सं. 3944.- बैंककारी कम्पनी ( उपक्रमों का अर्जन तथा अंतरण) अधिनियम , 1980 ( 1980 का 40 ) की धारा 12 की उप- धारा ( 2 ) के साथ पठित धारा 19 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, ओरियन्टल बैंक ऑफ कॉमर्स का निदेशक मंडल , भारतीय रिजर्व बैंक से परामर्श करके तथा केन्द्रीय सरकार की पूर्व स्वीकृति से , एतद्वारा ओरियन्टल बैंक ऑफ कॉमर्स ( अधिकारी ) सेवा विनियम, 1982 में आगे संशोधन करता है, अर्थात्:-
1. ( 1 ) ये विनियम ओरियन्टल बैंक ऑफ कॉमर्स ( अधिकारी ) सेवा ( संशोधन ) विनियम , 2007 कहलाएंगे ।
(2) ये विनियम सरकारी राजपत्र में अपने प्रकाशन की तारीख से लागू होंगे ।
2. ओरियन्टल बैंक ऑफ कॉमर्स ( अधिकारी ) सेवा विनियम,
1982 में, विनियम 5 में :-
(क ) उप- विनियम ( 1 ) में, खण्ड (ग) के अंतर्गत , परन्तुक के पश्चात्एवं टिप्पणी के पहले निम्नलिखित परन्तुक जोड़ा जाएगा , अर्थात्:-
" परन्तु, जो अधिकारी पदोन्नति का प्रस्ताव मिलने पर उसे अस्वीकार कर देता है उसे अगले उच्चतर वेतनमान/अवरोध वेतनवृद्धि/वेत्तनवृद्धियों में ऐसी वेतनवृद्धि/वेतनवृद्धियां प्रदान नहीं की जाएंगी । "
(ख) उप-विनियम ( 2 ) में स्पष्टीकरण के खण्ड ( घ ) में, 'टिप्पणी ( ii ) के पश्चात् निम्नलिखित टिप्पणी जोड़ी जाएगी, अर्थात्
" ( iii ) जो अधिकारी पदोन्नति का प्रस्ताव मिलने पर उसे अस्वीकार कर देता है वह उपरोक्तानुसार व्यावसायिक योग्यता, वेतन पाने का पात्र नहीं होगा । "

New Delhi , the 1st February, 2007
No. 3944. In exercise of the powers conferred by Section 19 read with Sub- section (2 ) of Section 12 of the Banking Companies (Acquisition and transfer of undertakings ) Act, 1980 (40 of 1980 ) , the Board of Directors ofthe Oriental Bank of Commerce in consultation with the Reserve Bank of India and with the previous sanction of the Central Government hereby makes the following regulations further to amend Oriental Bank of Commerce (Officers') Service Regulations , 1982 , namely : ---
1. ( 1) These regulations may be called Oriental Bank ofCommerce (Officers ' ) Service (Amendment) Regulations , 2007 .
(2) These regulations shall come into force on the date of its publication in the Official Gazette .
2. In the Oriental Bank of Commerce (Officers ' ) Scrvice Regulations , 1982 in regulation 5,-
(a) in sub- regulation ( 1 ) , under clause (c) , after the proviso and before the Note the following proviso shall be inserted , namely:

"Provided further that such increment/s in the next higher scale/stagnation increment/s shall not be allowed to an officer who refuses promotionwhen offered .".
(b) in sub - regulation (2 ) in clause (d) of the Explanation, after Note (ii ), the following Note shall be inserted , namely:
"( iii ) An Officer shall not be eligible for Professional Qualification Pay , as above , if he refuses to accept promotion when offered. "
