का.आ. 425( अ ).-केन्द्रीय सरकार की यह राय है कि बस बॉडी निर्माणकर्ताओं के प्रत्यायन के संबंध में कतिपय प्रमाप और प्रक्रिया को अधिसूचित करना लोकहित में आवश्यक और समीचीन है, अतः वह मोटर यान अधिनियम , 1988 ( 1988 का 59 ) की धारा 109 की उपधारा ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , ऐसे प्रमाप और प्रक्रिया को विनिर्दिष्ट करने के लिए निम्नलिखित आदेश करती है , अर्थात्:-

1. (1 ) इस आदेश का संक्षिप्त नाम केन्द्रीय मोटर यान (बस बॉडी निर्माणकताओं का प्रत्यायन) आदेश , 2007 (जिसे इसमें इसके पश्चात् उक्त आदेश कहा गया है) ।

(2) यह राजपत्र में इस आदेश के प्रकाशन की तारीख से एक वर्ष के पश्चात् प्रवृत्त होगा ।

2. परिभाषाएं

(क) " प्रत्यायन" से सक्षम प्राधिकारी द्वारा बस बॉडियों की विनिर्दिष्ट क्वालिटी का निरंतर रूप से उत्पादन करने के लिए किसी बॉडी निर्माणकर्ता की सामर्थ्यताओं और क्षमताओं के मूल्यांकन, निर्धारण और अनुमोदन करने की प्रक्रिया अभिप्रेत है ;

(ख ) " अधिनियम" से मोटर यान अधिनियम, 1988 (1988 का 59) अभिप्रेत है ;

(ग) " निर्धारक" से विहित प्रमाप मानकों और प्रक्रिया के अनुसार बस बॉडी निर्माणकर्ताओं और बस की गॅडियों का निरीक्षण करने के लिए जोन प्रत्यायन बोर्ड द्वारा नियुक्त कोई तकनीकी विशेषज्ञ अभिप्रेत है ;

(घ) " बस बॉडी निर्माणकर्ता " से बस बॉडियों के गढ़ने में नियोजित कोई फर्म अभिप्रेत है और जिसके पास निम्नलिखित न्यूनतम सुविधाएं हैं, अर्थात् :-

(i ) अवसंरचना सुविधाएं, अर्थात् भूमि, भवन और उपयोगिताएं ;

( ii) संक्षारण निवारक उपचार करने के लिए संयंत्र और उपस्कर ;

, पेंट करना, संरचना गढ़ना, पैनल बनाना, परिसाधित करना और आवश्यक संघटकों से सुसज्जित करना ;

(iii) पूर्णतः निर्मित बसों का, उनके सभी संघटकों के साथ चाहे वे कारखाने में तैयार किए गए हों या क्रय किए गए हों , निरीक्षण, क्वालिटी आश्वासन और परीक्षण करना और

(iv) केन्द्रीय मोटर यान नियम, 1989 की अद्यतन जानकारी रखना ।

(ङ) " प्ररूप " से इस आदेश से संलग्न कोई प्ररूप अभिप्रेत है ;

(च ) " राष्ट्रीय प्रत्यायन बोर्ड ( एन ए बी) " से उक्त नियमों को कार्यन्वित करने और जोन प्रत्यायन बोडों के कृत्यों की मानीटरी करने के लिए अभिकरण के रूप में सेवा करने के लिए भारत सरकार द्वारा गठित बोर्ड अभिप्रेत है ;

(छ) " सचिवालय " से क्रमशः पैरा 9 और पैरा 12 के अधीन स्थापित राष्ट्रीय प्रत्यायन बोर्ड और जोन प्रत्यायन बोर्ड अभिप्रेत है ;

4 (ज) " जोन प्रत्यायन बोर्ड(जेडएबी) " से राष्ट्रीय प्रत्यायन बोर्ड के समग्र दिशा निर्देश के अधीन कार्य करने के लिए चार जोनों अर्थात्, उत्तरी जोन, दक्षिणी जोन, पूर्वी जोन और पश्चिमी जोन में से किसी एक के लिए गठित निकाय अभिप्रेत है । ;

3. बस बॉडी निर्माणकर्ता : बस बॉडी निर्माणकर्ता नीचे दी गई सारणी में यथा उपदर्शित उनके द्वारा किए जाने वाले क्रियाकलापों के आधार पर वर्गीकृत किए जाएंगे : - भारत का राजपत्र असाधारण

संरचनात्मक, समुच्चय , संक्षारण निवारण उपचार, बस की बॉडियों का पैंट करना, परिसाधित करना और सुसज्जित करना, निरीक्षण और परीक्षण करना । वे उनके पास सदैव क्वालिटी आश्वान प्रणाली और क्रय की गई ऐसी सभी मदों के लिए , जिन्हें वे भारी संख्या में मदों और संघटकों को बाहर से प्राप्त करते हैं, सुविधाएं होंगी । भूमि, भवन और अन्य सुविधाएं उपलब्ध होंगी ।

ग

प्रवर्ग घ द्वारा संपादित किए जाने वाले क्रियाकलापों के अतिरिक्त इस प्रवर्ग के बस बॉडी निर्माणकर्ता के पास संरचना और अन्य संघटकों के गढ़ने के लिए सुविधाएं भी होंगी जबकि अन्य उपसमुच्चयों और समुच्चयों (जैसे स्थान, खिड़कियां और ऐसे ही अन्य मदें) मानक मद जैसे फास्टनर, ब्रेकेट, शीशे, रबड़ की मदें जो प्रवर्ग घ में हैं के अतिरिक्त उनके द्वारा बाहर से प्राप्त किए जाएंगे

प्रवर्ग ग द्वारा संपादित किए जाने वाले क्रियाकलापों के अतिरिक्त बस बॉडी निर्माणकर्ता का यह प्रवर्ग बस की बॉडियों का डिजाइन और उनका विकास भी करेगा ।

ख

प्रवर्ग ग द्वारा संपादित किए जाने वाले क्रियाकलापों के अतिरिक्त बस बाँकी निर्माणकर्ता का यह प्रवर्ग उपतंत्र और आसन, खिड़कियों जैसे समुच्चयों और ऐसे ही अन्य के गढ़ने के क्रियाकलापों को भी आरंभ करेगा, दूसरे शब्दों में बस बॉडी निर्माणकर्ताओं के इस प्रवर्ग के पास बस बॉडी डिजाइन करने और उसका विकास करने की सामर्थ्यता के अलावा बस बॉडी निर्माण के लिए सभी सुविधाएं होंगी ।

बस बॉडी निर्माणकर्ताओं के इस प्रवर्ग के पास केवल अपने कारखानें में ही संपूर्ण बस और उसके उपतंत्रों या समुच्चयों के निर्माण के लिए सुविधाएं नहीं होंगी बल्कि बस बॉडियों के डिजाइन और उसके विकास के लिए सामर्थ्यता भी होगी ।

बस बॉडी निर्माणकर्ता का प्रत्यायन सभी बस बॉडी निर्माणकर्ता उक्त आदेश के अधीन यथा अधिसूचित राष्ट्रीय प्रत्यायन बोर्ड और जोन प्रत्यायन बोडौँ द्वारा प्रत्यायित होंगे । प्रत्यायित बस बॉडी निर्माणकर्ता भारतीय मानक ब्यूरो अधिनियम, 1986 (1986 का 63) के अधीन तत्रथानी भारतीय मानक ब्यूरो विनिर्देशों के अधिसूचित किए जाने तक समय - समय पर यथा THE GAZETTE OF INDIA : EXTRAORDINARY

[PART II-SEC. 3(ii) ] संशोधित एआइ एसः 052: 2001 के अनुसार यान के सुसगत टाइप के लिए बस बॉडी कोड के सुसंगत उपबंधों में विनिर्दिष्ट टाइप अनुमोदन अपेक्षाओं को पूरा करेंगे ।

5. प्रत्यायन प्रणाली में अंतवर्तित क्रियाकलाप ( 1 ) प्रत्यायन की प्रक्रिया निम्नलिखित प्रक्रमों में कार्यान्वित की जाएगी, अर्थात् : -

(i ) केन्द्र सरकार द्वारा जोन और राष्ट्रीय प्रत्यायन बोर्डों का गठन और सूचना और अधिसूचना जिसके अंतर्गत जोन और राष्ट्रीय प्रत्यायन बोर्डों में स्थायी सचिवालय की स्थापना भी है ।

(ii) जोन प्रत्यायन बोर्डों में निर्धारकों के पैनल का चयन और तैयार करना ।

( iii) जोन प्रत्यायन बोर्ड में बस बॉडी निर्माणकताओं के प्रत्यायन के प्रारंभ के लिए सूचना और उसमें अंतवर्लित औपचारिकताएं ।

(iv) जोन प्रत्यायन बोर्ड में आवेदन की प्राप्ति और उसकी संवीक्षा ।

(v) जोन प्रत्यायन बोर्डों में निर्धारकों का नामांकन और निर्धारण की योजना ।

(vi) जोन प्रत्यायन बोर्डों में निर्धारण ।

(vii) जोन प्रत्यायन बोर्ड सचिवालय में उसकी पूर्णता के लिए निर्धारण रिपोर्ट की संवीक्षा और जोन प्रत्यायन बोर्ड को विचार के लिए प्रस्तुत करना ।

(ix) राष्ट्रीय प्रत्यायन बोर्ड द्वारा अनंतिम प्रत्यायन का अनुमोदन या अनुसमर्थन ;

(x) जोन प्रत्यायन बोर्ड सचिवालय द्वारा प्रत्यायन प्रमाण - पत्र का जारी किया जाना ;

(xi ) जोन प्रत्यायन बोर्ड में निगरानी या पुनः प्रत्यायन का संचालन ;

(xii ) राष्ट्रीय प्रत्यायन बोर्ड में शिकायतों या अभ्यावेदनों या अपीलों या अन्य सुसंगत मुद्दों का निपटान और

(xiii) जोन प्रत्यायन बोर्ड में प्रत्यायन का नवीकरण

2. प्रत्यायन क्रियाकलापों के लिए प्रगति चार्ट उपबंध खखख -1 में दिया गया है ।

6. प्रत्यायन तंत्र के लिए संगठन संरचना -चार जोन प्रत्यायन बोर्ड अर्थात् उत्तरी जोन प्रत्यायन बोर्ड, दक्षिणी जोन प्रत्यायन बोर्ड, पूर्वी जोन प्रत्यायन बोर्ड और पश्चिमी बोर्ड प्रत्यायन बोर्ड होंगे । अपने- अपने ये जोन निकाय उनके जोनों में प्रत्यायन प्रक्रिया आरंभ करने के लिए उत्तरदायी होंगे ।

इन सभी जोन प्रत्यायन बोडौँ के क्रियाकलाप राष्ट्रीय प्रत्त्यायन बोर्ड द्वारा समन्वित होंगे । बस बॉडी निर्माणकर्ता प्रत्यायन तंत्र के लिए संगठन संरचना उपाबंध खखख -2 और उपाबंध खखख -2 क में दी गई है ।

7. राष्ट्रीय प्रत्यायन बोर्ड की संरचना : - राष्ट्रीय प्रत्यायन बोर्ड की संरचना नीचे दी गई अनुसूची में यथा उपदर्शित के अनुसार होगी, अर्थात् :-

8. राष्ट्रीय प्रत्यायन बोर्ड के कृत्य राष्ट्रीय प्रत्यायन बोर्ड के कृत्य निम्मानुसार होंगे, अर्थात्:-

(क) जोन प्रत्यायन बोर्ड और राष्ट्रीय प्रत्यायन बोर्ड के लिए कारबार के संव्यवहार के नियम

(ख ) राष्ट्रीय प्रत्यायन बोर्ड और जोन प्रत्यायन बोर्डों में लगाए जाने वाले कर्मचारियों के स्तरों और सचिवालय कर्मचारिवृंद की संख्या को मंजूर करना ;

(ग) सचिवालय कर्मचारिवृंद के लिए सेवा की शर्तें और उनके वेतनमान और नियुक्ति के अन्य निबंधनों को अधिकथित करना ;

(घ) सचिवालय कर्मचारिवृंद की नियुक्ति के लिए अर्हता और वैसी ही बात को अधिकथित करना ;

(ङ) अपील प्राधिकारी के रूप में कार्य करना ;

(च) निर्धारकों की अर्हता, निबंधन और शर्तें तथा उनके नामों को अधिकथित करना ;

(छ) सचिव के लिए अपेक्षित अर्हता और सेवा की अन्य शर्तों को अधिकथित करना ;

(ज) जोन प्रत्यायन बोर्ड के सचिवालय के सुचारु कार्यकरण को सुनिश्चित करने के लिए स्थायी सचिव की शक्तियों और प्राधिकार को परिभाषित करना ;

(झ) बस बॉडी निर्माण से संबंधित भारत सरकार की नीतियों और विधान के कार्यान्वयन को सुनिश्चित करना ;

(ञ) विभिन्न जोन प्रत्यायन बोडों के बीच समन्वय ;

(ट) विभिन्न जोन प्रत्यायन बोर्डों द्वारा अपनाई जाने वाली प्रत्यायन प्रक्रिया में एकरूपता सुनिश्चित करना ;

(ठ) भारत सरकार के साथ पारस्परिक संपर्क ;

(ड) जोन प्रत्यायन बोर्डों द्वारा सिफारिश किए गए अनंतिम प्रत्यायन का अनुमोदन करना ;

(ढ़) शिकायतों या परिवादों या अपीलों का निपटान करना ;

(ण) प्रत्यायन मानकों के अनुपालन को सुनिश्चित करने के लिए यदा- कदा सांकेतिक परीक्षण करना ;

(त) समय- समय पर प्रत्यायन फीस संरचना विनिश्चित करना और उसका पुनर्विलोकन करना ;

(थ ) समुचित राष्ट्रीय प्रत्यायन बोर्ड लोगो का डिजाइन करना और उसके उचित उपयोग को सुनिश्चित करना ; और

(द) उस प्रयोजन के लिए अपेक्षित कोई अन्य कृत्य जो जोन प्रत्यायन बोर्ड या राष्ट्रीय प्रत्यायन बोर्ड द्वारा विनिश्चित किया जाए ।

9. राष्ट्रीय प्रत्यायन बोर्ड सचिवालय : (1 ) राज्य सड़क परिवहन उपक्रमों के सहयोग से, नई

दिल्ली में एक सचिवालय स्थापित किया जाएगा । सचिवालय से एक स्थायी सचिव सड़क परिवहन और राजमार्ग विभाग द्वारा नामनिर्देशित किया जाएगा । राष्ट्रीय प्रत्यायन बोर्ड या तों अपेक्षित पूरक कर्मचारिवृंद नियुक्त करेगा या राज्य सड़क परिवहन उपक्रमों के संगम को ऐसा करने के लिए प्राधिकृत करेगा ।

(2) राष्ट्रीय प्रत्यायन बोर्ड सचिवालय ऊपर पैरा 8 में यथा प्रगणित अपने कृत्यों के निर्वहन करने में राष्ट्रीय प्रत्यायन बोर्ड की सहायता करेगा ।

10. जोन प्रत्यायन बोर्ड की संरचना : प्रत्येक जोन प्रत्यायन बोर्ड की संरचना नीचे दी गई सारणी

[PART II-SBC. 3( ii)] 11. जोन प्रत्यायन बोर्ड के कृत्य : - जोन प्रत्यायन बोर्ड के कृत्य निम्नलिखित होंगे : -

(क) बोर्ड का स्थायी सचिव नियुक्त करना ;

(ख) सम्यक् मूल्यांकन के पश्चात् सचिव द्वारा प्रस्तुत निर्धारण पर विचार करना और अनुमोदन करना या अननुमोदन करना ;

(ग) बस बॉडी निर्माणकर्ताओं को अनंतिम प्रत्यायन प्रदत्त करना ;

(घ) किसी दी गई कालावधि के भीतर अनंतिम प्रत्यायन प्रमाण पत्र जारी करने के लिए सचिव को प्राधिकृत करना ;

(ङ) जोन में निर्धारकों के पैनल का अनुमोदन करना ;

(घ ) निर्धारण तकनीकियों में निर्धारकों का प्रशिक्षण सुनिश्चित करना ;

(छ) निर्धारकों और बस बॉडी निर्माणकर्ताओं के दल के परामर्श से निर्धारण योजना बनाने के लिए सचिव की शक्तियों और प्राधिकार को परिभाषित करना ।

12. जोन प्रत्यायन बोर्ड सचिवालय : - ( 1 ) प्रत्येक जोन प्रत्यायन बोर्ड के लिए एक सचिवालय स्थापित किया जाएगा । इसकी अध्यक्षता स्थायी सचिव द्वारा की जाएगी जो जोन प्रत्यायन बोर्ड के लिए अपेक्षित अन्य कर्मचारिवृंद की भी नियुक्ति करेगा ।

(2) पश्चिमी जोन प्रत्यायन बोर्ड और दक्षिणी जोन प्रत्यायन बोर्ड के लिए सचिवालय केन्द्रीय सड़क परिवहन संस्थान, पुणे में स्थापित किया जाएगा । उत्तरी जोन प्रत्यायन बोर्ड और पूर्वी जोन प्रत्यायन बोर्ड के लिए सचिवालय भारतीय ऑटोमोटिव अनुसंधान संगम, पुणे में स्थापित किया जाएगा ।

13. जोन प्रत्यायन बोर्ड सचिवालय के कृत्य : जोन प्रत्यायन बोर्ड सचिवालय के निम्नलिखित कृत्य होंगे : -

(क) भावी बस बॉडी निर्माणकर्ताओं से प्रत्यायन के लिए आवेदन (प्ररूप खखख -- 1 ) आमंत्रित करना और उन्हें स्वीकार करना ;

(ख) आवेदनों की समीक्षा करना और अतिरिक्त जानकारी, यदि अपेक्षित हो, प्राप्त करना ;

(ग) बस बॉडी निर्माणकर्ताओं के प्रायोगिक प्रवर्ग को अंतिम रूप देना और उस विशिष्ट प्रवर्ग के लिए प्रत्यायन फीस के संबंध में बस बॉडी निर्माणकर्ताओं को सूचना देना ;

(घ) निर्धारकों के किसी दल को नियुक्त करना ;

(ङ) रजिस्ट्रीकरण फीस और निर्धारण प्रभारों की प्राप्ति से एक मास के भीतर बस बॉडी निर्माणकर्ताओं के प्रवर्ग के अनुसार प्ररूप संख्या खखख -5 से प्ररूप संख्या खखख -10 के अनुसार प्रत्यायन के लिए निर्धारण की व्यवस्था करना ;

(च) सम्यक् परीक्षा के पश्चात् जोन प्रत्यायन बोर्ड को उनके विचार के लिए निर्धारित मामलों को प्रस्तुत करना ;

(छ) जोन प्रत्यायन बोर्ड की सिफारिश के अनुसार अनंतिम प्रत्यायन प्रमाण पत्र जारी करना ;

(ज) ' निर्धारकों की नियुक्ति और निर्धारण की योजना सहित निर्धारण से संबंधित सभी क्रियाकलापों का समन्वय करना ;

(झ) राष्ट्रीय प्रत्यायन बोर्ड को प्रस्तुत किए जाने वाले मामलों की प्रारूप कार्यसूची तैयार करना ;

(ञ) राष्ट्रीय प्रत्यायन बोर्ड द्वारा अनंतिम प्रत्यायन के अनुमोदन पर अंतिम प्रत्यायन प्रमाण पत्र तैयार करना और उसे जारी करना ;

(ट) अन्य बातों के साथ, निम्नलिखित को रखना और उन्हें अद्यतन करना : -

(क) निर्धारकों का पैनल ;

(ख) सभी दस्तावेज और

(ग) राष्ट्रीय प्रत्यायन बोर्ड/ जोन प्रत्यायन बोर्ड और उनके सदस्यों के साथ संपर्क ।

(ठ) क्रियाकलाप से संबंधित कोई अन्य कृत्य ।

(1 ) प्रत्यायन के लिए आवेदन :

[PART II--SEC. 3 (ii)] (i ) प्रत्यायन प्राप्त करने के लिए आशयित बस बॉडी निर्माणकर्ता विहित आवेदन प्ररूप (प्ररूप सं. खखख -1 ) में दो प्रतियों में आवेदन करेगा ।

(ii ) आवेदन के साथ राष्ट्रीय प्रत्यायन बोर्ड द्वारा समय - समय पर यथा विनिश्चित विहित आवेदन फीस होगी ।

(iii

) प्रत्यायन के लिए आवेदन करते समय बस बॉडी निर्माणकर्ता निम्नलिखित की उपलब्धता सुनिश्चित करेगा, अर्थात् : -

(क) इस प्रयोजन के लिए पर्याप्त मशीन और अवसंरचनात्मक सुविधाएं ;

(ख) सक्षम जनशक्ति ;

(ग) विनियामक या विधिक और सुरक्षा अपेक्षाओं के तंत्र की अनुपालना ;

(घ) पर्यावरणीय अपेक्षाओं के साथ तंत्र की अनुपालना जिससे कि पड़ोस और आसपास का वातावरण परिसंकटमय न हो सके

(ङ) तात्विक प्रबंध तंत्र की पर्याप्तता ;

(च) पर्याप्त उपस्कर और मद या सामग्री के लिए व्यवहार- ज्ञान प्राप्ति पर प्रक्रम क्वालिटी आश्वासन कारखाने की प्रक्रिया का निरीक्षण और बस बॉडी का अंतिम परीक्षण, जहां भी लागू हो ; और

(छ) निर्देश दस्तावेजों की प्रतियां ।

(2) आवेदन की अभिस्वीकृति की संवीक्षा और उस पर कार्यवाही :

(i) जोन प्रत्यायन बोर्ड सचिवालय, आवेदन की, उसके संलग्नकों और अपेक्षित फीस आदि की प्राप्ति पर दस कार्यदिवसों के भीतर बस बॉडी निर्माणकर्ताओं को रसीद के साथ अभिस्वीकृति जारी करेगा जिसमें बस बॉडी निर्माणकर्ताओं को निर्देश और पत्र व्यवहार के लिए भविष्य में प्रयोग किए जाने के लिए बस बॉडी निर्माणकर्ताओं को अद्वितीय ग्राहक रजिस्ट्रीकरण संख्यांक (सीआरएन) आवंटित करेगा ;

( ii) आवेदन की प्रारंभिक संवीक्षा जोन प्रत्यायन बोर्ड सचिवालय द्वारा की जाएगी । उक्त सचिवालय अतिरिक्त जानकारी या यदि आवश्यक हो तो स्पष्टीकरण के लिए मांग कर सकेगा । यदि भारी 11

कमियां हों तो उक्त सचिवालय द्वारा बस बॉडी निर्माणकर्ताओं से अपेक्षाओं की अनुपालना के लिए कहा जाएगा और अनुपालना रिपोर्ट के साथ आवेदन को पुनः प्रस्तुत किया जाएगा ; और

(iii ) यदि आवेदन साधारणतया ठीक पाया जाता है तो उस पर वर्गीकरण के लिए विचार किया जाता है । तत्पश्चात् बस बॉडी निर्माणकर्ता से तदनुसार निर्धारण फीस जमा करने की मांग की जाएगी ।

(3) निर्धारण :

(i ) निर्धारण फीस की प्राप्ति पर, जोन सचिव निर्धारण की समय अनुसूची की योजना के लिए निर्धारक और बस बॉडी निर्माणकर्ता से समन्वय करेगा ;

(ii ) दो निर्धारक, एक तकनीकी निर्धारक और एक प्रमुख तकनीकी निर्धारक निर्धारण के लिए प्रतिनियुक्त किए जाएंगे ।

(iii ) तकनीकी निर्धारक मशीनों, विनिर्माण तकनीकों, अभियोजित पद्धतियों और मशीनों या उपस्करों के अनुरक्षण तथा अंशशोधन के निबंधनों के अनुसार बस बॉडी निर्माणकर्ताओं की तकनीकी सक्षमताओं के निर्धारण के लिए उत्तरदायी होगा ;

(iv) प्रमुख तकनीकी निर्धारक आवेदन प्ररूप के मूल्यांकन, आवेदन प्ररूप की विषयवस्तु के सत्यापन बस बॉडी निर्माणकर्ता द्वारा किए गए दायों के सत्यापन, क्वालिटी प्रणाली के अनुरक्षण और बस बॉडी निर्माणकर्ता के समग्र निर्धारण के लिए उत्तरदायी होगा ;

(v) बस बॉडी निर्माणकर्ता को निर्धारण की अंतिम समय अनुसूची के बारे में संसूचित किया जाएगा और निर्धारण दल के बारे में सूचना दी जाएगी ;

(vi ) निर्धारण दल निम्नलिखित क्षेत्रों के लिए और बस बॉडी निर्माणकर्ता द्वारा किए गए दावे के विरुद्ध प्ररूप संख्या खखख -5 से प्ररूप संख्या खखख -10 का उपयोग करते हुए बस बॉडी निर्माणकर्ता की सामर्थ्यता का पुनर्विलोकन करेगा । प्ररूप संख्या खखख -2 निर्धारकों द्वारा की गई संप्रेक्षणाओं की नोटिंग के लिए उपयोग की जाएगी :

(क) मशीनरी , जिग और फिक्सचर सहित विनिर्माण सुविधा की उपलब्धता ;

[PART II-SBC. 3(ii) ] (ख) सक्षम जनशक्ति की उपलब्धता । इस प्रयोजन के लिए निर्धारण दल अभिलेखों का सत्यापन और जहां आवश्यक हो कार्मिकों से साक्षात्कार करेगा ;

(ग) सुसंगत विधिक अपेक्षाओं और अग्नि परिसंकट सहित पर्यावरणीय दशाओं की अनुपालना ;

( घ) सुरक्षा साधित्रों और उपायों का प्रावधान ;

(ङ) निरीक्षण, माप, आदि के लिए औजारों और उपस्करों की उपलब्धता ;

(च) बस बॉडियों की आंतिरिक प्रक्रिया और उनके अंतिम निरीक्षण के अभिलेख ;

(छ) यदि परिधि के अंतर्गत डिजाइन भी है तो सक्षम जनशक्ति और सुविधाओं के लिए सत्यापन किया जाएगा ;

(ज) पर्याप्त भूमि स्थान और अवसंरचनात्मक सुविधाओं की उपलब्धता ;

(झ) माप उपस्करों और निरीक्षण/ परीक्षण सुविधाओं के लिए अंशशोधन अभिलेख और

(ञ) जोन प्रत्यायन बोर्ड या राष्ट्रीय प्रत्यायन बोर्ड द्वारा समय - समय पर विनिश्चित या विनिर्दिष्ट कोई अन्य अपेक्षा ;

(vii) एक बार निर्धारण पूरा हो जाता है तो निर्धारण दल दस कार्यदिवसों के भीतर जोन प्रत्यायन बोर्ड सचिवालय को निर्धारण रिपोर्ट प्रस्तुत करेगा । निर्धारण रिपोर्ट प्ररूप खखख-4 में तकनीकी निर्धारक और प्रमुख तकनीकी निर्धारक द्वारा संयुक्त रूप से तैयार की जाएगी और उस पर हस्ताक्षर किए जाएंगे और बस बॉडी निर्माणकर्ता के प्रतिनिधि द्वारा प्रति हस्ताक्षरित होगी । निर्धारण रिपोर्ट प्रत्यायन बोर्ड की मंजूरी या सम्यक् न्यायोचित और बिना किसी संदिग्धता के साथ अन्यथा के लिए स्पष्ट सिफारिश देगी ।

(viii) निर्धारण के दौरान पाई गई अननुरूपता तकनीकी निर्धारक और प्रमुख तकनीकी निर्धारक द्वारा प्ररूप खखख -3 में अभिलिखित की जाएगी और बस बॉडी निर्माणकर्ता को इसकी सूचना दी जाएगी । बस बॉडी निर्माणकर्ता निश्चित समय अनुसूची के भीतर किन्तु तीन मास की अधिकतम अवधि के भीतर प्रस्तावित सुधार कार्य के बारे में विनिश्चय करेगा । जोन प्रत्यायन बोर्ड सचिवालय अननुरूपता के क्षेत्रों की अनुपालना की प्रगति की मानीटरी करेगा ।

(ix) अननुरूप्ता की प्रकृति पर निर्भर करते हुए ये बस बॉडी निर्माणकर्ता की लागत पर सत्यापन दौरे सहित या रहित सुधार कार्य के दस्तावेजी साक्ष्य के प्रस्तुत करने पर प्रमुख तकनीकी निर्धारक द्वारा बंद कर दी जाएगी ;

(x) आवेदन की प्रक्रिया के दौरान प्राप्त सूचना के आधार पर निर्धारण रिपोर्ट और निर्धारण के दौरान प्राप्त अतिरिक्त सूचना और परिणामिक सत्यापनों, यदि कोई हों के दौरान जोन सचिव संक्षिप्त सारांश तैयार करेगा । कार्य सूची मद जिसके अंतर्गत संक्षिप्त सिफारिशें, आदि हैं या अन्यथा से सम्यक् न्यायोचित अनंतिम प्रत्यायन की मंजूरी या अन्यथा उनके विचार के लिए जोन प्रत्यायन बोर्ड के समक्ष रख दी जाएगी ;

(xi) निर्धारण रिपोर्ट पर जोन प्रत्यायन बोर्ड की संप्रेक्षणा और उसकी सिफारिशें अनंतिम प्रत्यायन की मंजूरी या अन्यथा के लिए विनिश्चात्मक कारक होंगे । जोन प्रत्यायन बोर्ड द्वारा किए गए सभी विनिश्चय कार्यवृत्त के रूप में अभिलिखित किए जाएंगे । ये कार्यवृत्त राष्ट्रीय प्रत्यायन बोर्ड को सूचना के लिए भी भेजे जाएंगे ।

(xii) यदि जोन प्रत्यायन बोर्ड विनिश्चय पर पहुंचने के लिए निर्धारण रिपोर्ट में कमियां पाता है तो जोन सचिवालय निर्धारक या बस बॉडी निर्माणकतो से स्पष्टीकरण प्राप्त करेगा और जोन प्रत्यायन बोर्ड के समक्ष उसके विनिश्चय के लिए रखेगा ;

(xiii) जोन प्रत्यायन बोर्ड की अंतिम सिफारिश राष्ट्रीय प्रत्यायन बोर्ड के समक्ष रखी जाएगी जिसकी आवेदनों और रिपोटों की संख्या पर निर्भर करते हुए छह मास में कम से कम एक बार बैठक होगी ;

(xiv) प्रत्यायन की मंजूरी पर जोन प्रत्यायन बोर्ड सचिवालय प्रत्यायन प्रमाणपत्र तैयार करेगा जिसमें प्रमाणपत्र का प्रवर्ग जारी करने की तारीख और विधिमान्यता की तारीख का उल्लेख होगा ;

(xv) प्रत्येक प्रमाणपत्र जोन सचिव द्वारा हस्ताक्षरित होगा जिसमें जोन प्रत्यायन बोर्ड या राष्ट्रीय प्रत्यायनय बोर्ड द्वारा अनुमोदन करने का उल्लेख होगा ;

(PART II-SEC. 3 (ii)] (xvi) सभी आवेदक बस बॉडी निर्माणकर्ता, बस बॉडी निर्माणकर्ता प्रमाणपत्र किए जाने से पूर्व से पूर्व जोन प्रत्यायन बोर्ड के लिए शोघ्य सभी संदायों का भुगतान करेंगे ; और

(xvii) प्रत्यायन की मंजूरी और नामंजूरी के संबंध में जोन प्रत्यायन बोर्ड द्वारा किए गए सभी विनिश्चय राष्ट्रीय प्रत्यायन बोर्ड को अपीलीय हैं जिसका विनिश्चय अंतिम और बाध्यकर होगा ।

(4) प्रत्यायनः

(i) विधिमान्यताः बस बॉडी निर्माणकर्ता प्रत्यायन प्रमाणपत्र चार वर्ष की अवधि के लिए विधिमान्य होगा ;

(ii) राष्ट्रीय प्रत्यायन बोर्ड लोगो का उपयोग : प्रत्यायन की मंजूरी पर, बस बॉडी निर्माणकर्ता उसके कारबार संवर्धन साहित्य अर्थात् शीर्षनामा, परिचय पत्रों, विवरणिकाओं पर राष्ट्रीय प्रत्यायन बोर्ड लोगों का उपयोग करेगा ; और

(iii) निगरानी : जोन प्रत्यायन बोर्ड दो वर्ष में एक बार निगरानी करेगा और प्रत्यायन प्रमाणपत्र की समाप्ति के पूर्व बस बॉडी निर्माणकर्ता पुनः निर्धारण करेगा । निगरानी या पुनः निर्धारण प्रथम निर्धारण के समान ही होगा । प्रत्यायन की विधिमान्यता के दौरान बस बॉडी निर्माणकर्ता उक्त आदेश की अपेक्षाओं की निरंतर रूप से अनुपालना करेगा ।

(5) प्रत्यायन की परिधि का विस्तार या उसका कम किया जाना :

(i ) बस बॉडी निर्माणकर्ता यदि ऐसा चाहता है तो प्रत्यायन के प्रवर्ग में परिवर्तन के लिए जोन प्रत्यायन बोर्ड को लिखित रूप में अनुरोध कर सकेगा । इस प्रयोजन के लिए जोन प्रत्यायन बोर्ड निगरानी/ पुनः निर्धारण के दौरे के दौरान बस बॉडी निर्माणकर्ता का निर्धारण करेगा या पूरक कार्यों का विशेष दौरा आयोजित कर सकेगा ; और 15

(ii) यदि बस बॉडी निमार्णकर्ता एक जोन के लिए प्रत्यापित है और यदि उसकी परिधि का अन्य जोनों में विस्तार किया जाना अपेक्षित है तो वैसा किसी निर्धारण के बिना किन्तु राष्ट्रीय प्रत्यायन बोर्ड द्वारा यथा विनिश्चित अतिरिक्त फीस के संदाय पर किया जा सकता है ;

(6) पूरक या विशेष दौरा : राष्ट्रीय प्रत्यायन बोर्ड/ जोन प्रत्यायन बोर्ड निम्नलिखित परिस्थितियों में प्रत्यायन की विधिमान्यता के दौरान किसी भी समय पूरक या विशेष दौरे के लिए भी व्यवस्था कर सकेगा ;

(क) प्रवर्ग में परिवर्तन ;

(

(ख) प्रत्याययन या प्रमाणपत्र या लोगों का दुरुपयोग ;

(ग) किसी शिकायत की प्राप्ति पर तथ्यों के सत्यापन के लिए ; और ,

(घ) जोन प्रत्यायन बोर्ड या राष्ट्रीय प्रत्यायन बोर्ड द्वारा विनिश्चित कोई अन्य परिस्थिति ।

(7) स्वेच्छा से वापिस लिया जानाः प्रत्यायन की विधिमान्यता के दौरान किसी भी समय बस बॉडी निर्माणकर्ता जोन प्रत्यायन बोर्ड को लिखित अनुरोध करके स्वेच्छिक रूप से जोन प्रत्यायन को बंद कर सकेगा । यदि बस बॉडी निर्माणकर्ता स्वेच्छया वापिस लेने की मांग करने के पश्चात् प्रत्यायन प्रास्थिति को पुनः प्राप्त करने का विनिश्चय करता है तो उसे प्रत्यायन समझा जाएगा और उसके लिए आवेदन और प्रत्यायन के लिए सभी सिफारिशों और उस समय यथा लागू निर्धारण व्ययों का संदाय करना होगा ।

(8) निगरानी :

(i) जोन प्रत्यायन बोर्ड सभी प्रत्यायित बस बॉडी निर्माणकर्ताओं के लिए दो वर्ष में एक बार निगरानी करेगा ;

(ii) निगरानी का उद्देश्य यह परीक्षा करना है कि क्या प्रत्यायन बस बॉडी निर्माणकर्ता आवेदन में दावा की गई या घोषित की गई सभी अपेक्षाओं को बनाए रख रहा है ;

[PART II-SBC. 3(ii)) ( iii) जोन प्रत्यायन बोर्ड निगरानी निर्धारण और निगरानी दौरे के लिए नियत तारीख से कम से कम तीन मास पूर्व अग्रिम संदत्त की जाने वाले निगरानी फीस के बारे में प्रत्यायित बस बॉडी निर्माणकर्ता को सूचना देगा । बस बॉडी निर्माणकर्ता तीस दिन के भीतर उसकी तैयारी की पुष्टि करेगा ; और

( iv) बस बॉडी निर्माणकर्ता उनकी तैयारी की पुष्टी करते समय परिधि या प्रवर्ग में परिवर्तन के लिए अनुरोध कर सकेगा ।

(9) प्रत्यायन का नवीकरण और पुनः निर्धारण :

( i) बस बॉडी निर्माणकर्ता प्ररूप संख्या खखख -1 में दो प्रतियों में आवेदन प्रस्तुत करके प्रत्यायन के नवीकरण के लिए आवेदन कर सकेगा ;

( ii) आवेदन के साथ यथा अपेक्षित विहित निगरानी फीस होगी । बस बॉडी निर्माणकर्ता प्रत्यायन की परिधि या प्रवर्ग में परिवर्तन के लिए अनुरोध कर सकेगा, जिसका आवेदन प्ररूप में विशिष्ट रूप उल्लेख किया जाएगा ;

( iii ) निगरानी के लिए अनुरोध प्रत्यायन की विधिमान्यता की समाप्ति के छह मास पूर्व प्रस्तुत किया जाएगा । बस बॉडी निर्माणकर्ता की प्रत्यायन प्रास्थिति यदि समय पर कोई आवेदन नहीं किया गया है तो प्रमाणपत्र में वर्णित विधिमान्यता तारीख को समाप्त हो जाएगी । बस बॉडी निर्माणकर्ता को नया आवेदन करना पड़ेगा और प्रमाणपत्र की निरंतरता रद्द हो जाएगी ;

( iv) नवीकरण आवेदन की कार्यवाही के लिए प्रक्रिया वही है जो नए आवेदन के लिए है ;

(v ) यदि पुनःनिर्धारण दौरे के परिणाम सकारात्मक हैं और सभी अननुरूपताएं प्रमाणपत्र की समाप्ति के पूर्व बंद कर दी जाती हैं तब प्रमाणपत्र की विधिमान्यता बिना किसी रुकावट के अन्य चार वर्षों के लिए विस्तार कर दी जाएंगी और

(vi ) नवीकरण हो जाने पर प्रत्यायन का एक नया प्रमाणपत्र जारी कर दिया जाएगा तथापि, प्रमाणपत्र संख्यांक वही रहेगा ।

(10) अपील : प्रत्यायन की मंजूरी या निरंतरता या नवीकरण से संबंधित राष्ट्रीय प्रत्यायन बोर्ड या जोन प्रत्यायन बोर्ड द्वारा किए गए सभी विनिश्चय बस बॉडी निर्माणकर्ता द्वारा अध्यक्ष, राष्ट्रीय प्रत्यायन बोर्ड को अपील करने के लिए खुले रहेंगे ।

(11 ) संपरीक्षा : केन्द्रीय सरकार किसी भी संबंधित जोन में स्कीम के प्रभावी प्रवर्तन को सुनिश्चित करने के लिए समय- समय पर स्कीम की संपरीक्षा कर सकेगी । संपरीक्षक दल को यथास्थिति किसी बस बॉडी निर्माणकर्ता या निर्धारक को निरर्हित करने की शक्ति होगी यदि वह उसको लागू किसी उपबंध का दोषी या उसका उल्लंघन करते हुए पाया जाता है ।

(12 ) बस डिपो का टाइप अनुमोदन (टीए) और उत्पादन की अनुरूपता (सीओपी) : केन्द्रीय सरकार प्रत्यायित बस बॉडी निर्माणकर्ता द्वारा निर्मित बस बॉडी के टाइप अनुमोदन और उत्पादन की अनुरूपता के लिए उचित प्रक्रिया पृथक् रूप से अधिसूचित करेगी ।

(13) निर्धारकों का पैलन :

(i ) निर्धारकों का एक पैनल प्रत्येक जोन प्रत्यायन बोर्ड द्वारा तैयार किया जाएगा जिसमें उसी जोन अधिकारिता से अधिमानतः व्यक्तियों को नियोजित किया जाएगा ;

(ii ) तकनीकी निर्धारक के लिए न्यूनतम अर्हता, इंजीनियरी में स्नातक की डिग्री या इंजीनियरी क्षेत्र में पांच वर्ष के अनुभव के साथ सुसंगत क्षेत्र में प्रौद्योगिकी, होगी । सुसंगत शाखा में और उसी प्रकार की पृष्ठभूमि के साथ किन्तु दस वर्ष के अनुभव के साथ डिप्लोमा धारक भी पात्र होंगे । तकनीकी निर्धारक से टाइप अनुमोदन ( टी ए) और उत्पादन की अनुरूपता ( सी ओपी) के साथ ही साथ समय - समय पर यथा संशोधित केन्द्रीय मोटर यान नियम, 1989 के अधीन विहित प्रक्रियाओं का पालन करने की अपेक्षा की जाएगी ;

17025 (iii ) प्रमुख निर्धारक के लिए वही अर्हताएं होंगी जो ऊपर खंड (ख ) में दी गई हैं और इसके अतिरिक्त आईएसओ 9001 : 2000/ आईएसओ 14001 : 1996/आईएसओ/आईईसी

: 1999 (एनएबीएल) या किसी अन्य राष्ट्रीय या अंतरराष्ट्रीय प्रमाणन या प्रत्यायन प्रणाली के अनुसार क्वालिटी प्रबंध तंत्र में पृष्ठभूमि रखेगा ;

(iv) जोन प्रत्यायन बोर्ड द्वारा तैयार या पैनल में सम्मिलित किए गए निर्धारकों की सूची राष्ट्रीय प्रत्यायन बोर्ड को उनकी सूचना और अभिलेख के लिए भेजी जाएगी ; और

(v) यदि किसी भी समय कोई निर्धारक जोन प्रत्यायन बोर्ड और राष्ट्रीय प्रत्यायन बोर्ड की नीति और प्रक्रिया का उल्लंघन करते हुए पाया जाता है तो उसका नाम राष्ट्रीय प्रत्यायन बोर्ड को सूचना देकर जोन प्रत्यायन बोर्ड द्वारा पैनल से काट दिया जाएगा ।

(14) गोपनीयता : जोन प्रत्यायन बोर्ड के सदस्य, निर्धारक और राष्ट्रीय प्रत्यायन बोर्ड के पदधारी प्रत्यायन की मंजूरी के लिए मूल्यांकन की प्रक्रिया के दौरान बस बॉडी निर्माणकर्ताओं से संबंधित प्राप्त सूचना की सख्त गोपनीयता बनाए रखने की अपेक्षा की जाएगी । राष्ट्रीय प्रत्यायन बोर्ड उन व्यक्तियों पर गोपनीयता बनाए रखने की वैसी ही बाध्यता अधिरोपित करेगा जिन्हें वे ऊपर यथा वर्णित किसी गोपनीय प्रकृति का कार्य सौंपते हैं ।

(15) दायित्व : राष्ट्रीय प्रत्यायन बोर्ड किसी ऐसी नुकसानी के लिए उत्तरदायी नहीं होगा जिससे राष्ट्रीय प्रत्यायन बोर्ड की ओर से कार्य किए जाने वाले व्यक्तियों द्वारा किसी कार्रवाई या अपेक्षा और प्रत्यायन की मंजूरी के लिए किसी असफलता या प्रास्थगन या निलंबन या प्रत्यायन का दबाव से वापिस लिए जाने के परिणामस्वरूप हो सकेगी ।

(16) नीतियों और प्रक्रियाओं का संशोधन : राष्ट्रीय प्रत्यायन बोर्ड किसी भी समय प्रत्यायन की मंजूरी, प्रत्यायन बनाए रखने , निगरानी प्रत्यायन के नवीकरण और उनके संबंध में किए गए प्रतिकूल विनिश्चयों से संबंधित नीतियों और प्रक्रियाओं का संशोधन कर सकेगा । राष्ट्रीय प्रत्यायन बोर्ड संक्रमण अवधि, जो कम से कम छह मास की होगी, उपदर्शित करते हुए ऐसे संशोधन के संबंध में बस बॉडी निर्माणकर्ता को सूचित करेगा ।

NOTIFICATION

New Delhi , the 23rd March , 2007

S.O. 425 ( E ) .- Whereas the Central Government is of the opinion that it is necessary and expedient in the public interest to notify certain norms and process in respect of the accreditation of bus body builders , it therefore, in exercise of the powers conferred by the sub-section (3 ) of section 109 of the Motor Vehicles Act , 1988 ( 59 of 1988) makes the following order to specify such norms and process , namely: -

1. (1) This Order may be called as the Central Motor Vehicles (Accreditation ofBus Body Builders ) Order, 2007 ( hereinafter referred to as the said order) .

(2) Itshall come into force after one year from the date of publication of this Order in the Official Gazette .

Definitions.-

(a ) "Accreditation " means the process of evaluating , assessing and approving the capabilities and capacities of a Bus Body Builder to consistently produce specified quality of bus bodies by the competent authority;

(b) " Act" means the Motor Vehicles Act, 1988 (59 of 1988 ) ;

(c) "Assessor " means a technical expert appointed by the Zonal Accreditation Board to carry out the inspection of Bus Body Builders and bus bodies, as per the prescribed norms , standards and procedure;

(d) "Bus Body Builder ( BBB ) " means a firm engaged in the fabrication of bus bodies and having the following minimum facilities , namely: - (i) infrastructure facilities , namely the land , building and utilities ;

(ii ) plant and equipment to undertake corrosion preventive treatment ; painting , structural fabrication , paneling , finishing and equipping with necessary ingredients;

(iii ) inspection , quality assurance and testing of fully built buses with all its ingredients either made in- house or bought out; and (iv) having upto date knowledge of the Central Motor Vehicles Rules, 1989.

( e) " Form " means a Form appended to this order ;

(f) "National Accreditation Board ( NAB ) " means the body constituted by the Government of India to serve as the agency to implement the said rules and monitor the functions of Zonal Accreditation Boards;

(g) "Secretariat " means the National Accreditation Board Secretariat and the Zonal Accreditation Board Secretariat established under paragraph 9 and paragraph 12, respectively ;

(h) "Zonal Accreditation Board (ZAB ) " means a body constituted for any one of the four zones namely , North Zone , South Zone, East Zone and West Zone to function under overall guidance of National Accreditation Board. It shall be responsible for implementation of the process of Accreditation in the respective zone;

3. BusBody Builders.- Bus Body Builders shall be categorized on the basis of the activities undertaken by them as indicated in the Table given below:-

All the Bus Body Builders shall be accredited by National Accreditation Board and Zonal Accreditation Boards as notified under the said order . The accredited Bus Body builders shall meet the type approval requirements specified in the relevant provisions of the Bus Body Code for the relevant type of vehicle in accordance with AIS : 052 : 2001 as amended from time to time till the corresponding Bureau of Indian Standards specifications are notified under the Bureau of Indian Standard Act, 1986(63 of 1986 ) .

5. Activities involved in the Accreditation System.- ( 1 ) The process of accreditation shall be carried out in, the following stages , namely : -

(i) Constitution and notification of Zonal and National Accreditation Boards by Central Government including establishment of permanent Secretariat at Zonal and National Accreditation Boards .

(ii ) Selection and preparation of panel of assessors at Zonal Accreditation Boards .

(iii ) Notice for commencement of accreditation of Bus Body Builders and theformalities involved therein at Zonal Accreditation Board .

(iv) Receipt and scrutiny of application at Zonal Accreditation Board .

(v) Nomination of assessors and planning of assessment at Zonal Accreditation Boards .

(vi ) Assessment at Zonal Accreditation Boards.

(vii) Scrutiny of assessment report at Zonal Accreditation Board Secretariat for its completeness and putting up to Zonal Accreditation Board for consideration .

(viii) Grant of provisional accreditation by Zonal Accreditation Board .

(ix) Approval or ratification of provisional accreditation by National Accreditation Board.

(x) Issue of accreditation certificate by the Zonal Accreditation Board Secretariat.

(xi) Conduct of surveillance or re- accreditation assessment at Zonal Accreditation Board .

(xii) Dealing with the complaints or representations and appeals and other relevant issues at National Accreditation Board , and

(xiii) Renewal of accreditation at Zonal Accreditation Board .

(2) The flow chart for Accreditation Activities are given in Annexure BBB -I.

6. Organization Structure for Accreditation System . There shall be four

Zonal Accreditation Boards, namely North Zone Accreditation Board, South Zone Accreditation Board , East Zone Accreditation Board and West Zone Accreditation Board . These zonal bodies shall be responsible for undertaking the accreditation process in their respective zones . The activities of all these Zonal Accreditation Boards shall be co - ordinated by the National Accreditation Board . The organization structure for Bus Body Builder Accreditation System is given in Annexure BBB - 2 and 53

8. Functions of National Accreditation Board. The functions of the National Accreditation Board shall be as follows, namely: -

(a) to lay down rules of transaction of business for Zonal Accreditation Boards and the National Accreditation Board;

(b) to sanction the manning levels and the number of the Secretariat staff at the National Accreditation Board and Zonal Accreditation Boards;

(d) to lay down the qualification and the like for appointment of Secretariat staff;

(e) to act as appellate authority;

4 (f) to lay down the qualification , terms and conditions and names of theassessors;

(g) to lay down required qualification and other conditions of service for the Secretary ;

(h) to define powers and authority of the permanent Secretary as to ensure smooth functioning of the Secretariat of Zonal Accreditation Board;

(i ) to ensure the implementation of the policies and legislation of the Government of India concerning bus body building ;

(j ) co -ordination among the different Zonal Accreditation Boards;

(k) to ensure uniformity in the accreditation process being followed by different Zonal Accreditation Boards;

(1) interaction with the Government of India ;

(m) to approve the provisional accreditation recommended by Zonal Accreditation Boards;

(u) to handle grievances or complaints and appeals ;

(0) to undertake random test checks to ensure the compliance with accreditation standards;

(p) to decide and review the accreditation fee structure from time to time;

(q) to design the appropriate National Accreditation Board logo and to ensure its proper usage; and

(r) any other function required for the purpose as may be decided by Zonal Accreditation Board or National Accreditation Board;

9. National Accreditation Board Secretariat.- (1 ) A Secretariat shall be established in Association of State Road Transport Undertakings , New Delhi . A permanent Secretary from the Secretariat shall be nominated by Department of Road Transport and Highways. National Accreditation Board shall either appoint the requisite complement of staff or authorize Association of State Road Transport Undertakings to do so .

(2) The National Accreditation Board Secretariat shall assist the National Accreditation Board in discharging its functions as enumerated in paragraph 8 above .

11. Functions of Zonal Accreditation Board. The following shall be the functions of the Zonal Accreditation Board .

(a) to appoint permanent Secretary to the Board;

(b) to consider and approve or disapprove the assessment submitted by the Secretariat after due evaluation;

(d) within a given time span; to authorize Secretary to issue provisional accreditation certificate

(e) to approve the panel of assessors in the zone;

(f) to ensure the training of assessors in the assessment techniques ; and 56

(g) to define powers and authority of the Secretary to plan the assessment in consultation with the team of assessors and Bus BodyBuilders.

12. Zonal Accreditation Board Secretariat.- ( 1 ) A Secretariat shall be established for each Zonal Accreditation Boards . This shall be headed by a permanent Secretary who shall be appointed by Zonal Accreditation Board . Zonal Accreditation Board shall also appoint other staff required for the Board .

(2) Secretariat for West Zonal Accreditation Board and South Zonal Accreditation Board shall be established in Central Institute of Road Transport , Pune . Secretariat for North Zonal Accreditatior ! Board and East Zonal Accreditation Board shall be established in the Automotive Research Association of India , Pune .

13. Functions of Zonal Accreditation Board Secretariat.- The following shall be the functions of Zonal Accreditation Board Secretariat.

(a) to invite and accept applications ( Form No. BBB - 1) for accreditation from perspective Bus Body Builders;

(b) to scrutinize applications and obtain additional information , if required;

(c) to finalise tentative category of the Bus Body Builder and inform Bus Body Builder regarding accreditation fee for that particular category;

(d) to appoint a team of assessors;

(e) to arrange assessment for accreditation as per Form No. BBB- 5 to Form No. BBB - 10 according to the category of the Bus Body Builder , within one month of the receipt of registration fee and the assessment charges;

(f) to put up assessed cases after due examination to the Zonal Accreditation Board for their consideration;

(g) to issue a provisional accreditation certificate as per recommendation by Zonal Accreditation Board;

(h) to coordinate all the activities related to the assessment including appointment of assessors and planning the assessment ;

(i) to prepare draft agenda of cases to be put to National Accreditation Board;

(j ) to prepare and issue the final Accreditation Certificate on approval ofthe provisional accreditation by National Accreditation Board;

(k) to inter alia , maintain and update the following , namely : -

(a) panel of assessors ;

(b) all documents ; and

(1) any other function related to the activity 57

Accreditation Procedure.- ( 1 ) Application for Accreditation:

14.

(1 ) The Bus Body Builder intending to get the accreditation shall apply to Zonal Accreditation Board In the prescribed application form ( Form No. BBB - 1 ) In duplicate;

(il ) The application shall be accompanied with the prescribed application fee as decided from time to time by the National Accreditation Board.

(III ) While applying for accreditation , the Bus Body Builder shall ensure availability of the following , namely:-

(a) adequate machines or Infrastructural facilities for the purpose;

(b) competent manpower ;

(d) compliance mechanism with the environmental requirements so as not to cause hazard to the neighborhood and surroundings;

(e) adequacy of material management system;

(f) adequate, equipments and know how for item or materials , receipt stage quality assurance, the in-process inspection and final testing of the bus body, wherever applicable; and

(g) copies of reference documents.

(2) Acknowledgement , scrutiny and processing of Application:

(1 ) Zonal Accreditation Board Secretariat , on receipt of the application along with its enclosures and the requisite fees , etc. shall issue an acknowledgement along with receipt to Bus Body Builder within ten working days , allotting unique Customer Registration Number (CRN ) to Bus Body Bullder, to be used in future for reference and correspondence;

(II ) The preliminary scrutiny of the application shall be done by Zonal Accreditation Board Secretariat. The said Secretariat may ask for additional information or clarification , if necessary. If there are gross shortcomings, the Bus Body Builder shall be asked by the said Secretariat to comply with the requirements and shall re submit the application with Compliance Report; and (iii) If the application is found to be generally in order, the same is considered for categorization . The Bus Body Builder shall be asked to remit the assessment fee accordingly thereafter.

(3) Assessment:

(1 ) On receipt of assessment fee, the Zonal Secretary shall coordinate with the assessor and the Bus Body Builder for planning the schedule of assessment;

(11 ) Two assessors, a Technical Assessor and a Lead Technical Assessor shall be deputed for assessment;

(iii ) The Technical Assessor shall be responsible for assessment of the technical competency of the Bus Body Builder in terms of machines, manufacturing techniques, method deployed and maintenance and calibration of machines or equipments ;

(iv) The Lead Technical Assessor shall be responsible for the evaluation of Application form , verification of the contents of the application form , verification of the claims made by the Bus Body Builder, maintenance of quality system and overall assessment of the Bus Body Builder;

(v) The Bus Body Builder shall be informed about the final schedule of assessment and the information about Assessment Team;

(vi ) The Assessment Team shall review the capability of the Bus Body Builder using Form No. BBB- 5 to Form No. BBB -10 for the following areas , and against the claim made by Bus Body Builder. Form No. BBB - 2 shall be used for noting the observations made by assessors:

(

a) availability of manufacturing facility including machineries, jigs and fixtures;

(b ) availability of competent manpower . For this purpose the Assessment Team shall verify the records and interview the personnel , where necessary;

(

c) compliance with the relevant legal requirements and environmental conditions including fire hazards;

(d) provision of safety appliances and measures ;

( e) availability of tools or equipments for inspection , measurement , etc .;

(f) records of in - process and final inspection of bus bodies;

( g) if design is included in the scope , verification for the competent manpower and facilities shall be made;

( h) availability of adequate land , space and infrastructure facilities ;

(i ) calibration records for the measuring equipments and inspection/ testing facilities ; and

(j) any other requirement decided or specified by the Zonal Accreditation Board or National Accreditation Board from time to time.

(vii ) Once the Assessment is completed, the Assessment Team shall submit the Assessment Report to the Zonal Accreditation Board Secretariat within ten working days . The Assessment Report shall be jointly prepared and signed by the Technical Assessor and the Lead Technical Assessor in Form No. BBB- 4 and shall be countersigned by the representative of Bus Body Builder. The assessment report shall give clear recommendation for grant of accreditation or otherwise with due justification and without any ambiguity;

(viii) Non-conformance found during assessment shall be recorded in Form No. BBB- 3 by Technical Assessor and Lead Technical Assessor and shall be informed to Bus Body Builder . The Bus Body 59

Builder shall decide about the proposed corrective action within thedefinite time schedule but within a maximum period of three months . The Zonal Accreditation Board Secretariat shall monitor theprogress of compliance with areas of non -conformity;

(ix) Depending on the nature of non -conformity, these shall be closed by the Lead Technical assessor on the submission of documentary evidence of corrective action with or without verification visits at the Bus Body Builder's cost;

(x) Based on the information gathered during the processing of the application , the assessment report, additional information gathered during the assessment and the consequent verifications, if any, the Zonal Secretary shall prepare a brief summary. An agenda item including the summary recommendations, etc. or otherwise with due justification for accreditation shall be placed before the Zonal Accreditation Board for their consideration for grant of provisional accreditation or otherwise;

(xi) The Zonal Accreditation Board's observation on the Assessment Report and its recommendations shall be the deciding factors for grant of Provisional Accreditation or otherwise . All decisions taken by the Zonal Accreditation Board shall be recorded in the form of minutes . These minutes shall also be sent to National Accreditation Board for information;

(xii) In case the Zonal Accreditation Board finds deficiencies in the assessment report to arrive at the decision , the Zonal Secretariat shall obtain clarification from the assessor or Bus Body Builder and placebefore Zonal Accreditation Board for its decision;

(xiii ) The final recommendation of Zonal Accreditation Board shall be placed before the National Accreditation Board, who shall meet at least once in six months depending on the number of applications and reports;

(xiv) On grant of Accreditation , Zonal Accreditation Board Secretariat shall prepare an Accreditation Certificate mentioning therein the category, date of issue and date of validity of Certificate;

(xv) Each Certificate shall be signed by the Zonal Secretary mentioning therein the approval by Zonal Accreditation Board and National Accreditation Board;

(xvi ) All the applicant Bus Body Builders shall make all the payments due to Zonal Accreditation Board before the Certificate is issued to BusBody Builder; and

(xvii ) All the decisions taken by the Zonal Accreditation Board regarding grant or refusal of accreditation , are subject to appeal to the National Accreditation Board whose decision shall be final and binding.

(4) Accreditation :

(i ) Validity: The Bus Body Builder Accreditation Certificate shall be valid for a period of four years;

(ii) Use of National Accreditation Board Logo : On grant of Accreditation , the Bus Body Builder shall use National Accreditation Board Logo on its business promotion literature , namely letter heads , visiting cards, brochures, etc.; and

(iii ) Surveillance: Zonal Accreditation Board shall conduct surveillance assessment once in two years and a re-assessment of the Bus Body Builder before the expiry of the Accreditation Certificate. The Surveillance or Re-assessment shall be similar to the first assessment . During the validity of Accreditation , the Bus Body Builder shall continuously comply with the requirements of the said order.

(5) Extension or Reduction of Scope of Accreditation:

(i) The Bus Body Builder, if so desires, may request in writing to Zonal Accreditation Board for the change in the category of Accreditation . For this purpose, Zonal Accreditation Board shall assess the Bus Body Builder during surveillance/ re - assessment visit or may organize a supplementary or a special visit ; and

(ii ) In case of the Bus Body Builder is accredited for one zone , and if scope is required to be extended to other zones , the same can be done without any assessment but on the payment of additional fee as decided by National Accreditation Board .

(6) Supplementary or Special Visit : The National Accreditation Board/Zonal Accreditation Board may also arrange for supplementary or special visit at any time during the validity of accreditation in the following circumstances:

(a) change in category;

(b) misuse of Accreditation or Certificate or Logo;

on receipt of a complaint , for the verification of facts ; and

(c)

(d) any other circumstances decided by the Zonal Accreditation Board or National Accreditation Board.

(7) Voluntary Withdrawal : The Bus Body Builder at any time during the validity of accreditation may discontinue their accreditation voluntarily by making a written request to Zonal Accreditation Board . If the Bus Body Builder decides to regain the accreditation status , after it has sought voluntary withdrawal , it shall be treated as a fresh accreditation , and it shall have to pay all the fees for application and accreditation and assessment expenses , as applicable at that time.

(8) Surveillance:

(1 ) Zonal Accreditation Board shall conduct surveillance once in two years for all accredited Bus Body Builders;

(II ) Surveillance is aimed at examining whether the accredited Bus Body Builder is maintaining all the requirements claimed or declared in the Application ;

(iii ) Zonal Accreditation Board shall inform the accredited Bus Body Builder about the surveillance assessment and the surveillance fee to be paid in advance , at least three months before the due date for surveillance visit . The Bus Body Builder shall confirm its readiness within thirty days ; and

(iv) The Bus Body Builder may request for change in scope or category whileconfirming their readiness.

(9) Renewal of Accreditation and Re-Assessment :

(i) The Bus Body Builder may apply for renewal of accreditation by submitting an application in Form No. BBB - 1 in two copies ;

(ii ) The application shall be accompanied with the prescribed renewal fee, as required. The Bus Body Builder may request for change in scope of accreditation or category, which shall explicitly be mentioned in the application form;

(iii ) The request for renewal shall be submitted at least six months before the expiry of the validity of accreditation . Accreditation status of the Bus Body Builder shall expire on the validity date mentioned in the certificate, in case there is no application in time. The Bus Body Builder shall have to apply afresh and the continuity ofthe Certificate would stand cancelled;

(iv) The procedure for processing of renewal application is similar to that of fresh application ;

(v) If the results of reassessment visit are positive and all non- conformities are closed before the expiry of the certificate, then the validity of the certificate shall be extended by another four years without any discontinuity; and

(vi ) A new certificate of accreditation shall be issued on renewal , however , the Certificate number remains same.

(10) Appeal : All decisions taken by National Accreditation Board or Zonal Accreditation Board regarding grant or continuation or renewal of accreditation shall be open to appeal by the Bus Body Builder, to the Chairman, National Accreditation Board.

(11) Audit: The Central Government may carry out Audit of the scheme from time to time to ensure the effective operation of the scheme in any of 62

the respective zones . The audit team shall have the power to disqualify any Bus Body Builder or assessor as the case may be in case he is found guilty or violating any of the provisions that is applicable to him.

(12) Type Approval (TA) and Conformity of Production (CoP) of Bus Bodies: The Central Government will separately notify a suitable procedure for the Type Approval and Conformity of Production of the bus bodies built by the accredited Bus Body Builder .

(13) Panel of Assessors:

(i ) A panel of assessors shall be prepared by each Zonal Accreditation Board wherein the persons preferably from the same zonal jurisdiction shall be employed;

(ii ) The minimum qualification for Technical Assessor shall be a Bachelor's Degree In Engineering or Technology in relevant field with five years experience in the engineering field. Diploma holders in relevant branch and with the similar background but with a minimum experience of ten years shall also be eligible. The Technical Assessor shall also be required to keep abreast of the Type Approval (TA) and the Conformity of Production ( COP) procedures prescribed under the Central Motor Vehicles Rules , 1989 as amended from time to time;

(iii ) The Lead Assessor shall have the same qualifications as given at clause (b) above and in addition , shall have a background in quality management systems as per ISO 9001 : 2000/ ISO : 14001: 1996/ ISO/ IEC 17025 : 1999 . ( NABL) or any other National or International Certification or Accreditation System;

(iv) The list of empanelled assessors prepared or approved by Zonal Accreditation Board shall be sent to National Accreditation Board for their information and record ; and

(v) If at any time any of the Assessors is found to be transgressing the policy and procedures of Zonal Accreditation Board and National Accreditation Board , their name shall be struck off from the panel by Zonal Accreditation Board under intimation to the National Accreditation Board.

(14) Confidentiality: The members of the Zonal Accreditation Board, assessors and National Accreditation Board officials shall be required to maintain strict confidentiality of the information gathered regarding the Bus Body Builders during the process of evaluation for grant of accreditation . National Accreditation Board shall impose the same obligation of maintaining secrecy on those to whom they entrust the tasks of a confidential nature , as described above .

(15) Liability: National Accreditation Board shall not be responsible for any damages, which the Bus Body Builder may suffer as a result of any action or negligence by those who are carrying out the tasks on behalf of National Accreditation Board and any failure to the grant of accreditation or abeyance or suspension or forced withdrawal of the accreditation.

(16) Amendments to the Policies and Procedures : National Accreditation Board may at any time amend the policies and procedures related to grant of accreditation , maintaining accreditation , surveillance, renewal of accreditation and the adverse decisions taken thereon . National Accreditation Board shall inform the Bus Body Bullder regarding such amendments indicating the transition period which shall be at least six months.

15. Fees for Assessment of Bus Body Builders.- The following fees as maybe amended by Central Government shall be charged:
