सा.का. नि. 16 ( अ.). - जबकि भारतीय पत्तन अधिनियम, 1908 ( 1908 के अधिनियम सं 0 15 ) की धारा 6 की उप -धारा ( 2 ) द्वारा की * गई अपेक्षा के अनुसार , अंडमान और निकोबार द्वीप- पत्तन नियम, 2004 में संशोधन करने की दृष्टि से प्रस्तावित किए जा रहे अंडमान और निकोबार द्वीप - पत्तन (संशोधन ) नियम , 2006 का प्रारूप , उससे प्रभावित होने संभावित सभी संबंधित व्यक्तियों की जानकारी के लिए और उनसे आपत्तियाँ तथा सुझाव आमंत्रित करने तथा उन्हें यह सूचना देने हेतु भारत सरकार के पोत परिवहन , सड़क परिवहन और राजमार्ग मंत्रालय , पोत परिवहन विभाग के पत्तन स्कंध की दिनांक 26 अक्तूबर , 2006 की अधिसूचना सं. सा.का.नि. 671 ( अ ) द्वारा भारत के असाधारण राजपत्र के भाग II , खंड 3 , उप - खंड ( i ) में प्रकाशित कर दिया गया कि उपर्युक्त अधिसूचना के प्रकाशन की तारीख से 45 दिन की समाप्ति पर या उसके बाद उपर्युक्त नियमों के प्ररूप पर उक्त अवधि के दौरान प्रकट कर दी गई आपत्तियों प्रस्तुत कर दिए गए सुझावों के साथ - साथ विचार किया जाएगा ।
और जबकि 26 अक्तूबर , 2006 को उपर्युक्त अधिसूचना प्रकाशित कर दी गई और जनता को सुलभ करवा दी गई ;
और जबकि की उपर्युक्त अवधि समाप्त होने से पहले उपर्युक्त नियमों के प्ररूप के बारे में किसी भी व्यक्ति से कोई भी आपत्ति या सुझाव नहींमिला है ; अतः , अब , उपर्युक्त अधिनियम की धारा 6 की उप - धारा ( 1 ) द्वारा प्रदत्त अधिकार प्रयुक्त करके , केन्द्रीय संरकार, एतद्वारा , निम्नलिखित नियम बनाती है , अर्थात्ः-
1. इन नियमों का नाम , अंडमान और निकोबार द्वीप- पत्तन ( संशोधन ) नियम , 2007 है ।
2. अंडमान और निकोबार द्वीप - पत्तन नियम, 2004 में; नियम 98 के बाद , निम्नलिखित नियम जोड़ दिया जाए :-
" 98 ( क ) पोत- भंजन के बारे में बैंक प्रतिभूति ( गांरटी ) निर्धारित किए जाने का मानदण्ड या मानक, न्यूनतम दो लाख रु. की शर्त पर , पचास रु० , प्रति जलयान का सकल टन- भार होगा " ।

NOTIFICATION
New Delhi , the 11th January, 2007
G.S.R. 16 (E ) .- Whereas draft of the Andaman and Nicobar Islands Port (Amendment) Rules, 2006 being proposed to amend theAndaman and Nicobar Islands Port Rules , 2004 , was published as required by Sub- section (2) of Section 6 of the Indian Ports Act, 1908 ( 15 of 1908) in the Gazette of India , Extraordinary , Part II , Section (3 ) Sub- section ( i) under notification of the Government of India in the Ministry of Shipping , Road Transport and Highways , Department of Shipping, (Ports Wing ) videG.S.R. 671 (E) dated the 26th October , 2006 for information of and inviting objections and suggestions from all concerned likely to be affected thereby and giving notice that the draft rules shall be taken into consideration on or after expiry of forty five days from the publication of the notification alongwith the objections and suggestions made within the said period ;
And whereas the said notification was published and made available to the public on the 26th October , 2006 ;
Andwhereas no suggestions and objections have been received from the public before the expiry of the aforesaid period;
Now, therefore , in exercise of the powers conferredby Sub - section (1) of Section 6 of the said Act , the Central Government hereby makes the following rules , namely
1. These rules may be called the Andaman and Nicobar Islands Port (Amendment) Rules , 2007 .
2. In the Andaman and Nicobar Islands Ports Rules , 2004, after the rule 98, following rule shall be inserted:-
" 98 (A) The criteria/ or norms to determine the Bank Guarantee for Ship Breaking shall be Rupees Fifty per Gross Tonnage of the vessel subject to minimum of Rupees two Lakhs . " .
