स. एफ. 37-3 /विधिक/2007.-अखिल भारतीय तकनीकी शिक्षा परिषद् अधिनियम, 1987 ( 1987 का 52 ) की धारा 10 ( ख ) , ( ण ) तथा ( फ ) के साथ पठित धारा 23 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए परिषद्द्वारा निम्नलिखित विनियम एतद्वारा अधिसूचित किए जाते हैं :
(1) संक्षिप्त नाम और प्रारंभ :-
A (क) इन विनियमों का संक्षिप्त नाम अखिल भारतीय तकनीकी शिक्षा परिषद् (अभातशिप ) डिग्री इंजीनियरी कार्यक्रमों में पार्श्विक प्रवेश के माध्यम से छात्रों का प्रवेश विनियम, 2007 है ।
(ख) ये भारत के राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।
: (2) परिभाषाएं :-
इन विनियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,
(क) " अधिनियम " से अखिल भारतीय तकनीकी शिक्षा परिषद् अधिनियम, 1987 (1987 का 52) अभिप्रेत है ;
(ख) "आयोग " से विश्वविद्यालय अनुदान आयोग अधिनियम, 1956 की धारा 4 के अधीन स्थापित विश्वविद्यालय अनुदान आयोग अभिप्रेत है ;

(ग) " तकनीकी संस्था " से अभिप्रेत है एमसीए, वास्तुकला, नगर आयोजना, प्रबंधन, भेषजी, होटल प्रबंधन एवं खानपान प्रौद्योगिकी, अनुप्रयुक्त कला एवं शिल्प सहित इंजीनियरी , प्रौद्योगिकी में तकनीकी शिक्षा, प्रशिक्षण एवं शोध के क्षेत्र में तथा परिषद् द्वारा समय- समय पर यथाअधिसूचित ऐसे अन्य कार्यक्रमों एवं क्षेत्रों में पाठ्यक्रम/ कार्यक्रम संचालित करने के लिए सरकार द्वारा स्थापित, सरकार द्वारा सहायताप्राप्त तथा निजी (स्व-वित्तपोषित) कोई संस्था ;
(घ) " विश्वविद्यालय " से अभिप्रेत है विश्वविद्यालय अनुदान आयोग, अधिनियम, 1956 की धारा 2 के खंड ( च) के अधीन परिभाषित कोई विश्वविद्यालय तथा इसमें शामिल है उक्त अधिनियम की धारा 3 के अधीन कोई मानित विश्वविद्यालय संस्था ।
(ङ) इसमें प्रयुक्त अन्य सभी शब्दों तथा अभिव्यक्तियों, जिन्हें यहां परिभाषित नहीं किया गया है परंतु अखिल भारतीय तकनीकी शिक्षा परिषद् अधिनियम, 1987 (1987 का 52) में परिभाषित किया गया है, का क्रमशः वही अर्थ होगा जो उन्हें उक्त अधिनियम में निर्दिष्ट किया गया है ;
(3) उद्देश्य: -
ये विनियम इंजीनियरी एवं प्रौद्योगिकी में द्वितीय वर्ष डिग्री कार्यक्रमों में पार्श्विक प्रवेश के माध्यम से डिप्लोमा धारकों तथा बी.एससी . स्नातकों के दाखिले का उपबंध करते हैं ।
प्रयोज्यता : -

ये विनियम निम्नलिखित पर लागू होंगे :
( क) सभी संरकारी, सरकार द्वारा सहायताप्राप्त तथा निजी ( स्व - वित्तपोषित) तकनीकी संस्थाएं जो एमसीए , वास्तुकला, नगर आयोजना, प्रबंधन, भेषजी, होटल प्रबंधन एवं खानपान प्रौद्योगिकी, अनुप्रयुक्त कला एवं शिल्प सहित इंजीनियरी , प्रौद्योगिकी में तकनीकी शिक्षा , प्रशिक्षण एवं शोध के क्षेत्र में तथा परिषद् द्वारा समय - समय पर यथाअधिसूचित ऐसे अन्य कार्यक्रमों एवं क्षेत्रों में पाठ्यक्रम/ कार्यक्रम संचालित कर रही हैं ;
(ख) सरकारी , सरकार द्वारा सहायताप्राप्त तथा निजी ( स्व-वित्तपोषित) विश्वविद्यालय, जिनमें मानित विश्वविद्यालय भी शामिल हैं, जो एमसीए , वास्तुकला, नगर आयोजना, प्रबंधन, भेषजी , होटल प्रबंधन एवं खानपान प्रौद्योगिकी, अनुप्रयुक्त कला एवं शिल्प सहित इंजीनियरी , प्रौद्योगिकी में तकनीकी शिक्षा, प्रशिक्षण एवं शोध के क्षेत्र में तथा परिषद् द्वारा समय - समय पर यथाअधिसूचित ऐसे अन्य कार्यक्रमों और क्षेत्रों में पाठ्यक्रम /कार्यक्रम संचालित कर रहे हैं
अपेक्षा

क) अभातशिप की धारा 10 (ण) के अधीनं, परिषद् का यह दायित्व होगा कि वह तकनीकी और प्रबंधन शिक्षा का समन्वित और एकीकृत विकास तथा मानकों का अनुरक्षण सुनिश्चित करने के लिए सभी ऐसे कदम उठाएगी, जो वह ठीक समझे तथा इस अधिनियम के अधीन कृत्यों 3

का निष्पादन करने के प्रयोजनों के लिए परिषद् तकनीकी शिक्षा प्रदान कर रही तकनीकी संस्थाओं और विश्वविद्यालयों को छात्रों के प्रवेश हेतु दिशा- निर्देश उपलब्ध कराएगी ।
6.1 द्वितीय वर्ष डिग्री इंजीनियरी कार्यक्रमों में डिप्लोमा धारकों का पार्श्विक प्रवेश के माध्यम से दाखिला
6.1 (क) डिप्लोमा धारकों का दाखिला
हालांकि इंजीनियरी डिप्लोमा कार्यक्रमों को सीमांतक प्रकृति का समझा जाता है, डिप्लोमा धारकों में से मेधावी छात्रों को इंजीनियरी डिग्री प्राप्त करने के लिए समर्थ बनाने के लिए कुछ लचीलापन दिया जाना आवश्यक है । ऐसे डिप्लोमा धारकों का प्रमाण विद्यमान है, जो न केवल अपने शैक्षणिक जीवन में बल्कि अपनी नौकरियों में भी बेहतर कार्य करने पर इंजीनियरी कार्यक्रम के लिए अध्ययन करते हैं ।
6.1 (ख) पात्रता
किसी इंजीनियरी डिग्री कार्यक्रम में द्वितीय वर्ष तृतीय सत्रीय स्तर पार्श्विक प्रवेश प्राप्त करने हेतु पात्र बनने के लिए उम्मीदवार को न्यूनतम 60 प्रतिशत योग के साथ संबंधित शाखा में इंजीनियरी डिप्लोमा अनिवार्यतः उत्तीर्ण किया होना चाहिए । केवल इन शर्तों को पूरा करने वाले उम्मीदवार ही डिग्री कार्यक्रम हेतु पार्श्विक प्रवेश के लिए डिप्लोमा धारकों के चयन हेतु आशयित प्रवेश परीक्षा में बैठने के पात्र होंगे । उम्मीदवारों का चयन एक प्रवेश परीक्षा पर आधारित होगा तथा परीक्षा में योग्यता संबंधी वरीयता दाखिले का आधार होगी ।
वर्तमान में छात्र विभिन्न राज्यों/ संघ राज्यक्षेत्रों में विभिन्न कार्यक्रमों के माध्यम से डिप्लोमा प्राप्त करते हैं । ऐसे कार्यक्रमों की भिन्न संरचना और भिन्नः स्वरूप होता है, जैसे सत्रीय पैटर्न, वार्षिक पैटर्न, सैंडविच पैटर्न आदि । एकरूपता बनाने के लिए एक सामान्य प्रवेश परीक्षा अनिवार्य प्रतीत होती है । इसके अलावा, यह आवश्यक है कि केवल ऐसे मेधावी छात्रों का ही चयन किया जाए जिन्होंने अच्छे शैक्षिक रिकार्ड के साथ डिप्लोमा उत्तीर्ण किया हो ।

ऐसे छात्र को, जिसने 10+ (सेकेंडरी स्कूल लीविंग सर्टिफिकेट परीक्षा) के पश्चात् सांस्थानिक अध्ययन के न्यूनतम तीन वर्षों के माध्यम से डिप्लोमा हासिल किया है, शैक्षणिक रूप से उस छात्र के समकक्ष मानने पर विचार किया जा सकता है जिसने चार वर्षीय इंजीनियरी डिग्री कार्यक्रम का प्रथम वर्ष उत्तीर्ण कर लिया है, जिसके लिए अर्हक परीक्षा 12+ स्तर की है ।
संबंद्धक विश्वविद्यालय कमियों को पूरा करने के लिए ' ऐसे डिप्लोमा धारकों के लिए प्रतिपूरक पाठ्यक्रम विहित कर सकते हैं, जिन्हें पार्श्विक प्रवेश के माध्यम से प्रवेश दिया गया है ।

6.2 ( क) बी.एससी. , स्नातकों का दाखिला
देश में विज्ञान शिक्षा को मुख्य रूप ने डिग्री पाठ्यक्रम पूरे कर लेने के पचात् रोजगार के अवसरों की कमी के कारण ही हानि हो रही है । इस प्रवृत्ति ने देश में वेज्ञान शिक्षा को प्रभावित किया है तथा कुछ ही विद्यार्थी विज्ञान के विषयक्षेत्र में जाने का नेकल्प चुनते हैं । स्नातक शिक्षा पूरी कर लेने के प्श्चात् विज्ञान के छात्रों के रोजगार के समुचित अवसर उपलब्ध कराने के लिए , विज्ञान के स्नातकों को डिप्लोमा धारकों के साथ पार्श्विक प्रवेश के माध्यम से द्वितीय वर्ष में इंजीनिररी पाठ्यक्रमों में शामिल होने की अनुमति प्रदान की जानी चाहिए ।
6.2 (ख) पात्रता :
द्वितीय वर्ष/ तृतीय सत्रीय स्तर पर किसी इंजीनियरी डिग्री कार्यक्रम में पार्श्विक प्रवेश हेतु पात्र बनने के लिए उम्मीदवार को एक विषय के रूप में गणित तथा न्यूनतम 60 प्रतिशत अंकों के योग के साथ विज्ञान में डिग्री (बी.एससी. ) अवश्य उत्तीर्ण की होनी चाहिए । केवल इन शर्तों को पूरा करने वाले उम्मीदवार है. किसी इंजीनियरी डिग्री कार्यक्रम में पार्श्विक प्रवेश हेतु बी.एससी . स्नातकों के चयन के लए आशयित प्रवेश परीक्षा में बैठने के पात्र होंगे । उम्मीदवारों का चयन प्रवेश परीक्षा पर भाधारित होगा तथा परीक्षा में योग्यता संबंधी रैंकिंग दाखिले का आधार होगी ।
संबद्धक विश्वविद्यालय बी.एससी. डिग्री धारकों को द्वितीय वर्ष स्तर पर विज्ञान पाठ्यक्रमों तथा अन्य संबद्ध पाठ्यक्रमों से छूट प्रदान कर सकता है तथा कमियों को पूरा करने के लिए प्रतिपूरक पाठ्यक्रम विहित कर सकता है ।
(7) पार्श्विक प्रवेश की व्याप्ति
डिप्लोमा धारक तथा बी.एससी . डिग्री धारक द्वितीय वर्ष इंजीनयरी डिग्री कार्यक्रमों में प्रवेश के लिए संस्वीकृत प्रवेश क्षमता के अधिकतम 10 प्रतिशत तव ही पात्र होंगे, जो अनुमोदित प्रवेश- क्षमता के अलावा (अतिरिक्त) होगी । इसके अलावा, ये उम्मीदवार प्रथम वर्ष स्तर के रिक्त स्थानों पर द्वितीय वर्ष में दाखिले के लिए पात्र होगे। संबंधित प्रवेश प्राधिकरण प्रवेश के लिए डिप्लोमा धारकों तथा बी.एससी . स्नातकों के बीच अनुपात का निर्णय करेगा ।
(8) निर्वचन
यदि इन विनियमों के निर्वचन के संबंध में कोई प्रश्न उठता है, तो उसका निर्णय परिषद् द्वारा किया जाएगा ।
परिषद् को इन विनियमों के क्रियान्वयन के संबंध में उठने वाली किसी भी शंका के निराकरण के लिए स्पष्टीकरण जारी करने की शक्ति होगी ।

(9) छूट देने की शक्ति
परिषद्, अपवाद स्वरूप मामलों में, किसी भी कठिनाई अथवा लिखित रूप में दर्ज किए जाने -वाले ऐसे अन्य कारणों के निराकरण के लिए , इन विनियमों के किन्हीं उपबंधों में छूट दे सकेगी ।

NOTIFICATION,
New Delhi , the 12th January, 2007
No. F. 37-3/Legal/2007.-in exercise of the powers conferredby Sub-section (1 ) of Section 23 read with Section 10 (b) , (0) & (v) of the All India Council for Technical Education Act, 1987 (52 of 1987) , following Regulations are hereby notified by the Council :
Short title and commencement: -
(1)
(a) These Regulations maybe called the All India Council for Technical Education ( AICTE) admission ofstudents in Degree Engineering Programmes through lateral entry Regulations 2007 .
(b) They shall come into force w.e.f. the date of publication in the Official Gazette of India .
Definitions: -

In these Regulations , unless the context otherwise requires , -
(a) "Act " means the All India Council for Technical Education Act , 1987 ( 52 of 1987 ) ;
(b) "Commission " means the University Grants Commission established under section 4 of the University Grants Commission Act 1956;
(c) ' Technical Institution " means an Institution set up by Government , Government Aided and Private (self financing) for conducting courses / programmes in the field technical education , training and research in Engineering , Technology Including MCA, Architecture , Town Planning , Management , Pharmacy, Hotel Management & Catering Technology , Applied Arts & Crafts and such other programmes and areas as are notified by the Council from time to time;
(d ) " University" means a University defined under clause ( f ) of Section 2 of the University Grants Commission Act , 1956 and includes an institution deemed to be University under section 3 of that Act;
(e) All other words and expressions used herein and not defined but defined in the All India Council for Technical Education Act , 1987 ( 52 of 1987 ) , shall have the meanings respectively assigned to them in the said Act ;
Purpose:-

These Regulations provide for admission of diploma holders and B.Sc. graduates into second year degree programmes in Engineering and Technology through lateral entry.
Applicability: -
(4)
TheseRegulations shall be applicable to:
(a) All technical institutions of Govt . , Govt . Aided and Private (Self financing ) conducting courses / programs in the fields of technical education , training and research in Engineering , Technology including MCA, Architecture , Town Planning , Management , Pharmacy, Hotel Management &

Catering Technology, Applied Arts & Crafts and such other programs and areas as are notified by the Council from time to time .
(b ) Universities including Deemed to be Universities of Government , Government Aided and Private (self financing) conducting courses / programs in the fields of technical education , training and research in Engineering , Technology including MCA, Architecture , Town Planning , Management , Pharmacy, Hotel Management & Catering Technology , Applied Arts & Crafts and such other programs and areas as are notified by the Council from time to time .
(5) Requirement: -
1 Under section 10 ( 0 ) of AICTE Act , it shall be the duty of the Council to take all such steps as it may think fit for ensuring coordinated and integrated development of technical and management education and maintenance of standards and for the purposes of performing the functions under this Act , the Council may provide guidelines for admission of students to technical institutions and Universities imparting technical education .
6.1 ADMISSION OF DIPLOMA HOLDERS INTO SECOND YEAR DEGREE ENGINEERING PROGRAMES THROUGH LATERAL ENTRY
6.1 . (a) Admission of Diploma Holders
Although engineering diploma programmes are conceived as terminal in nature , some flexibility has to be built in to enable the meritorious amongst diploma holders to obtain Engineering degrees . There is evidence of diploma holders pursing an Engineering programme having performed well not only in their academic careers but also in their jobs .
6.1 ( b ) Eligibility
For being eligible to seek lateral entry to an Engineering degree programme at the second year / third semester level , a candidate must have passed the diploma in Engineering in the relevant branch with a minimum of 60 percent in the aggregate . Only candidates fulfilling these conditions would be eligible for appearing in the entrance test meant for selection of diploma holders for Lateral entry to degree programmes . The selection of candidates will be based on an entrance test, the merit ranking in the test being the basis of admission .
At present students obtain diploma through different programmes in different States / UTs . Such programmes have different structures and forms like the semester pattern , annual pattern , sandwich pattern , etc. in order to maintain uniformity , a common entrance examination seems essential . Further, it is necessary to select only meritorious students who have passed the diploma. with good academic record .
A student who has acquired a diploma in Engineering through a minimum of three years of institutional study, after 10+ ( Secondary School Leaving Certificate Examination ) can be considered to be academically equivalent to a student who has passed the first year of the four year Engineering degree programme for which the qualifying examination is of the 12+ level .
The Affiliating University may prescribe compensatory courses to make up deficiencies for diploma holders , who are admitted through lateral entry.
6.2(a) Admission of B. Sc ,. Graduates
Science education in the country is suffered primarily due to lack of employment opportunities after completion of degree courses . This trend is affected the science education in the country and only a few students are opting to go for the science stream . In order to provide science भारत का राजपत्र : असाधारण

students avenues for proper employment opportunities after completing graduation , Science graduates may be permitted to join Engineering courses at second year along with the diploma holders through lateral entry .
6.2 (b ) Eligibility:
For being eligible to seek lateral entry to an Engineering degree programme at the second year/ third semester level , a candidate must have passed the Degree in Science ( B.Sc. , ) , with Mathematics as a subject and with a minimum of 60 percent marks in the aggregate . Only candidates fulfilling these conditions would be eligible for appearing in the entrance test meant for selection of B.Sc. , graduates for Lateral entry to an Engineering degree programme. The selection of candidates will be based on an entrance test , the merit ranking in the test being the basis of admission .
The affiliating University may exempt B.Sc. , degree holders form Science courses and other relevant courses at the second year level and prescribe compensatory courses to makeup deficiencies .
Extent of Lateral Entry

Diploma holders and B.Sc Degree holders shall be eligible for admission to second year Engineering degree programmes up to a maximum of 10% of sanctioned intake , which will be over and above theapproved intake (supernumerary) . In addition , these candidates shall be eligible for admission in the second year against the vacant seats at first year level . The concerned Admission Authority shall decide the ratio between the diploma holders and B.Sc graduates for admission .
Interpretation

If any question arises as to the interpretation of these Regulations, the same shall be decided by theCouncil .
The Council shall have the power to issue clarification to remove any doubt which may arise in regard to implementation of these Regulations .
(9) Power to relax
The Council may , in exceptional cases , for removal of any hardship or such other reasons to be recorded in writing , relax any of the provisions of these Regulations .
