आदेश
नई दिल्ली, 12 जनवरी, 2007
सा.का.नि. 18( अ), केन्द्रीय सरकार आवश्यक वस्तु अधिनियम, 1955 ( 1955 का 10 ) की धारा 3 द्वारा प्रदत्त शक्तियों का उपयोग करते हुए , एतद्वारा मोटर स्पिरिट और उच्च वेग डीजल ( प्रदाय और वितरण का विनियमन और अनाचार निवारण ) आदेश , 2005 में संशोधन करने के लिए, निम्नलिखित आदेश करती है , अर्थात्:-
1. ( 1 ) इस आदेश का नाम मोटर स्पिरिट और उच्च वेग डीजल ( प्रदाय और वितरण का विनियमन और अनाचार निवारण ) संशोधन आदेश , 2007 है ।
(2) यह सरकारी राजपत्र में प्रकाशन की तारीख से प्रवृत्त होगा ।
2. मोटर स्पिरिट और उच्च वेग डीजल ( प्रदाय और वितरण का विनियमन और अनाचार निवारण ) आदेश , 2005 ( जिसे इसके बाद उक्त आदेश कहा गया है ) में खण्ड 2 में,-
(क) मद (क ) में " अभिप्रेत " शब्दों के बाद निम्नलिखित जोड़ा जाएगा , अर्थात्, - " मोटर स्पिरिट और उच्च वेग डीजल में मार्कर की उपस्थिति और/या"
( ख ) मद ( ङ) में " आईएस 1460 " अक्षरों और अंकों के बाद निम्नलिखित शब्द जोड़े जाएंगे , अर्थात्-
" और मार्कर के भी कोई चिन्ह अन्तर्विष्ट नहीं करता है" ,
(ग) मद ( च ) के बाद निम्नलिखित जोड़ा जाएगा , अर्थात्, -
" ( च1 ) " मार्कर " का अर्थ वह रासायनिक पदार्थ है जिसका केन्द्रीय सरकार द्वारा मिट्टी तेल और अन्य पेट्रोलियम उत्पादों में मिश्रण के लिए उनके विपथन या मोटर स्पिरिट या उच्च वेग डीजल की मिलावट को रोकने के उद्देश्य से समय- समय पर अनुमोदन किया जाता है, "
(घ) मद ( छ ) में " आईएस 2796 " अक्षरों और अंकों के बाद निम्नलिखित शब्द जोड़े जाएंगे , अर्थात्- " और मार्कर के भी कोई चिन्ह अन्तर्विष्ट नहीं करता है",

(ङ) मद (ङ) के बाद निम्नलिखित को डाला जाएगा , अर्थात्-
" ( ङ1 ) " परीक्षण किट " का अर्थ उपकरण के ऐसे सेट से है जिसका उपयोग मिट्टी तेल , मोटर स्पिरिट, उच्च वेग डीजल और अन्य पेट्रोलियम उत्पादों में मार्कर की उपस्थिति का निर्धारण करने के लिए किया जाता है "
(च) मद ( न ) में " किसी व्यौहारी " शब्दों के बाद " मार्कर और/या के चिन्ह होना " जोड़ा जाएगा।
(3 ) उक्त आदेश में खण्ड 8 में, -
(क ) " उत्पाद का नमूना तैयार करना " शीर्षक के स्थान पर " उत्पाद का नमूना तैयार करना और परीक्षण " शीर्षक प्रतिस्थापित किया जाएगा ,
(ख ) शीर्षक के बाद और उप- खण्ड ( 1 ) से पहले निम्नलिखित उप- खण्ड जोड़ा जाएगा , अर्थात्-
" ( 1 क ) खण्ड 7 के अंतर्गत प्राधिकृत अधिकारी परीक्षण किट में टैंक , नोजल , वाहन या वर्तन, जैसा भी मामला हो, में नमूना लेगा और इस बात की जांच करने के लिए परीक्षण किट की सहायता से उत्पाद का परीक्षण करेगा कि क्या उत्पाद में मार्कर के कोई चिन्ह हैं । यदि उत्पाद में ऐसे चिन्ह पाए जाते हैं, तो प्राधिकृत अधिकारी इसे तीन प्रतियों में दर्ज करेगा जिस पर उसके द्वारा याडीलर या परिवहनकर्ता या संबंधित व्यक्ति या उसके प्रतिनिधि , जैसा भी मामला हो , द्वारा संयुक्त रूप से हस्ताक्षर किए जाएंगे और वह इस प्रकार दर्ज किए जाने की एक प्रति डीलर या परिवहनकर्ता या संबंधित व्यक्ति या उसके प्रतिनिधि को देगा और एक अन्य प्रति संबंधित तेल कम्पनी , जैसा भी मामला हो , को देगा। "
(ग) उप- खण्ड ( 1 ) में " प्राधिकृत " शब्दों के बदले निम्नलिखित प्रतिस्थापित किया जाएगा , अर्थात्-
" जहां उत्पाद में उप - खण्ड ( 1 क ) के अंतर्गत मार्कर अंतर्विष्ट नहीं हैं, प्राधिकृत अधिकारी "

MINISTRY OF PETROLEUM AND NATURAL GAS ORDER
New Delhi , the 12th January , 2007
G.S.R. 18 (E) . In excrcise of the powers conferred by Section 3 of the Essential Commodities Act, 1955 ( 10 of 1955) , the Central Government hereby makes the following order to amend the Motor Spirit and High Speed Diesel (Regulation of Supply, Distribution and Prevention of Malpractices) Order , 2005, namely :-
1. (1) This Order may be called the Motor Spirit and High Speed Diesel (Regulation of Supply , Distribution and Prevention ofMalpractices) Amendment Order, 2007 .
(2) It shall come into force on the date of its publication in the Official Gazette .
2. In the Motor Spirit and High Speed Diesel (Regulation of Supply, Distribution and Prevention of Malpractices) Order , 2005 , (hereinafter referred to as the said order) , in clause 2 , -
(a) initem (a) , after the words ' means ' , the following shall be inserted, namely: -
"presence of marker in motor spirit and high speed diesel and/or "
(b) in item (e) , after the letters and figures ' IS 1460 ' , the following words shall be inserted , namely :-
"and also does not contain any traces of marker" ;
(c) after item (f) , the following shall be inserted, namely :-
'( f1 ) " marker " means a chemical substance approved by the Central Government from time to time for blending in kerosene and other petroleum products with the objective of preventing their diversion or adulteration of motor spirit or high speed diesel ; ' .
(d) in item (g), after the letters and figures ' IS 2796 ' , the following words shall be inserted , namely:--- "and also does not contain any traces of marker" ;
(e) after item (m) , the following shall be inserted, namely:-
'(m1) " test kit " means a set of equipment used to determine the presence of marker in kerosene , motor spirit , high speed diesel & other petroleum products ' ;:

(f) in item (t) , after the words ' dealer of ' , the words "having traces of marker and/or " shall be inserted .
(3) In the said order , in clause 8 ,--
(a) for the heading "sampling of product ", the heading " sampling of product and testing " shall be substituted.
(b) after the heading and before the sub- clause (1) , the following sub - clause shall be inserted, namely:-- "(1A) The authorized officer under clause 7 shall draw the sample from the tank, nozzle , vehicle or receptacle , as the case may be , in the test kit and test the product with the aid of test kit, to check whether the product contains any traces of marker . If such traces are found in the product, the authorized officer shall record the same in triplicate which shall be jointly signed by him and the dealer or transporter or concerned person or his representative, as the case may be , and give one copy of such recording to the dealer or transporter or concerned person or his representative and another copy to the oil company concerned, as the case may be" .
(c) in sub-clause ( 1 ) , for the words , "The authorized", the following shall be substituted, namely:- "Where the product does not contain marker under sub - clause (IA ), the authorized officer" .

सा.का.नि. 19( अ ), केन्द्रीय सरकार आवश्यक वस्तु अधिनियम , 1955 ( 1955 का 10 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, एतदद्वारा किरोसिन ( उपयोग पर निबंधन और अधिकतम कीमत नियतन ) आदेश , 1993 का और संशोधन करने के लिए निम्नलिखित आदेश करती है , अर्थात्-
1. ( 1 ) इस आदेश का नाम किरोसिन ( उपयोग पर निबंधन और अधिकतम कीमत नियतन ) ) संशोधन आदेश , 2007 है;
(2) यह राजपत्र में प्रकाशन की तारीख को प्रवृत्त होगा।
2. किरोसिन ( उपयोग पर निबंधन और अधिकतम कीमत नियतन ) आदेश , 1993 में ( इसके बाद इसे उक्त आदेश कहा जाएगा ) , खण्ड 2 में,-
(i ) मद ( छ ) के बाद, निम्नलिखित अन्तर्विष्ट किया जाएगा , अर्थात्,-
' (छक ) " मार्कर " कार अर्थ केन्द्रीय सरकार द्वारा समय- समय पर अनुमोदित वह रासायनिक पदार्थ है जो किरोसिन और अन्य पेट्रोलियम उत्पादों में मिश्रण के लिए है जिसका उद्देश्य मोटर स्पिरिट अथवा हाई स्पीड डीजल और अन्य पेट्रोलियम उत्पादों का विपथन अथवा मिलावट रोकना है ' ;
(ii ) मद ( ट ) के बाद निम्नलिखित अन्तर्विष्ट किया जाएगा , अर्थात्,-
'( टक ) " परीक्षण किट " का अर्थ है उपकरण का वह सैट , जिसका प्रयोग किरोसिन , मोटर स्पिरिट, हाई स्पीड डीजल और अन्य पेट्रोलियम उत्पादों में मार्कर की विद्यमानता निश्चित करने के लिए किया जाता है ' ;
3. उक्त आदेश में , खण्ड 8 के बाद, निम्नलिखित खण्ड अन्तर्विष्ट किया जाएगा , अर्थात्,-

" 8क. मार्कर के साथ मिश्रित किया जाने वाला किरोसिन--
( 1 ) भारत में बेचा गया सभी प्रकार का किरोसिन चाहे सार्वजनिक वितरण प्रणाली के अंतर्गत बिका अथवा समानान्तर विपणन प्रणाली के अंतर्गत , को मार्कर के पांच भाग प्रति मिलियन ( पीपीएम ) सान्द्रण की दर से मिश्रित किए जाएंगे , जिसका उद्देश्य अन्य पेट्रोलियम उत्पादों के साथ विपथन अथवा मिलावट को रोकना होगा। " [PART II-SEC . 3 (i) ) THE GAZETTE OF INDIA EXTRAORDINARY

(4 ) उक्त आदेश में , खण्ड 9 में उप- खण्ड ( क) में, मद ( iii ) में, " प्रक्रिया " शब्द के बाद निम्नलिखित अन्तर्विष्ट किया जाएगा , अर्थात् " किरोसिन में मार्कर के मिश्रण को निश्चित करने के लिए परीक्षण किट की सहायता से उत्पाद लेना और नमूने का परीक्षण करना।" ।

ORDER
New Delhi , the 12th January , 2007
G.S.R. 19 (E) . In exercise of the powers conferred by Section 3 of the Essential Commodities Act , 1955 (10 of1955) , the Central Government hereby makes the following order further to amend the Kerosene (Restriction on Use and Fixation of Ceiling Price) Order , 1993, namely:-
1. (1) This Order may be called the Kerosene (Restriction on Use and Fixation of Ceiling Price ) Amendment Order, 2007.
(2) It shall come into force on the date of its publication in the Official Gazette . 2. In the Kerosene ( Restriction on Use and Fixation of Ceiling Price ) Order , 1993 (hereinafter referred to as the said order) , in clause 2 ,-
(i) after item (g) , the following shall be inserted, namely
'(ga) " marker" means a chemical substance approved by the Central Government from time to time for blending in kerosene and other petroleum products with the objective of preventing their diversion or adulteration of motor spirit or high speed diesel and other petroleum products ' ;
(ii) after item (k ) , the following shall be inserted, namely:-
'(ka) " test kit " means a set of equipment used to determine the presence of marker in kerosene , motor spirit, high speed diesel and other petroleum products ' ;.
(3) In the said order , after clause 8, the following clause shall be inserted , namely :-
"8A. Kerosene to be blended with marker-All kerosene sold in India , whether under the public distribution system or parallel marketing system , shall be blended with marker at five parts per million (ppm) concentra- tion with the objective of preventing its diversion or adulteration of other petroleum products . " ( 4) In the said order, in clause 9 , in sub - clause ( a) , in item ( iii ), after the word "procedures " the following shall be added, namely :-
"draw and test samples of the product with the aid of test kit to determine blending of marker in kerosenc . " .
