आ.अ. 34( अ ).-यतः , उत्तर प्रदेश राज्य से लोक सभा में उस राज्य के 60- बिल्हौर संसदीय निर्वाचन क्षेत्र से निर्वाचित , श्री राजा राम पाल का स्थान अध्यक्ष , लोक सभा के आदेश दिनांक 23-12-2005 द्वारा 23-12-2005 से सदस्यता समाप्ति के कारण रिक्त हो गया है; और
यतः , अध्यक्ष के उक्त आदेश को चुनौती देते हुए भारत के सर्वोच्च न्यायालय के समक्ष 2006 की रिट याचिका संख्या-1 तथा कुछ स्थानान्तरण मामले दर्ज किए गये तथा सर्वोच्च न्यायालय ने 3 अप्रैल, 2006 को यह निदेश दिया था कि उक्त मामलों के लंबित होते हुए उन स्थानों को भरने के लिए उप - निर्वाचन नहीं करवाये जा सकते हैं; और
यतः , सर्वोच्च न्यायालय ने दिनांक 10-1-2007 के अपने निर्णय द्वारा इन सभी मामलों को रद्द करने की घोषणा की है ; और
'यतः , इस प्रकार हुई रिक्ति को भरने के प्रयोजन से उप - निर्वाचन कराया जाना है;
अतः , अब, लोक प्रतिनिधित्व अधिनियम, 1951 ( 1951 का 43 ) की धारा 149 की उप- धारा ( 1 ) , तथा धाराओं 30 और 56 के अनुसरण में, भारत निर्वाचन आयोग एतद्वारा-
(अ) उत्तर प्रदेश राज्य में उक्त 60 - बिल्हौर संसदीय निर्वाचन क्षेत्र से यह अपेक्षा करता है कि वह 13 मई , 2007 ( रविवार ) से पूर्व : तथा उक्त अधिनियम के और तद्धीन बनाए गए नियमों और किए गए आदेशों के उपबंधों के अनुसार लोक सभा में उक्त रिक्तिको भरने के प्रयोजन से एक व्यक्ति निर्वाचित करें ;
(आ) उक्त निर्वाचन के संबंध में-
क) नाम निर्देशन करने की अन्तिम तारीख : 20 मार्च, 2007 (मंगलवार) ;
(
ख) नाम निर्देशनों की संवीक्षा की तारीख 21 मार्च, 2007 ( बुधवार );
(
(ग) अभ्यर्थिताएं वापस लेने की अंतिम तारीख : 23 मार्च, 2007 ( शुक्रवार) ;
( घ ) वह तारीख जिसको यदि आवश्यक हुआ तो मतदान होगा 7 अप्रैल , 2007 ( शनिवार ) ;
(ड. ) वह तारीख जिससे पूर्व निर्वाचन सम्पन्न करा लिया जाएगा 13 मई , 2007 (रविवार ) ;
नियत करता है; और

( ई) 7.00 बजे पूर्वाह्न से 5.00 बजे अपराह्न तक का समय ऐसे समय के रूप में नियत करता है जिसके दौरान यदि आवश्यक हुआ तो , निर्वाचन के लिए उपर्युक्त विनिर्दिष्ट तारीख को मतदान होगा ।

NOTIFICATION
New Delhi , the 13th March , 2007
Ο.Ν. 34 ( E ) .-Whereas , the seat of Shri Raja Ram Pal in the House of the People , elected from 60 - Bilhaur Parliamentary Constituency in the State of Uttar Pradesh , has become vacant on 23-12-2005 , due to cessation of his membership on the order of the Speaker , Lok Sabha on 23-12-2005; and Whereas . a Writ Petition No. 1 of 2006 and certain Transferred Cases were filed before the Supreme Court of India challenging the order of the Speaker , and the Supreme Court had directed on 3rd April, 2006 that the bye election to fill the said vacancy may not be held, pending the above cases ; and
Whereas , the Supreme Court has pronounced its judgment dismissing all these cases on 10-1-2007; and Whereas, a bye -election is now to be held for the purpose of filling the said vacancy:
Now , therefore , in pursuance of Sub - section (1 ) of Section 149 , and Sections 30 and 56 of the Representation of the PeopleAct , 1951 ( 43 of 1951 ) , the Election Commission of India hereby-
(A) calls upon the said 60 - Bilhaur Parliamentary Constituency in the State of Uttar Pradesh to elect , before the 135-2007 ( Sunday) and in accordance with the provisions of the said Act and of the rules and orders made thereunder , a person for the purpose of filling the said vacancy in the House of the People ; and (B) appoints , with repsect to the said election ,-
(a ) the 20-3-2007 (Tuesday ) , as the last date or making nominations :
(b ) the 21-3-2007 (Wednesday ) , as the date for the scrutiny of nominations ;
( c ) the 23-3-2007 ( Friday ) , as the last date for the withdrawal of candidatures ;
( d) the 07-4-2007 (Saturday) , as the date on which a poll shall, if necessary , be taken ; and
( c) the 13-5-2007 ( Sunday) , as the date before which the election shallbe completed ; and
(C) fixes the hours from 7.00 A.M. to 5.00 P.M. , as the hours during which the poll shall , if necessary , be taken on the date specified above for the election .
