विषय: -चीन जन, गण, के मूल के वहां से निर्यातित फ्लैट बेस स्टील व्हील से संबंधित पाटनरोधी जांच के बारे में प्रारंभिक जांच परिणाम।
सं. 14/8 / 2005 -डीजीएडी.-यतः वर्ष 1995 में यथा संशोधित सीमाशुल्क टैरिफ अधिनियम , 1975 और उसकी सीमाशुल्क टैरिफ (पाटित वस्तुओं का अभिज्ञान , उन पर पाटनरोधी शुल्क का आकलन और वसूली तथा क्षति निर्धारण ) नियमावली , 1995 को ध्यान में रखते हुए निर्दिष्ट प्राधिकारी ने संबंधित पाटनरोधी जांच में 12 जनवरी , 2007 की अधिसूचना द्वारा प्रारंभिम जांच परिणाम अधिसूचित किए हैं।
दिनांक 12 जनवरी , 2007 की उक्त अधिसूचना में एतद्वारा निम्नलिखित संशोधन समाविष्ट किए जाते हैं। उक्त अधिसूचना के पैरा 62 और उक्त पैराग्राफ के बाद दी गई शुल्क तालिका में संशोधन किया जाएगा जिसे निम्नानुसार पढ़ा जाएगा :
62. कमतर शुल्क के नियम को ध्यान में रखते हुए प्राधिकारी पाटन मार्जिन के बराबर पाटनरोधी शुल्क की निर्धारित राशि की वसूली का प्रस्ताव करते हैं। तदनुसार , प्राधिकारी यह सिफारिश करते हैं कि अंतिम निर्धारण होने तक संबद्ध देश के मूल के या वहां से निर्यातित सीमाशुल्क शीर्ष 87 के अंतर्गत आने वाले स्टील व्हील के आयातों पर केन्द्र सरकार द्वारा इस संबंध में जारी की जाने वाली अधिसूचना की तारीख से अनंतिम पाटनरोधी शुल्क लगाया जाए। पाटनरोधी शुल्क निम्नलिखित तालिका के कॉलम -8 में उल्लिखित राशि होगी:-

NOTIFICATION

New Delhi , the 21st February , 2007
Subject: Preliminary Findings in respect of anti -dumping investigations concerning Flat Base Steel Wheels originating in/exported from China PR.
No. 14/8/2005 -DGAD.-Whereas , having regardto the Customs Tariff Act, 1975 as amended in 1995 and Customs Tariff (Identification, Assessment and Collection of Anti - dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995 , thereof, the Designated Authority has notified the preliminary findings vide notification dated 12th January, 2007 in the subject anti - dumping investigation.
In the said notification dated 12th January , 2007, the following amendments are hereby incorporated , Para 62 of the said notification and duty table after the said paragraph shall be amended to read as follows:
62.Having regard to the lesser duty rule , the Authority proposes levy of fixed amount of anti - dumping duty equal tothe dumping margin. Accordingly , the Authority recommends that the provisional anti -dumping duties be imposed from the date of notification to be issued in this regard by the Central Government on imports of Steel Wheels falling under CustomHeading 87 originating in or exported from subject country pending final determination. The Anti-dumping duty shall be the amount mentioned in column 8 of the following table :-
