प्रतिपूरक वनीकरण कोष प्रबंधन और योजना प्राधिकरण ( संशोधन ) अधिसूचना , 2007
का.आ. 354( अ ), पर्यावरण ( संरक्षण) अधिनियम , 1986 ( 1986 का 29 ) की धारा 3 की उप - धारा ( 3 ) में प्रदत्त शक्तियों का प्रयोग करते हुए और रिट याचिका ( सिविल ) 1995 की संख्या 202 में आई ए संख्या 556 में माननीय उच्चतम न्यायालय के दिनांक 29 अक्तूबर, 2002 के आदेश के अनुसरण में केन्द्रीय सरकार द्वारा पर्याव्ररण एवं वन मंत्रालय, भारत सरकार की अधिसूचना संख्या 5-1/98 एफ सी के तहत प्रतिपूरक वनीकरण कोष प्रबंधन एवं योजना प्राधिकरण ( जिसे इसके बाद कम्पा कहा जाएगा ) का गठन किया गया था इसे भारत के राजपत्र असाधारण के भाग II , खण्ड 3 , उप- खण्ड ( ii ) में दिनांक 23 अप्रैल , 2004 की संख्या का.आ. 525 ( अ ) के तहत प्रकाशित किया गया था;
.और दिनांक. 28 नवम्बर , 2006 को भारत के माननीय उच्चतम न्यायालय ने उच्चतम न्यायालय के दिनांक 26 सितम्बर , 2005 के आदेशों के तहत दिनांक 23 अप्रैल , 2004 की कम्पा अधिसूचना में कतिपय संशोधन करने के आदेश दिए हैं;
और इसके अतिरिक्त पर्यावरण ( संरक्षण ) अधिनियम, 1986 ( 1986 का 29 ) की धारा 3 की उप- धारा (3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और माननीय उच्चतम न्यायालय के दिनांक 28 नवम्बर, 2006 और 26 सितम्बर , 2005 के आदेशों के अनुपालन में केन्द्रीय सरकार दिनांक 23 अप्रैल, 2004 की कम्पा अधिसूचना में निम्नलिखित संशोधन करती है :
1. इस अधिसूचना को " प्रतिपूरक वनीकरण कोष प्रबंधन एवं योजना प्राधिकरण ( संशोधन ) अधिसूचना, 2006" कहा जाएगा।
" कार्यकारी निकाय " के गठन से संबंधित दिनांक 23 अप्रैल , 2004 की कम्पा अधिसूचना के पैरा 2.2 में निम्नलिखित उप-पैरा जोड़ा जाए नामतः :- 2.
" ( viii ) दो विशेषज्ञ , वानिकी और वन आर्थिक विकास के क्षेत्र से एक- एक सदस्य "
3. " कोष के प्रबंधन " से संबंधित दिनांक 23 अप्रैल , 2004 की कम्पा अधिसूचना के पैरा 6.3 में उप- पैरा ( iv ) के स्थान पर निम्नलिखित प्रतिस्थापित किया जाए अर्थात्:-
" ( iv ) कम्पा दोहरी' प्रणाली के आधार पर सामूहिक लेखा-जोखा तैयार करेगा और इसके लेखा- जोखा की भारत के महालेखा निरीक्षक द्वारा लेखा परीक्षा की जाएगी। "
4. " कोषों के वितरण " से संबंधित दिनांक 23 अप्रैल , 2004 की कम्पा अधिसूचना के पैरा 6.4 में उप- पैरा ( v ) के स्थान पर निम्नलिखित प्रतिस्थापित किया जाए अर्थात्:-
" (v ) कम्पा में किसी राज्य अथवा संघ शासित क्षेत्र से पैरा 6.2 के अनुसार प्राप्त धन तथा कम्पा द्वारा इसकी स्थापना, मानीटरिंग और प्रो- रेटा आधार पर मूल्यांकन के लिए खर्च को घटाने के बाद अर्जित आय साधारणतः उस विशिष्ट राज्य अथवा संघ शासित क्षेत्र द्वारा प्रयोग की जाती है तथापि सीमापार वानिकी और/ अथवा विशिष्ट राज्य अर्थवा संघ शासित क्षेत्र में गैर- वानिकी उद्देश्यों के लिए वन भूमि के वनेतर प्रयोग के पर्यावरणीय निहितार्थ, यदि " कम्पा " द्वारा उचित और आवश्यक 856 GI/2007

समझा जाता है तब विशिष्ट राज्य अथवा संघ शासित क्षेत्र से प्राप्त धन को साथ के राज्य ( राज्यों) अथवा संघ शासित क्षेत्र ( क्षेत्रों) द्वारा कम्पा द्वारा इस उद्देश्य के लिए निर्धारित अनुपात में प्रयोग किया जा सकता है ताकि वन और/ अथवा पर्यावरण पर पार-सीमा प्रतिकूल प्रभाव ( प्रभावों ) को कम किया जा सके । "
5. " अन्य कार्यों " से संबंधित दिनांक 23 अप्रैल , 2004 की कम्पा अधिसूचना के पैरा 6.6 के उप - पैरा ( i ) के स्थान पर निम्नलिखित प्रतिस्थापित किया जाए नामतः :-
" ( i ) कम्पा, प्रतिपूरक वनीकरण को करने के लिए विशेषतः बड़े सार्वजनिक उपक्रमों को शामिल करते हुए, जिन्हें उनकी परियोजनाओं के लिए अक्सर वनभूमि की आवश्यकता होती है , सी ई सी के परामर्श और जहाँ तक संभव हो सहमति से और साथ ही भारत के माननीय उच्चतम न्यायालय की अनुमति के साथ कार्य विशेष वाहन स्थापित करेगा। "

NOTIFICATION
New Delhi , the 13th March, 2007
CompensatoryAfforestation Fund Management and Planning Authority ( Amendment ) Notification , 2007 S.O. 354 ( E) . Whereas , in exercise of the powers conferred by Sub - section ( 3 ) of Section 3 of the Environment (Protection) Act , 1986 ( 29 of 1986 ) , and in pursuance of the Hon'ble Supreme Court's order dated 29th October , 2002 in L.A. No. 566 in Writ Petition ( Civil) No. 202 of 1995 , Compensatory Afforestation Fund Management and Planning Authority (hereinafter referred to as ' CAMPA ' ) was constituted by the Central Government vide Notification No. 5-1/ 98 - FC of the Ministry of Environment and Forests , Government of India , which was published in Part H. Section 3 , Sub- section (ii) ofthe Gazette of India ( Extraordinary) vide S.O. 525 ( E ) , dated 23rd April 2004;
And whereas , vide order dated 28th November , 2006 , the Hon'ble Supreme Court of India directed for making certain amendments in the CAMPA Notification dated 23rd April , 2004 in terms of the Supreme Court's order dated 26th September , 2005;
And therefore, in exercise of the power conferred by Sub - section (3 ) of Section 3 of the Environment (Protection) Act , 1986 (29 of 1986 ) , and in compliance of the Hon'ble Supreme Court's orders dated 28th November, 2006 and 26th September , 2005, the Central Government hereby makes the following amendments in the CAMPA Notification dated 23rd April, 2004:
1. This Notification may be called the Compensatory Afforestation Fund Management and Planning Authority (Amendment) Notification , 2007
2. In para 2.2 of the CAMPA Notification dated 23rd April , 2004 concerning constitution of ' Executive Body ' , following sub -para may be added , namely "(viii ) Two Experts , one cach in the fields of Forestry and Forest Economy Development -Members. " 3. In para 6.3 ofthe CAMPA Notification dated 23rd April , 2004, concerning Management of the Fund' ,for sub- para (iv) , following shall be substituted, namely:---
" ( iv) The CAMPA shall have Corporate Accounting based on double entry system , and auditing of its accounts shall be conducted by the Comptroller and Auditor General ( CAG ) of India . "
4. In para 6.4 of the CAMPA Notification dated 23rd April , 2004 , concerning Disbursement of Funds ' , for sub- para (v) , following shall be substituted, namely:
" (v) The monies received in CAMPA from a State or Union Territory as per para 6.2 , and the income earned thereon after deducting the expenditure incurred by CAMPA on its establishment , monitoring and evaluation on a pro - rata basis, shall ordinarily be used only in that particular State or Union Territory . However , in cases oftrans-boundary forestry and/ or environmental implication ( s) of diversion of forest land for non- forestry purposes in a particular State or Union Territory , if found expedient and necessaryby CAMPA, the monies received from that particular State or Union Territory may also be used , in the proportion as determined by CAMPA for the purpose , in the adjoining State( s ) or Union Territory (ies ) to mitigate trans - boundary adverse impacts on forest and/ or environment . "
5. In para 6.6 of the CAMPA Notification dated 23rd April, 2004, concerning Other Functions ' , for sub-para ( i ) , following shall be substituted , namely
"( i ) The CAMPA shall establish Special Purpose Vehicles ( SPV) for undertaking Compensatory Afforestation, especially by involving large Public Sector Undertakings which frequently require forest land for their projects , in consultation and as far as possible, with concurrence of the CEC, and with the permission of the Hon'ble Supreme Court of India. "
