सा.का.नि. 59(अ).-कीटनाशी अधिनियम, 1968 की धारा 5 के अधीन गठित रजिस्ट्रीकरण समिति ने देश में कीटनाशकों के सतत उपयोग या अन्यथा का पुनर्विलोकन करने के लिए एक विशेषज्ञ समूह गठित किया था;
और केन्द्रीय सरकार ने उक्त विशेषज्ञ समिति की सिफारिशों पर विचार करने और कीटनाशी अधिनियम , 1968 ( 1968 का 46 ) के अधीन गठित रजिस्ट्रीकरण समिति से परामर्श करने के पश्चात् यह संतुष्ट हो जाने पर कि फैनिट्रोथियोंन के उपयोग का मनुष्यों के साधारण स्वास्थ्य और पर्यावरण के लिए परिसंकटमय है;
अतः , अब, केन्द्रीय सरकार, कीटनाशी अधिनियम, 1968 ( 1968 का 46) की धारा 28 के साथ पठित धारा 27 की उप- धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित आदेश करने का प्रस्ताव करती है , अर्थात्: -
प्रारूप आदेश
1. ( 1) अनुसूचित मरुभूमि क्षेत्र में टिड्डी के नियंत्रण और लोक स्वास्थ्य के सिवाय कृषि में फैनिट्रोथियोन के उपयोग की पाबंदी होगी।
(2) यह राजपत्र में अंतिम प्रकाशन की तारीख को प्रवृत्त होगा।
(3 ) फैनिट्रोथियोन के लिए अनुदत्त रजिस्ट्रीकरण प्रमाण- पत्रों को रजिस्ट्रीकरण समिति द्वारा सभी रजिस्ट्रीकृत व्यक्तियों से जिसके अंतर्गत नए रजिस्ट्रीकृत व्यक्ति भी हैं, लेबलों और पत्रकों पर " कृषि में उपयोग पर पाबंदी " स्पष्ट अक्षरों में चेतावनी की अपेक्षा को शामिल करने के लिए वापिस मांगे जाएंगे।
(4) उन रजिस्ट्रीकृत व्यक्तियों के बारे में जो अधिसूचना के अंतिम प्रकाशन की तारीख से छः मास के भीतर इस आदेश के अनुसार रजिस्ट्रीकरण प्रमाण- पत्र वापिस नहीं करते हैं तो कीटनाशी अधिनियम की धारा 13 के. अधीन अनुदत्त की गई अनुज्ञाप्तियां नवीनीकृत नहीं की जाएंगी या उक्त अधिनियम की धारा 14 के संबंध में कार्रवाई की जाएगी ।

2. प्रत्येक राज्य सरकार उक्त अधिनियम और उसके अधीन बनाए गए नियमों के सुसंगत उपबंधों के अधीन ऐसे उपाय करेगी, जो इस आदेश के निष्पादन के लिए वह करना आवश्यक समझे।
3. प्रारूप आदेश को , जो केन्द्रीय सरकार प्रस्तावित करती है, ऐसे सभी व्यक्तियों की जानकारी के लिए जिसके उससे प्रभावित होने की संभावना है, प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप आदेश पर उस तारीख से, जिसको इस आदेश की भारत के राजपत्र की प्रतियां जनता को उपलब्ध करा दी जाती हैं, पैंतालीस दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा।
4. उक्त प्रारूप आदेश के संबंध में, कोई व्यक्ति, किसी सुझाव या आक्षेप करने की वांछा करता है तो उनको इसके लिए विनिर्दिष्ट अवधि के भीतर केन्द्रीय सरकार द्वारा विचार करने के लिए संयुक्त सचिव ( पौध संरक्षण ) , कृषि मंत्रालय ( कृषि और सहकारिता विभाग ) कृषि भवन, नई दिल्ली को भेजा जा सकेगा ।

NOTIFICATION
New Delhi, the 1st February, 2007
G.S.R. 59 (E) . Whereas the Registration Committee constituted under Section 5 of the Insecticides Act, 1968 had constituted an Expert Group to review the continued use or otherwise of pesticides in the country;
Andwhereas the Central Government, after considering the recommendations of the said Expert Group and after consultation with the Registration Committee set up under the Insecticides Act, 1968 (46 of 1968) is satisfied that the use of Fenitrothion involves health hazards to human beings and environment ;
Now, therefore, in exercise of the powers conferred by Sub - section (2) of Section 27 read with Section 28 of the Insecticides Act, 1968 (46 of 1968 ) , the Central Government hereby proposes to make the following Order , namely :--
DRAFT ORDER
1. (1) The use of Fenitrothion shall be banned in agriculture except for locust control in scheduled desert area and public health.
(2) It shall come into force on the date of publication of the final notification.
(3) The Certificates of Registration granted for Fenitrothion shall be called back by the Registration Committee from all registrants including new registrants for incorporation of the requirement of the warning in bold letters "BANNED FOR USE ON AGRICULTURE " on labels and leaflets .
(4) Inrespect of those registrants who do not return the registration certificate , as per this Order within a period of six months w.e.f. the date of publication of final notification, their licence granted under Section 13 of the Insecticides Act shall not be renewed or action under Section 14 of the said Act will be taken.
2. Every State Government shall take all such steps under the relevant provisions of the said Act and the rules made thereunder , as it considers necessary for the execution of this Order in the State.
3. The draft Order , which the Central Government proposes to make, is hereby published for information of all persons likely to be affected thereby; and notice is hereby given that the said draft Order shall be taken into consideration after the expiry of a period of forty- five days from the date on which the copies of the Gazette of India containing this Order are made available to the public .
4. Any person desirous of making any suggestion or objection in respect of the said draft Order may forward the same for consideration of the Central Government within the period so specified to the Joint Secretary (Plant Protection), Ministry of Agriculture , Department ofAgriculture & Cooperation, Krishi Bhavan, New Delhi .
