आ.अ. 37( अ ).-यतः लोक सभा के द्वारा दिनांक 23 दिसंबर , 2005 को एक प्रस्ताव अंगीकृत करके, श्री अन्नासाहेब एम. के. पाटिल को शामिल करते हुए उसके दस सदस्यों को निष्कासित कर दिया गया, जैसा कि उसकी दिनांक 23 दिसंबर, 2005 की अधिसूचना संख्या 21/5/2005 /टी में अधिसूचित है; जिसके परिणामस्वरूप लोक सभा में महाराष्ट्र राज्य में 16 - इरन्दोल संसदीय निर्वाचन क्षेत्र से निर्वाचित श्री अन्नासाहेब एम. के. पाटिल का स्थान उनकी सदस्यता की समाहित के कारण दिनांक 23 दिसंबर , 2005 को रिक्त हो गया था; और
यतः , भारत के उच्चतम न्यायालय के समक्ष लोक सभा से सदस्यों के निष्कासन' को चुनौती देते हुए 2006 की रिट याचिका सं. 1 और कुछ अंतरित मामले दाखिल किए गए थे और उच्चतम न्यायालय ने अपने दिनांक 3 अप्रैल , 2006 के आदेश द्वारा निदेश दिया था कि 16 - इरन्दोल संसदीय निर्वाचन क्षेत्र की रिक्ति को शामिल करते हुए किन्हीं भी आकस्मिक रिक्तियों को भरने के लिए उप- निर्वाचन , उपर्युक्त स्टि याचिका और अंतरित मामलों के निपटान लंबित रहने तक नहीं करवाए जा सकते; और
यतः , उच्चतम न्यायालय ने अपने दिनांक 10 जनवरी , 2007 के आदेश द्वारा उपर्युक्त रिट याचिका और अंतरित मामलों को खारिज करते हुए अपना निर्णय सुनाया है; और
यतः , इस प्रकार हुई रिक्ति को भरने के प्रयोजन से उप- निर्वाचन कराया जाना है;
अतः , अब , लोक, प्रतिनिधित्व अधिनियम , 1951 ( 1951 का 43 ) की धारा 149 की उप - धारा ( 1 ) तथा धारा 30 और 56 के अनुसरण में, भारत निर्वाचन आयोग एतद्वारा :-
( अ ) महाराष्ट्र राज्य के उक्त 16 - इरन्दोल संसदीय निर्वाचन क्षेत्र से यह अपेक्षा करता है कि वह 16 अप्रैल, 2007 ( सोमवार) से पूर्व और उक्त अधिनियम और तद्दीन बनाए गए नियमों और किए गए आदेशों के उपबन्धों के अनुसार लोक सभा में उक्त रिक्ति को भरने के प्रयोजन से एक व्यक्ति निर्वाचित कर दें;
( आ) उक्त निर्वाचन के संबंध में:-
-23 मार्च, 2007 ( शुक्रवार)
(क) नाम निर्देशन करने की अन्तिम तारीख
-24मार्च, 2007 (शनिवार)
(ख ) नाम निर्देशन की संवीक्षा की तारीख

( ग ) अभ्यर्थिताएं वापस लेने की अंतिम तारीख
-9 अप्रैल , 2007 ( सोमवार )
( घ ) वह तारीख , जिसको यदि आवश्यक हुआ तो मतदान होगा
( ङ ) वह तारीख , जिससे पूर्व निर्वाचन सम्पन्न करा लिया जाएगा 16 अप्रैल , 2007 (सोमवार ) नियत करता है; और
( ङ ) 8.00 बजे पूर्वाहन् से 5.00 बजे अपराह्न तक का समय , ऐसे समय के रूप में नियत करता है जिसके दौरान यदि आवश्यक हुआ तो, निर्वाचन के लिए उपर्युक्त विनिर्दिष्ट तारीख को, मतदान होगा ।

NOTIFICATION
New Delhi , the 16th March , 2007
O.N. 37 ( E ) . Whereas , the seat of Shri Annasaheb M.K. Patil , in the House of the People , elected from 16 - Erandol Parliamentary (Constituency in the State of Maharashtra, had become vacant on 23rd December , 2005 , due to cessation of his membership consequent upon the adoption of the Motion by the I ok Sabha on 23rd December , 2005 expelling its ten members including Shri Annasaheb M.K. Patil , as notified in its Notification number 21/5/2005/1 dated 23rd December, 2005; and
Whereas , a Writ Petition No. 1 of 2006 and certain Transferred Cases were filed before the Supreme Court of India , challenging expulsion of the members from I ok Sabha and the Supreme Court had directed , vide its order dated 3rd April , 2006, that bye- elections to fill any of the casual vacancies including the vacancy of 16 - Erandol Parliamentary Constituency may not be held, pending disposal of the above said Writ Petition and transferred cases ; and
Whereas , the Supreme Court has pronounced its judgment dismissing the above said Writ Petition and transferred cases vide its order dated 10th January, 2007; and
Whereas , a byc- election is now required to be held for the purpose of filling the said vacancy;
Now , therefore , in pursuance of Sub - section (1) of Section 149, and Sections 30 and 56 of the Representation ofthe People Act . 1951 (43 of 1951 ) , the Election Commission of India hercby-
(A) Calis upon the said 16 - Erandol Parliamentary Constituency in the State of Maharashtra to elect , before the 16th April, 2007 ( Monday ) and in accordance with the provisions of the said Act and of the rules and orders made thereunder , a person for the purpose of filling the said vacancy in the House of the People ; and
(B) appoints , with respect to the said election
( a ) the 23rd March , 2007 ( Friday) , as the last date for making nominations ;
th the 24th March , 2007 ( Saturday) , as the date for the scrutiny of nominations ;
(c) the 26th March , 2007 ( Monday) , as the last date for the withdrawal of candidatures;
( 2) the 9th April , 2007 (Monday) , as the date on which a poli shali , if necessary, be taken; and (c) the 16th April , 2007 ( Monday) , as the date before which the election shall be completed ; and (4) fixes the hours from 8.00 A.M. to 5,00 P.M. , as the hours during which the poll shall, if necessary, be taken on the date specified above for the election .
