सा.का.नि. 208 ( अ ).-अखिल भारतीय सेवाएँ अधिनियम, 1951 ( 1951 का 61 ) की धारा 3 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्र सरकार , राज्य सरकार से परामर्श करने के उपरांत अखिल भारतीय सेवाएँ ( अवकाश ) नियमावली , 1955 में और आगे संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्ः-
1. ( i ) इन नियमों का नाम अखिल भारतीय सेवाएँ ( अवकाश ) द्वितीय संशोधन नियमावली , 2007 है ।
(ii ) ये सरकारी राजपत्र में इनके प्रकाशन की तिथि से लागू होंगे ।
2. अखिल भारतीय सेवाएँ ( अवकाश ) नियमावली , 1955 में, नियम10 , उप - नियम ( 1 ) में:-
(क) खंड ( क ) के बाद निम्नलिखित जोड़ा जाएगा , अर्थात्:--
" बशर्ते कि उत्तर - पूर्व में कार्यरत सेवा के किसी सदस्य या जो किसी उत्तर- पूर्व राज्य में अन्तर - संवर्ग प्रतिनियुक्ति पर जाता है, के अवकाश खाते में एक कैलेण्डर वर्ष में 40 दिन का अर्जित अवकाश जोड़ दिया जाएगा । यह प्रत्येक वर्ष पहली जनवरी तथा पहली जुलाई को प्रति 20 दिन के हिसाब से दो किश्तों में अग्रिम तौर पर किया जाएगा। "
(ख ) खंड ( घ ) के बाद निम्नलिखित जोड़ा जाएगा , अर्थात्ः-
" बशर्ते कि उत्तर - पूर्व में कार्यरत सदस्य या उत्तर - पूर्व राज्य में अन्तर - संवर्ग प्रतिनियुक्ति पर सेवा के किसी सदस्य के अवकाश लेखा में सेवा के पूरे प्रत्येक कैलेण्डर मास के लिए 3-1 / 3 दिनों की दर से अर्जित अवकाश जोड़ा जाएगा। " (ग ) खंड ( ड. ) के बाद निम्नलिखित जोड़ा जाएगा , अर्थात्ः-
" बशर्ते कि आधे साल के लिए जिसमें उत्तर - पूर्व में कार्यरत या उत्तर - पूर्व राज्य में अन्तर- संवर्ग प्रतिनियुक्ति पर कार्यरत सेवा का सदस्य सेवानिवृत्त होने वाला है या सेवा से त्याग - पत्र देने वाला है , तो उसके अवकाश खाते में प्रत्येक पूरे कैलेण्डर मास के लिए 3-1/3की दर से जोड़ा जाएगा । "
(घ) खंड ( च ) के बाद निम्नलिखित जोड़ा जाएगा , अर्थात्ः-
" बशर्ते कि जब उत्तर - पूर्व में कार्यरत या उत्तर- पूर्व में अन्तर - संवर्ग प्रतिनियुक्ति पर कार्यरत सेवा का कोई सदस्य सेवा से हटाया या बर्खास्त किया जाता है तो उसके अर्जित अवकाश के खाते में प्रत्येक कैलेण्डर मास के लिए 3-1 / 3 की दर पर अर्जित अवकाश अनुमत्य किया जाएगा। "
ङ ) खंड ( छ ) के बाद निम्नलिखित जोड़ा जाएगा , अर्थात्ः-

[नोट :-उप नियम ( 1 ) में ( क ) , ( घ) , ( ङ ) , ( च ) खंडों में परन्तुकों के लिए " उत्तर - पूर्व " या " उत्तरी - पूर्वी राज्य " का आशय असम मेघालय , मणिपुर- त्रिपुरा , नागालैण्ड तथा सिक्किम के उत्तर - पूर्व संवर्ग होगा। ]

NOTIFICATION
New Delhi , the 19th March, 2007
G.S.R. 208 (E) . In exercise of the powers conferred by Sub- section ( 1) of Section 3 of the All India Services Act , 1951 (61 of 1951 ) , the Central Government, after consultation with the State Governments , hereby makes the following rules further to amend the All India Services (Leave ) Rules , 1955, namely :-
1. (1) These rules may be called the All India Services (Leave ) Second Amendment Rules , 2007 .
(2) They shall come into force from the date of their publication in the Official Gazette.
2. In the All India Services (Leave ) Rules, 1955, in rule 10, in sub - rule ( 1), —
(a) after clause ( a) the following shall be inserted, namely:-
"Provided that the leave account of a member of the Service working in the North East or who goes on inter- cadre deputation to a North Eastern State shall be credited 40 days earned leave in calendar year . This shall be done in advance in two instalments of 20 days each on the 1st of January and July, every year " .
(b) after clause (d), the following shall be inserted, namely:---
"Provided that earned leave shall be credited to the leave Account at the rate of3-1/3 days for each completed calendar month of service for a member of the Service working in the North East or on inter - cadre deputation to a North Eastern State" .
(c) after clause (e) , the following shall be inserted, namely :-
"Provided that the credit for the half year in which a member of the Service working in the North East or on inter-cadre deputation to a North Eastern State is due to retire or resign from service shall be afforded at the rate of 3-1 /3 days for each completed calendar month" .
(d) after clause (f), the following shall be inserted, namely :-
"Provided that when a member of the Service working in the North East or on inter -cadre deputation to a North Eastern State is removed or dismissed from the service , credit of earned leave shall be allowed at the rate of 3-1/3 days for each calendar month" .
(e) after clause (g) , the following shall be inserted, namely :-
[Note: For the provisos in clauses (a), (d) , (e), (f) , in sub- rule (1 ) , "North East " or " North Eastern State " shall mean North East cadres of Assam-Meghalaya, Manipur - Tripura, Nagaland and Sikkim .]
