सा.का.नि. 773 (अ). - खाद्य अपमिश्रण निवारण नियम , 1955 का और संशोधन करने के लिए कतिपय प्रारूप, नियमों, खाद्य अपमिश्रण निवारण अधिनियम , 1954 ( 1954 का 37) की धारा 23 की उपधारा (I) की अपेक्षानुसार भारत सरकार के स्वास्थ्य और परिवार कल्याण मंत्रालय (स्वास्थ्य विभाग ) की अधिसूचना सं. सा.का.नि. 298 (अ) तारीख 20 मई , 2006 द्वारा भारत के राजपत्र , में प्रकाशित किया गया था, जिसमें ऐसे सभी व्यक्तियों से, जिनके उससे प्रभावित होने की संभावना है, उस तारीख से, जिसको उक्त अधिसूचना से युक्त राजपत्र की प्रतियां जनता को उपलब्ध करा दी गई थी, साठ दिन की अवधि की समाप्ति तक आक्षेप और सुझाव मांगे गए थे;
थी; और उक्त अधिसूचना की प्रतियां तारीख 23 मई , 2006 को जनता को उपलब्ध करा दी गई
और उक्त प्रारूप नियमों के संबंध में विनिर्दिष्ट अवधि के भीतर जनता से प्राप्त आक्षेपों और सुझावों पर केन्द्रीय सरकार द्वारा विचार कर लिया गया है ;
अतः, अब, केन्द्रीय सरकार, खाद्य अपमिश्रण निवारण अधिनियम, 1954, (1954 का 37) की धारा 23 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय खाद्य मानक समिति से परामर्श करने के पश्चात खाद्य अपमिश्रण निवारण नियम, 1955 का और संशोधन करने के लिए निम्नलिखित नियम बनातीहै, अर्थात: -
1. ( 1 ) इन नियमों का संक्षिप्त नाम खाद्य अपमिश्रण निवारण (.10.ौँ संशोधन ) नियम, 2006 है । (2) ये सरकारी राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे सिवाय नियम 2 और नियम 4के, जो 30.3.2007 को प्रवृत्त होंगे ।

2. खाद्य अपमिश्रण निवारण नियम, 1955 (जिन्हें इसमें इसके पश्चात उक्त नियम कहा गया है) के, नियम 42 में , उप-नियम (य यय) (23), के पश्चात् निम्नलिखित उप-नियम अन्तः स्थापित किया जाएगा, अर्थात्: -
" (य यय) (24) ताजा फल या खुले में बिक्रीत ताजा फल के प्रत्येक पैकेज पर, यदि वैक्स से विलेपित है, निम्नलिखित लेबल लगा होगा, अर्थात्: -
" वैक्स से विलेपित (वैक्स का नाम दें) तारीख से पहले उत्तम । "
3. उक्तनियमों के नियम 47 की , सारणी में, एस. सल्फेम पोटेशियम से संबंधित क्रम संख्या 3 के सामने स्तंभ 3 और स्तंभ 4 में , विद्यमान प्रविष्टियों के पश्चात् निम्नलिखित प्रविष्टि अंतः स्थापित की जाएगी , अर्थात्: -

4. अर्थात्: - उक्त नियमों के नियम 48 ङ में, निम्नलिखित परन्तुक अंत में अन्तः स्थापित किया जाएगा,
" परन्तु ताजा फलों को नियम 42 के उप-निमय (य य य) (24) में उपबंधित रूप में, उचित लेबल घोषणा के अंतर्गत खाद्य योगात्मक ( जी एम पी) के प्रयोग के लिए अच्छे विनिर्माण पद्धतियों के अनुसार बी वैक्स (सफेद और पीला) अथवा कारनौबा वैक्स से विलेपित किया जा सकेगा । "
5. उक्त नियमों के नियम 57- क के, उप-नियम (2) में सारणी के स्थान पर निम्नलिखित सारणी रखी जाएंगी , अर्थात्: -

(ii) बीटा कैरोटीन से संबंधित मद क. 26.06 में,
"धात्विक अपद्रव्य की अधिकतम सीमा इस प्रकार होगी- आर्सेनिक (As के रूप में) 5 भाग प्रति दस लाख सीसा (Pb के रूप में) 20 भाग प्रति दस लाख " , प्रविष्टियों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्ः-
"धात्विक अपद्रव्य की अधिकतम सीमा इस प्रकार होगी-
3 भाग प्रति दस लाख
आर्सेनिक (As के रूप में)
10 भाग प्रति दस लाख
सीसा (Pb के रूप में)
40 भाग प्रति दस लाख
भारी धातु
तथा निम्नलिखित अपेक्षाओं को भी पूरा करेगाः-
(i) अनुषंगी रंग पदार्थ, भार के अनुसार प्रतिशत अधिकतम-3;
(ii) सल्फेट युक्त राख , कुल रंग पदार्थों का प्रतिशत , अधिकतम-0.1 " ;
(iii) क्लोरोफिल से संबंधित मद क 26.07 में,
(क) धात्विक अपद्रव्य के लिए अधिकतम सीमाओं से संबंधित पैरा में, आर्सेनिक (As के रूप में) तथा सीसा ( Pb के रूप में) के सामने प्रविष्टियों के स्थान पर क्रमशः निम्नलिखित रखा जाएगा, अर्थात्ः-
3 भाग प्रति दस लाख
" आर्सेनिक (As के रूप में)
10 भाग प्रति दस लाख "
सीसा (Pb के रूप में)
(ख) अंत में निम्नलिखित अंतः स्थापित किया जाएगा, अर्थात्: -

उक्तनियमों के परिशिष्ट ग की, सारणी 3 में, -
(i) स्तंभ 9 के पश्चात निम्नलिखित नया स्तंभ और शीर्षक अंतः स्थापित किया जाएगा,
अर्थात्ः-

"प्रतिआक्सीकारक

(ग) इस प्रकार अंतः स्थापित स्तंभ 10 के अंतर्गत निम्नलिखित प्रविष्टियां अंतः स्थापित की जाएंगी , अर्थात्ः-
"टी.बी.एच.क्यू. ( तृतकीय ब्यूटिल हाइड्रोक्विनोन) तथा बी.एच.ए. (ब्यूटिलेटड हाइड्रोक्सिल एनिसोल)- अधिकतम 0.01 प्रतिशत "

नोट : मूल नियम 12 सितम्बर, 1955 की अधिसूचना संख्या का.नि.आ.2106 द्वारा भारत के राजपत्र में प्रकाशित हुए थे और अंतिम संशोधन अधिसूचना संख्या सा.का.नि.679(अ) तारीख 31 अक्टूबर, 2006 द्वारा संशोधित किया गया ।

NOTIFICATION
New Delhi , the 29th December, 2006
G.S.R. 773 (E)-WHEREAS certain draft rules further to amend the Prevention of Food Adulteration Rules 1955 were published , as required by sub- section ( 1 ) of section 23 of the Prevention of Food Adulteration Act , 1954 ( 37 of 1954) , in the Gazette of India , vide notification of the Government of India in the Ministry of Health and Family Welfare (Department of Health ) , numberG. S. R. 298 (E) , dated the 20th May, 2006 , inviting objections and suggestions from all persons likely to be affected thereby till the expiry of the period of sixty days from the date on which copies of the Official Gazette containing the said notification , were made available to the public ;
AND WHEREAS , the copies of the said notification were made available to the public on the 23rd May, 2006;
AND WHEREAS , objections and suggestions received from the public within the specified period on the said draft rules have been considered by the Central Government;
NOW, THEREFORE, in exercise of the powers conferred by section 23 of the Prevention of Food Adulteration Act, 1954(37 of 1954) , the Central Government , after consultation with the Central Committee for Food Standards , hereby makes the following rules further to amend the Prevention of Food Adulteration Rules , 1955, namely: -
1. (1 ) These rules may be called the Prevention of Food Adulteration (... 10th Amendment) Rules , 2006.
(2) They shall come into force on the date of their publication in the Official Gazette, except rules 2 and 4, which shall . come into force on the 30th day of March , 2007 .
2. In the Prevention of Food Adulteration Rules , 1955, ( hereinafter referred to as said rules) , in rule 42 , after sub - rule ( ZZZ ) ( 23 ) , the following sub - rule shall be inserted , namely: -

"(ZZZ ) ( 24 ) Every package of fresh fruit or fresh fruits sold in loose, if coated with wax shall carry the following label , namely: -
"Coated with wax (give name of wax ) Best before date
3. in rule 47 of the said rules , in the Table , against serial number 3 relating to Acesulfame Potassium , following entry shall be inserted after the existing entries in columns 3 and 4, namely: -

4. In rule 48- E of the said rules , the following proviso shall be inserted , namely : -
"Provided that fresh fruits may be coated with bees wax (white and yellow ) or carnauba wax in accordance with the good manufacturing practices for use of food additives (GMP) under proper label declaration as provided in sub - rule ( ZZZ ) (24 ) of rule 42. "
5. In rule 57-A of the said rules , in sub - rule (2) , for the Table, the following Table shall be substituted, namely: -
