आदेश
नई दिल्ली, 9 फरवरी , 2007
विषय : मध्य प्रदेश राज्य में 3 - ग्वालियर संसदीय निर्वाचन क्षेत्र 10 - सीधी ( अ.ज.जा. ) संसदीय निर्वाचन क्षेत्र तथा 153 - उदयपुरा विधानसभा निर्वाचन क्षेत्र से उपनिर्वाचन-निर्वाचक नामावलियों का पुनरीक्षण ।
आ.अ. 15(अ) .-यतः , मध्य प्रदेश राज्य से लोकसभा के लिए तथा राज्य की विधानसभा के लिए साधारण निर्वाचन क्रमशः 2004 तथा 2003 में संपन्न कराए गए थे; तथा
यतः , मध्य प्रदेश राज्य की निर्वाचन नामावलियां पिछली बार 1 जनवरी , 2006 को अर्हता की तारीख मानकर पुनरीक्षित की गई थी; तथा यतः लोकसभा में मध्य प्रदेश राज्य से 3 - ग्वालियर संसदीय निर्वाचन क्षेत्र तथा 10- सीधी ( अ.ज.जा. ) संसदीय निर्वाचन क्षेत्र से क्रमशः निर्वाचित श्री रामसेवक सिंह ( बाबूजी ) तथा श्री चन्द्रप्रताप सिंह का स्थान23-12-2005 को लोकसभा के अध्यक्ष के आदेश से उनकी सदस्यता की समाप्ति के कारण रिक्त हो गया है; और
यतः , अध्यक्ष के उक्त आदेश को चुनौती देते हुए भारत के सर्वोच्च न्यायालय के समक्ष 2006 की रिट याचिका सं. 1 तथा कुछ स्थानांतरण मामले दर्ज किए गए तथा सर्वोच्च न्यायालय ने 3 अप्रैल , 2006 को यह निदेश दिया था कि उक्त मामलों के लंबित होते हुए उन स्थानों को भरने के लिए उप - निर्वाचन नहीं करवाए जा सकते; तथा
यतः , सर्वोच्च न्यायालय ने दिनांक 10-1-2007 को अपने निर्णय द्वारा इन सभी मामलों को रद्द करने की घोषणा की है; तथा यतः , मध्य प्रदेश विधान सभा में 14-11-2006 को उस विधान सभा में 153 - उदयपुरा विधान सभा निर्वाचन क्षेत्र से निर्वाचित श्री रामपाल सिंह के त्यागपत्र देने के कारण एक आकस्मिक रिक्ति उत्पन्न हो गई है; तथा
यतः , इस प्रकार हुई रिक्तियों को भरने के प्रयोजन से उप - निर्वाचन कराया जाना है; तथा
यतः , लोक प्रतिनिधित्व अधिनियम , 1950 की धारा 14( ख ) के अनुसार निर्वाचक नामावलियों को तैयार करने या उनका पुनरीक्षण करने के लिए अर्हता की तिथि अर्थात् उस वर्ष के जनवरी माह का प्रथम दिन जिस वर्ष निर्वाचक नामावलियों को इस प्रकार तैयार किया जाता है या उनका पुनरीक्षण किया जाता है; तथा
यतः , यह आयोग की संगत नीति रही है कि देश का कोई भी भाग एक लंबे समय तक प्रतिनिधि विहीन न छोड़ा जाए और इसके अनुसार लोक प्रतिनिधित्व अधिनियम, 1951 ( 1951 का 43 ) की धारा 151 क के द्वारा नियत समय के भीतर अस्थायी रिक्ति को भर दिया जाए; तथा यतः , मध्य प्रदेश राज्य में 1 जनवरी , 2007 के संदर्भ में निर्वाचक नामावलियों के पुनरीक्षण की प्रक्रिया अभी तक प्रारम्भ नहीं हुई है; तथा यतः , 1-1-2007 को अर्हता की तारीख मानकर इसके संदर्भ में निर्वाचक नामावलियों को पुनरीक्षित किए जाने तक पूर्वोक्त आकस्मिक रिक्तियों को भरने के लिए उप - निर्वाचनों को स्थगित नहीं किया जा सकता , क्योंकि इसका अर्थ यह होगा कि लोक प्रतिनिधित्व अधिनियम , (1) 439G1/2007 THE GAZETTE OF INDIA: EXTRAORDINARY

1951 की धारा 151 क में विनिर्दिष्ट कालावधि से अधिक समय तक निर्वाचन क्षेत्रों को प्रतिनिधि विहीन छोड़ दिया गया है और केन्द्र सरकार से परामर्श करके आयोग को यह प्रमाणित करना होगा कि उक्त कालावधि के भीतर उप- निर्वाचन कराना कठिन है;
अतः , अब , आयोग , पूर्वोक्त कारणों से , लोक प्रतिनिधित्व अधिनियम , 1950 की धारा 21 ( 2 ) के परन्तुक के साथ पठित धारा 21 (2) ( क) ( ii ) के अधीन एतद्वारा निदेश देता है कि मध्य प्रदेश राज्य में 3 - ग्वालियर संसदीय निर्वाचन क्षेत्र, 10- सीधी ( अ.ज.जा. ) संसदीय निर्वाचन क्षेत्र और 153 - उदयपुरा विधानसभा निर्वाचन क्षेत्र के लिए पूर्वोक्त उप- निर्वाचन , 1 जनवरी , 2006 को अर्हता की तारीख मानकर इसके संदर्भ में पुनरीक्षित विद्यमान निर्वाचक नामावली के आधार पर कराए जाएंगे ।

Subject :-Bye- elections from 3 - Gwalior Parliamentary Constituency , 10 - Sidhi (ST) Parliamentary Constituency and 153 -Udaipura Assembly Constituency in the State of Madhya Pradesh -Revision of electoral rolls .
O.N. 15 (E) . Whereas , the general elections to the House of People from the State of Madhya Pradesh and the Legislative Assembly of the State of Madhya Pradesh was held in 2004 and 2003 ; respectively ; and
Whereas , the electoral rolls of the State of Madhya Pradesh were last revised with reference to 1st January , 2006 as the qualifying date ; and
Whereas, seats of Shri Ramsevak Singh (Babuji ) and Shri Chandra Pratap Singh in the House of the People , elected from 3 -Gwalior Parliamentary Constituency and 10 - Sidhi (ST ) Parliamentary Constituency respectively in the state ofMadhya Pradesh have become vacant due to cessation of their membership on the order of the Speaker, Lok Sabha on 23-12-2005; and
Whereas , a Writ Petition No. 1 of 2006 and certain Transferred Cases were filed before the Supreme Court of India challenging the order of the Speaker , and the Supreme Court had directed on 3rd April , 2006 that the bye- clection to fill the said vacancy may not be held , pending the above cases ; and
Whereas , the Supreme Court has pronounced its judgment dismissing all these cases on 10-01-2007; and Whereas , one casual vacancy occurred in the Madhya Pradesh legislative Assembly by reason of resignation of Shri Rampal Singh on 14-11-2006 , elected to that Assembly from 153 - Udaipura Assembly Constituency ; and Whereas,bye- elections are now to be held for the purpose of filling the said vacancies ; and
Whereas, the qualifying date in relation to the preparation or revision of electoral rolls means the 1st day of the January of the year in which it is so prepared or revised as per Section 14(b ) of the Representation of the People Act, 1950; and
Whereas , it hasbeen a consistent policy of the Commission not to leave any part of the country un - represented for a long time and accordingly to fill the casual vacancy within the time stipulated by Section 151A of the Representation ofPeople Act , 1951 (43 of 1951) ; and
Whereas , the process of the revision of the electoral rolls with reference to 1st January , 2007 in the State of Madhya Pradesh has not yet started; and
Whereas , thebye- elections to fill the aforesaid casual vacancies cannot be postponed till the electoral rolls are revised with reference to 1-1-2007 as the qualifyingdate as that would mean leaving the constituencies un - represented beyond the period specified in Section 151A of the representation of the People Act , 1951 and the Commission will have to certify , in consultation with the Central Government , that it is difficult to hold the bye -election within the said period;
Now, therefore , the Commission , for the aforesaid reasons , hereby directs under Section 21 (2 ) (a ) ( ii ) read with the proviso to Section 21 (2) of the Representation of the People Act , 1950 that aforesaidbye - elections to the 3 -Gwalior Parliamentary Constituency , 10 - Sidhi (ST) Parliamentary Constituency and 153 -Udaipura Assembly Constituency in the State of Madhya Pradesh shallbe conducted on the basis of the existing electoral rolls revised with reference to 1st January, 2006 as the qualifyingdate.
