सा.का.नि. 29( अ.).-केन्द्रीय सरकार, जल ( प्रदूषण निवारण तथा नियंत्रण ) अधिनियम, 1974 ( 1974 का 6 ) की धारा 63 की उप- धारा (2 ) के खंड ( ङ ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और अध्यक्ष , केन्द्रीय प्रदूषण नियंत्रण बोर्ड भर्ती नियम , 2006 को उन बातों के सिवाय अधिक्रान्त करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप, किया गया है प्रदूषण नियंत्रण बोर्ड ने अध्यक्ष की सेवा के निबंधनों और शर्तों का विनियमन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम अध्यक्ष , केन्द्रीय प्रदूषण नियंत्रण बोर्ड भर्ती नियम , 2006 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. उक्त पदों की संख्या , उनका वर्गीकरण और उनका वेतनमान वह होगा , जो इन नियमों से अनुबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट है ।
3. अध्यक्ष , केन्द्रीय प्रदूषण नियंत्रण बोर्ड के पद की भर्ती की पद्धति, आयु सीमा, शैक्षणिक योग्यताएं, वेतन , भत्ते, छुट्टी और सेवा की अन्य शर्तें आदि-
( 1 ) अध्यक्ष का वेतनमान वह होगा जो अनुसूची के स्तंभ 4 निर्दिष्ट है ।
( 2 ) केन्द्रीय सरकार के अधीन तत्समान वेतनमान के पदों को धारण करने वाले किसी अधिकारी को लागू तत - समय प्रवृत्त नियम और आदेश बोर्ड के अध्यक्ष के भत्तों, छुट्टी, कार्य ग्रहण अवधि, कार्यग्रहण अबधि वेतन , भविष्य निधि , उपदान अधिवर्षिता की आयु , सेवा निवृत्ति सुविधाएं, चिकित्सा सुविधाएं और सेवा की अन्य शर्तों की बाबत सेवाओं की शर्तों का विनियमन करेंगे ।
4. भर्ती की पद्धति , आयु सीमा, शैक्षिक योग्यताएं आदि. भर्ती की पद्धति, आयु -सीमा और शैक्षिक योग्यताएं वे होंगी जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।
5. निरर्हता.-वह व्यक्ति,-
(क) जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है; या
(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए , किसी व्यक्ति से विवाह किया है ,
उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा :
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति या विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
6. शिथिल करने की शक्ति, जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।
7. व्यावृत्ति. इन नियमों की कोई बात, ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय -समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों और अन्य पिछड़े वर्गों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

(ख ) निम्नलिखित शैक्षणिक अर्हताएं और अनुभव रखता हो -
(i ) पर्यावरण से संबद्ध भौतिक विज्ञान में स्नातकोत्तर डिग्री/पर्यावरण से संबद्ध किसी विधा में इंजीनियरिंग में डिग्री ।
(ii) सरकारी /विभाग/संस्थाओं/सार्वजनिक के क्षेत्र उपक्रमों/विश्वविद्यालयों/मान्यता प्राप्त अनुसंधान संस्थानों /स्वायत्तशासी या अर्द्ध सरकारी या सांवैधानिक संगठनों या अन्य गैर सरकारी निकायों में पर्यावरणीय संरक्षण से संबंधित मामलों में व्यावहारिक अनुभव अथवा ऐसे मामलों में व्यवहार करने का प्रशासनिक संस्थाओं में प्रबंधक स्तर पर 18 वर्ष का अनुभव

पर्यावरण से संबंधित फिजिकल साइंस में पी.एच.डी/पर्यावरण से संबंधित विधा में, इंजीनियरिंग में एम.टेक
टिप्पण: - केन्द्रीय सरकार के अनुरुप अथवा अन्य विभाग/ संगठन में इस नियुक्ति के तुरंत पूर्व अन्यं बाह्य संवर्ग पदों पर प्रतिनियुक्ति की अवधि सहित प्रतिनियुक्ति की अवधि सामान्य रुप से 3 वर्ष से अधिक नहीं होगी ।
प्रतिनियुक्ति के लिए अधिकतम आयु सीमा आवेदन पत्र की प्राप्ति की अंतिम तारीख से 56 वर्ष से अधिक नहीं होगी ।

NOTIFICATION
New Delhi , the 17th January, 2007
G.S.R. 29( E) . In exercise of the powers conferred by clause (e) of sub- section 2 of section 63 of the Water ( Prevention and Control of Pollution ) Act , 1974, (6 of 1974) and in supesession of the Chairman , Central Pollution Control Board Recruitment Rules , 2006, except as respects things done or omitted to be done before such supersession , the Central Government hereby makes the following rules for regulating the terms and conditions of service of the Chairman in the Central Pollution Control Board namely: -
1. Short title and commencement:-( 1 ) These rules may be called the Chairman Central Pollution Control Board Recruitment Rules , 2006.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of the said posts , their classification and the scale of pay attached thereto shall be as specified in columns 2 to of the Schedule annexed to these rules.
3. Method of recruitment, age limit , qualification , pay, allowances , leave and other conditions of service etc of Chairman Central Pollution Control Board -
(1) The scale of pay of Chairman shall be as specified in column 4 of Schedule.
(2) The rules and orders for the time being in force applicable to an officer holding posts of the corresponding scale of pay under the Central Government , shall regulate the conditions of service in respect of allowance , leave, joining time, joining time pay , provident fund, gratuity , age of superannuation , retirement benefits , medical facilities and other conditions of service of the Chairman of the Board.
4. Method of recruitment , age limits , qualification etc:-The method of recruitment, age limit, qualification and other matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule
5. Disqualification: - No Person,
( a) who has entered into or contracted a marriage with a person having a spouseliving, or
( b) who having a spouse living has entered into or contracted a marriage with any person ,
shall be eligible for appointment to the said post .
Provided that the Central Government may, if satisfied that such marriage permissible under personal law applicable to such person or the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .
6. Power to relax: Where the Central Government is of the opinion that it is necessary or expedient to do so , it mayby order for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class of category of persons .
7 Saving: - Nothing in these rules shall affect reservation , relaxation of age limit and other concessions required to be provided for Schedule Caste/ Schedule Tribe/Other Backward Classes /Ex - Servicemen and other special categories of persons in accordance with the orders issues by the Central Government from time to time in this regard .
