का.आ. 198(अ).- जबकि केन्द्रीय सरकार की यह राय है कि इसके साथ संलग्न अनुसूची में निर्धारित मामलों के संबंध में सार्वजनिक क्षेत्र के उपक्रमों के बीमा क्षेत्र के प्रबंधनों और उनके कर्मकारों, जिनका अनुबंध में उल्लेख किए गए अनुसार संघ/एसोसिएशन प्रतिनिधित्व कर रहे हैं, के बीच एक औद्योगिक विवाद मौजूद है और यह विवाद राष्ट्रीय महत्व से जुड़ा है और इसकी प्रकृति भी ऐसी है कि एक राज्य से अधिक में स्थित बीमा क्षेत्र प्रतिष्ठानों की रुचि इस विवाद में होने या इस विवाद से उनके प्रभावित होने की संभावना है;
और जबकि केन्द्रीय सरकार की राय है कि उक्त विवाद का न्यायनिर्णयन एक राष्ट्रीय अधिकरण द्वारा किया जाए;
अतः , अब, केन्द्रीय सरकार , औद्योगिक विवाद अधिनियम , 1947 ( 1947 का 14 ) की धारा 7 ख द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , एतद्वारा एक राष्ट्रीय औद्योगिक अधिकरण का गठन करती है जिसका मुख्यालय कोलकाता में होगा और न्यायमूर्ति सी.पी. मिश्र को पीठासीन अधिकारी के रूप में नियुक्त करती है । और अतः अधिनियम की धारा 10 की उप- धारा ( 1 - क) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, एतद्वारा इस विवाद को न्यायनिर्णयन के लिए राष्ट्रीय औद्योगिक अधिकरण निर्दिष्ट करती है।
अनुसूची
" क्या ओरियन्टल इंश्योरेन्स कम्पनी लिमिटेड , नेशनल इंश्योरेन्स कम्पनी लिमिटेड, न्यू इण्डिया इंश्योरेन्स कम्पनी लिमिटेड, और यूनाईटेड इण्डिया इंश्योरेन्स कम्पनी लिमिटेड के प्रबंधन की श्रेणी- III और श्रेणी- IV कर्मचारियों का स्थानांतरण किए जाने के कारण उनकी वरिष्ठता समाप्त होने से उन्हें पर्याप्त संरक्षण दिए बिना भिन्न - भिन्न पदोन्नति जोनों में एक स्थान से दूसरे स्थान पर स्थानांतरित किए जाने की कार्रवाई न्यायोचित है? यदि नहीं, तो कामगार किस राहत के हकदार हैं। "

ORDER
New Delhi , the 14th February, 2007
S.O. 198 (E). Whereas the Central Government is of the opinion that an Industrial Dispute exists between the managements in Insurance Sector of Public Sector Undertakings and their workmen represented by Unions /Associations as mentioned in the Annexure , in respect of the matters prescribed in the Schedule hereto annexed and that the dispute involves question of national importance and also is of such nature that Insurance Sector establishments situated in more than one State are likely to be interested in or affected by such dispute ;
And whereas the Central Government is of the opinion that the said dispute should be adjudicated by a National Tribunal:
Now, therefore , the Central Government , in exercise of the powers conferred by Section 7 -B of the Industrial Disputes Act, 1947 (14 of 1947), hereby constitutes a National Industrial Tribunal with headquarters at Kolkata and appoints Justice C. P. Mishra as the Presiding Officer , and in exercise of the powers conferred by Sub- section ( 1A) of Section 10 of the said Act, hereby refers the said industrial dispute to the National Industrial Tribunal for adjudication.
SCHEDULE
"Whether the action of the management of Oriental Insurance Company Ltd. , National Insurance Company Ltd. , New India Insurance Company Ltd. and United India Insurance Company Ltd. in transferring the Class - III and Class - IV employees from one station to another in different promotion zones without any adequate protection against loss of seniority due to transfer is justified ? If not, to what relief are the workmen entitled?"
