का.आ. 95 (अ).-केन्द्रीय सरकार ने, भारत के तत्कालीन सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना सं. का.आ. 919 ( अ) , तारीख 28 अगस्त, 2002 द्वारा भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 ( 1988 का 68 ) की धारा 31 की उप- धारा ( 1 ) के अधीन भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को राष्ट्रीय राजमार्ग सं 8 के 366.20 कि.मी. से 396 कि.मी. तक ( किशनगढ़ - अजमेर खंड ) और 0 कि.मी. से 263/500 कि.मी. तक ( अजमेर - उदयपुर खंड ) के भूखंडों का प्रबंध अधिसूचना के प्रकाशन की तारीख अर्थात्, 28 अगस्त, 2002 से पांच वर्ष की अवधि के लिए राजस्थान की ,राज्य सरकार को सौंपने के लिए निदेश जारी किया था।
2. और, उक्त भूखंडों को उक्त निदेश के अनुसरण में भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा राजस्थान सरकार को सौंप दिया गया है।
3. और, केन्द्रीय सरकार की यह राय है कि निर्निहितीकरण की अवधि को कम करना और राष्ट्रीय राजमार्ग सं. 8 के 366.20 कि.मी. से 396.00 कि.मी. तक ( किशनगढ़ - अजमेर खंड ) अर्थात्, केवल 366.200 कि.मी. से 377.00 कि.मी. तक के विस्तार तक के भूखंड के एक भाग के प्रबंध को नियंत्रण में लेने के लिए भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को निदेशित करना लोकहित में आवश्यक और समीचीन है ।
4. अतः , अब , केन्द्रीय सरकार , उक्त अधिनियम की धारा 31 की उप - धारा ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निर्निहितीकरण की अवधि को कम करती है और यह निदेश करती है कि भारतीय राष्ट्रीय राजमार्ग प्राधिकरण इसके पश्चात् राष्ट्रीय राजमार्ग सं. 8 के 366.20 कि.मी. से 396.00 कि.मी. तक ( किशनगढ़- अजमेर खंड ) के भूखंड में से 366.200 कि.मी. से 377.00 कि.मी. तक के भूखंड को नियंत्रण में लेगा और उक्त अधिनियम के उपबंधों के अनुसार उसके संबंध में शक्तियों का प्रयोग और कृत्यों * का पालन करेगा ।

NOTIFICATION
New Delhi , the 31st January, 2007
S.O. 95 (E) . Whereas , by notification of the Government of India in the erstwhile Ministry of Road Transport andHighways number $ .O . 919 (E) , dated the 28th August , 2002, the Central Government had issued a direction to the National Highways Authority of India under Sub - section (1 ) of Section 31 of the National Highways Authority of India Act, 1988 (68 of 1988 ) to entrust the management of the stretches from Km. 366.20 to Km. 396.00 (Kishangarh-Ajmer Section) and from Km . 0 to Km. 263/500 (Ajmer- Udaipur Section) of National Highway No. 8 to the State Government of Rajasthan for a period of five years from the date of publication of notification i.e. , the 28th August, 2002 .
2. And, whereas , the said stretches have been entrusted to the Government of Rajasthan by the National Highways Authority of India in pursuance of the said direction.
3.And, whereas , the Central Government is of the opinion that in the public interest , it is necessary and expedient to reduce the period of divestment and direct the National Highways of India to take control of the management of a part of the stretch from Km. 366.20 to Km. 396.00 (Kishanagarh-Ajmer Section ) i.e. , to the extent of Km. 366.200 to Km. 377.00 only ofthe National Highway No. 8.
Now, therefore , in exercise of the powers conferred by Sub - section (3) of Section 31 of the said Act , the Central Government hereby reduces the period of divestment and directs that the National Highways Authority of India shall hereafter take control of the stretch from Km . 366.200 to 377.00 out of the stretch from Km. 366.20 to Km . 396.00 (Kishangarh-Ajmer Section ) ofNational Highway No. 8 and in exercise ofthe powers and perform functions in respect thereof, in accordance with the provisions of the saidAct .
