आ.अ. 17 (अ).-यतः , मध्य प्रदेश राज्य से लोक सभा में उस राज्य के 10- सीधी ( अ.ज.जा. ) संसदीय निर्वाचन क्षेत्र से निर्वाचित , श्री चन्द्र प्रताप सिंह का स्थान अध्यक्ष , लोक सभा के आदेश दिनांक 23-12-2005 द्वारा 23-12-2005 से सदस्यता समाप्ति के कारण रिक्त हो गया है; और
यतः , अध्यक्ष के उक्त आदेश को चुनौती देते हुए भारत के सर्वोच्य न्यायालय के समक्ष 2006 की रिट याचिका संख्या-1 तथा कुछ स्थानांतरण मामले दर्ज किए गये तथा सर्वोच्च न्यायालय ने 3 अप्रैल, 2006 को यह निदेश दिया था कि उक्त मामलों के लम्बित होते हुए उन स्थानों को भरने के लिए उप - निर्वाचन नहीं करवाये जा सकते हैं; और
यतः, सर्वोच्च न्यायालय ने दिनांक 10-1-2007 के अपने निर्णय द्वारा इन सभी मामलों को रद्द करने की घोषणा की है; और
यतः , इस प्रकार हुई रिक्ति को भरने के प्रयोजन से उप - निर्वाचन कराया जाना है;
अतः , अब, लोक प्रतिनिधित्व अधिनियम , 1951 ( 1951 का 43 ) की धारा 149 की उप- धारा ( 1 ) , तथा धाराओं 30 और 56 के अनुसरण में, भारत निर्वाचन आयोग एतद्वारा-
(अ) मध्य प्रदेश राज्य में उक्त 10- सीधी ( अ.ज.जा. ) संसदीय निर्वाचन क्षेत्र से यह अपेक्षा करता है कि वह 14 मार्च , 2007 ( बुधवार) से पूर्व तथा उक्त अधिनियम के और तद्धीन बनाए गए नियमों और किए गए आदेशों के उपबन्धों के अनुसार लोक सभा में उक्त रिक्ति को भरने के प्रयोजन से किसी भी राज्य के अनुसूचित जनजातियों से संबंध रखने वाले एक व्यक्ति को निर्वाचित करें;
:
(आ) उक्त निर्वाचन के संबंध में -
: 19फरवरी, 2007 ( सोमवार ) ;
(क) नाम निर्देशन करने की अन्तिम तारीख
: 20फरवरी , 2007 (मंगलवार);
( ख ) नाम निर्देशनों की संवीक्षा की तारीख
: 22फरवरी, 2007 ( वीरवार );
(ग) अभ्यर्थिताएं वापस लेने की अन्तिम तारीख
: 8मार्च, 2007 (वीरवार ); और
(घ) वह तारीख जिसको यदि आवश्यक हुआ तो मतदान होगा

(ङ) वह तारीख जिससे पूर्व निर्वाचन सम्पन्न करा लिया जाएगा : 14मार्च , 2007 ( बुधवार );
नियत करता है; और
( ई ) 7.30 बजे पूर्वाह्न से 4.30 बजे अपराह्न तक का समय ऐसे समय के रूप में नियत करता है जिसके दौरान यदि आवश्यक हुआ तो , निर्वाचन के लिए उपर्युक्त विनिर्दिष्ट तारीख को मतदान होगा।

NOTIFICATION
New Delhi, the 12th February , 2007
Whereas , the Supreme Court has pronounced its judgment dismissing all these cases on 10-1-2007; and Ο.Ν. 17 (E ).-Whereas , the seat of Shri Chandra Pratap Singh in the House of the People , elected from 10 -Sidhi (ST) Parliamentary Constituency in the State of Madhya Pradesh , has become vacant on 23-12-2005 , due to cessation of his membership on the order of the Speaker , Lok Sabha on 23-12-2005 ; and Whereas , a Writ Petition No.1 of 2006 and certain Transferred Cases were filed before the Supreme Court of India challenging the order of the Speaker, and the Supreme Court had directed on 3rd April , 2006 that the bye clection to fill the said vacancy may notbe held , pending the above cases ; and Whereas , a bye- election is now to be held for the purpose of filling the said vacancy;
Now, Therefore , in pursuance of sub- section ( 1 ) of Section 149 , and Sections 30 and 56 of the Representation ofthe People Act, 1951 (43 of 1951 ) , the Election Commission of India hereby
(A) calls upon the said 10- Sidhi (ST ) Parliamentary Constituency in the State of Madhya Pradesh to elect , before the 14-03-2007 ( Wednesday) and in accordance with the provisions of the said Act and of the rules and orders made thereunder , a person belonging to any of the Scheduled Tribes of any State for the purpose of filling the said vacancy in the House of the People; and
(B) appoints, with respect to the said election-
(a) the 19-2-2007 (Monday) , as the last date for making nominations ;
(b) the 20-2-2007 (Tuesday) , as the date for the scrutiny of nominations;
(c) the 22-2-2007 ( Thursday) , as the last date for the withdrawal of candidatures ;
(d) the 8-3-2007 (Thursday) , as the date on which a poll shall , if necessary, be taken; and
(e) the 14-3-2007 (Wednesday) , as the date before which the election shall be completed ; and
(C) fixes the hours from 7.30 A.M. to 4.30 P.M. , as the hours during which the poll shall , if necessary , be taken on the date specified above for the clection .
