का.आ. 362 ( अ ). विदेश व्यापार नीति, 2004-2009 के पैराग्राफ 2.1 के साथ पठित विदेश व्यापार ( विकास और विनियमन ) अधिनियम , 1992 की धारा 5 के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्र सरकार , एतद्वारा , निर्यात और आयात मदों के आई टी सी ( एच एस ) वर्गीकरण , 2004-2009 में निम्नलिखित संशोधन करती है :-
1. निर्यात और आयात मदों के आई टी सी ( एच एस ) वर्गीकरण 2004-2009 के अध्याय1क की शर्त 16 ( आयात नीति की सामान्य टिप्पणियाँ ) को संशोधित करके निम्नानुसार पढ़ा जाएगा:-
" 16. एवियन एंफ्लूएंजा ( हाइली पैथोजेनिक एवियन एंफ्लूएंजा और लो पैथोजेनिक एवियन एंफ्लूएंजा दोनों ) को ध्यान में रखते हुए निम्नलिखित पशुधन और पशुधन उत्पादों का सभी देशों से भारत में आयात निषिद्ध होगाः-
( i ) कैद पक्षियों सहित घरेलू और वन्य पक्षी ( कुक्कुट को छोड़कर ) ;
(ii ) वन्य पक्षियों सहित एवियन प्रजातियों का असंसाधित मांस और मांस उत्पाद, ( कुक्कुट के अलावा ) ;
( iii ) घरेलूऔर वन्य पक्षियों का वीर्य ।
इसके अलावा , केन्द्र सरकार ऐसे किसी अन्य देश से भी निम्नलिखित पशुधन और पशुधन उत्पादों का भारत में आयात निषिद्ध करती है जहां से एवियन एंफ्लूएंजा ( हाइली पैथोजेनिक एवियन एंफ्लूएंजा और लो पैथोजेनिक एवियन एंफ्लूएंजा दोनों) की सूचना प्राप्त हुई है , नामत :-
( i) जीवित कुक्कुट;
( ii ) एक दिन के चूजे , बत्तखें, टर्की एवं अन्य नवजात एवियन प्रजातियाँ;
( iii) वन्य पक्षियों सहित एवियन प्रजातियों का मांस और मांस उत्पाद;
(iv) सेने वाले अंडे ( हैचिंग एग्स) ;

(v) अंडा और अंडा उत्पाद ( विशिष्ट पैथोजेन मुक्त अण्डों के अलावा ) ;
(vi) पंख;
(vii ) जीवित सूअर और सूअर मांस के उत्पाद;
(viii ) पैथोलोजिकल सामग्री तथा पक्षियों के जैविकीय उत्पाद;
(ix) पशु आहार में उपयोग के लिए या कृषि या औद्योगिक उपयोग के लिए अभिप्रेत पशुजनित ( पक्षियों से ) उत्पाद। "
2. निषेध अगले आदेशों तक लागू रहेगा ।
3. इसे लोकहित में जारी किया जाता है ।

NOTIFICATION
NewDelhi , the 13th March , 2007
No. 55 (RE -2006)/2004-2009
S.O. 362( E) . In exercise of powers conferred by Section 5 of the Foreign Trade ( Development and Regulation) Act , 1992 read with paragraph 2.1 of the Foreign Trade Policy-2004-2009, the Central Government hereby amends the ITC (HS) Classification ofExport and Import Items 2004--2009 as under:-
1. Condition 16 of Chapter 1A ( General Notes to Import Policy ) of the ITC ( HS ) Classifications of Export and Import Items , 2004-2009 shall be amended to read as under :-----
" 16. Import into India of the following live - stock and live - stock products shall be prohibited from all countries , in view of Avian Influenza (both Highly Pathogenic Avian Influenza and Low Pathogenic Avian Influenza) :
(1) domestic and wild birds including the captive birds ( excluding poultry );
(ii) unprocessed meat and meat products from Avian species including wild birds (except poultry);
(iii) semen of domestic and wild birds .
Further , the Central Government hereby prohibits also the import into India from the countries reporting Avian Influenza (both Highly Pathogenic Avian Influenza and I ow Pathogenic Avian Influenza) , the following live -stock and live- stock products , namely :-
Live poultry;
(ii) day old chicks , ducks , turkey and other newly hatched Avian species;
(in) meat and meat products from Avian species including wild birds ;
(iv) hatching eggs;
(v) eggs and egg products ( except Specific Pathogen Free eggs ) ;
(vi) feathers;
(vii) live pig and pig meat products;
(viii) pathological material and biological products from birds;
(ix) product of animal origin ( from birds ) intended for use in animal feeding or for agricultural or industrial use . " 2. The prohibition shall be in force till further orders .
3. This issues in public interest.
