सा.का.नि. 169( अ ) वायुयान नियम , 1937 का और संशोधन करने के लिए कतिपय नियमों का निम्नलिखित प्रारूप, जो केन्द्रीय / सरकार, वायुयान अधिनियम, 1934 ( 1934 का 22 ) की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बनाना चाहती है, उक्त अधिनियम की धारा 14 द्वारा अपेक्षित तथा उन सभी व्यक्तियों की जानकारी के लिए जिनके उससे प्रभावित होने की संभावना है , प्रकाशित किया जाता है और सूचना दी. जाती है कि भारत के राजपत्र में प्रकाशित अधिसूचना की प्रतियों को सार्वजनिक रूप से उपलब्ध कराए जाने की तारीख से तीस दिन की अवधि के पश्चात् उक्त प्रारूप पर विचार किया जाएगा ।
आपत्तियां या सुझाव , यदि कोई है , तो महानिदेशक, नागर विमानन , सफदरजंग हवाई अड्डा के सामने, नई दिल्ली -110003 को संबोधित किए जाएं ।
उक्त विनिर्दिष्ट अवधि की समाप्ति से पूर्व, उक्त प्रारूप नियमों के संबंध में किसी व्यक्ति से प्राप्त आपत्ति या सुझाव पर केन्द्र सरकार द्वारा विचार किया जाएगा।
प्रारूप नियम
1. ( 1 ) इन नियमों को वायुयान ( संशोधन ) नियम, 2007 कहा जाएगा ।
(2) ये सरकारी राजपत्र में अंतिम प्रकाशन की तारीख से प्रभावी होंगे ।
2. वायुयान नियम, 1937 में, अनुसूची II में,-
( 1 ) अनुभाग ञ, पैरा 1 में, खण्ड ( ज) में, " आवेदन की तारीख से ठीक पूर्ववर्ती छह माह की अवधि के भीतर सक्षमता -में प्रकट करनी होगी" शब्दों के स्थान पर निम्नलिखित प्रतिस्थापित किए जाएंगे , नामशः -
" आवेदन की तारीख से ठीक पूर्ववर्ती छह माह की अवधि के भीतर तथापि , महानिदेशक, कौशल परीक्षण या उसके भाग को, वायुयान की किस्म के लिए वायुयान/अनुमोदित शून्य उड़ान समय प्रशिक्षण सिमुलेटर स्तर ' घ ' पर संचालित करने की अनुज्ञा दे सकेंगे। सक्षमता का प्रदर्शन में करना होगा-" 4.
(2 ) अनुभाग ड में, पैराग्राफ 1 में, खण्ड (छ ) के वर्तमान मूल पाठ के अंत में, निम्नलिखित शब्द अन्तःस्थापित किए जाएंगे , नामशः:
" तथापि , महानिदेशक , कौशल परीक्षण या उसके भाग को वायुयान की किस्म के लिए वायुयान/ अनुमोदित शून्य उड़ान समय प्रशिक्षण सिमुलेटर स्तर ' घ ' पर संचालित करने की अनुज्ञा दे सकेंगे। "

NOTIFICATION
NewDelhi , the 2nd March , 2007
G.S.R. 169 ( E ) .- The following draft of certain rules further to amend the Aircraft Rules , 1937, which the Central Government proposes to make in exercise of the powers conferred by Section 5 of the Aircraft Act , 1934 (22 of 1934) , is hereby published as required by Section 14 of the said Act, for information of all persons likely to be affected thereby; and notice is hereby given that the said draft will be taken into consideration after a period of thirty days from the date on which copies of the Gazette of India in which this notification is published , are made available to the public:
Objections or suggestions , if any , may be addressed to the Director General of Civil Aviation . Opposite Safdarjung Airport, New Delhi - 110003;
Any objection or suggestion, which may be received from any person with respect to the said draft rules before the expiry of the period specified above , will be considered by the Central Government .
DRAFT RULES
1. (1) These rules may be called the Aircraft( .... Amendment) Rules , 2007 .
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Aircraft Rules , 1937 , in Schedule II , ---
(1) in Section J , in paragraph 1 , in clause (h) , for the words " within a period of six months immediately preceding the date of application . The competency shall be demonstrated in-" , the following shall be substituted, namely :--
"within a period of six months immediately preceding the date of application. The Director General may , however , allow Skill Text or part thereof to be carried out on aircraft/ approved Zero Flight Time Training simulator level ' D' for the type of aircraft . The competency shall be demonstrated as in-" (2) in Section M, in paragraph 1, in the end of existing text of clause ( g ) , the following words shall be inserted , namely:-
"The Director General may , however , allow skill tests or part thereof to be carried out on aircraft/ approved Zero Flight Time Training simulator level ' D' for the type of aircraft. "
