का.आ. 314( अ), केन्द्रीय सरकार ने पेट्रोलियम और खनिज पाइपलाईन ( भूमि में उपयोग के अधिकार का अर्जन ) अधिनियम, 1962 ( 1962 का 50 ) ( जिसे इसके पश्चात् उक्त अधिनियम कहा गया है ) की धारा 3 की उप - धारा ( 1 ) के अधीन जारी की गई भारत सरकार के पेट्रोलियम और प्राकृतिक गैस मंत्रालय की अधिसूचना संख्या का. आ.692 ( अ ) तारीख 14-6-2004 द्वारा उन अधिसूचनाओं से संलग्न अनुसूची में विनिर्दिष्ट भूमि में गेल ( इण्डिया ) लिमिटेड द्वारा महाराष्ट्र राज्य दहेज - हज़ीरा - उरान एवं स्पर पाइपलाईनों ( पनवेल - दाभोल सेक्सन ) के माध्यम से प्राकृतिक गैस परिवहन के लिए पाइपलाईन बिछाने के प्रयोजन के लिए उपयोग के अधिकार का अर्जन करने के अपने आशय की घोषणा की थी ;

और, उक्त राजपत्रित अधिसूचनाओं की प्रतियाँ जनता को तारीख 4-2-2005 तक उपलब्ध करा दी गई थीं ;

और, पाइपलाईन बिछाने के संबंध में जनता से प्राप्त आक्षेपों पर सक्षम प्राधिकारी द्वारा विचार कर लिया गया है और उन्हें अननुज्ञात कर दिया गया है;

और , सक्षम प्राधिकारी ने , उक्त अधिनियम की धारा 6 की उप - धारा ( 1 ) के अधीन केन्द्रीय सरकार को अपनी रिपोर्ट दे दी है ;

और , केन्द्रीय सरकार ने , उक्त रिपोर्ट पर विचार करने के पश्चात् और यह समाधान हो जाने पर कि उक्त भूमि में पाइपलाईनें बिछाने के लिये अपेक्षित हैं, उसमें उपयोग के अधिकार का अर्जन करने का विनिश्चय किया है ;

और , उक्त अधिनियम की धारा 3 की उप - धारा ( 1 ) के अन्तर्गत अधिसूचना संख्या का.आ. 692 ( अ ) तारीख 14-06-2004 द्वारा अधिसूचित भूमि में से कुछ भूमि की अधिसूचना उक्त अधिनियम की धारा 6 की उप- धारा ( 1 ) के अन्तर्गत का.आ. 2062 तारीख 18-05-2006, का.आ. 2063 तारीख 20-05-2006 एवं का. आ. 1736( अ ) तारीख 09-10-2006 द्वारा की जा चुकी है;

अतः , अब , केन्द्रीय सरकार , उक्त अधिनियम की धारा 6 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह घोषणा करती है कि इस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में पाइपलाईनें बिछाने के लिए उपयोग के अधिकार का अर्जन किया जाता है;

और , केन्द्रीय सरकार, उक्त अधिनियम की धारा 6 की उप- धारा (4 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निर्देश देती है कि पाइपलाईनें बिछाने के लिए भूमि में उपयोग का अधिकार , इस घोषणा के प्रकाशन की तारीख को, केन्द्रीय सरकार में निहित होने की बजाय 709 GI/2007 (1) THE GAZETTE OF INDIA : EXTRAORDINARY

पाइपलाईनें बिछाने का प्रस्ताव करने वाली गेल ( इण्डिया ) लिमिटेड में निहित होगा और तदुपरि, भूमि में ऐसे उपयोग का अधिकार, इस प्रकार अधिरोपित निबंधनों और शर्तों के अधीन रहते हुए , सभी विल्लंगमों से मुक्त , गेल ( इण्डिया ) लिमिटेड में निहित होगा ।

MINISTRY OF PETROLEUM AND NATURAL GAS

NOTIFICATION

New Delhi , the 2nd March , 2007

S.O. 314 (E) . Whereas , by notification of the Government of India in the Ministry of Petroleum and Natural Gas number S.O. 692 ( E) dated 14-06-2004 issued under Sub - section ( 1 ) of Section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of Users in Land ) Act , 1962 (50 of 1962 ) ( hereinafter referred to as the said Act ) , the Central Government declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose of laying pipeline for transport of natural gas through Dahej -Hazira - Uran & its spur pipelines (Panvel- Dabhol section) in the State of Maharashtra by GAII . ( India ) Limited;

And, whereas , copies of the said Gazette notifications were made available to the public on 04-02-2005;

And, whercas , the objection received from the public to the laying of the pipeline have been considered and disallowed by the Competent Authority;

And, whereas , the Competent Authority has , under Sub - section ( 1) of Section of the said Act , submitted its report to the Central Government;

And, whereas , the Central Government has, after considering the said report , decided to acquire the Right of User in the lands specified in the Schedule;

And, whereas , part of the land notified under Sub - section ( 1 ) of Section 3 of the said Act vide S.O. 692 (E) dated 14- 06-2004 has been earlier notifed under Sub - section ( 1 ) of Section 6 of the said Act vide S.O. 2062 dtd . 18-05-2006 , S.O. 2063 dtd. 20-05-2006 and 1736 (E) dtd. 09-10-2006;

Now, therefore , in exercise of the powers conferred by Sub - section (1) of Section 6 of the said Act, the Central Government hereby declares that the Right of User in the land specified in the Schedule is hereby acquired for laying the pipeline;

And, further , in exercise of the powers conferred by Sub- section (4) of Section 6 of the said Act, the Central Government hereby directs that the Right of User in the said land for laying the pipeline shall , instead of vesting in the Central Government , vest , on this date of the publication of the declaration , in the (GAl . ( India ) Limited , free from all encumbrances .
