedlock ), Annexure " G " (when passport is being applied for by single parent or legal guardian ), Annexure " I" (when a minor between 15-18 years of age applies for a full validity 10 year passport OR in case either parents who do not hold valid Indian passport while applying passport for their minor child), as the case maybe. Single Parents applying for the passport for their child should fill up Annexure " C" and or Annexure " G" , as the case maybe.

b) Attested photocopy of passport, if any , ofboth parents, if applicahle.

( (c) Original passports of parents should be presented for verification of particulars.

(d) If one parent is resident abroad, a Sworn affidavit by the parent resident abroad attested by the Indian Mission along with affidavit from parent residing in India as well be submitted .

N.B.: Ordinarily the consent ofboth parents is required for issue of a passport to a minor (below 18 years of age ) . However if it is absolutely not possible due to any reason, the parent applying for a passport for his/her minor child may submit an affidavit (Annexure G) and based on the same passport application will be procussed. In case where the parent( s ) is/are resident outside India, such consent from the parent (s), in the form of a sworn affidavit , duly attested by the Indian Mission abroad, is acceptable. In the cases where the minor children who are less than 18 years of age, the details of valid passports held by BOTH OR EITHER parents should be furnished. In such cases , passport to their minor child will be issued without any police verification basis. Further, in the cases where the parents do not hold valid passports , applications for such minors can be made on the basis ofthree documents of parents details of which are giver para C(B ) of Section IV of the Passport Information Booklet along with Standard Affidavit Annexure I. In alt such cases , passport to their minor child will be issued on post-police verification basis. Children of all age must apply for separate passports . However , those below 15 years will be given 5 years validity passport or passport till 18 years of age. In case the minor child who is between 15 and 18 years of age wishes to obtain a full validity passport for 10 years , the same can be issued only on post -police verification basis on submission of Standard Atfidavit as in Annexure " I " and three of the 14 document as mentioned in para C(B ) of Section IV of Passport Information Booklet by the parents and on payment of fee equivalent to the normal passport fee i.e. Rs 1000/- for a 36 pages passport, as applicable for an adult. In the case of single parents or of parents who are separated but not formally divorced, an affidavit at ' Annexure C is to be submitted.

For Adopted Children:

Incase of Adopted Children the following documents are to be furnished:

i) Valid adoption deed registered as per Indian laws

ii ) In the case of Christians , Muslims and Parsis, a court order granting guardianship and allowing the child to be taken out ofthe Country.

iii) Copy of the guarantee executed before the Court concerned.

CHANGE OF NAME

11 .

Following marriage , remarriage or divorce:

(a) Awoman applying for change of name/ surname in existing passport due to marriage must furnish:

Photocopy of the Husband's passport, if any, and (i)

An attested copy of marriage certificate issued by Registrar of Marriage OR an affidavit from the husband and wife along with a joint photograph , ( Specimen at Annexure D) . (it)

(i)

(b) Divorcees applying for change of name OR for deletion of spouse's name in existing passport must furnish Certified copy of Divorce decree .

(ii) Deed poll/sworn affidavit ( ANNEXURE ' E ' )

(i) Divorce deed/death certificate as the case may be in respect of first spouse, and

Document as at ( a) above relating to second marriage .

(ii) II . In other circumstances for change of name, the applicant ( both male and female) should furnish:

(A) If an applicant desires to obtain his passport under the Tatkal Scheme , a verification certificate as per the specimen at ANNEXURE ' F ' and standard affidavit as Annexure " I" should be submitted along with the TATKAAL fee. The Passport Issuing Authority shall retain the right to verify in writing the authenticity of the Verification Certificate from the official who has issued it. All applicants seeking a passport out of tum under the TATKAAL Scheme are advised to submit their application , documentation and fee as specified under . No proof of urgency is required for Out-of- Turn issue of passport . Post Police Verification shall be done in all cases of issue of passport under Tatkal Scheme.

(B) The applicant also has the option to obtain a passport under Tatkal Scheme on submission of three documents from the Fourteen documents as mentioned below, provided one of the three documents is a photo identity document and atleast one ofthe three is amongst the documents indicated at (a) to( i ) and standard affidavit duly attested by a Notary as at Annexure " I " . All applicants seeking a passport out of tum under the TATKAAL Scheme are advised to submit their application, documentation and fee as specifiedbelow.

SECTION 6( 2) ( C) OF THE PASSPORT ACT, 1967

"Subject to the other provisions of this Act , the passport authority shall refuse to issue a passport or travel docurnent for visiting any foreign country under clause ( C ) sub - section 5 of anyone or more of the following grounds , and on no other ground, namely:

(a) that the applicant is not a citizen of India .

(b) that the applicant may, or is likely to engage outside India in activities prejudicial to the sovereignty and integrity of India.

(d) that the presence of the applicant outside India may, or is likely to prejudice the friendly relations of India with any foreign country. (e) that the applicant has , at any time during the period of five years immediately preceding the date of his application been convicted by a court of India for any offence involving moral turpitude and senter ced in respect thereof imprisonment for not less than two years . (

f) that criminal proceedings in respect of an offence alleged to have been committed by the applicant are pending before a court in India .
