सा.का.नि. 72( अ ).- केन्द्रीय सरकार , अप्रवासन (वाहक दायित्व) अधिनियम , 2000 (2000 का 52 ) की धारा 8 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , एतद्वारा निम्नलिखित नियम बनाती है , अर्थात्:-
1. संक्षिप्त शीर्षक और प्रवृत्त होने की तारीख-
(1 ) इन नियमों को अप्रवासन ( वाहक दायित्व ) नियम , 2007 कहा जाएगा ।
(2 ) ये नियम सरकारी राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. परिभाषाएं
(1) इन नियमों में , जब तक अन्यथा अपेक्षित न हो-
(क) " अधिनियम " का तात्पर्य अप्रवासन ( वाहक दायित्व ) अधिनियम , 2000 (2000 का 52 ) है;
(ख) अधिनियम में प्रयोग किए गए ऐसे शब्दों एवं वाक्यांशों , जिनकी व्याख्या नहीं दी गई है , परन्तु अधिनियम में जिनकी व्याख्या दी गई है, का आशय अधिनियम में उनके लिए दी गई परिभाषा से है ।
3. अपील के लिए शुल्क-
( 1 ) आदेश के विरुद्ध अपील दायर करने के लिए , वाहक या उसका एजेन्ट अथवा प्रतिनिधि , सक्षम प्राधिकारी के पक्ष में देय बैंक ड्राफ्ट के माध्यम से एक हजार रुपये के शुल्क का भुगतान करेगा ।
( 2 ) सन्दर्भित सक्षम प्राधिकारी , शुल्क के रूप में प्राप्त की गई पूरी राशि का हिसाब रखेगा और यह राशि गृह मंत्रालय के बजट शीर्ष में शीर्ष " 0070 "-अन्य प्रशासनिक सेवाएं-60- अन्य सेवाएं- 117-वीजा शुल्क में डाली जाएगी ।

NOTIFICATION
New Delhi , the 8th February, 2007
G.S.R. 72 (E) . In exercise of the powers conferred by Section 8 of the Immigration ( Carriers ' Liability) Act , 2000 (52 of 2000) , the Central Government hereby makes the following Rules , namely :---
1. Short title and commencement-
(1) These Rules may be called the ' Immigration ( Carriers ' Liability) Rules , 2007.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Definitions-
(1) In these Rules, unless the context otherwise requires ,-
(a) "Act" means the Immigration ( Carriers ' Liability ) Act , 2000 ( 52 of 2000 ) ;
(b ) Words and expressions used herein and not defined butdefined in the Act have the meanings respectively assigned to them in the Act .
3. Fees for appeal-
(1) The carrier or his agent or representative shall pay a fee of rupees one thousand in the form of a Bank Draft drawn in favour of the competent authority for filing an appeal against the order .
(2) The said competent authority shall keep an account of all the amount received as fees which shall be credited to the Budgetary Head of the Ministry of External Affairs under the Head "0070 "----Other Administrative Services-60- Other Services- 117 -visa fee .
