का.आ. 171 ( अ ).- केन्द्रीय सरकार, अप्रवासन ( वाहक दायित्व ) अधिनियम, 2000 (2000 का 52 ) की धारा 3 क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए एतद्वारा निम्नलिखित आदेश करती है, अर्थात्:-
1. संक्षिप्त शीर्षक , प्रवृत्त होने की तारीख तथा विस्तार:-
( 1 ) इस आदेश को अप्रवासन ( वाहक दायित्व ) आदेश , 2007 कहा जाएगा ।
(2 ) यह आदेश पूरे भारत में लागू होगा ।
(3 ) यह आदेश सरकारी राजपत्र में इसके प्रकाशन की तारीख से प्रवृत्त होगा ।
2. छूटें:-सन्दर्भित अधिनियम के प्रावधान निम्नलिखित को ले जाने वाले वाहकों पर लागू नहीं होंगे :-
( i ) फर्जी दस्तावेजों के आधार पर यात्रा करने वाले यात्रियों पर , यदि ऐसे फर्जी दस्तावेजों की पहचान विशेषज्ञों की सहायता के बिना न की जा सकती हो;
(ii ) छिपाकर लाए गए ऐसे यात्रियों पर , जिन्हें वाहक वापिस ले जाने के लिए तैयार है;
( iii ) किसी ऐसे वायुयान या जलयान , जिसे प्रस्थान के बाद वाहक के नियन्त्रण से बाहर की परिस्थितियों के कारण से भारत की ओर मोड़ दिया गया था, द्वारा आने वाले यात्रियों पर;
(iv ) पासपोर्ट ( भारत में प्रवेश ) अधिनियम , 1920 ( 1920 का 34 ) के प्रावधानों के अन्तर्गत केन्द्र सरकार के आदेशों द्वारा पासपोर्ट अथवा वीजा की अपेक्षता से छूट प्राप्त विदेशियों पर;
( v ) किसी मान्यताप्राप्त भारतीय ट्रेवल एजेन्सी द्वारा प्रायोजित , वायु या जल मार्ग से वीजा के बिना आने वाले चार या पांच व्यक्तियों के विदेशी पर्यटक दल पर , जिसे प्रवेश के पत्तन पर अस्थाई लैंडिग अनुमति प्राप्त है;
(vi ) पूर्व वीजा अपेक्षताओं से छूट प्रदान करने वाली किसी सन्धि के तहत राजनयिक और सरकारी पासपोर्ट धारक विदेशियों पर।

NOTIFICATION
New Delhi , the 8th February , 2007
S.O. 171 (E) . In exercise of powers conferred by Section 3A of the Immigration ( Carriers ' Liability ) Act , 2000 (52 of2000) , the Central Government hereby makes the following Order , namely:-
1. Short title , commencement and extent.-
(1) This Order may be called the Immigration (Carriers' Liability ) Order , 2007.
(2) It extends to the whole of India .
(3) It shall come into force from the date of its publication in the Official Gazette .
2. Exemptions . The provisions of the said Act shall not apply to the carrier carrying:-
(i) passengers travelling on forged documents if such forgery cannot be detected without the help of experts ;
(ii) stow- away passengers whom the carrier is ready to take back:
(iii) passengers who have arrived on an aircraft or ship which , on departure , had been diverted to India for reasons beyond the control of the carrier ;
(iv) foreigners exempted from the requirement of passport or visa by the orders of the Central Government under the provisions of Passport ( Entry into India) Act , 1920 ( 34 of 1920 ) ;
(v) foreign tourist group consisting of four or more persons sponsored by a recognised Indian travel agency arriving without visa by air or by sea who have obtained Temporary Landing Permit at the port of entry;
(vi) foreigners holding diplomatic and official passport under any treaty waiving prior visa requirements .
