आ.अ. 25( अ ).-यतः लोक सभा द्वारा दिनांक 23 दिसम्बर , 2005 को एक प्रस्ताव स्वीकृत कर श्री मनोज कुमार सहित उसके दस सदस्यों को निष्कासित कर दिया गया, जैसा कि उसकी दिनांक 23 दिसम्बर , 2005की अधिसूचना सं. 2175 /2005 /ट में अधिसूचित है , जिसके परिणामस्वरूप लोक सभा में, झारखण्ड राज्य में 13 पलामू ( अ.जा. ) संसदीय निर्वाचन क्षेत्र से निर्वाचित श्री मनोज कुमार का स्थान उनकी सदस्यता समाप्त हो जाने के कारण दिनांक 23 दिसम्बर , 2005 को रिक्त हो गया था; और
यतः , लोक सभा से सदस्यों के निष्कासन को चुनौती देते हुए 2006 की रिट याचिका सं. 1 और कुछ अंतरिम मामले उच्चतम न्यायालय में दाखिल किये गये थे और उच्चतम न्यायालय ने अपने दिनांक 3 अप्रैल , 2006 के आदेश द्वारा निदेश दिया था कि उपर्युक्त रिट याचिका और अंतरिम मामलों के निपटान लम्बित रहने तक किसी भी आकस्मिक रिक्ति, जिसमें 13 पलामू ( अ.जा. ) की रिक्ति शामिल है , को भरने के लिए उप निर्वाचन नहीं कराया जा सकता; और
यतः , उच्चतम न्यायालय ने अपने दिनांक 10 जनवरी , 2007 के आदेश द्वारा उपर्युक्त, रिट याचिका और अंतरित मामलों को खारिज करते हुए अपने निर्णय की घोषणा की है ; और
यतः , उक्त रिक्ति को भरने के प्रयोजन से अब एक उप निर्वाचन कराया जाना अपेक्षित है;
अतः अब , लोक प्रतिनिधित्व अधिनियम, 1951 ( 1951 का 43 ) की धारा 149 की उप - धारा ( 2 ) और धारा 30 और 56 के अनुसरण में भारत निर्वाचन आयोग एतद्वारा
( क ) झारखण्ड राज्य में उक्त 13 - पंलामू ( अ.जा. ) संसदीय निर्वाचन क्षेत्र में 3 अप्रैल , 2007 ( मंगलवार ) से पहले और उक्त अधिनियम के उपबन्धों और तद्दीन बनाए गए नियमों और आदेशों के अनुसार, लोक सभा में उक्त रिक्ति को भरने के प्रयोजन से अनुसूचित जाति से संबंध रखने वाले एक व्यक्ति को निर्वाचित कर दें; और
(ख ) उक्त निर्वाचन के संबंध में

(ङ) वह तारीख जिससे पूर्व निर्वाचन सम्पन्न

(ग) 00 बजे पूर्वाहन से 4.00 बजे अपराहन् तक का समय उस समय के रूप में नियत करता है जिसके दौरान यदि आवश्यक हुआ उपरोक्त निर्वाचन के लिए ऊपर विनिर्दिष्ट तारीख को मतदान होगा ।

NOTIFICATION
New Delhi , the 3rd March , 2007
O.N. 25( E ) . Whereas, the seat of Shri Manoj Kumar in the Lok Sabha, elected from 13 - Palamu ( SC ) Parliamentary Constituency in the State of Jharkhand , had become vacant on 23rd December , 2005 , due to cessation of his membership consequent upon the adoption of a Motion by the Lok Sabha on 23rd December , 2005 expelling its terr members including Shri Manoj Kumar , as notified in its notification number 21 / 5 / 2005 / T dated 23rd December , 2005 ; and Whereas , a Writ Petition No. 1 of 2006 and certain Transferred Cases were filed before the Supreme Court of India, challenging expulsion of the members from Lok Sabha and the Supreme Court had directed , vide its order dated 3rd April, 2006, that bye elections to fill any of the casual vacancies including the vacancy of 13 - Palamu ( SC ) may not be held , pending disposal of the above said Writ Petition and transferred cases ; and Whereas , the Supreme Court has pronounced its judgment dismissing the above said Writ Petition and transferred cases vide its order dated 10th January, 2007 ; and Whereas , a bye - election is now required to be held for the purpose of filling the said vacancy; Now, therefore, in pursuance of Sub - section (2 ) of Section 149 , and Sections 30 and 56 of the Representation of the People Act , 1951-43 of 1951 ) , the Election Commission of India hereby: (A) calls upon the said 13 -Palamu ( SC) Parliamentary Constituency in the State of Jharkhand to elect , before the Sed April , 2007 ( Tuesday) and in accordance with the provisions of the said Act and of the rules and orders made thereunder , a person belonging to Scheduled Caste for the purpose of filling the said vacancy in the House of the People ; and
(B) appoints , with respect to the said election-
14: the 10th March , 2007 ( Saturday ) , as the last date for making nominations:
the 12th March, 2007 ( Monday ) , as the date for the scrutiny of nominations:
the 14th March, 2007 ( Wednesday ), as the last date for the withdrawal of candidatures;
J: the 29th March , 2007 ( Thursday ) , as the date on which a poll shatl , if necessary .be taken ; and the 3rd April , 2007 ( Tuesday ) as the date before which the election shall be completed ; and
(C) Exes the hours from 7.00 A.M. to 4.00 P.M. , as the hours during which the poil shall , ifnecessary , be taken on the date specified above for the election.
