सा.का.नि. 91 (अ ).-खादी और ग्रामोद्योग आयोग अधिनियम , 1956 ( 1956 का 61 ) की धारा 27 की उप - धारा ( 1 ) और (3 ) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार , खादी और ग्रामोद्योग आयोग कर्मचारी ( वर्गीकरण , नियंत्रण और अपील ) विनियमन, 2003 में और संशोधन के लिए एतद्द्वारा निम्नलिखित विनियमन बनाती है :-
1. ( 1 ) इन विनियमनों को खादी और ग्रामोद्योग आयोग कर्मचारी ( वर्गीकरण , नियंत्रण और अपील ) संशोधन विनियमन, 2007 कहा जा सकता है ।
(2 ) इस अधिसूचना में अन्यथा उपलब्ध के अतिरिक्त, ये विनियमन अक्तूबर , 2004 के 14वें दिन से लागू एवं प्रभावी होंगे।
2. आरम्भिक पैराग्राफ के लिए खादी और ग्रामोद्योग आयोग कर्मचारी ( वर्गीकरण , नियंत्रण और अपील ) संशोधन विनियमन, 2006 में, निम्नलिखित प्रतिस्थापित किए जाएंगे , नामतः:-
" खादी और ग्रामोद्योग आयोग अधिनियम , 1956 ( 1956 का 61 ) की धारा 27 की उप - धारा ( 3 ) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए , सरकार , खादी और ग्रामोद्योग आयोग कर्मचारी ( वर्गीकरण , नियंत्रण एवं अपील ) विनियमन, 2003 में संशोधन हेतु एतद्वारा निम्नलिखित विनियम बनाती है, नामतः "
3. भाग- VII में " खादी और ग्रामोद्योग आयोग कर्मचारी ( वर्गीकरण , नियंत्रण और अपील ) विनियमन, 2003 के,
(i ) विनियमन 18 और उसमें की गई प्रविष्टियों को हटा दिया जाएगा।
(ii ) विनियमन 19 में," विनियमन 18 के प्रावधानों के अधीन " शब्दों और अक्षरों को हटा दिया जाएगा।

व्याख्यात्मक ज्ञापन
1. आयोग के पुनरुद्धार के उद्देश्य से दिनांक 14 अक्तूबर , 2004 के अधिसूचना संख्या-1120 ( अ ) के तहत दिनांक 14-10-2004 को खादी और ग्रामोद्योग आयोग का विघटन कर दिया गया था ।

2. आयोग के विघटन की अवधि के दौरान , अनुशासनात्मक और अपीलीय शक्तियों का प्रयोग में लाने का प्राधिकरण खादी और ग्रामोद्योग आयोग कर्मचारी ( वर्गीकरण , नियंत्रण और अपील ) विनियमन , 2003 की अनुसूची में यह निर्दिष्ट करना अपेक्षित था क्योंकि इससे पूर्व शक्तियोंका प्रयोग करने वाले अध्यक्ष और आयोग के कार्यालय , विघटन के पश्चात् अस्तित्व में नहीं रहे। इसलिए, अंतरिम अवधि, अर्थात् आयोग के विघटन की तिथि 14 अक्तूबर , 2004 से 19 जुलाई , 2006 तक की अवधि के बीच , उक्त अनुसूची में अनुशासनात्मक और अपीलीय प्राधिकारियों को, निर्दिष्ट करना संगत हो गया। इसलिए, उक्त अवधि के लिए अनुसूची की सारणियों में संशोधन पीछे 14 अक्तूबर , 2004 से ही प्रभावी किया। खादी और ग्रामोद्योग आयोग कर्मचारी ( वर्गीकरण , नियंत्रण और अपील ) विनियमनों को 12 सितम्बर , 2006 की अधिसूचना संख्या सा.का.नि. 549 ( अ ) के तहत संशोधित किया गया।
3. अनेजाने में दिनांक 12-9-2006 की अधिसूचना के आरम्भिक पैरा में गलती हो गई है जहां यह उल्लेख किया गया है कि " खादी और ग्रामोद्योग आयोग अधिनियम , 1956 ( 1956 का 61 ) की धारा 27 की उप - धारा ( 1 ) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए , आयोग , केन्द्र सरकार के पूर्व अनुमोदन सें, खादी और ग्रामोद्योग आयोग कर्मचारी ( वर्गीकरण , नियंत्रण और अपील ) विनियमन , 2003 में संशोधन के लिए एतद्वारा निम्नलिखित विनियमन बनाता है : नामतः " यह उल्लेखनीय है कि यद्यपि खादी और ग्रामोद्योग आयोग कर्मचारी ( वर्गीकरण , नियंत्रण और अपील ) विनियमन, 2003 में संशोधन का कार्य 14-10-2004 और19-7-2006 के बीच आयोग की विघटन अवधि के दौरान आरम्भ किया गया था , खादी और ग्रामोद्योग आयोग कर्मचारी ( वर्गीकरण , नियंत्रण औरअपील ) विनियमन , 2003 में संशोधन करते हुए अधिसूचना विधायी कार्य विभाग से अनुमोदन प्राप्ति सहित सभी औपचारिकताओं को देखने के बाद ही 12-9-2006 को जारी की जा सकी क्योंकि उक्त अधिसूचना कृषि एवं ग्रामीण उद्योग मंत्रालय में सरकार द्वारा जारी की गई जिसमें शब्द " केन्द्र सरकार की पूर्व अनुमति से आयोग , एतद्वारा खादी और ग्रामोद्योग आयोग कर्मचारी ( वर्गीकरण , नियंत्रण और अपील ) विनियमन , 2003 में संशोधन के लिए निम्नलिखित विनियमन , 2003 बनाता है; नामतः " यथा " केन्द्र सरकार की पूर्व अनुमत्ति से आयोग " शब्दों को निकालने के लिए संशोधन किया जा सकता है , क्योंकि आयोग की विघटन अवधि के दौरान आयोग का कार्यालय मौजूद नहीं था। इसलिए, खादी और ग्रामोद्योग आयोग ( वर्गीकरण , नियंत्रण एवं अपील ) विनियमन, 2003 में संशोधन करने का प्रस्ताव है ।
4. यथा संशोधित खादी और ग्रामोद्योग आयोग कर्मचारी विनियमन , 2003 , उक्त विनियमनों में निर्दिष्ट पदों के लिए सभी शास्तियों के लिए अपील प्राधिकारी के रूप में कृषि एवं ग्रामीण उद्योग मंत्री हेतु व्यवस्था है । इसलिए , उक्त विनियमनों के भाग VII में विनियमन-18 और उसमें की गई प्रविष्टियों की निकालना आवश्यक हो गया है । फलस्वरूप विनियमन 19 में " विनियमन 18 के अधीन " प्रविष्टि को भी हटा दिया जाएगा। चूंकि, खादी और ग्रामोद्योग आयोग ( वर्गीकरण , नियंत्रण और अपील ) विनियम , 2003 के संशोधन को 14 अक्तूबर , 2004 से भूतलक्षी प्रभाव से लागू किया गया था , इसलिए उक्त विनियमनों के भाग VII में विनियमन 18 को निकालने तथा विनियमन 19 में विनियमन 18 के संदर्भ को भी दिनांक 14-10-2004 से भूतलक्षी प्रभाव से लागू किया गया है।
यह प्रमाणित किया जाता है कि कोई भी व्यक्ति इस अधिसूचना के भूतलक्षी प्रभाव से पक्षपात रूप से प्रभावित नहीं होगा ।

NOTIFICATION

G.S.R. 91(E) . In exercise of the powers conferred under Sub - sections ( 1 ) and (3 ) of Section 27 of the Khadi and Village Industries Commission Act, 1956 ( 61 of 1956) , the Central Government hereby makes the following Regulations further to amend the Khadi and Village Industries Commission Employees ( Classification , Control and Appeal ) Regula- tions , 2003 , namely :-
1..( 1 ) These Regulations may be called the Khadi and Village Industries Commission Employees ( Classification, Control and Appeal ) Amendment Regulations, 2007.
(2) Save as otherwise provided in this notification, these Regulations shall come into force and deemed to have been effective from the 14th day of October , 2004.
2. In the Khadi and Village Industrics Commission Employecs ( Classification , Control and Appeal ) Amendment Regulations , 2006, for the opening paragraph, the following shall be substituted, namely:
"In exercise of the powers conferred under Sub - section (3 ) of Section 27 of the Khadi and Village Industries Commission Act , 1956 (61 of 1956) , the Central Government , hereby makes the following regulations to amend the Khadi and Village Industries Commission Employees ( Classification , Control and Appeal ) Regulations , 2003, namely: -" 3

3. In the Khadi and Village Industries Commission Employees (Classification, Control and Appeal ) Regulations , 2003 in Part VII,-
(i) regulation 18, and the entries thereto shall be omitted.
(ii) in regulation 19, the words and letters "subject to the provisions of regulation 18 " shall be omitted.

ExplanatoryMemorandum
1. The Khadi and Village Industries Commission was dissolved on 14th October, 2004, under notification number 1120 (E), dated the 14th October , 2004, in order to facilitate revamping of the Commission.
2.During the period of dissolution of the Commission, the authorities for exercising disciplinary and appellate powers were required to be specified in the Schedule to the Khadi and Village Industries Commission Employees (Classifi- cation, Control and Appeal ) Regulations , 2003, as the offices of the Chairman and the Commission hither - to- fore exercising these powers , were no longer in existence . It had, therefore, become pertinent to specify the disciplinary and appellate authorities in the said Schedule , for the interim period i.e. , the period between the date ofdissolution of the Commission on 14th October, 2004, till its re-constitution on 19th July, 2006. Hence , the amendments in the table to the Schedule for the said period have been given effect retrospectively from 14th October, 2004. The KVIC Employees (CCA) Regulations were amended under Notification No. G.S.R. 549 (E) dated 12th September, 2006.
3. Inadvertently an error has crept in the opening Para of the Notification dated 12-9-2006, where it has been mentioned that "in exercise of the powers conferred under Sub - section (1) of the Section 27 of the Khadi and Village Industries Commission Act, 1956 (61 of 1956) the Commission , with the previous sanction of the Central Government, hereby makes the following Regulations to amend the Khadi and Village Industries Commission Employees (Classification, Control andAppeal ) Regulations , 2003 , namely-" It may be stated that though the action to altend the KVIC Employees (CCA) Regulations , 2003 was initiated during the period of dissolution of the Commission between 14-10-2004 and 19-7-2006, the Notification amending the KVIC Employees (CCA) Regulations, 2003 couldbe issued only on 12-9-2006 after observingall formalities including obtaining the approval from the Department of Legislative Affairs. Since the notification was made by the Government in the Ministry of Agro and Rural Industries , the words , "the Commission with the previous sanction of the Central Government, hereby makes the following regulations to amend the Khadi and Village Industries CommissionEmployees (Classification, Control and Appeal) Regulations, 2003 namely" may be amended to delete the words " the Commission with the previous sanction of the Central Government " as during the period of dissolution ofthe Commission, the Office of the Commission was non -existent. Hence it is proposed to amend the Khadi and Village Indus- tries Commission Employees (Classification, Control and Appeal ) Regulations, 2003 .
4.As the amended KVIC Employees Regulations, 2003 provide for Minister for Agro and Rural Industries as the Appellate Authority for all penalties for the posts specified in the said Regulations , it has become necessary to delete Regulation 18 and entries relating thereto in Part VII of the said Regulations . Consequently, the entry "subject to Regula- tion 18" in Regulation 19 shall also be omitted. Since the amendment to the Schedule to KVIC CCA Regulations , 2003 was given retrospective effect with effect from 14th October , 2004, the deletion of Regulation 18 in Part VII of the said Regula- tions and reference to Regulation 18 in Regulation 19 also has been given effect retrospectively from 14-10-2004.
5. It is certified that no person will be prejudicially affected with the retrospective effect being given to this notification.
Note: The Principal regulations were published in the Gazette of India vide notification No. G.S.R. 433 (E) , dated the 27thMay,2003 and amended vide Notification No. G.S.R. 549(E) , dated 12th September , 2006.
