का.आ. 79( अ).-जबकि औद्योगिक विवाद अधिनियम, 1947 की धारा 2 ( त ) , धारा 12 ( 3 ) और धारा 18 के उपबंधों के अनुसार कांडला डॉक लेबर बोर्ड को अंततः कांडला पत्तन न्यास में मिला दिए जाने के बारे में कांडला डॉक लेबर बोर्ड के कर्मकारों और कांडला पत्तन न्यास के प्रबंधन के बीच एक समझौता हो गया है ।
2. अतः , अब, डॉक कर्मकार ( नियोजन का विनियमन) (महापत्तनों पर लागू न होना ) अधिनियम , 1997 ( वर्ष , 1997 के अधिनियम सं. 31 ) की धारा 4 के साथ पठित धारा 3 द्वारा प्रदत्त अधिकार प्रयुक्त करके , केन्द्रीय सरकार , एतद्वारा , यह निदेश देती है कि डॉक कर्मकार ( नियोजन का विनियमन ) अधिनियम , 1948 ( वर्ष , 1948 के अधिनियम सं. 9 ) के उपबंध, वर्ष , 2007 के जनवरी माह के 24 वें दिन से कांडला पत्तन पर लागू नहीं होंगे ।

NOTIFICATION
New Delhi , the 24th January, 2007
S.O. 79 (E). Whereas a settlement has been arrived atbetween the Kandla Dock Labour Board, its workmen and the management of Kandla Port Trust for eventual merger of Kandla Dock Labour Board with Kandla Port Trust, in accordance with the provisions of Section 2(p) , Section 12(3) and Section 18 of the Industrial Disputes Act, 1947.
2.Now, therefore, in exercise ofthe powers conferred by Section 3 , read with Section 4, of the Dock Workers' (Regulation of Employment) (Inapplicability to Major Ports)Act, 1997 (No. 31 of 1997) , the Central Government hereby directs that the provisions of the Dock Workers ' (Regulation of Employment ) Act, 1948 (9 of 1948 ) shall cease to have effect in relation to the Port of Kandla with effect from 24th day of January, 2007.
