सा.का.नि. 188(अ )-केन्द्रीय सरकार, चीनी विकास निधि अधिनियम, 1982 ( 1982 का 4 ) की धारा 9 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, चीनी विकास निधि नियम , 1983 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-
1.. ( 1 ) इन नियमों का संक्षिप्त नाम चीनी विकास निधि (संशोधन ) नियम , 2007 है ।
(2) यह राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. चीनी विकास निधि नियम , 1983 में, नियम 24 के पश्चात् निम्नलिखित अध्याय अंतःस्थापित किया जाएगा , अर्थात्: -
"अध्याय 14
चीनी विकास निधि के उधार पर प्रतिभूति ब्याज और अतिरिक्तब्याज
25. ( 1 ) चीनी विकास निधि नियम 16, 17 , 21 , 22 और 23 के अधीन निधि से दिए गए उधारों के लिए प्रतिभूति, ब्याज और अतिरिक्त ब्याज निम्नानुसार शासित होंगे ।
(2) उधार पर बैंक दर से 2 % कम साधारण ब्याज रियायती दर पर देय होगा ।
(3) उधार की रकम के प्रति संदाय में या उसकी किसी किस्त या उस पर ब्याज के संदाय में किसी व्यतिक्रम (नियमों के अनुसार ) की दशा में, चीनी कारखाना
(1) 801 GI/2007
द्वारा व्यतिक्रम की रकम पर ढाई प्रतिशत प्रति वर्ष की दर पर अतिरिक्त ब्याज देय होगा ।
(4) चीनी कारखाना, अपेक्षित करार किए जाने के पश्चात्. और नियमों के अधीन उधार के संवितरण से पहले, केन्द्रीय सरकार के समाधान को उधार के लिए प्रतिभूति जमा करेंगी।
(5 ) प्रतिभूति, नियमों में यथा उपबंधित प्रति संदाय की पूरी अवधि के लिए उधार और उस पर ब्याज की रकम और उपर्युक्त उप - नियम ( 3 ) में यथा उपबंधित व्यतिक्रम की रकम पर अतिरिक्त ब्याज की रकम समाविष्ट होगी और यह निम्नलिखित किसी रीति में दी जाएगी अर्थात्:-
(i ) किसी अनुसूचित बैंक से बैंक गारंटी; या
(ii ) चीनी कारखाना की सभी चल और अचल सम्पत्तियों पर समरूप प्रथम चार्ज पर बंधक' जिसके न होने पर पूर्ण रूप से द्वितीय चार्ज के आधार पर :
परन्तु नियम 17 और नियम 21 के अधीन गन्नाविकास उधार के मामले में , सहकारी चीनी कारखाना राज्य सरकार की गांरटी के रूप में प्रतिभूति दे सकेगी।
(6) उधार या उसकी किस्त की प्रति संदाय में लगातार दो बार व्यतिक्रम होने की दशा में, केन्द्रीय सरकार, उपर्युक्त उप- नियम ( 5 ) के अधीन उधार के लिए दी गई किसी प्रतिभूति से या केन्द्रीय सरकार के प्रति चीनी कारखाने के किसी दावे से ब्याज सहित समस्त रकम और उस पर अतिरिक्त ब्याज की रकम वसूल करेगी। " 2

3. निम्नलिखित उप - नियम का लोप किया जाएगा :-
(i) नियम 16 में उप- नियम ( 9 ) खंड ( ii- क) और (iii);
(ii ) नियम 17 में, उपनियम ( 3 ) , खंड ( क ) में, " इस नियम के अधीन दी गई ऋण की रकम पर बैंक दर से दो प्रतिशत कम के साधारण ब्याज की रियायती दर होगी और " शब्दों और उप-नियम 3 ( ख ) ;
(iii) नियम 17 क में, उप- नियम (8 ) ; ( 11 ) और ( 12 ) ;
(iv) नियम 21 में , उप- नियम ( 11 ) खंड ( iii ) और उप- नियम ( 13 ) में खंड ( iii );

NOTIFICATION
New Delhi , the 9th March , 2007
G.S.R. 188 (E) . In exercise of the powers conferred by Section 9 of the Sugar Development Fund Act, 1982 (4 of 1982) , the Central Government hereby makes the following rules further to amend the Sugar Development Fund Rules , 1983 , namcly :-
(v) नियम 22 में, उप- नियम ( 13 ) , उप - नियम ( 16 ) और उप - नियम ( 18 ) और उप- नियम 18 के अधीन परन्तुक;
1. (1) These rules may be called the Sugar Development Fund (Amendment) Rules , 2007 .
(vi ) नियम 23 में, उप- नियम ( 15 ) , उप- नियम ( 16) और उप- नियम ( 18 ) और उप - नियम 18 के अधीन परन्तुक ।
(2) They shall come into force on the date of their publication in Official Gazette .

(2) The loans shall carry a concessional rate of simple interest of 2 % below the Bank Rate .
(3) In case of any default in repayment of the amount of loan or payment of any instalment thereof or interest thereon ( in accordance with the Rules) , an additional interest at the rate of two and half per cent per annum on the amount ofdefault shall be payable by the sugar factory .
i (4) The sugar factory shall , after the execution of the agreement required to be entered into and before the disbursement of the loan under Rules , furnish security for the loan to the satisfaction of the Central Government .
(5) The security shall cover the amount of loan and interest thereon for the full period of repayment as provided in the Rules and further additional interest on the amount of default as provided in sub -rule ( 3 ) above , and shall be furnished in any of the following manners namely:---
(i) Bank Guarantee from a Scheduled Bank: or 3

(ii) A mortgage on all immovable and movable properties of the sugar factory onpari passu first charge basis failing which on the basis of an exclusive second charge:
Provided that in case of sugarcane development loan under Rules 17 and 21 , a cooperative sugar factory can furnish the security in the form of State Government Guarantee .
(6) In case of two consecutive defaults in repayment of the loan or instalment thereof, the Central Government shall realise the entire amount of loan alongwith the interest and the additional interest thereon from any of the security provided for the loan under sub - rule (5) above or any claim of the sugar factory against the Central Government . "
3. The following sub - rules shall be deleted:-
(1) In Rule 16 , sub - rule (9 ), clause (ii - A) ; and clause (iii)
(ii) In Rule 17, sub - rule (3) , clause (a), the words from "The amount of loan" to "two per cent below the bank rate and " ; and sub - rule 3 (b) .
(iii) In Rule 17 A, sub- rules (8) ( 11) and (12) ;
(iv) In Rule 21, in sub - rule ( 11 ) clause (iii ) and in sub -rule ( 13) clause (iii);
(v) In Rule 22, sub - rules ( 13 ), ( 16) and (18 ) and proviso under sub- rule 18;
(vi) In Rule 23, sub - rules (15), ( 16) and ( 18 ) and proviso under sub - rule 18 .
