आ.अ. 24( अ ). - यतः , छत्तीसगढ़ राज्य से लोक सभा में उस राज्य के 11 राजनांदगांव संसदीय निर्वाचन क्षेत्र से निर्वाचित , श्री प्रदीप गांधी का स्थान अध्यक्ष , लोक सभा के आदेश दिनांक 23-12-2005 द्वारा 23-12-2005 से सदस्यता समाप्ति के कारण रिक्त हो गया है; और
यतः , अध्यक्ष के उक्त आदेश को चुनौती देते हुए भारत के सर्वोच्च न्यायालय के समक्ष 2006 की रिट याचिका संख्या । तथा कुछ स्थानांतरण मामले दर्ज किए गये तथा सर्वोच्च न्यायालय ने 3 अप्रैल , 2006 को यह निदेश दिया था कि उक्त मामलों के लंबित होते हुए उन स्थानों को भरने के लिए उप- निर्वाचन नहीं करवाये जा सकते हैं; और
यतः , सर्वोच्च न्यायालय ने दिनांक 10-1-2007 के अपने निर्णय द्वारा इन सभी मामलों को रद्द करने की घोषणा की है; और
यतः , इस प्रकार हुई रिक्ति को भरने के प्रयोजन से उप - निर्वाचन कराया जाना है ;
अतः , अब लोक प्रतिनिधित्व अधिनियम, 1951 ( 1951 का 43 ) की धारा 149 की उप - धारा ( 1 ) तथा धाराओं 30. और 56 के अनुसरण में, भारत निर्वाचन आयोग एतद्वारा
(अ ) छत्तीसगढ़ राज्य में उक्त 11 - राजनांदगांव संसदीय निर्वाचन क्षेत्र से यह अपेक्षा करता है कि वह 03 अप्रैल , 2007 (मंगलवार) से पूर्व तथा उक्त अधिनियम के और तद्धीन बनाए गए नियमों और किए गए आदेशों के उपबन्धों के अनुसार लोक सभा में उक्त रिक्ति को भरने के प्रयोजन से एक व्यक्ति निर्वाचित करें;
(आ) उक्त निर्वाचन के संबंध में-
(क) नाम निर्देशन करने की अन्तिम तारीख
:
10 मार्च , 2007 ( शनिवार );
(ख) नाम निर्देशनों की संवीक्षा की तारीख
:
12 मार्च, 2007 ( सोमवार) ;
( ग ) अभ्यर्थिताएं वापस लेने की अन्तिम तारीख
: 14 मार्च, 2007 ( बुधवार ) ;
:
( घ ) वह तारीख जिसको यदि आवश्यक हुआ तो मतदान होगा
29 मार्च , 2007 ( वीरवार ) ; और
:
( ङ) वह तारीख जिससे पूर्व निर्वाचन सम्पन्न करा लिया जाएगा
3 अप्रैल , 2007 (मंगलवार) ;
नियत करता है ; और

( इ) 7:30 बजे पूर्वाहन से 4:30 बजे अपराहन तक का समय ऐसे समय , के रूप में नियत करता है जिसके दौरान यदि आवश्यक हुआ तो , निर्वाचन के लिए उपर्युक्त विनिर्दिष्ट तारीख को मतदान होगा।

NOTIFICATION
New Delhi , the 3rd March , 2007
Ο.Ν. 24 ( E ) . Whereas , the seat of Shri Pradeep Gandhi in the House of the People , elected from 11 -Rajnandgaon Parliamentary Constituency in the State of Chhattisgarh , has become vacant on 23-12-2005 , due to cessation of his membership on the order of the Speaker , Lok Sabha on 23-12-2005 ; and Whereas, a Writ Petition No. 1 of2006 and certain Transferred Cases were filed before the Supreme Court of India challenging the order of the Speaker , and the Supreme Court had directed on 3rd April , 2006 that the bye - election to fill the said vacancy may not be held , pending the above cases ; and
Whereas, the Supreme Court has pronounced its judgment dismissing all these cases on 10-01-2007; and Whereas, a bye - election is now to be held for the purpose of filling the said vacancy :
Now, therefore, in pursuance of Sub- section ( 1) of Section 149 , and Sections 30 and 56 of the Representation of the People Act , 1951 ( 43 of 1951 ) , the Election Commission of India hereby .--.
(A) calls upon the said 11 - Rajnandgaon Parliamentary Constituency in the State of Chhattisgarh to elect, before the 03-04-2007 ( Quesday) and in accordance with the provisions of the said Act and of the rules and orders made thereunder , a person for the purpose of filling the said vacancy in the House of the People ; and
(B) appoints , with respect to the said election .
(a) the 10-03-2007 ( Saturday ) , as the last date for making nominations;
(b ) the 12-03-2007 ( Monday) , as the date for the scrutiny of nominations ;
(c ) the 14-03-2007 ( Wednesday) , as the last date for the withdrawal of candidatures ;
(d) the 29-03-2007 ( Thursday ) , as the date on which a poll shall, if necessary , be taken ; and
(e) the 03-04-2007 ( Tuesday) . as the date before which the election shall be completed; and
(C) fixes the hours from 7.30 A.M. to 4.30 P.M. , as the hours during which the poll shall . if necessary, be taken on the date pecified above for the election .
