सा.का.नि. 184( अ ) अखिल भारतीय सेवाएँ अधिनियम , 1951 ( 1951 का 61 ) की धारा 3 की उप- धारा ( 1 क ) के साथ पठित उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार , संबंधित राज्य सरकारों के साथ परामर्श करने के पश्चात् अखिल भारतीय सेवाएँ ( मृत्यु- सह -सेवानिवृत्ति- लाभ ) नियमावली , 1958 में आगें और संशोधन करने के लिए एतद्वारा निम्नलिखित नियम बनाती है :-
1. (1 ) इन नियमों का नाम अखिल भारतीय सेवाएँ (मृत्यु-सह- सेवानिवृत्ति-लाभ ) तृतीय संशोधन नियमावली , 2007 है ।
(2) ये सरकारी राजपत्र में इनके प्रकाशन की तारीख से लागूहोंगे ।
2. अखिल भारतीय सेवाएँ ( मृत्यु- सह- सेवानिवृत्ति-लाभ) नियमावली , 1958 के नियम 26 के उप- नियम ( 1 ) में दूसरे परन्तुक के बाद, निम्नलिखित परन्तुक अन्तःस्थापित किया जाए , अर्थात्:-
" बशर्ते यह भी कि केन्द्र सरकार अथवा राज्य सरकार , जैसा भी मामला हो , अखिल भारतीय सेवा के सम्बन्धित संवर्ग नियमों के प्रावधानों के अन्तर्गत किसी पेंशनभोगी को ऐसे संगठन , जिसमें अखिल भारतीय सेवा के सदस्य को 'उसकी सेवानिवृत्ति के पूर्व तैनात किया गया था पर वाणिज्यिक रोजगार कीऔपचारिक स्वीकृति मिलने तक इस शर्त पर वाणिज्यिक रोजगार पर बने रहने की अनुमति देने के लिए सक्षम होगी कि सेवा का सदस्य, सक्षम प्राधिकारी द्वारा उसके उस पद पर बने

रहने की मंजूरी न देने का निर्णय किए जाने पर ऐसे संगठन को तुरन्त छोड़ देगा । "

G.S.R. 184 (E ). --- In exercise of the powers conferred by Sub - section ( 1) read with Sub - section ( 1A) of Section 3 ofthe All India Services Act , 1951 ( 61 of 1951 ) , the Central Government , after consultation with the Governments of the States concerned , hereby makes the following rules further to amend the All India Services ( Death - cum- Retirement Benefits ) Rules , 1958 , namely :----

3-2-1979 "Provided also that it shall be competent for the Central Government or the State Government, as the case may be, to allow the pensioner to continue in any commercial employment in an organisation with whom the services of the Members of the All India Services had been placed immediately before his /her retirement under the provisions of the respective Cadre Rules of All India services pending formal sanction of such commercial employment subject to the condition that the Member of the Service shall withdraw from such organisation forthwith once a decision is taken by the Competent Authority not to accord such sanction . "
