विषय: -चीन जन, गण. के मूल के अथवा वहां से निर्यातित सैकरीन के आयात से संबंधित पाटनरोधी जांच के अंतिम जांच परिणाम में संशोधन ।
सं. 14/27/2004-डीजीएडी. यतः, वर्ष 1995 में यथासंशोधित सीमाशुल्क टैरिफ अधिनियम , 1975 और उसकी सीमाशुल्क टैरिफ (पाटित वस्तुओं की पहचान, उन पर पाटनरोधी शुल्क का आकलन एवं संग्रहण तथा क्षति के निर्धारण ) नियमावली , 1955 को ध्यान में रखते हुए , निर्दिष्ट प्राधिकारी ने दिनांक3-1-2007 की अधिसूचना सं. 14/27/2004-डीजीएडी के तहत अंतिम जांच परिणामों को अधिसूचित किया है।
दिनांक 3-1-2007 की उपर्युक्त अधिसूचना के पैरा सं. 122 एवं 124 में निम्नानुसार संशोधन किया जाता है :-
122. पाटन मार्जिन के बराबर अथवा उससे कम पाटनरोधी शुल्क की सिफारिश करने का निर्णय लिया गया है जिसके लगाए जाने से घरेलू उद्योग को हुई क्षति समाप्त हो जाएगी । आयातों के पहुंच मूल्य की तुलना जांच अवधि के लिए निर्धारित घरेलू उद्योग की क्षति- रहित कीमत से भी की गई थी । इस मामले में पाटन मार्जिन , क्षति मार्जिन से कम है, तदनुसार केन्द्र सरकार द्वारा संबद्ध देश के मूल की अथवा वहां से निर्यातित संबद्ध वस्तु के सभी आयातों पर नीचे दी गई तालिका के कालम 8 में उल्लिखित राशि के बराबर पाटनरोधी शुल्क लगाए जाने की सिफारिश कीजाती है ।

124. उपर्युक्त के अध्यधीन , प्राधिकारी दिनांक 1 अप्रैल , 2006 के प्रारंभिक जांच परिणामों की पुष्टि करते हैं; तथापि सीमाशुल्क टैरिफ अधिनियम , 1975 की धारा 9 क ( 2 ) के अनुसार पैरा 122 में संस्तुत शुल्क , अनंतिम पाटनरोधी शुल्क लगाए जाने की तारीख से लागू होगा ।

Subject :- Amendment in Final Findings regarding anti - dumping investigations involving imports of Saccharin exported from or originating in China PR.
No. 14/27/2004-DGAD. Whereas, having regard to the Customs Tariff Act, 1975 as amended in 1995 ( hereinafter referred to as the Act) and the Customs Tariff (Identification , Assessment and Collection of Anti - Dumping Duty on Dumped Articles and for Determination of Injury) Rules , 1995, thereof, the Designated Authority has notified the Final Findings vide Notification No. 14/27/2004 -DGAD, dated 3-1-2007.
In the above said Notification dated 3-1-2007 paras Nos . 122 and 124 are amended to read as follows :-
122. It is decided to recommend the amount of anti -dumping duty equal to the margin of dumping or less , which if levied, would remove the injury to the domestic industry. The landed price of imports was also compared with the non- injurious price of the domestic industry, determined for the period of investigation . In this case clumping margin is less than injury margin , accordingly , anti -dumping duty equal to the amount indicated in Col. 8 of the table below is recommended to be imposed by the Central Government , on all imports of subject goods originating in or exported from the subject country .

124. Subject to the above, the Authority confirms the preliminary findings dated 1st April, 2006, howeverduty recommended in para 122 above would be applicable from the date of imposition of provisional anti -dumping duty as per Section 9A(2) of the Custom Tariff Act, 1975.
