का.आ. 138( अ ) - चूंकि केंद्र सरकार को मै. आयल एंड नेचुरल गैस कार्पोरेशन लिमिटेड, डीजीएम ( वेल्स) , लॉगिंग सर्विसेज, मुंबई क्षेत्र , पहली मंजिल , 11 हाई बिल्डिंग , बान्द्रा - सियोन लिंक रोड , मुंबई - 400017 से तेल निकालने के प्रयोग के लिए यू.एस.ए. से हवाई जहाज द्वारा कुछ विशेष विस्फोटकों को आयात करने की अनुमति हेतु पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन (पीईएसओ ) में एक प्रस्ताव प्राप्त हुआ है
और चूंकि पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन (पीईएसओ) संतुष्ट है कि विस्फोटकों के प्रस्तावित आयात का उपयोग , तेल खोज प्रयोजन में किया जाएगा और , इसलिए विस्फोटक नियमावली , 1983 ( इसे यहां उक्त नियमावली कहा गया है ) के नियम 31 के उप- नियम (2) के दायरे से आवश्यक छूट प्रदान की जा सकती है , जिसके तहत यहां विनिर्दिष्ट किए गए विस्फोटकों का हवाई जहाज द्वारा आयात अथवा निर्यात निषिद्ध है;
और जबकि नागर विमानन महानिदेशक ने वायुयान ( खतरनाक वस्तुओं का वहन) नियमावली, 2003 के नियम 3 के उप- नियम ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए अपने परमिट सं . 394-डीजी /2006 दिनांक 15 नवम्बर , 2006 द्वारा जो कि 15 मई , 2007 तक वैध है , इस प्रकार के विस्फोटकों को वायु मार्ग द्वारा ले जाने के लिए मैं . आयल एंड नेचुरल गैस कार्पोरेशन लिमिटेड , मुंबई को कतिपय शर्तों के साथ आवश्यक अनुमति प्रदान की है ।
अतः अब विस्फोटक अधिनियम , 1884 (1884 का 4) की धारा 14 की उप-धारा (2) द्वारा प्रद शक्तियों का प्रयोग करते हुए तथा पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन ( पीईएसओ ) और नागर विमानन महानिदेशक द्वारा की गईं सिफारिशों के आधार पर केन्द्र सरकार एतद्वारा. मै . आयल एंड नेचुरल गैस कार्पोरेशन लिमिटेड , मुंबई को मै . हैलीबर्टन एनर्जी सर्विसेज इंक , जेट

रिसर्च सेंटर डिवीजन , एक्सप्लोसिव प्रोडक्ट्स सेंन्टर , 8432 , साउथ I एच-35 वेस्ट अल्वाराडो, टेक्सास - 76009-9775 संयुक्त राज्य अमेरिका से मुंबई हवाई पर निम्नलिखित विस्फोटकों का वायुमार्ग द्वारा आयात करने के लिए उक्त नियमावली के नियम 31 के उप- नियम (2 ) के उपबंधों से छूट देती है जिसकी मदों और मात्राओं को नीचे दी गई तालिका में विनिर्दिष्ट किया गया है , नामतः

2. उक्त सारणी में उल्लिखित विस्फोटकों का आयात निम्नलिखित शर्तों के अध्यधीन होगा, नामतः: -
( 1 ) नागर विमानन महानिदेशक और भारतीय हवाई अड्डा प्राधिकरण से आवश्यक स्वीकृति प्राप्त की जाएगी और उनके द्वारा लगाई गई शर्तों, यदि कोई हों , का पालन किया जायेगा ;
(2) 1 जनवरी , 1996 से लागू हुई अन्तरराष्ट्रीय वायु परिवहन एसोसिएशन खतरनाक माल विनियमावली के 37वें संस्करण की धारा 3 के 3.1 के तहत आने वाले प्रथम श्रेणी के विस्फोटकों से संबंधित प्रभाग के प्रभाग 1.4 के ही अनुरूप विस्फोटकों का आयात किया जायेगा ;
(3) ( नियम 31 के उपनियम ( 2 ) के अलावा) उक्त नियमों में यथा निहित विस्फोटकों के कब्जे, परिवहन , प्रयोग और आयात से संबंधित सुसंगत उपबंधों का पालन किया जायेगा ;
(4) उक्त नियमों के अधीन लाइसेंसशुदा विस्फोटक सामग्री के वाहनों की पर्याप्त संख्या हवाई अड्डे पर तैयार रखी जायेगी ताकि विस्फोटक सामग्री को , वायुयान के उतरते ही शीघ्रता से हटाया जा सके ;
(5 ) वायुयान को हवाई अड्डे पर दूरस्थ स्थान पर खड़ा किया जायेगा और विस्फोटकों का वायुयान से वाहन में अंतरण शुरू होने से पहले महानिदेशक , नागर विमानन से परामर्श करके पर्याप्त संख्या में सुरक्षा गार्डों का प्रबंध करके वायुयान और विस्फोटक सामग्री वाहन के चारों ओर कम से कम 500 वर्गमीटर क्षेत्र को घेर लिया जायेगा । उक्त व्यवस्था तब तक बनी रहेगी जब तक कि अन्तरण पूरा नहीं हो जाता और अच्छी तरह से बन्द वाहन उक्त स्थान से रवाना नहीं हो जाता ;

(6) घिरे हुए क्षेत्र के अन्दर कोई धूम्रपान अथवा खुली बत्ती के उपयोग की अनुमति नहीं होगी ; तथा
(7) उपर्युक्त विस्फोटक सामग्री को ले जा रहे वाहन उक्त नियमों के अधीन लाइसेंसयुक्त भण्डारण मैगजीन की ओर अग्रसर होगें और रास्ते में कोई अनुचित विलम्ब नहीं किया जायेगा और विस्फोटकों के परिवहन के दौरान उक्त नियमों के सभी उपबंधों और स्थानीय यातायात नियमों और नगर पालिका के विनियमों , यदि कोई हों, का पालन किया जायेगा ।

NOTIFICATION
New Delhi , the 7th February, 2007
S. O. 138 (E ). Whereas the Central Government has received a proposal made by M/s . Oil and Natural Gas Corporation Limited, DGM (Wells) , Logging Services , Mumbai Region , 1st Floor , 11. High Building , Bandra - Sion Link Road, Mumbai - 400 017 to the Petroleum and Explosivės Safety Organisation ( PESO ) for permission to import certain Explosives by air from United States of America for oil exploration purposes ;
And, whereas the Petroleum and Explosives Safety Organisation (PESO) is satisfied that the proposed import of explosives shall be used for oil exploration purposes and , therefore , exemption from the provision of sub -rule (2) of rule 31 of the Explosives Rules , 1983 ( hereinafter referred to as the said rules ) is necessary as the provisions of that sub - rule prohibit import or export of explosives specified herein by air ;
And, whereas the Director General of Civil Aviation has , in exercise of the powers conferred by sub- rule ( 1 ) of rule 3 of the Aircraft (Carriage of Dangerous Goods) Rules , 2003 , granted necessary permission with certain conditions to M/ s . Oil and Natural Gas Corporation Limited , Mumbai to carry such explosives by air vide their permit number 394- DG/2006 dated the 15th November , 2006 which is valid upto the 15th May, 2007;
Now, therefore , in exercise of the powers conferred by sub - section (2 ) of section 14 of the Explosives Act, 1884 (4 of 1884) , and on the recommendations made by the Petroleum and Explosives Safety Organisation (PESO) and the Director General of Civil Aviation, the Central Government hereby exempts M/ s . Corporation Limited , Mumbai from the provisions of sub - rule (2 ) of rule 31 of the said rules , for import of the following explosives , the items and quantities of which are specified in the Table below , by air from M/s Halliburton Energy Services Inc , Jet Research Centre Division , Explosive Products Centre , 8432 , South IH - 35 , West Alvarado , Texas 76009-9775 , United States of America at Mumbai airport , namely: -

2. The explosives mentioned in the Table shall be imported subject to the following conditions , namely: -
(1 ) necessary clearances are obtained from the Director General of Civil Aviation and the Airports Authority of India and conditions , if any , imposed by the said authorities shall be complied with ;
(2) explosives conforming only to Division 1.4 relatingto class 1. Explosives falling under 3.1 of section 3 of International Air Transport Association Dangerous Goods Regulations , 37th Edition , which became effective on the 1st January , 1996 , shall be imported;
(3) strict compliance with the relevant provisions relating to the possession , transport, use and import of explosives , ( except sub - rule ( 2 ) of rule 31 ) of the said rules ;
(4) requisite number of explosives vans , licensed under the said rules , shall be kept ready at the airport so that the explosives can be removed expeditiously from the aircraft after its landing ;
(5) aircraft shall be parked at a remote place at the airport and an area of at least five hundred square metres around the aircraft and the explosives van shall be cordoned off by providing adequate number of security guards in consultation with the Director General of Civil Aviation before the transfer of explosives from aircraft to van begins . The arrangement shall continue till such transfer is completed and the van is duly locked and leaves the site ;
(6) smoking or use of naked light shall not be permitted within the cordoned area ; and (7) vans carrying the explosives shall proceed to the storage magazine licensed under the said rules and no undue delay shall be made on the way and all provisions of the said 5

rules and local traffic rules and municipal regulations , if any , shall be complied with during the transportation of the explosives .

2. उक्त सारणी में उल्लिखित विस्फोटकों का आयात निम्नलिखित शर्तों के अध्यधीन होगा , नामतः:-
