का.आ. 38 (अ).-केन्द्रीय सरकार , राष्ट्रीय राजमार्ग अधिनियम, 1956 ( 1956 का 48 ) की धारा ४ क द्वारा प्रदत्त शक्तियों का प्रयोग. करते हुए राष्ट्रीय राजमार्ग के एक भाग का अर्थात् निर्माण , प्रचालन और अंतरण ( बीओटी ) स्कीम के अधीन पंजाब राज्य के जिला एसएएस नगर, मोहाली में कुराली के पास चण्डीगढ़ रोपड़ मार्ग ( राष्ट्रीय राजमार्ग संख्या 21 ) के 26.428 किलोमीटर पर लेवल क्रासिंग संख्या 32 /बी पर . दोलेन वाले रेल उपरि पुल ( जिले इसमें इसके पश्चात् पुल कहा गया है) के भाग के निर्माण अनुरक्षण प्रबन्ध और प्रचालन अंतर्वलित व्यय , विनिहित पूंजी पर ब्याज , विनिहित पूंजी पर युक्तियुक्त प्रत्यागम , यातायात परिमाण के संबंध में मैसर्स पर्ल्स बिल्डवेल इंफ्रास्ट्रक्चर लि. ( मैसर्स तातिया कंस्ट्रक्शन कम्पनी लि. का संयुक्त उपक्रम ) जिसका कार्यालय कुराली टॉलब्रिज कम्पनी प्राइवेट लिमिटेड एससीओ 76 , फेस 9 एसएएस नगर मोहाली , पंजाब में है , के साथ हुए करार की अवधि को ध्यान में रखते हुए अधिसूचित करती है कि इससे उपाबद्ध अनुसूची में विनिर्दिष्ट दरों पर पुल के उपयोग के लिए यांत्रिक यानों पर फीस उद्गृहीत और संदत्त की जाएगी और मैसर्स कुराली टॉलब्रिज कम्पनी प्राइवेट लिमिटेड ( मैसर्स पर्ल्स बिल्डवेल इफ्रास्ट्रक्चर लि. और मैसर्स तातिया कंस्ट्रक्शन कम्पनी लि. का संयुक्त उपक्रम ) या उसके प्राधिकृत विधिक प्रतिनिधि इस 'अधिसूचना के प्रकाशित होने की तारीख से 17 अक्तूबर, 2012 को समाप्त होने वाली रियायत अवधि तक उक्त अनुसूची में विनिर्दिष्ट दरों पर फीस संगृहीत. और उद्गृहीत करने के लिए प्राधिकृत करती है, अर्थात्:-

टिप्पण- इस अधिसूचना के प्रयोजन के लिए :

( 1 ) जब उसी यान को दिन में एक से अधिक बार उक्त पुल को पार करना हो तो उपयोक्ताओं को यह विकल्प होगा कि वह पहली बार में ही पुल को पार करते समय उपर्युक्त दरों के डेढ़ गुणा का संदाय करें और यदि यान को सम्पूर्ण मास या उससे भी अधिक अवधि के लिए लगातार और प्रायः बार - बार पुल का उपयोग करना पड़ता है तो यान का स्वामी ऊपर अनुसूची में यथाविनिर्दिष्ट उसको लागू 30 एकल दर के समतुल्य प्रभारों का संदाय करके मासिक पास प्राप्त कर सकता है ।
(2) निम्नलिखित प्रकारों के यानों को फीस से छूट दी जाती है , अर्थात्:-
(i) रक्षा यान या कार्मिक जो भारतीय पथकर ( सेना और वायु सेना ) अधिनियम , 1901 के अधीन हकदार है ;
(ii ) अतिविशिष्ट व्यक्ति प्रतीकों वाले यान;
(iii ) पुलिस यान;
(iv) अग्निशमन यान;
(v ) एबुलेंस;
(vi ) अन्त्येष्टि वैन;
(vii ) डाक और तार , तार विभाग के यान;
(viii) केन्द्रीय सरकार और राज्य सरकार के कार्यस्थ यान;
(3 ) शासकीय रूप से निम्नलिखित से संबंधित यान अतिविशिष्ट व्यक्ति प्रतीक वाले यान समझें जाएंगे : -
भारत के राष्ट्रपति , भारत के उपराष्ट्रपति , केन्द्रीय मंत्री और राज्य मंत्री , लोक सभा या राज्य सभा में विपक्ष के नेता , राज्य विधानमण्डल के ऐसे व्यक्ति जिन्हें कैबिनेट मंत्री का दर्जा प्राप्त है या राज्यपाल या उपराज्यपाल या कार्यपालक पार्षद या केन्द्रीय और राज्य विधान मण्डलों के अध्यक्ष या सभापति, भारत की शासकीय यात्रा पर आए विदेशी उच्च प्राधिकारी, भारत में ठहरे हुए विदेशी राजनायिक जो कार राजनायिक प्रतीकों (सीडी) वाली कारों का उपयोग करते हैं।
4. ऊपर वर्णित दरें, पथकर स्टेशन के आस - पास किसी बोर्ड/बोडों पर सहज दृश्य रूप से संप्रदर्शित की जाएगी , जो चालक सीट से पढ़ने योग्य होने चाहिए। मैसर्स कुराली टॉलब्रिज कम्पनी प्राइवेट लिमिटेड या इसके प्राधिकृत विधिक प्रतिनिधि , संदायकर्ता को, इस अधिसूचना के अधीन , प्रत्येक अवसर पर फीस की वसूली की प्राप्ति रसीद देंगे ।

NOTIFICATION
New Delhi , the 12th January , 2007
S.O. 38 (E) . In exercise of the powers conferred by Section 8A of the National High Ways Act, 1956 ( 48 of 1956) , the Central Government having regard to the expenditure involved in building , maintenance , management and operation of the part of the National Highway, that is two lane Railway Over Bridge ( hereinafter referred to as the bridge ) at Level Crossing No. 32/B near Kurali on Chandigarh ---Ropar Road (National Highway -21 ) at km. 26.428 , District SAS Nagar, Mohali in the State of Punjab under Build , Operate and Transfer (BOT) Scheme , interest on the capital invested , reasonable return on the capital invested , the volume of traffic and the period of agreement entered into with M/s . Pearls Buildwell Infrastructure Limited. , (Joint Venture with M/s . Tantia Construction Company Limited) having its office at Kurali Toll Bridge Company Private Limited , S.C.O. 76, Phase 9 , SAS Nagar , Mohali , Punjab , hereby notifies that there shall be levied and paid fees on mechanical vehicles for the use of the bridge at the rates specified in the Schedule annexed hereto and hereby authorises the Kurali Toll Bridge Company Private Limited, ( Joint Venture of M/ s . Pearls Buildwell Infrastructure Limited, and M/s. Tantia Construction Company I imited) as authorised legal representative to collect and retain fees at the rates specified in the said Schedule from the date of publication of this notification in the Official Gazette till the concession period is over on the 17th day of October , 2012 , namely :---

4. Other mechanically propelled vehicles not mentioned in Serial number 1, 2 or 3 such as mobile crane dozers , earthmovers , road rollers , etc. , loaded or unloaded.
Notes : For the purpose of this notification:
(1) When the same vehicle has to cross the bridge more than once in a day, the users have the option to pay one and half times the above rates while crossing the bridges in the first trip itself, and if the vehicle has to use the bridge continuously and quite frequently for entire month or even beyond that, for much long period , the vehicle owner can have a monthly pass on the payment of charges equal to 30 single rates applicable to it as specified in the above schedule.
(2) The following types of vehicles are exempted from the fee , namely:-
(i) Defence Vehicles or personal as entitled under Indian Tolls (Army and Air Force) Act , 1901;
(ii) Vehicles with Very Important Person symbols;
Police Vehicles;
(iii)
(iv) Fire Fighting Vehicles ;
(v) Ambulances;
(vi) Funeral Van;
(vii) Post and Telegraph Department Vehicles ;
(viii) Central and State Government Vehicles on Duty.
(3) The vehicles officially belonging to the following shall be deemed to be vehicles having Very Important Person Symbol :
President of India, Vice President of India, Central and State Minister , Leader of Oppositions in Lok Sabha or Rajya Sabha, State Legislatures having the status of Cabinet Ministers or Governors or Lieutenant Governors , Executive Councillors or Speakers or Chairman of Central and State Legislatures , Foreign dignitaries on State visit of India , Foreign Diplomats stationed in India using cars with Car Diplomatic (CD) symbols .
(4). The above mentioned rates shall be conspicuously displayed on a Board/s in the vicinity of the Toll Station, which should be readable from driver's seat . M/s Kurali Toll Bridge Company Private Limited or its authorised legal representative shall pass a receipt to the payer on each and every occasion of recovery of fee under this notification.
