का.आ. 380( अ)- कर्मचारी भविष्य निधि तथा प्रकीर्ण उपबंध अधिनियम , 1952 ( 1952 का 19 ) की धारा 7 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार एतद्वारा कर्मचारी भविष्य निधि योजना , 1952 में आगे संशोधन करने हेतु निम्नांकित स्कीम बनाती है , अर्थात्:-
( 1 ) ( i ) इस स्कीम को कर्मचारी भविष्य निधि ( संशोधन ) योजना, 2007 कहा जाएगा ।
(ii ) यह सरकारी राजपत्र में प्रकाशित होने की तिथि से प्रभावी होगा ।
( 2 ) कर्मचारी भविष्य निधि योजना , 1952 में पैराग्राफ 60 में उप्र - पैराग्राफ ( 2 ) के खंड ( ख ) के द्वितीय परंतुक के बाद निम्नांकित परंतुक को जोड़ा जाएगा , अर्थात्:-
" बशर्ते यह भी कि ब्रोकन करेंसी पीरियड के लिए वापसी हेतु दावों पर अनुमेय ब्याज दर कर्मचारी भविष्य निधि पर घोषित पिछली दर होगी और यदि किसी चालू वर्ष के लिए घोषित दर पिछले वर्ष की घोषित दर से कम हो , तो इसे निवर्तमान सदस्य को बोनस के रूप में दिया जाएगा और इसे वर्ष के अंत में चालू वर्ष की ब्याज दर प्राप्त करने के लिए गणना में शामिल किया जाएगा तथा इस परंतुक के अधीन निपटाए गए दावे अंतिम होंगे । "

गुरजोत कौर , संयुक्त सचिव पाद टिप्पणी: कर्मचारी भविष्य निधि योजना भारत के राजपत्र में संख्या का.नि.आ. 1509 , दिनांक 2 सितम्बर , 1952 द्वारा प्रकाशित की गई थी और इसे पिछली बार संख्या का. आ. 1190 ( अ ) , दिनांक 27 जुलाई, 2006 द्वारा संशोधित किया गया था ।

NOTIFICATION
New Delhi , the 15th March, 2007
S.O. 380 (E) . In excrcise of the powers conferred by Sub- section ( 1 ) of Section 7 of the Employees ' Provident Funds andMiscellaneous Provisions Act, 1952 ( 19 of 1952) , the Central Government hereby makes the following Scheme further to amend the Employees ' Provident Funds Scheme . 1952 , namely :-
(1) (i) This Scheme may be called the Employees ' Provident Funds ( Amendment ) Scheme , 2007 .
(ii) It shall come into force on the date of its publication in the Official Gazette .
(2) In the Employees ' Provident Funds Scheme, 1952, in paragraph 60, after the second proviso to clause (b ) of sub -paragraph (2 ) , the following proviso shall be added , namely:
"Provided also that the rate of interest to be allowed on claims for refund for the broken currency period shall be. the last declared rate on Employees ' Provident Fund and if the rate declared for any current year happens to be less than the previous year's declared rate , then it would accrue as bonus to the outgoing members and it shall be incorporated into calculation for deriving the current year's rate of interest at the end of the year and the claims settled under this proviso shall be final ."
