सा.का.नि. 17( अं ), महापत्तन न्यास अधिनियम, 1963 ( 1963 का अधिनियम सं. 38 ) की धारा 132 की उप - धारा ( 1 ) के साथ पठित धारा 124 की उप- धारा ( 1 ) द्वारा प्रदत्त अधिकार प्रयुक्त करके, केन्द्रीय सरकार इस अधिसूचना के साथ लगाई जा रही अनुसूची में यथा निर्धारित मुम्बई पत्तन न्यास के न्यासी बोर्ड द्वारा बनाए गए मुम्बई पत्तन न्यास ( पेंशन निधि) विनियम, 2004 में एतद्वारा , संशोधन किया जाना अनुमोदित करती है ।
उपर्युक्त अधिसूचना , इस अधिसूचना के सरकारी राजपत्र में प्रकाशित होने की तारीख से लागू होगी।
अनुसूची
महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38 ) की धारा 28 के खण्ड (बी) द्वारा सौंपे गए अधिकारों का उपयोग करते हुए मुम्बई पोर्ट कान्यासी मंडल कथित अधिनियम की धारा 124 की उप- धारा ( 1 ) की आवश्यकतानुसार केन्द्र सरकार के अनुमोदन से निम्न विनियम बनाता है। विनियम निम्न प्रकार हैं,-
1. संक्षिप्त शीर्षक एवं प्रारम्भ :
( 1 ) ये विनियम मुम्बई पोर्ट ट्रस्ट ( निवृत्ति वेतन निधि ) ( पहला संशोधन ) विनियम, 2006 कहलाए जाएं।
(2) भारत के राजपत्र में उनके प्रकाशन की तिथि से वे लागू होंगे।
2. विनियम 3 में " मृत्यु एवं सेवानिवृत्ति उपादान/उपादान अधिनियम , 1972 के तहत देय उपादान " ये शब्द हटा दिए जाएं ।
3. विनियम 5 में उप- विनियम ( बी) हटा दिया जाए।

4. वर्तमान विनियम 7 हटा दिया जाए और उसकी जगह निम्न का समावेश किया जाए-
"निधि में अधिकतम कितनी राशि संचित की जाए इसका निर्णय निवृत्ति वेतन- निधि के न्यासी समय- समय पर ( i ) निवृत्ति वेतन , ( ii ) परिवार पेन्शन , तथा ( iii ) सानुग्रह पेन्शन भुगतान के प्रति देयताओं के बीमांकिक मूल्य निर्धारण के आधार पर करेंगे। "
5. विनियम के " न्यासी, विलेख - मुम्बई पोर्ट ट्रस्ट निवृत्ति वेतन निधि " शीर्षक वाले अनुलग्नक के अनुच्छेद 8 और 9 हटा दिए जाएं।

टिप्पणी: - मुख्य विनियम को भारत सरकार ने दिनांक 21-5-2004 की अधिसूचना क्र. पीआर 12016 /24/ 2002- पीई-1 के जरिए मंजूरी दी और वे दिनांक 21-5-2004 के राजपत्र में सं. सा.का.नि 341 ( अ ) के तहत प्रकाशित किए गए।

NOTIFICATION
New Delhi , the 11th January , 2007
G.S.R. 17 (E) . In exercise of the powers conferred by Sub - section ( 1 ) of Section 124 , read with Sub - section (1) ofSection 132 of the Major Port Trusts Act, 1963 (38 of 1963 ) , the Central Government hereby approves the amendment to the Mumbai Port Trust (Pension Fund ) Regulations , 2004 made by the Board of Trustees of Mumbai Port Trust as set out in the Schedule annexed to this Notification .
The said Notification shall come into force from the date of publication of this Notification in the Official Gazette .
SCHEDULE
In exercise of the powers conferred by clause (b ) of Section 28 of Major Port Trusts Act, 1963 (38 of 1963 ) , the Board of Trustees of the Port of Mumbai , with the approval of the Central Government, as required by Sub - section ( 1 ) of Section 124 of the said Act, hereby makes the following regulations , namely,-
1. Short title and commencement :
(1) These regulations may be called the 'Mumbai Port Trust (Pension Fund) (First Amendment ) Regulations , 2006'.
(2) They shall come into force from the date of notification in the Official Gazette of India .
2. In regulation 3, the words " death - cum -retirement gratuity /gratuity payable under the Payment ofGratuity Act, 1972" be deleted .
3. In regulation 5 , sub -regulation (b) be deleted .
4. The existing regulation 7 be deleted and substituted with the following:
"The maximum amount that may be accumulated in the fund will be decided by the Trustees of Pension Fund Trust fromtimeto time on the basis of actuarial valuation of liabilities towards ( i ) pension, (ii ) family pension, (iii) ex-gratia pension payment, etc."
5. In the Annexure to the Regulations titled 'Trust Deed - Mumbai Port Trust Pension Fund ' paragraphs 8 and 9 be deleted.
