भारत में सेमीकण्डक्टर संविरचना तथा अन्य माइक्रो एवं नैनो प्रौद्योगिकी विनिर्माण उद्योग स्थापित करने के लिए पूंजीनिवेश प्रोत्साहित करने के प्रधोजन से विशेष प्रोत्साहन पैकेज योजनाः
सं. 3( 1 )/2007- आईपीएचडब्ल्यू ( एसआईपीएस ) -सेमीकण्डक्टर उद्योग तथा अन्य उच्च प्रौद्योगिकी उद्योगों की विशेषता इसकी विशिष्ट बाधाएं हैं, जो इसकी व्यवहार्यता को चुनौती देती हैं । इसमें बहुत अधिक पूंजी की आवश्यकता होती है तथा इसे निरंतर बदलती प्रौद्योगिकी के अनुसार कार्य करना पड़ता है । अतः सरकार के लिए यह आवश्यक हो जाता है कि वह विनिर्माण का एक अनुकूल वातावरण तैयार करे तथा ऐसे प्रोत्साहनों के पैकेज की पेशकश करे जिसकी तुलना दूसरे देशों के साथ की जा सकती है ताकि इस विनिर्माण क्षेत्र में वैश्विक पूंजीनिवेश को आकर्षित किया जा सके और साथ ही पर्याप्त मूलसंरचना तथा आर्थिक प्रणाली के अभाव के कारण व्यवहार्यता के अंतराल को दूर किया जा सके । हालांकि देश में विनिर्माण उद्योग आरम्भ करने के लिए इसमें सरकार द्वारा आरंभिक लागत का वहन करना शामिल होगा , लेकिन सकल घरेलू उत्पाद में योगदान के रूप में पूंजीनिवेश का जो प्रतिफल प्राप्त होगा वह देश में सेमीकण्डक्टर विनिर्माण तथा अन्य उच्च प्रौद्योगिकी उद्योगों के लिए विशेष प्रोत्साहन पैकेज के एक भाग के रूप में जिन प्रोत्साहनों की योजना की गई है, उसका पूरा औचित्य रहेगा ।
2. विशेष प्रोत्साहन पैकेज
विशेष प्रोत्साहन पैकेज नीचे दिए अनुसार हैं :
2.1 पूंजीनिवेश सभी सेमीकण्डक्टरों तथा आर्थिक प्रणाली इकाइयों अर्थात् तरल क्रिस्टल प्रदर्श ( एलसीडी ) सहित प्रदर्शों , कार्बनिक प्रकाश उत्सर्जन डायोड ( ओएलईडी ) , प्लाज्मा प्रदर्श पैनल ( पीडीपी ) , कोई अन्य उदीयमान प्रदर्शः भण्डारण युक्तियां, सौर सेल, फोटोवोल्टेयिक , अन्य उन्नत माइक्रो एवं नैनो प्रौद्यागिकी उत्पाद , उपर्युक्त सभी उत्पादों के संयोजन एवं परीक्षण के लिए होगा ।
2.2 विशेष प्रोत्साहन पैकेज अद्यतन तकनीकी जानकारी की प्रौद्योगिकी के लिए होगा ।
2.3 सेमीकण्डक्टर विनिर्माण ( फैब इकाई ) उत्पादों के मामले में पूंजीनिवेश का आरंभिक शुद्ध वर्तमान मान ( एनपीवी ) 2,500 करोड़ रुपए तथा उससे अधिक होगा । अन्य आर्थिक प्रणाली उत्पादों के विनिर्माण के लिए पूंजीनिवेश का आरम्भिक एनपीवी 1,000 करोड़ रुपए तथा उससे अधिक होगा । इस आरम्भिक मान को परियोजना के जीवनकाल के प्रथम 10 वर्षों के दौरान किए गए पूंजीनिवेश का शुद्ध वर्तमान मान (एनपीवी) माना जाएगा और छूट की दर 9 % होगी ।

3.1 केन्द्र सरकार अथवा इसकी कोई एजेंसी विशेष आर्थिक क्षेत्र में इकाइयों के लिए प्रथम 10 वर्षों के दौरान पूंजीगत व्यय ( जैसा कि उप- पैराग्राफ 3.3 पर बताया गया है ) का 20 % प्रोत्साहन उपलब्ध कराएगी और विशेष आर्थिक क्षेत्र से बाहर स्थित इकाइयों को पूंजीगत व्यय का 25% उपलब्ध कराएगी । विशेष आर्थिक क्षेत्र से बाहर स्थित इकाइयों को सीवीडी से छूट दी जाएगी । राज्य सरकार अथवा इसकी कोई एजेंसी अथवा स्थानीय निकायों द्वारा यदि कोई प्रोत्साहन दिया जाता है तो वह इस राशि के अतिरिक्त होगा ।
टिप्पणी: विशेष आर्थिक क्षेत्र से बाहर स्थित इकाइयों को सीवीडी से छूट देने संबंधी अधिसूचना वित्त मंत्रालय द्वारा अलग से जारी की जाएगी
3.2 10 वर्षों की अवधि परियोजना को आरंभ करने से परियोजना काल के प्रथम 10 वर्ष होंगे न कि परियोजना के किसी अन्य पश्चात्वर्ती चरण के आरम्भ से ।
3.3 भूमि, भवन , संयंत्र तथा मशीनरी और अनुसंधान एवं विकास सहित प्रौद्योगिकी में पूंजीगत व्यय का योग कुल पूंजीगत व्यय होगा । पूंजीगत व्यय के 2 % से अधिक भूमि की लागत को इस संबंध में गणना के लिए शामिल नहीं किया जाएगा ।
4. कोई भी इकाई निम्नलिखित के किसी भी सम्मिश्र में पूंजीगत इमदाद अथवा साम्यापूंजी प्रतिभागिता के रूप में प्रोत्साहन का दावा कर सकती है :
( i ) परियोजना में साम्यापूंजी , 26 % के अनधिक ।
( ii ) प्रोत्साहन अनुदान अथवा ब्याज इमदाद के रूप में पूंजीगत इमदाद ।
प्रोत्साहन पैकेज के मान का निर्धारण करने के लिए साम्यापूंजी में समग्र अंशदान को हिसाब में लिया जाएगा । जब परियोजना पूरी तरह चलने लगेगी तब भविष्य में किसी भी उपयुक्त समय पर इससे बाहर निकलने का विकल्प रहेगा , जिसका प्रयोग सरकार द्वारा किया जाएगा ।
5.1 जो निवेशक अपने प्रोत्साहन पैकेज के एक भाग के रूप में साम्यापूंजी का चयन करते हैं, उन्हें परियोजना के वित्तीय समापन के पश्चात् ऐसी साम्यापूंजी दी जाएगी और प्रवर्तकों द्वारा जिस प्रकार साम्यापूंजी लाई जाएगी उस समानुपात में साम्यापूंजी जारी की जाएगी ।
5.2 अन्य सभी प्रोत्साहन उस वित्तीय वर्ष के अंत के पश्चात् जारी किए जाएंगे जिसमें कुल पूंजीनिवेश का एनपीवी आरम्भिक मान से अधिक हो जाता है ।
5.3 उसके पश्चात् प्रोत्साहन वर्ष के दौरान किए गए पूंजीनिवेश के मूल्य के आधार पर वार्षिक रूप में उपलब्ध कराए जाएंगे और यह परियोजना के जीवनकाल के प्रथम 10 वर्षों तक सीमित होगा ।
6. इकाइयों की संख्या की एक ऊपरी सीमा होगी-2-3 ' फैब ' इकाइयां तथा 10 आर्थिक प्रणाली इकाइयां । विशेष प्रोत्साहन पैकेज केवल 31-3-2010 तक ही उपलब्ध होगा ।
7.1 सूचना प्रौद्योगिकी विभाग द्वारा एक मूल्यांकन समिति का गठन अपर सचिव , सूचना प्रौद्योगिकी विभाग की अध्यक्षता में किया जाएगा । मूल्यांकन समिति निवेशकों से इच्छा पत्र प्राप्त करेगी तथा अपनी सिफारिशें सरकार को प्रस्तुत करेगी । सरकार उन सिफारिशों पर विचार करेगी तथा अनुमोदन प्रदान करेगी ।
7.2 मूल्यांकन समिति के कार्यों को प्रभावी बनाने के प्रयोजन से, सूचना प्रौद्योगिकी विभाग द्वारा अलग से दिशा- निर्देश तैयार करके जारी किए जाएंगे ।

Special Incentive Package Scheme to encourage Investments for setting up Semiconductor Fabrication and other micro and nano technology manufacture industries in India
No. 3 (1 ) /2007 - IPHW (SIPS) . The semiconductor industry and other high tech industries are characterized by specific constraints that challenge their viability. These are highly capital intensive and have to deal with constantly changing technology. It, therefore, becomes imperative on part of the Government to create a conducive environment for 3

manufacturing and offer a package of incentives comparable with other countries to attract global investments into the manufacturing sector as well as help bridge the viability gap due to lack of adequate infrastructure and eco - system . While this will involve an initial cost incurred by the Government to seed the manufacturing industry in the country , the return on investments by way of contribution to GDP will succinctly justify the incentives planned as a part of the Special Incentive Package for semi - conductor manufacturing and other high tech industries in the country.
2. Special Incentive Package
The Special Incentive Package is as under:
2.1 The investment will be for the manufacture of all semi-conductors and eco- system units , namely displays including Liquid Crystal Displays (LCD) , Organic Light Emitting Diodes (OLED) , Plasma Display Panels (PDP) , any other emerging displays ; storage devices ; solar cells ; Photovoltaics; other advanced micro and nano technology products ; assembly and test of all the above products .
2.2 The Special Incentive Package shall be for state of the art technology.
2.3 In the case of semi - conductor manufacturing (Fab units ) products , the threshold Net Present Value (NPV) of investment will be Rs . 2,500 crore and above . The threshold NPV of investment in manufacture of other eco - system productswill be Rs.1,000 crore and above . This threshold value shall be taken as the Net Present Value (NPV) of investments made during the first 10 years of the project life and the discount rate will be @ 9% .
3.1 The Central Government or any of its agencies shall provide incentive of 20% of the capital expenditure ( as defined in sub -paragraph 3.3) during the first 10 years for the units in SEZ and 25 % of the capital expenditure for non -SEZ units . Non - SEZ units shall be exempt from CVD . The incentives , if any, offered by the State Government or any of its agencies or local bodies shall be over and above this amount .
Note : The customs notification exempting CVD for non -SEZ units will be issued separately by the Ministry of Finance.
3.2 The period of 10 years shall be the first 10 years of the project life from the start of the project and not with regard to the start of any subsequent phase of the project .
3.3 The capital expenditure will be the total of capital expenditure in land , building , plant and machinery and technology including R&D . The cost of land exceeding 2% of the capital expenditure shall not be considered for calculation inthis regard.
4. Any unit may claim incentives in the form of capital subsidy or equity participation in any combination of the following:
(i) equity in the project, not exceeding 26% .
(ii) capital subsidy in the form of investment grant and interest subsidy .
The entire equity contribution will be taken towards the value of incentive package . There shall be an exit option, to be exercised by the Government, at a suitable point of time in the future , after the project goes on stream.
5.1 Those investors who choose equity as part of their incentive package shall be given such equity after the financial closure for the project and equity shall be released on a proportionate basis as equity is brought in by the promoters.
5.2 All other incentives shall be released after the end of the financial year in which the NPV of the total investment exceeds the threshold value .
5.3 Thereafter , the incentives shall be provided on an annual basis on the value of investments made during the year and be restricted to the first 10 years of the project life.

6. There shall be a ceiling on number of units 2 to 3 'fab' units and 10 eco - system units . The Special Incentive Package shall be available only up to 31 - .3-2010 .
7.1 An Appraisal Committee shall be set up by the Department of Information Technology and headed by the Additional Secretary, Department of Information Technology. The Appraisal Committee will receive expressions of interest from investors and submit its recommendations to the Government . The Government shall consider such recommendations and grant approvals.
7.2 For the effective functioning of the Appraisal Committee ( A.C. ) , a set of guidelines shall be drawn up by DIT and issued separately .
