आदेश
है और यह निदेश दिया है कि लोक सभा में दस रिक्तियों , जोकि दिनांक 23 दिसम्बर , 2005 को सदस्यता की समाप्ति के परिणामस्वरूप उत्पन्न हुए हैं; के विरुद्ध अब उप - निर्वाचन कराया जा सकता है;

आ.अ. 44( अ ).-यतः , लोक सभा के गठन के लिए साधारण निर्वाचन 2004 में कराया गया था;
यतः , देश के किसी भी भाग को लम्बे समय तक प्रतिनिधि रहित नहीं छोड़ना और तद्नुसार लोक प्रतिनिधित्व अधिनियम , 1951 (1951 का 43 ) की धारा 151 क के द्वारा अनुबंधित समय के भीतर आकस्मिक रिक्ति को भरना आयोग की एक संगत नीति रही है; और यतः , झारखंड राज्य के लिए निर्वाचक नामावलियों को 1 जनवरी , 2006 को अर्हता की तिथि मानकर अंतिम रूप से पुनरीक्षित किया गया था; और
यतः , लोक प्रतिनिधित्व अधिनियम , 1950 की धारा 21 (2) (क) ( ii ) के अनुसार निर्वाचक नामावलियों को , लिखित रूप में रिकार्ड किए जाने वाले कारणों से निर्वाचन आयोग द्वारा अन्यथा निदेशित किए जाने तक , निर्वाचन क्षेत्र को आबंटित स्थान में आकस्मिकरिक्ति को भरने के लिए उप - निर्वाचन के पूर्व अर्हता की तिथि के संदर्भ में निर्धारित रीति से पुनरीक्षित नहीं किया जाएगा; और यतः , लोक सभा द्वारा दिनांक 23 दिसम्बर , 2005 को एक प्रस्ताव स्वीकृत कर झारखंड राज्य में 13 - पलामू ( अ.जा. ) संसदीय निर्वाचन क्षेत्र से निर्वाचित श्री मनोज कुमार सहित उसके दस सदस्यों को 23 दिसम्बर , 2005 से निष्कासित कर दिया गया है , जिसके परिणामस्वरूप लोक सभा में एक आकस्मिक रिक्ति हो गई है ; और
यतः , निर्वाचक नामावलियों को तैयार करने अथवा पुनरीक्षा करने के संबंध में अर्हता की तारीख का अर्थ है, उस वर्ष की जनवरी का पहला दिन जिसमें लोक प्रतिनिधित्व अधिनियम , 1950 की धारा (14 ) ( ख ) के अनुसार इन्हें इस प्रकार तैयार अथवा पुनरीक्षित किया जाता है; और
यतः , आयोग ने अपनी अधिसूचना संख्या 100 /झार.- लो.स. / 1 /2007 तारीख 3 मार्च , 2007 द्वारा उक्त रिक्ति को भरने के लिए उप - निर्वाचन का कार्यक्रम अधिसूचित कर दिया है ।
यतः , आयोग , लोक प्रतिनिधित्व अधिनियम , 1951 ( 1951 का43 ) की धारा 151 क के द्वारा अनुबंधित समय के भीतर, उपर्युक्त कारणों से उत्पन्न रिक्तियों को भरने के लिए उप- निर्वाचनों की घोषणा नहीं कर सका , क्योंकि लोक सभा से सदस्यों के निष्कासन को चुनौती देते हुए 2006 की रिट याचिका सं. 1 और कुछ अंतरित मामले उच्चतम न्यायालय में दाखिल किये गये थे और उच्चतम न्यायालय ने यह निदेश दिया था कि उपर्युक्त रिट याचिका और अंतरित मामलों के निपटान लम्बित रहने तक किसी भी आकस्मिक रिक्ति, को भरने के लिए उप - निर्वाचन नहीं कराया जा सकता; और
यतः, 13 - पलामू ( अ.जा. ) संसदीय निर्वाचन क्षेत्र के अन्तर्गत 76 -डालटनगंज , 77 - बिश्रामपुर , 78 -छतरपुर ( अ.जा. ) , 79- हुसैनाबाद , 80 - गढ़वा और 81 - भवनाथपुर विधान सभा निर्वाचन क्षेत्र को छोड़कर झारखंड राज्य में 1-1-2007 के संदर्भ में इस समय यतः , उच्चतम न्यायालय ने अपने दिनांक 10 जनवरी , 2007 के आदेश के द्वारा 2006 की रिट याचिका सं. 1 और 2006 के अंतरित मामला सं. 83-90 में उपर्युक्त मामलों को खारिज कर दिया

निर्वाचक नामार्वालयों का विशेष पुनरीक्षण प्रगति पर है, इसे 20 अप्रैल , 2007 से पहले पूरा नहीं किया जा सकता;
and transferred Cases No. 83-90 of 2006 has dismissed the above said cases and directed that bye - clection against the ten vacancies in Lok Sabha that have resulted due to cessation of the membership w.e.f. 23rd December , 2005 canbe held now:
यतः , पृर्वोक्त आकस्मिक रिक्ति को भरने के लिए उप-निर्वाचन को अंतिम रूप से निर्वाचक नामावलियां प्रकाशित होने तक स्थगित नहीं किया जा सकता , क्योंकि, इसका अर्थ यह होगा कि लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 151 क में विनिर्दिष्ट कालावधि से अधिक समय तक निर्वाचन क्षेत्रों को प्रतिनिधि विहीन छोड़ दिया गया है ।
Whereas , it has been a consistent policy of the Commission not to leave any part of the country unrepresentative for a long time and accordingly to fill the casual vacancy within the time stipulated by Section 151A of the Representation of the People Act , 1951 (43 of 1951); and
Whereas , according to Section 21 ( 2) (a) ( ii ) of the Representation of the People Act, 1950 , the electoral roll shall , unless otherwise directed by the Election Commission for the reasons to be recorded in writing, be revised in the prescribed manner by reference to the qualifying date before bye-electionto fill a casual vacancy in the seat allotted to the constituency; and
अतः. अब, आयोग , पूर्वोक्त कारणों से लोक प्रतिनिधित्व अधिनियम, 1950 की धारा 21 ( 2 ) के परन्तुक के साथ पठित धारा 21 (2 ) ( क ) ( ji ) के अधीन एतद्वारा निदेश देता है कि 76 -डालटनगंज . 77-विश्रामपुर , 78 - छतरपुर ( अ.जा. ) , 79-हुसैनाबाद, 80- गढ़वा और ह । भवनाथपुर विधान सभा निर्वाचन क्षेत्र जो 13 - पलामू (अ.जा. ) संसदीय निर्वाचन क्षेत्र के अंतर्गत आते हैं, के लिये 1-1-2006 को अर्हता की तारीख मानकर पुनरीक्षित नामावलियां 13 पलामू (अ.जा. ) संसदीय निर्वाचन क्षेत्र से उप-निर्वाचन के लिए प्रयोग में लाई जाएगी ।

Whereas , the qualifying date in relation to the preparation or revision of electoral rolls means the 1st day of the January of the year in which it is so prepared or revised as per Section 14( b ) of the Representation of the People Act, 1950 ; and

Whereas , the Commission has notified the programme for holding bye - election to the said vacancy, vide its notification number 100 / JKD / HP/ 1/2007 dated 3rd March, 2007:
ORDER
NewDelhi , the 20th March , 2007
Ο.Ν. 44 ( E ) . Whereas , theGeneral Election to constitute the Lok Sabha was held in , 2004; and
Whereas , the special revision of electoral rolls w.r.t. 1-1-2007 is in progress in Jharkhand , excluding the 76-Daltonganj , 77 - Bishrampur , 78 - Chhatarpur ( SC) , 79- Hussainabad, 80- Garhwa and 81 - Bhavnathpur Assembly constituency comprised within 13 - Palamu (SC) Parliamentary Constitutency, as it on could not be completedbefore 20th April , 2007;
Whereas , the electoral rolls of the State of Jharkhand were last revised with reference to 1st January , 2006 as the qualifying date ; and
Whereas , the bye- electionto fill the aforesaid casual vacancy should not be postponed till the electoral rolls are finally published , as that would mean leaving the constituency unrepresentative beyond the period specified in Section 151A of the Representation of the People Act, 1951:
Whereas , one casual vacancy has occurred in Lok Sabha consequent to adoption of a motion by the Lok Sabha on 23rd December , 2005 expelling from membership ofLok Sabha itsten members including Shri Manoj Kumar electedfrom 13 - Palamu (SC) Parliamentary Constituency in the State of Jharkhand with effect from 23rd December, 2005; and
Now, therefore , the Commission , for the aforesaid reasons, hereby directs under Section 21 (2) (a) (ii) read with the proviso the Section 21 ( 2 ) of the Representation of the People Act , 1950 that the electoral rolls of 76 -Daltonganj , 77 -Bishrampur , 78- Chhatarpur (SC) , 79 - Hussainabad , 80-Garhwa and 81 - Bhavnathpur , Assembly Constituencies comprised within 13 - Palamu ( SC) Parliamentary Constituency as stand revised with 1-1-2006 as qualifying date shall be used for conducting bye-election from 13 -Palamu (SC) Parlimentary Constituency .
[No. 100 /JKD -HP/1 /2007] Whereas , the Commission could not announce bye-elections to fill the vacancies arisen duerto aforesaid reason , within the period stipulated by Section 151A of the Representation of the People Act , 1951 (43 of 1951 ) as a WritPetition No. 1 of 2006 and certain Transferred cases were filed in the Supreme Court of India challenging the expulsion from the membership of the Lok Sabha and the Supreme Court had directed that the bye elections to fill up the casual vacancies shall not be held by the Commission until said the writ petition is finally disposed of ; and
ByOrder, Whereas, the Supreme Court of India vide its order dated 10th January , 2007 in Writ Petition No. 1 of 2006
