सं. टीएएमपी/8 /2003- सीएचपीटी. महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38 ) की धारा 48 , के द्वारा प्रदत्त शक्तियों काप्रयोग करते हुए, महापत्तन प्रशुल्क प्राधिकरण एतद्वारा , संलग्न आदेशानुसार , चेन्नई पत्तन न्यास पर स्टीवडोरिंग गतिविधियों के लिए लेवी की वैधता का 31 मार्च , 2007 तक, विस्तार करता है ।

चेन्नई पत्तन न्यास (सीएचपीटी ) पर स्टीवडोरिंग गतिविधियों के लिए लेवी के संशोधन के संबन्ध में, इस प्राधिकरण ने दिनांक 22 अक्तूबर, 2003 को एक आदेश पारित किया था । यह आदेश दिनांक 7 नवंबर, 2003 को भारत के राजपत्र में अधिसूचित किया गया था । 2.1 . अनुमोदित दरों की दो साल अवधि की वैधता , दिनांक 6 नवम्बर , 2005 को समाप्त हो चुकी है ।
2.2. अपने दरमान में सामान्य संशोधन प्रस्ताव से संबन्धित प्रशुल्क प्रकरण की कार्यवाही में सीएचपीटी ने यह प्रस्तावित किया था कि वह स्टीवडोरिंग गतिविधियों के लिए लेवी की समीक्षा हेतु , उपयोक्ताओं के साथ परामर्श करने के बाद , एक अलग प्रस्ताव दाखिल करेगा और उसने तब तक अक्तूबर 2003 में अनुमोदित दरों को जारी रखने की अनुमति का अनुरोध किया था। इस प्राधिकरण ने 7 नवंबर 2005 से प्रभावी, एक साल की अवधि के लिए स्टीवडोरिंग लेवी की वैधता को विस्तारित किया था और दिनांक 7 मार्च , 2006 के आदेश द्वारा , सीएचपीटी को 31 जुलाई , 2006 तक अपना प्रस्ताव दाखिल करने का निदेश दिया था । विस्तारित अवधि की वैधता 6 नवंबर , 2006 को समाप्त हो चुकी है ।
3. सीएचपीटी ने अपने पत्र दिनांक 5 जनवरी , 2007 द्वारा यह रिपोर्ट किया है कि वह प्रस्ताव पर उपयोक्ताओं के साथ परामर्श में है और जल्दी ही प्राधिकरण के सामने प्रस्ताव दाखिल करेगा । सीएचपीटी ने यह भी अनुरोध किया है कि स्टीवडोरिंग लेवी की वैधता को 31 मार्च, 2007 तक विस्तार किया जाए ।

4. यह प्राधिकरण सीएचपीटी के अनुरोध से सहमत होने के लिए इच्छुक है तथा अक्तूबर 2003 , जैसा कि आदेश संख्या टीएएमपी/63 /2004- सीएचपीटी दिनांक 25 जनवरी , 2007 द्वारा स्पष्ट किया गया है, में अनुमोदित स्टीवडोरिंग की गतिविधियों के लिए लेवी की वैधता , 7 नवंबर , 2006 से विस्तारित किया हुआ समझा जाएगा और 30 जून , 2007 तक अथवा अधिसूचित होने वाले संशोधित दरों के कार्यान्वयन की प्रभावी तिथि तक , इनमें से जो भी पहले हो वैध रहेगा। सीएचपीटी को यह निदेश दिया जाता है कि भारत के राजपत्र में इस आदेश की " अधिसूचना की तिथि से 15 दिनों के भीतर , स्टीवडोरिंग की गतिविधियों के लिए लेवी की समीक्षा हेतु अपने प्रस्ताव को दाखिल करे।

TARIFF AUTHORITY FOR MAJOR PORTS NOTIFICATION Mumbai , the 7th February, 2007
No. TAMP/8/2003 - CHPT. In exercise of the powers conferred under Section 48 of the Major Port Trusts Act , 1963 (38 of 1963 ) , the Tariff Authority for Major Ports hereby extends the validity of the levy for Stevedoring activity at the Chennai Port Trust upto 31 March, 2007 as in the Order appended hereto.

(Passed on this 25th day of January 2007)
ThisAuthority had passed an Order dated 22 October, 2003 regarding revision of levy for stevedoring activity at the Chennai Port Trust ( CHPT) . This Order was notified in the Gazette of India on 7 November , 2003.
2.1 . The two year validity period for the approved rates had expired on 6 November , 2005 .
2.2. The CHPT had proposed during the proceedings in the tariff case relating to the general revision proposal of its Scale of Rates that it would file a separate proposal for review of levy for stevedoring activity in consultation with users; and, requested to allow it to continue with the rates approved in October 2003. This Authority extended the validity of the stevedoring levy for a period of one year with effect from 7 November , 2005 and directed the CHPT to file its proposal by 31 July, 2006 vide Order dated 7 March , 2006. The validity of the extended period has expired on 6 November, 2006.
3. By its letter dated 5 January 2007 , the CHPT has reported that it is in consultation with users on the proposal and shall file the proposal before this Authority shortly. The CHPT has also made a request to extend the validity of Stevedoring levy upto 31 March , 2007.
4. This Authority is inclined to accede to the request of the CHPT and the validity of the levy for stevedoring activity approved in October, 2003 , as clarified by Order No. TAMP/63 /2004 - CHPT dated 25 January 2007, shall be deemed to have been extended from 7 November, 2006 and shall remain valid till 30 June, 2007 or effective date of implementationof the revised rates to be notified, whichever is carlier . The CHPT is directed to file its proposal for review of levy for stevedoring activity within 15 days from the date of Notification of this Order in the Gazette of India .
